Home My WebLink AboutCC Reso No 2002-11RESOLUTION NO. 2002-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, MAKING AN AMENDMENT TO THE LAKE ELSINORE GENERAL PLAN FOR THE FIRST CYCLE OF CALENDAR YEAR 2002 TO UPDATE THE HOUSING ELEMENT OF THE GENERAL PLAN (LAKE ELSINORE HOUSING ELEMENT 2000-2005) - GENERAI, PLAN AMENDMENT NO. 2000-03. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Section 65300 of the State of California Government Code, requires Cities to prepare and adopt General Plans (Comprehensive Plans) which lay the foundation for the long-term, future growth and physical development of the community through policy goals and statements. WHEREAS, Section 65358(b) of the Government Code provides that no mandatory element of a General Plan shall be amended mare frequently than four times during any calendar yeaz; WHEREAS, pursuant to Section 65302(c) of the State of Califomia Govemment Code, the Housing Element is a required elements of the General Plan. WHEREAS, pursuant to State Government Code Section 65588, Housing Elements, shall be revised and/or updated as appropriate, but not less than every 5 years, In addition, Section 65583(c) requires housing elements to include a program which sets forth a five-year schedule of actions the local government is undertaking to address state-wide housing needs. WHEREAS, pursuant to State Govemment Code Section 65585(b), prior to adoption of housing elements and/or updates, the State Department of Housing and Community Development (HCD) is required to review and comment on the adequacy of draft elements and ultimately issue element certification. WHEREAS, the State Department of Housing and Community Development (HCD) has reviewed a Screencheck Draft of the Housing Element Update and has issued tentative certification pending approval of "Response to Comments to HCD". In addition, Response to Comments document has received tentative approval. WHEREAS, the City Council of the City of Lake Elsinore has been delegated with the responsibility far approving the Update to the Housing Element of the General Plan, and WHEREAS, public notice of said project has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on February 26, 2002. CITY COUNCIL RESOLUTION NO. 2002- 11 PAGE TWO SECTION 1. The City Council has considered the proposed General Plan Amendment No. 2000-03 which represents a complete update to the Housing Element of the General Plan, prior to approving such proposal. The City Council finds and determines that Negative Declaration for the Housing Element Update is adequate and prepared in accordance with the requirements of the California Environmental Quality Act (CEQA) which analyzes environmental effects of General Plan Amendment No. 2000-03, based upon the following finding and determinations: 1. The Negative Declaration has been prepared, submitted, and reviewed in accordance with the requirements of the Califomia Environmental Quality Act (CEQA) and the City's CEQA requirements, and is complete and adequate in the evaluation of all environmental effects of the Housing Element Update of the General Plan and associated discretionary approvals. The Housing Element Update of the General Plan and associated discretionary approvals will not result in any significant impacts. SECTION 2. That in accardance with State Government Code and the City of Lake Elsinore the following findings for the approval of General Plan Amendment No. 2000-03 have been made as follows: 1. The proposed General Plan Amendment for the update to the Housing Element of the General Plan complies with the policy and intent of Government Code Sections 65580 and 65581. 2. The proposed General Plan Amendment for the update to the Housing Element of the General Plan complies with the required contents outlined in Section 65583 of the Government Code. 3. The proposed General Plan Amendment for the update to the Housing Element of the General Plan is consistent with other elements of the Lake Elsinore General Plan. 4. The proposed General Plan Amendment for the update to the Housing Element of the General Plan could not haue a significant effect on the environment, and a Negative Deciaration has been prepared to serve as environmental cleazance. 5. The proposed General Plan Amendment for the update to the Housing Element of the General Plan and adoption of the Negative Declaration comply with the requirements of CEQA and the City's Guidelines for Implementing CEQA. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Council of the City of Lake Elsinore, California, that the City of Lake Elsinore General Plan Housing Element hereof be amended for the first time in calendar yeaz 2002 to reflect General Plan Amendment No. 2000-03 (Lake Elsinore Housing Element 2000-2005).
