Home My WebLink AboutCC Reso No 2002-15RESOLUTION NO. 2002-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA APPROVING THE PLAN OF 5ERVICES FOR AND REQUESTING LOCAL AGENCY FORMATION COMMISSION (LAFCO) APPROVAL OF ANNEXATION NO. 70 WHICH REPRESENTS AN AMENDMENT TO THE CITY'S CORPORATE BOUNDARY (BY ANNEXING AND DETACHING CERTAIN PROPERTIES ALONG HWY. 74) WITHIN THE VICINITY OF THE RAMSGATE SPECIFIC PLAN. WIIEREAS, proceedings have been initiated pursuant to the Cortese-Knox Hertzberg Local Government Reorganization Act of 2000, Government Code Section 57082, for annexation and detachment of appro~mately 2.5 acres of land located within the Caltrans ROW along Highway 74 and; WHEREAS, said annexation/detachment is entirely within the City Sphere of Influence within the unincorporated area of the County of Riverside, and; WHEREAS, a Plan of Services is required as a condition of approval by the Local Agency Formation Commission (LAFCO), and; WHEREAS, the City Council finds that the Plan of Services for Annexation No. 70 is acceptable, that it is consistent with the City's Sphere of Influence, General Plan, and that it is an appropriate extension of the city's boundaries, and consents to the approval of the Plan of Services for the purpose of submitting an application to LAFCO, and WIIEREAS, the City Council consents to and accepts the transfer of property tazc revenue from the County of Riverside to the City of Lake Elsinare for Annexation No. 70. NOW, THEREFORE, BE IT RESOLVED BY TIIE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA. That it hereby concurs with the proposal to annex and detach approximately 2.5 acres of land to be used for right-of way purposes for inclusion in the City's Municipal Boundary and detachxnent from the County of Riverside and approves the Plan of Services for proposed Annexation No. 70, attached hereto as Ea~hibit "A" and incorporated herein as though fully set forth, and; ; RESOLUTION NO. 2002-15 ~ PAGE 2 2. The City Council hereby recommends the Loca1 Agency Formarion Commission approve annexation/detachment of approximately 2.5 acres of land to the City of Lake Elsinore as Annexation 70 in the manner provided by the Cortese-Knox Hertzberg Local Government Reorganization Act of 2000, Government Code Section 57082. Main Street Lake Elsinore, CA 92530 Proiect Descrintion: Caltrans and the Riverside County Transportation Commission (RCTC) aze coordinating efforts to improve and widen State Highway 74 from the 15 Freeway to the City of Perris (Hwy. 215). Improvements include construction and re-aligning certain sections of highway to improve safety, more specifically an approximately '/4 mile section of highway right-of-way located within the city limits azound the vicinity of the Ramsgate Specific Plan. Currently, city boundaries are located at centerline of existing highway right-of-way. Proposed improvements within the 3/< mile section wili re-align highway right-of-way therefore changes to the existing city boundaries will be required. The areas to be annexed and detached will be entirely within Caltrans right-of-way (ROW). Affected area is illustrated in Exhibit "B" attached. Plan of Services: The area subject to annexatior and detachment will be entirely within Caltrans ROW and therefore not developable. (Exhibit "B"). The subject areas will be used strictiy for highway construction. Caltrans would own an maintain ail subject areas. Consequently, the City of Lake Elsinore does not anticipate the need to provide municipal public services that would normally be required of developable land. In addition, the affected area does not require pre-zoning. All required sections under LAFCO "Standazds for Preparation of Plan of Services" have been deemed not to apply to this request.
