HomeMy WebLinkAboutCC Reso No 2005-175RESOLUTION NO. 2005- 175 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP NO. 34017, A SUBDIVISION OF 611 SINGLE FAMILY RESIDENTIAL LOTS, FOUR LOTS FOR R-3 RESH)ENTIAL DEVELOPMENT, A RECREATION CENTER, AND SIX OPEN SPACE LOTS, ON APPROXIMATELY 396.4+ ACRES LOCATED SOUTH OF MISSION TRAIL, WEST OF CORYDON STREET, NORTH OF COMO STREET AND EAST OF THE PROPOSED JOHN LAING HOMES PROJECT, AND KNOWN AS ASSESSOR'S PARCEL NOS. 370-020-003; 370-030-004, -006, AND -012; 370-040-036 THRU -038; 370-0700-001, -002, -004 THRU -006, AND -010; 370-080- 009 AND -010 WHEREAS, an application has been filed with the City of Lake Elsinore by Lumos Communities LLC to subdivide approximately 396.4+ acres of unimproved property into 611 residential lots, four lots for R-3 development, a recreation center, and six open space lots; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on December 6, 2005, made its report upon the desirability of the proposed project and made its recommendations to the City Council in favor of the project by adopting Planning Commission Resolution No. 2005-150 recommending to the City Council approval of Vesting Tentative Tract Map No. 34017; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on December 13, 2005. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed subdivision, prior to making a decision to subdivide approximately 396.4+_ acres into 611 residential lots, four lots for R-3 residential development a recreation center, and six open space lots. Pursuant to Section 21080 (c)(2) of the California RESOLUTION NO. 2005-175 PAGE 2 OF 4 Environmental Quality Act (CEQA), the City Council finds and determines that the Supplemental Environmental Impact Report (SCH2005061033) is adequate and prepared in accordance with the requirements of CEQA which analyzes environmental effects of the proposed East Lake Specific Plan Amendment No. 8. The City Council further finds that Vesting Tentative Tract Map No. 34017 is consistent with and implements the East Lake Specific Plan Amendment No. 8, and therefore, no additional environmental review is necessary for the approval of the map. SECTION 2. That in accordance with State of California Subdivision Map Act, and the City of Lake Elsinore Municipal Code the following findings for the approval of Vesting Tentative Tract Map No. 34017 have been made as follows: 1. The proposed subdivision, together with the provisions for its design and improvements, is consistent with the City of Lake Elsinore General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). a. The design of the proposed subdivision and density are consistent with proposed Amendment No. 8 to the East Lake Specific Plan No. 93-3, and therefore with the General Plan. b. The project proposes single family residential lots ranging in size from 4,000 square feet to 15,168 square feet, with average lot sizes ranging from 4,770 to 7,214 square feet in various neighborhoods. The project represents a reduction in the amount of residential units from the originally approved Specific Plan by 459 units. 2. The site of the proposed division of land is physically suitable for the proposed density of development in accordance with the General Plan. a. The General Plan encourages clustered development in order to facilitate the conservation of identified wildlife corridors and habitat. The project density and design is compatible with recently approved development adjacent to its westerly boundary. b. The map provides open space areas that protect the natural topography, habitat, lake management and views. RESOLUTION NO. 2005-175 PAGE 3 OF 4 3. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. a. The project is consistent with the City's General Plan. During the approval of City's General Plan, housing needs, public services and fiscal resources were scrutinized to achieve a balance within the City. b. The map has been conditioned to annex into Community Facilities District 2003-01 to offset the annual negative fiscal impacts of the project on public safety operations and maintenance issues in the City. c. The map has been conditioned to annex into Lighting and Landscape Maintenance District No. 1 to offset the annual negative fiscal impacts of the project on public right-of--way landscaped areas to be maintained by the City, and for street lights in the public right-of- way for which the City will pay for electricity and a maintenance fee to Southern California Edison. d. The map has been conditioned to form aMello-Roos Community Facilities District to fund the on-going operation and maintenance of the new parks, parkways, open space and public storm drains constructed within the development, and federal NPDES requirements, to offset the annual negative fiscal impacts of the project. 4. The design of the proposed division of land ox type of improvements axe not likely to cause serious public health problems. a. Vesting Tentative Tract Map No. 34017 is conditioned to comply with all development standards of proposed Amendment No. 8 to the East Lake Specific Plan. These standards have been prepared and reviewed to benefit the public health, safety and welfare. 5. The design of the proposed division of land or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed division of land. RESOLUTION N0.2005-175 PAGE 4 OF 4 a. All known easements or requests for access have been incorporated into Vesting Tentative Tract Map No. 34017. b. The map has been circulated to City departments and outside agencies, and appropriate conditions of approval have been applied for their approval during construction. Section 3. This Resolution shall take effect from and after the date of its passage and adoption.
