RESOLUTION NO. 2005-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA APPROVING RESIDENTIAL DESIGN
REVIEW NO. 2004-14 FOR THE PROJECT LOCATED AT THE
NORTHWEST CORNER OF MOUNT AIN AVENUE AND RA VET A
LANE WITHIN TENTATIVE PARCEL MAP NO. (S) 31357 AND 31685.
WHEREAS, Sam & Y olla Rizk has initiated proceedings to approve Residential Design
Review No. 2004-14 for the property located at the northwest comer of Mountain Avenue and
Raveta Lane within Tentative Parcel Map No. (s) 31357 and 31685; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting
held on July 5, 2005 made its report upon the desirability of the proposed project and made its
recommendations in favor of the project by adopting Planning Commission Resolution No.
2005-86 recommending to the City Council approval of Residential Design Review No. 2004-
14; and
WHEREAS, public notice of said application has been given, and the City Council has
considered evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on July 26, 2005.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed project prior to making a
decision to approve Residential Design Review No. 2004-14. The City Council finds and
detennines, per Section 15332 of the California Environmental Quality Act (CEQA), that the
project is exempt fonn further environmental review which analyzes the environmental effects of
the proposed project prior to City Council certification, based upon the following findings and
detenninations:
1. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Pursuant to the California Environmental Quality Act (CEQA), the proposed
Residential Design Review located at the northwest and northeast corners of
Mountain Street and Raveta Lane, as reviewed and conditioned by all applicable
City Divisions and Departments and Agencies, will not have a significant effect
on the environment pursuant to Article 19 (Categorical Exemptions) and Section
15332 (In-Fill Development Projects).
SECTION 2. That in accordance with State Planning and Zoning law and the City of
Lake Elsinore, the following findings for the approval of Residential Design Review No. 2004-
14 have been made as follows:

1. The project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the project is located.
The proposed Residential Design Review located at the northwest and northeast
corners of Mountain Street and Raveta Lane complies with the goals and
objectives of the General Plan, in that the approval of this single-family
residential development will assist in achieving the development of a well-
balanced and functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses as well as encouraging the development
and maintenance of a broad range of housing types for all income groups and age
categories.
2. The project complies with the design directives contained in Section 17.82.060
and all other applicable provisions of the Municipal Code.
The proposed Residential Design Review located at the northwest and northeast
corners of Mountain Street and Raveta Lane is appropriate to the site and
surrounding developments in that the single family residential development has
been designed in consideration of the size and shape of the property, thereby
creating interest and varying vistas as a person moves along the street. Further
the project as proposed will complement the quality of existing development and
will create a visually pleasing, non-detractive relationship between the proposed
and existing projects in that the architectural design, color and materials
proposed exceeds the size and design of the homes in the surrounding area.
3. Conditions and safeguards pursuant to Chapter 17.82.060 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake
Elsinore Municipal Code (LEMC), the proposed Residential Design Review
located at the northwest and northeast corners of Mountain Street and Raveta
Lane has been scheduled and considered for approval by the Planning
Commission.
SECTION 3. Based upon the above findings, the City Council of the City of Lake
Elsinore, California hereby approves Residential Design Review No. 2004-14.

PASSED, APPROVED AND ADOPTED this 26th day of July 2005, by the following
vote:
