AN RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, MAHING AN
AMENDMENT TO THE LAKE ELSINORE GENERAL
PLAN LAND USE ELEMENT FOR THE SECOND CYCLE
OF THE CALENDAR YEAR 2005 APPROVING GENERAL
PLAN AMENDMENT NO. 2004-05, AMENDING THE
GENERAL PLAN LAND USE MAP DESIGNATION ON
APPROXIMATELY 37.12+ ACRES LOCATED WEST OF
GREENWALD AVENUE, APPROXIMATELY 3.12 MILES
SOUTH OF STATE HIGHWAY 74, EAST OF MARELLI
ROAD AND NORTH OF PONTE RUSSO, AND KNOWN AS
ASSESSOR'S PARCEL NOS. 349-390-001 THRU -004, -015
AND -016, FROM "LOW MEDIUM DENSITY
RESIDENTIAL, 6 DWELLING iJiVITS PER ACRE" TO
°`TUSCANY HILLS SPECIFIC PLAN."
WIIEREAS, Chris Holmquist, Centex Homes has initiated proceedings to amend
the General Plan Land Use Map on approximately 3712+ acres of unimproved property
from "Low Medium Density Residential, 6 dwelling units per acre" to "Tuscany Hills
Specific Plan" on parcels known as Assessar Parcel Numbers 349-390-001 thru -004, -
O15 and -016; and
WHEREAS, Section 65361(a) of the Government Code provides that no
mandatory element of a General Plan sha11 be amended more frequently than four times
during any calendar year; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular
meeting held on March 1, 2005, made its report upon the desirability of the proposed
project and made its recommendations in favor of General Plan Amendment No. 2004-OS
by adopting Planning Commission Resolution No. 2005-28 recommending to the City
Council approval of General Plan Amendment No. 2004-05; and
WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development Deparhnent
and other interested parties at a public hearing held with respect to this item on March 22,
2005;
NOW THEREFORE, the City Council of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:

SECTION 1. The City Council has considered proposed General Plan
Amendment No. 2004-OS prior making a decision to approve the proposed amendment to
the Land Use Plan. The City Council fmds and determines that the Final Subsequent
Environmental Impact Report SCH # 2004071082, Findings of Fact, Statement of
Overriding Considerations, and Mitigation Monitoring and Reporting Program prepared
far this project is adequate and prepazed in accordance with the requirements of the
California Environmental Quality Act (CEQA) which analyzes environmental effects of
the proposed project prior to City Council certification.
SECTION 2. That in accordance with State Planning and Zoning law and the
City of La1ce Elsinore Municipal Code, the following findings for the approval of General
Plan Amendment No. 2004-OS have been made as follows:
1. The proposed amendment will not be (1) detrimental to the health, safeTy,
comfort, or general welfare of the persons residing or working within the
neighborhood of the proposed amendment ar within the City, (2) injurious to
property or improvements in the neighborhood or within the City.
a. The existing designation of Low Medium DensiTy Residential is similar to
the residential development proposed for the site in Amendment No. 1 to
the Tuscany Hills Specific Plan. Moreover, the proposal to develop the
site under the Specific Plan designation assures that the development
standards and design guidelines of the Specific Plan will be consistently
applied.
b. The proposed amendment will benefit persons residing in this
neighborhood because, as members of the homeowners' association, they
would have access and use of Association facilities.
2. The proposed amendment will be consistent with the latest General Plan.
a. The existing designation of Low Medium Density Residential is similar to
the residential development proposed for the site in Amendment No. 1 to
the Tuscany Hills Specific Plan. Therefore, there is no change to the
anticipated land use for the site.
b. The General Plan encourages cohesive development in the City, rather
than piecemeal or leapfrog residential development.

PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the Ciry
Council of the City of Lake Elsinore, California, that the City of Lake Elsinore General
Plan Land Use Map hereof be amended for the second cycle in calendar year 2005 to
reflect General Plan Amendment No. 2004-05.
PASSED, APPROVED AND ADOPTED this 22"d day of March 2005, by the
following vote:
