RESOLUTION NO. 2005-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA APPROVING RESIDENTIAL
DESIGN REVIEW NO. 2004-23 FOR THE PROJECT KNOWN AS
"BROOKSIDE TERRACE" LOCATED WITHIN PLANNING AREA
NO.5 OF THE CANYON HILLS SPECIFIC PLAN
WHEREAS, Dan Mallec, Rick Engineering has initiated proceedings to approve
Residential Design Review No. 2004-23 for the property located within Planning Area
No.5 of the Canyon Hills Specific Plan; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular
meeting held on June 21, 2005 made its report upon the desirability of the proposed
project and made its recommendations in favor of the project by adopting Planning
Commission Resolution No. 2005-67 recommending to the City Council approval of
Residential Design Review No. 2004-23; and
WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on July 26,
2005.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The City Council has considered the proposed Condominium
project prior to making a decision to approve Residential Design Review No. 2004-23.
The City Council finds and determines, per Section 15162 (Subsequent EIRs and
Negative Declarations) of the California Environmental Quality Act (CEQA), that the
Final Environmental Impact Report for the Canyon Hills Specific Plan is adequate and
prepared in accordance with the requirements of the California Environmental Quality
Act (CEQA) which analyzes the environmental effects of the proposed project prior to
City Council certification, based upon the following findings and determinations:
1. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.

Pursuant to the California Environmental Quality Act (CEQA), the
proposed Residential Design Review as reviewed and conditioned by all
applicable City Divisions and Departments and Agencies, will not have a
significant effect on the environment pursuant to attached Conditions of
Approval.
SECTION 2. That in accordance with State Planning and Zoning law and the
City of Lake Elsinore, the following findings for the approval of Residential Design
Review No. 2004-23 have been made as follows:
1. The project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the project is located.
The proposed Residential Design Review complies with the goals and
objectives of the General Plan, in that the approval of this Condominium
Community will assist in achieving the development of a well-balanced and
functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses as well as encouraging industrial
land uses to diversify Lake Elsinore's economic base.
2. The project complies with the design directives contained in Section
17.82.060 and all other applicable provisions of the Municipal Code.
The proposed Residential Design Review is appropriate to the site and
surrounding developments in that the Condominium project has been
designed in consideration of the size and shape of the property, thereby
creating interest and varying vistas as a person moves along the street.
Further the project as proposed will complement the quality of existing
development and will create a visually pleasing, non-detractive
relationship between the proposed and existing projects in that the
architectural design, color and materials and site design proposed evidence
a concern for quality and originality.
3. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning
Code, including guarantees and evidence of compliance with conditions,
have been incorporated into the approval of the subject project to ensure
development of the property in accordance with the objectives of Chapter
17.82.

Pursuant to Section 17.82.070 (Action of the Planning Commission) of the
Lake Elsinore Municipal Code (LEMC), the proposed Residential Design
Review has been scheduled for consideration and approval of the Planning
Commission.
SECTION 3. Based upon the above findings, the City Council of the City of
Lake Elsinore hereby approves Residential Design Review No. 2004-23.
PASSED, APPROVED AND ADOPTED this 26th day of July 2005, by the
following vote:
