HomeMy WebLinkAboutCC Reso No 2005-059 RESOLUTION NO. 2005- 59 A RESOLUTION OF THE CITY COUNCILL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 2005-01, CHANGING THE CLASSIFICATION OF LA STRADA ROAD ON THE GENERAL PLAN CIRCULATION ELEMENT, FROM "MAJOR ROADWAY" TO "MODIFIED SECONDARY ROADWAY" FROM SUMMERHILL DRIVE TO FRANKLIN STREET. WHEREAS, La Strada Partners, LLC. Has initiated proceedings to change the General Plan Circulation Element roadway classification of La Strada Road from "Major" to "Modified Secondary," at its terminus with Summerhill Drive and southwesterly to Franklin Street; and WHEREAS, Section 65361(a) of the Government Code provides that no mandatory element of a General Plan shall be amended more frequently than four times during any calendar year; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on June 21, 2005, made its report upon the desirability of the proposed project and made its recommendations in favor of General Plan Amendment No. 2005-01 by adopting Planning Commission Resolution No. 2005-60 recommending to the City Council approval of General Plan Amendment No. 2005-01; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on June 28, 2005; NOW THEREFORE, the City Council of the City of Lake Elsinore DOES HEREBY RESOLVE as follows: SECTION 1. The City Council has considered the proposed General Plan Amendment No. 2005-01, prior to making a decision to approve the proposal to change the General Plan Circulation Element roadway classification for La Strada Road from "Major" to "Modified Secondary." Pursuant to Section 21080(c)(2) of the California Environmental Quality Act (CEQA), the City Council finds and determines that the Initial Study for Mitigated Negative Declaration No. 2005-01 is adequate and prepared in accordance with the requirements of CEQA which analyzes environmental effects of the proposed project. That in accordance with State Planning and Zoning law and the City of Lake Elsinore Municipal Code the following findings for the approval of General Plan Amendment No. 2005-01 have been made as follows: 1. The proposed amendment will not be (1) detrimental to the health, safety, comfort, or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, (2) injurious to property or improvements in the neighborhood or within the City. a. The design of La Strada Road is based upon the Traffic Impact Analysis prepared for the La Strada project by Urban Crossroads dated February 7, 2005. The findings of this study are supported by other traffic studies and documents compiled for roadways and projects in the surrounding vicinity, including the proposed Camino del Norte project, anticipated to connect to La Strada Road from the south. 2. The proposed amendment will be consistent with the latest General Plan. a. Development in the vicinity of this project have been resubmitted or approved with reduced densities, such as the east portion of the Ramsgate Specific Plan, and the north portion of the Tuscany Hills Specific Plan. The overall reduction in vehicle trips can be accommodated by the proposed La Strada Road. b. Development in the vicinity of this project have been affected by the Multiple Species Habitat Conservation Program (MSHCP). As an example, the La Strada project is donating approximately 75.5 acres of natural open space for conservation. The proposed La Strada Road accommodates and enhances this effort towards conservation. The construction of La Strada Road through the conservation area is a "covered activity" within the MSHCP. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Council of the City of Lake Elsinore, California, that the City of Lake Elsinore General Plan Circulation Element hereof be amended for the first cycle in calendar year 2005 to reflect General Plan Amendment No. 2005-01.
