HomeMy WebLinkAboutCC Reso No 2005-093 RESOLUTION NO. 2005-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2005-04, FOR THE DESIGN AND DEVELOPMENT OF A 1,854 SQUARE FOOT EXPRESS AUTOMOTIVE LUBRICATION FACILITY LOCATED ON PAD "T" OF THE LAKE ELSINORE MARKET PLACE, ASSESSOR PARCEL NO. 377-040-027 ON TPM NO. 23269 WHEREAS, B.P. Hanrath of WD Partners, agent for EZ Lube, has initiated proceedings to request the approval of Commercial Design Review No. 2005-04 to allow for the design and development of a 1,854 square foot "Express Automotive Lubrication Facility" located on Pad "T" of the Lake Elsinore Market Place, Assessor Parcel No. 377- 040-027; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on July 5, 2005, supported the proposed project by adopting Planning Commission Resolution No. 2005-85 approving Commercial Design Review No. 2005- 04; WHEREAS, the City Council has considered evidence presented by the Community Development Department and other interested parties. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed Commercial Design Review No. 2005-04 prior to prior to making a decision to approve the proposed project. The City Council finds and determines that the proposed facility complies with the California Environmental Quality Act (CEQA), Section 15162 - Subsequent EIRs and Negative Declaration. Subsequent to the certification of the EIR prepared for the Lake Elsinore Market Place (SCH No. 2004012018), no substantial changes are proposed, nor have substantial changes occurred with respect to the circumstances under which the project is undertaken. There is no known new information of substantial importance which was not known and could not have been known with the exercise of reasonable diligence. No further environmental documentation or clearance is required. SECTION 2. That in accordance with State Planning and Zoning law and the City of Lake Elsinore the following findings for the approval of Commercial Design Review No. 2005-04 have been made as follows: RESOLUTION NO. 2005-93 COMMERCIAL DESIGN REVIEW NO. 2005-04 PAGE 2 OF 4 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Commercial Design Review located within Assessor Parcel Number 377-040-027 complies with the goals and objectives of the General Plan, in that the approval of this Express Automotive Lubrication Facility will assist in achieving the development of a well-balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses, diversifying Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Commercial Design Review located at Assessor Parcel Number 377-040-027 is appropriate to the site and surrounding developments in that the Shopping Center known as the Lake Elsinore Market Place has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. The proposed Commercial Design Review for the EZ Lube located on a portion oft Assessor Parcel Number 377-040-027 complies with the approved development known as the Lake Elsinore Market Place. Further the project as proposed will complement the quality of existing development and will create a visually pleasing, non-detractive relationship between the proposed and existing projects in that the architectural design, color and materials and site design proposed evidence a concern for quality and originality. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. The project complies with the California Environmental Quality Act (CEQA), Section 15162 - Subsequent EIRs and Negative Declarations, as well as Environmental Impact Report (State Clearinghouse No. 2004021018}for the Lake Elsinore Market Place. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. RESOLUTION NO. 2005-93 COMMERCIAL DESIGN REVIEW NO. 2005-04 PAGE 3 OF 4 Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake Elsinore Municipal Code (LEMC), the proposed Commercial Design Review located at Assessor Parcel Number377-040-027 has been scheduled for consideration and approval of the Planning Commission. SECTION 3. Based upon the above findings, the City Council of the City of Lake Elsinore hereby approves Commercial Design Review No. 2005-04, subject to the attached Conditions of Approval.
