RESOLUTION NO. 2005-91
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA APPROVING TENTATIVE PARCEL MAP
NO. 33635 (FOR CONDOMINIUM PURPOSES) FOR THE PROJECT
KNOWN AS "BROOKSIDE TERRACE" LOCATED WITHIN PLANNING
AREA NO.5 OF THE CANYON HILLS SPECIFIC PLAN.
WHEREAS, Dan Mallec, Rick Engineering has initiated proceedings to approve
Tentative Parcel Map No. 33635 for the property located within Planning Area No. 5 of the
Canyon Hills Specific Plan; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting
held on June 21, 2005 made its report upon the desirability of the proposed project and made its
recommendations in favor of said Tentative Parcel Map by adopting Planning Commission
Resolution No. 2005-66 recommending to the City Council approval of Tentative Parcel Map
No. 33635; and
WHEREAS, public notice of said application has been given, and the City Council has
considered evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on July 26,2005.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed Tentative Parcel Map, prior
to making a decision to approve Tentative Parcel Map No. 33635. The City Council finds and
determines, per Section 15162 (Subsequent EIRs and Negative Declarations) of the California
Environmental Quality Act (CEQA), that the Final Environmental Impact Report for the Canyon
Hills Specific Plan is adequate and prepared in accordance with the requirements of the
California Environmental Quality Act (CEQA) which analyzes the environmental effects of the
proposed project prior to City Council certification.
SECTION 2. That in accordance with State Planning and Zoning law and the City of
Lake Elsinore, the following findings for the approval of Tentative Parcel Map No. 33635 have
been made as follows:
1. The proposed subdivision, together with the prOVIsIOns for its design and
improvement, is consistent with the General Plan. The proposed subdivision is
compatible with the objectives, policies, general land uses and programs specified
in the General Plan (Government Code Section 66473.5).
The project as designed assists in achieving the development of a well-balanced
and functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses (GOAL 1.0, Land Use Element) as well

provide decent housing opportunities and a satisfYing living environment for
residents of Lake Elsinore (GOAL 1.0, Housing Element)
2. The effects this project is likely to have upon the housing needs of the region, the
public service requirements of its residents and the available fiscal and
environmental resources have been considered and balanced.
Considering the effects this project is likely to have upon the needs of the region a
condition of approval was implemented which would require the applicant to
enter into an agreement with the Redevelopment Agency of the City of Lake
Elsinore, providing 15% of the units in the project as affordable housing units in
accordance with the requirements of Section 33413(b) of the California
Community Redevelopment Law or an alternative equivalent action which may
include (without limitation) dedication of vacant land, construction of affordable
units on another site, or payment of an in lieu fee calculated to provide sufficient
funds to underwrite the long-term affordability of an equivalent number of
affordable dwelling units constructed or substantially rehabilitated on other sites
within the City's redevelopment project areas.
3. Subject to the attached conditions of approval, the proposed project IS not
anticipated to result in any significant environmental impact.
The project has been adequately conditioned by all applicable departments and
agencies and will not therefore result in any significant environmental impacts.
SECTION 3. Based upon the above findings, the City Council of the City of Lake
Elsinore, hereby approves Tentative Parcel Map No. 33635.
