HomeMy WebLinkAboutCC Reso No 2005-153RESOLUTION NO. 2005-153 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING RESIDENTIAL DESIGN REVIEW NO. 2005-02 FOR THE DEVELOPMENT "TESSARE" LOCATED AT SOUTHEAST OF THE I-15 FREEWAY, SOUTH OF FRANKLIN STREET - APN 373-017-013 WHEREAS, an application has been filed with the City of Lake Elsinore by Lumos Communities, LLC to request the approval of Residential Design Review No. 2005-02 for the design, construction and establishment of a residential condominium community; and WHEREAS, the City Council of the City of Lake Elsinore has been delegated with the responsibility of approving the Design Reviews for residential projects; and WHEREAS, public notice of said application has been given, and the Planning Commission has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on October 11, 2005. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed request for Residential Design Review No. 2005-02 and has found it acceptable. The City Council finds and determines that this project is consistent with the Lake Elsinore Municipal Code and has adopted Resolution No. 2005-151 finding and determining that Mitigated Negative Declaration No. 2005-07 is adequate and prepared in accordance with the requirements of the California Environmental Quality Act (CEQA) which analyzes environmental effects of the proposed project. SECTION 2. That in accordance with Chapter 17.82 (Design Review) of the Lake Elsinore Municipal Code the following findings for the project have been made as follows: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Residential Design Review contained herein complies with the goals and objectives of the General Plan, in that the approval of this Condominium CITY COUNCIL RESOLUTION NO. 200-153 Page 2 of 3 Community will assist in achieving the development of a well-balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses as well as encouraging industrial land uses to diversify Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Residential Design Review contained herein is appropriate to the site and surrounding developments in that the Condominium project has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further the project as proposed will create a visually pleasing non-detractive relationship between the proposed and existing projects in the architectural design, color and materials and site design proposed evidence a concern for quality and originality. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Although the proposed project could have a significant effect on the environment, because revisions in the project have been made by or agreed to by the project proponent and significant adverse effects would not be anticipated. Further, pursuant to the California Environmental Quality Act (CEQA), the Mitigated Negative Declaration for the proposed Residential Design Review referenced herein found that the proposed project will not have a significant effect on the environment pursuant to the attached Conditions of Approval and mitigations proposed. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake Elsinore Municipal Code (LEMC), the proposed Residential Design Review referenced herein has been scheduled for consideration and approval of the Planning Commission. SECTION 3. This Resolution shall take effect from and a8er the date of its passage and adoption.
