RESOLUTION NO. 2005- 57
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, ADOPTING
MIITIGATED NEGATIVE DECLARATION NO. 2005-01
AND THE MITIGATION MONITORING PROGRAM
THERETO, FOR GENERAL PLAN AMENDMENT NO.
2005-01, AMENDMENT NO.3 TO THE CANYON CREEK
SPECIFIC PLAN NO. 85-1, AND TENTATIVE TRACT MAP
NO. 32077, ON APPROXIMATELY 140::tACRES LOCATED
NORTHEAST OF INTERSTATE 15, APPROXIMATELY
ONE MILE WEST OF CANYON LAKE, WEST OF
SUMMERHILL DRIVE, SOUTH OF GREENWALD, AND
SOUTH OF THE EXTENSION OF LA STRADA ROAD,
ADJACENT TO THE EXISTING TUSCANY HILLS
COMMUNITY TO THE EAST, AND KNOWN AS
ASSESSOR'S PARCEL NO. 363-020-008.
WHEREAS, an application has been filed with the City of Lake Elsinore by La
Strada Partners, LLC to change the roadway classification of La Strada Road, to amend
the relevant specific plan, and to subdivide approximately 140::!:: acres of unimproved
property into 134 residential lots, a neighborhood park/recreational facility, water tank
and basin sites, and seven (7) open space lots; and
WHEREAS, General Plan Amendment No. 2005-01, Amendment No.3 to the
Canyon Creek Specific Plan No. 85-1, Tentative Tract Map No. 32077 and Mitigated
Negative Declaration No. 2005-01 together comprise the "project" as defined by Section
21065 of the California Environmental Quality Act (CEQA), and the California Public
Resources Code Section 21000 et. seq. defines them as an activity which may cause
either a direct physical change in the environment or a reasonably foreseeable indirect
physical change in the environment, and which includes the issuance to a person of a
lease, permit, license, certificate, or other entitlement for use by one or more public
agencies; and
WHEREAS, Mitigated Negative Declaration No. 2005-01 has been prepared to
evaluate environmental impacts resulting from the project; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular
meeting held on June 21, 2005, made its report upon the desirability of the proposed
project and made its recommendations in favor by adopting Planning Commission
Resolution No. 2005-58 recommending to the City Council adoption of Mitigated
Negative Declaration No. 2005-01; and

WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on June 28,
2005;
NOW THEREFORE, the City Council of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The City Council has considered the proposed Mitigated Negative
Declaration prior to making a decision. Pursuant to Section 15063, of the California
Environmental Quality Act (CEQA), it has been determined that:
1. The proposed project is located within and contains habitat suitable for several
listed species that would occupy Riversidian coastal sage scrub. The project site is
located within the Riverside County Multiple species Habitat Conservation Plan
(MSHCP) area and has been reviewed by Riverside County and the Riverside
Conservation Authority (RCA). The project will set aside 75.5 acres of the project
site for permanent retention in accordance with MSHCP requirements. Based on
approval of this mitigation, the project will not cause either project specific or
cumulative unavoidable significant impacts on biological resources as outlined in
the CEQA Guidelines.
2. No cumulative environmental impacts have been identified in association with the
proposed project that cannot be mitigated to a less than significant impact level.
Potentially significant cumulative effects are reduced to a less than significant
impact level for biological resources, air quality and traffic.
3. A number of project impacts were identified as having a potential to significantly
impact humans, either directly or indirectly. Noise, traffic, air quality, and
geology impacts all pose a potential for adverse impacts to humans, but mitigation
measures have been established to control these impacts to a less than significant
impact level. With implementation of the identified measures, the proposed
project is not forecast to cause significant adverse impacts to humans. All such
impacts are avoidable and the City will ensure that measures imposed to protect
humans are implemented.

SECTION 2. PURSUANT TO THE ABOVE FINDINGS, the City Council of
the City of Lake Elsinore DOES HEREBY RESOLVE that Mitigated Negative
Declaration No. 2005-01 and the Mitigation Monitoring Program thereto are complete
and adequate and provides appropriate environmental documentation for the project, and
fully complies with the requirements of CEQA, the State CEQA Guidelines, and the
City's environmental clearance procedures
PASSED, APPROVED AND ADOPTED, this 28th day of June, 2005 by the
following vote:
