HomeMy WebLinkAboutCC Reso No 2004-30RESOLUTION NO. 2004- 30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING MITIGATED NEGATIVE DECLARATION 2004-04, WITHIN APN(S) 363- 540-010, Oil, 012, 013, 017, 018, 019 020 AND 024. WHEREAS, Robert Gregory has submitted applications General Plan Amendment 2004- 03, Zone Change 2004-03, Commercial Design Review No. 2004-01, Conditional Use Permit No. CUP 2004-O1, Variance No. 2004-03, Uniform Sign Program 2004-03 and Mitigated Negative Declaration 2004-04 for the purpose of developing an automobile dealership, known as the "Lake ChevroleY' automobile dealership; WHEREAS, the General Plan Amendment 2004-03, Zone Change 2004-03, Commercial Design Review No. 2004-01, Conditional Use Permit No. CUP 2004-O1, Variance No. 2004-03, Uniform Sign Program 2004-03 and Mitigated Negative Declazation 2004-04 together comprise the "project" as defined by Section 21065 of the California Environmental Quality Act (CEQA), Cal. Public Resources Code Section 21000 et seq., which is defined as an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and which includes the issuance to a person of a lease, permit, license, certificate, or other entitlement for use by one or more public agencies; WHEREAS, Mitigated Negative Declaration No. 2004-04 has been prepared to evaluate environxnental impacts resulting with the project; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on May 4, 2004, made its report upon the desirability of the proposed project and made its recommendations in favor of approving the proposed Mitigated Negative Declaration No. 2004- 04, by adopting Plauning Commission Resolurion No. 2004-58 recommending to the City Council approval of Mitigated Negative Declaration No. 2004-04; and WHEREAS, public notice of said applications has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on May 25, 2004; and NOW THEREFORE, the City Council of the City of Lake Elsinore DOES HEREBY RESOLVE as follows: Mitigated Negative Declazation No. 2004-04 has been prepazed, submitted and reviewed in accordance with requirements of the California Environmental Quality Act and the City's CEQA requirements. The report is complete and adequate in iYs evaluation of all environmental effects of the project known as Lake Chevrolet and associated discretionary approvals and will not result in any significant environmental affects with mitigation measures Based on the following findings; MITIGATED NEGATIVE DECLARATION MND 2004-04 Page 2 of 3 1. Revisions in the project plans or proposals made by or agreed to by the applicant before a proposed mitigated negative declaration and initial study aze released for public review would avoid the effects or mitigate the effects to a point where clearly no significant effects would occur; and The app[icant has made revisions to the project or has agreed to specific conditions which would avoid the effects or mitigate the effects of the project to a point where no signiftcant effects would occur. 2. There is no substantial evidence, in the light of the whole record before the agency, that the project as revised may have significant effect on the environment. Pursuant to the evidence received in the light of the whole record presented to staff the project will not have a signifcant effect on the environment considering the app[icable Conditions of Approval and Mitigation Monitoring Program. 3. Mitigation measures are required to ensure all potentially significant impacts are reduced to levels of insignificance. Mitigation measures have been required which will reduce significant environmental impacts to the level of insignificance. PURSUANT TO THE ABOVE FINDINGS, this City Council of the City of Lake Elsinore resolves that Mitigated Negative Declaration No. 2004-04 is complete and adequate and provides appropriate environmental documentation for the project and fully complies with the requirements of CEQA, the State CEQA Guidelines, and the City's environmental clearance procedures.
