HomeMy WebLinkAboutCC Reso No 2005-167RESOLUTION N0.2005-167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING INDUSTRIAL DESIGN REVIEW NO. 2005-03 FOR AN INDUSTRIAL COMPLEX LOCATED ON THE NORTHEAST CORNER OF MINTHORN AND 3~ STREET(S). WHEREAS, VanDerHoek Architects, Inc, has initiated proceedings for Industrial Design Review No. 2005-03 for the construction of three (3) industrial buildings and related improvements located on the northeast corner of Minthorn and 3`a Street(s); and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on November 1, 2005, supported the proposed project by adopting Planning Commission Resolution No. 2005-134 recommending that the City Council approve Industrial Design Review No. 2005-03; and WHEREAS, the City Council has considered evidence presented by the Community Development Department and other interested parties. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed Industrial Design Review prior to making a decision to approve the proposed project. The City Council finds and determines that the proposed facility complies with the California Environmental Quality Act (CEQA), and is Categorically Exempt in accordance with Section 15332 (Infill Development). SECTION 2. That in accordance with State Planning and Zoning law and the City of Lake Elsinore the following findings for the approval of Industrial Design Review No. 2005-03 have been made as follows: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Industrial Design Review located at the northeast corner of Minthorn and 3"d Streets complies with the goals and objectives of the General Plan, in that the approval of this industrial complex will assist in achieving the development of awell-balanced and functional mix of residential, commercial, CITY COUNCIL RESOLUTION NO. 2005-167 PAGE 2 OF 3 industrial, open space, recreational and institutional land uses as well as encouraging industrial land uses to diverse Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Industrial Design Review located at the northeast corner of Minthorn and 3"d Streets is appropriate to the site and surrounding developments in that the proposed industrial complex has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further the project as proposed will complement the quality of existing development and will create a visually pleasing, non- detractive relationship between the proposed and existing projects in that the architectural design, color and material and site designs proposed evidence a concern for quality and originality. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Pursuant to the California Environmental Quality Act (CEQA), the proposed Industrial Design Review located at the northeast corner of Minthorn and 3". Streets, as reviewed and conditioned by all applicable City Divisions and Departments and Agencies, will not have a significant effect on the environment pursuant to Section 15332 (In-Fill Development Projects). 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake Elsinore Municipal Code (LEMC), the proposed Industrial Design Review located at the northeast corner of Minthorn and 3"d Streets have been scheduled for consideration and approval by the Planning Commission. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
