A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, ADOPTING
FINDINGS OF CONSISTENCY WITH THE MUI.,TIPLE
SPECIES HABITAT CONSERVATION PLAN (MSHCP)
FOR THE PROJCT KNOWN AS INDUSTRIAL DESIGN
REVIEW NO. I 2004-06 TO BE LOCATED ON PASA~ENA
STREET AND CENTRAL AVENUE - APN 377-140-019
WHEREAS, Carl Johnson, Trip(e J Development, has submitted application(s) for
Industrial Design Review No. 2004-06; and
WHEREAS, Mitigated Negative Declaration No. 2602-03 was certified by City Council
on August 27, 2002 for Tentative Parcel Map 30395 (the underlying Parcel Map of Industrial
Design Review I 2004-06) complying with Section 15067 of the California Environmental
Qualiry Act (CEQA) and a Habitat Suitability Assessment Letter Report was provided meeting
the requirements of the MSHCP; and Industrial Design Review No. 2004-OS together comprise
the "projecP' as defined by Section 21065 of the California Environmental Quality Act (CEQA),
California Public Resources Code Section 21000 et seq., which is defined as an activity which
may cause either a direct physica( change in the environment, or a reasonably foreseeable
indirect physical change in the environment and which includes the issuance to a person of a
lease, permit, license, certificate or other entitlement for use by one or more public agencies; and

WHEREAS, public notice of said application has been given, and the Planning
Commission has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on March 15, 2005;
and
SECTION 1. The City Council has considered the Habitat Suitability Assessment Letter
Report; and Industrial Design Review No. 2004-06. The City Council finds and determines that
the project is consistent with all of the required procedures, policies, guidelines and provisions of
the MSHCP based on the following findings:
MSHCP CONSISTENCY FINDINGS
The proposed project is consistent with the Protection of Nanow Endemic Plant Species
Guidelines.
According to the Multiple Species Habitat Conservation Plan (MSHCP), "Within identified
Narrow Endemic Plant Species survey areas (NEPSSA), site-specific focused surveys for
Narrow Endemic Plant Species shall be required for all public and private projects when
appropriate habitat is present. " Since the Habitat Suitability Assessment Letter Report dated
March 2, 2005 found no appropriate habitat for Narrow Endemic Plant Species future focus
studies are not required.

PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Council
of the City of Lake Elsinore, California, that the City of Lake Elsinore Multi-Species Habitat
Conservarion Plan Findings of Consistency hereof be adopted.
