A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, APPROVING
GENERAL PLAN AMENDMENT NO. 2005-07, CHANGING
THE GENERAL PLAN CIRCULATION ELEMENT
ALIGNMENT OF BUNDY CANYON ROAD THROUGH
THE EAST LAKE SPECIFIC PLAN AMENDMENT #8
AREA
WHEREAS, an application has been filed with the City of Lake Elsinore
by Lumos Communities LLC to change the General Plan Circulation Element
alignment of Bundy Canyon Road, at its extension of Diamond Drive in the East
Lake Specific Plan Amendment #6 and easterly to the existing Bundy Canyon
Road at Mission Trail; and
WHEREAS, Section 65361(a) of the Government Code provides that no
mandatory element of a General Plan shall be amended more frequently than four
times during any calendar year; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a
regular meeting held on December 6, 2005, considered General Plan Amendment
No. 2005-07. However, the Commission failed to make its recommendation in
favor or against the approval of General Plan Amendment No. 2005-07; and
WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to
this item on December 13, 2005.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed General Plan
Amendment, prior to making a decision to approve the proposal to change the
General Plan Circulation Element alignment for Bundy Canyon Road. Pursuant to
Section 21080(c)(2) of the California Environmental Quality Act (CEQA), the
City Council adopted Resolution No. 2005-173 finding and determining that the
Supplemental Environmental Impact Report for Waterbury (SCH #2005061033) is
adequate and prepared in accordance

with the requirements of CEQA which analyzes environmental effects of the
proposed project.
SECTION 2. That in accordance with State Planning and Zoning law and
the City of Lake Elsinore Municipal Code the following findings for the approval
of General Plan Amendment No. 2005-07 have been made as follows:
1. The proposed amendment will not be (1) detrimental to the health, safety,
comfort, or general welfare of the persons residing or working within the
neighborhood of the proposed amendment or within the City, (2) injurious
to property or improvements in the neighborhood or within the City.
a. The design of Bundy Canyon Road is based upon the Traffic Impact
Analysis prepared for the Waterbury project by Urban Crossroads
dated July 25, 2005. The study analyzed several alternative
alignments.
b. The design of Bundy Canyon Road is based upon meetings and
discussions between the City and the Riverside County
Transportation Department.
c. Weighing the relative merits of the alternative alignments, the.
alignment shown as Alternative 5 on Exhibit 6-I in the traffic study
is considered the preferred alignment, with such further technical
adjustments as may be made by staff.
2. The proposed amendment will be consistent with the latest General Plan.
a. Development approvals in the East Lake Specific Plan have reduced
the overall density in the Plan. The reduction of vehicle trips can be
accommodated by the proposed Bundy Canyon Road.
b. Development in the vicinity of this project has been affected by the
Multiple Species Habitat Conservation Program (MSHCP). The
proposed Bundy Canyon Road alignment accommodates this effort
towards conservation.
SECTION 3. This Resolution shall take effect from and after the date of
its passage and adoption.
