RESOLUTION NO. 2001-08
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LAKE ELSINORE, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL OF THE
CITY OF LAKE ELSINORE APPROVAL OF THE FIRST
AMENDMENT TO THE DEVELOPMENT AGREEMENT
BETWEEN THE CITY OF LAKE ELSINORE AND LA
LAGUNA ESTATES.
WHEREAS, an application has been filed with the City of Lake Elsinore by La Laguna
Estates to extend and amend the adopted Development Agreement pursuant to Section 19.12.120
of the LEMC, and;
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of making recommendations to the City Council pertaining to adoption
and amendments to Development Agreement pursuant to Section 19.12.070 of the LEMC; and
WHEREAS, public notice of said application has been given, and the Planning
Commission has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on March 7, 2001;
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed amendment, prior
to making a decision to recommend that the City Council approve the proposed amendment
subject to modifications. The Planning Commission finds and determines that Environmental
Impact Report No. 88-2 (West-End Elsinore) is adequate and prepared in accordance with the
requirements of the California Environmental Quality Act (CEQA) which analyzes
environmental effects of the adopted Development Agreement, and has recommended City
Council certification.
SECTION 2. That in accordance with Section 19.12 of the Lake Elsinore Municipal
Code the following findings for the approval of Amendment No.1 to La Laguna Development
Agreement have been made as follows:
The Agreement is:
1. Is consistent with the objectives, policies, general uses and programs specified in the
general plan and any applicable specific plan;
2. Is compatible with the uses authorized in, and the regulations prescribed for, the land use
district in which the real property is located;
3. Is in conformity with public convenience, general welfare, and good land use practices;
4. Will not be detrimental to the health, safety, and general welfare;
5. Will not adversely affect the orderly development of property or the preservation of
property values;
6. Is consistent with the provisions of Government Code Sections 65864-65869.5.
NOW, THEREFORE, based on the above findings, the Planning Commission of the City
of Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake
Elsinore approve, Amendment No.1 to the La Laguna Development Agreement subject to
modifications.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LAKE ELSINORE, CALIFORNIA,
RECOMMENDING APPROVING TO THE CITY COUNCIL
OF ZONING CODE AMENDMENT NO. 2001-01 WHICH
PROPOSES TO AMEND TITLE 17, ZONING CODE,
CHAPTER 17.11, OF THE LAKE ELSINORE MUNICPAL
CODE
WHEREAS, the City of Lake Elsinore has established Chapter 17.11, "Historic
Downtown Elsinore Overlay District" of the Lake Elsinore Municipal Code (LEMC)
establishing standards to insure that future development in the historic core of the City is
compatible with the character of the existing historic downtown and to provide a framework for
allowable permitted uses, signs, new construction and the renovation of buildings which already
exist;
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of making recommendations to the City Council for changes to the
Zoning Code;
WHEREAS, public notice of said proposed zoning code amendment has been given, and
the Planning Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this item on April
4,2001.
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed Zoning Code
Amendment No. 2001-01, prior to making a decision to recommend that the City Council
approve the proposed amendment to Title 17, Zoning Code, Chapter 17.11, 'Historic Downtown
Elsinore Overlay District." The Planning Commission finds and determines that the proposed
amendment to the Zoning Code is consistent with the City's Adopted General Plan.
Consequently, any environmental impacts associated with this proposal are adequately addressed
by the Environmental Impact Report (EIR) prepared for the 1990 General Plan, certified
November 27, 1990.
SECTION 2. That is accordance with State and Zoning Law and Chapter 17.84,
Amendments, of the Lake Elsinore Municipal Code the following findings for the approval of
Zoning Code Amendment No. 2001-01 have been made:
1. As stated in the adopted EIR for the General Plan, any project consistent with the said
document will not create any significant imparts on the environment or any potential impacts
will be mitigated.
2. The proposed zone code amendment will not be (1) detrimental to the health, safety, comfort,
or general welfare of the persons residing or working within the neighborhood of the
proposed amendment or within the City, (2) injurious to property or improvements in the
neighborhood or within the City.
3. The proposed action will be consistent with the Goals, Objectives and Policies of the General
Plan and the Standards established in the Municipal Code.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL OF THE CITY OF LAKE ELSINORE CERTIFICATION OF
NEGATIVE DECLARATION NO. 2001-01
WHEREAS, an application has been filed with the City of Lake Elsinore by Tozai, Inc.
requesting approval of Tentative Tract Map No. 29637 located in the northern section of the
City, west of Lake Street and north of Mountain Avenue on Running Deer Road. The applicant
proposes to subdivide 10.5 acres into 44 single family residential lots; and
WHEREAS, Tentative Tract Map No. 29637 comprises the "project" as defined by
Section 21065 of the California Environmental Quality Act (CEQA), Cal. Public Resources
Code S 21000 et seq., which is defined as an activity which may cause either a direct physical
change in the environment, or a reasonably foreseeable indirect physical change in the
environment and which includes the issuance to a person of a lease, permit, license, certificate,
or other entitlement for use by one or more public agencies; and
WHEREAS, Negative Declaration No. 2001-01 has been prepared to evaluate
environmental impacts resulting with the project; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of making recommendations to the City Council to certify Negative
Declaration No. 2001-01; and
WHEREAS, public notice of said applications has been given, and the Planning
Commission has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on April 18, 2001;
and
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
1. Negative Declaration No. 2001-01 has been prepared, submitted and reviewed in accordance
with requirements of the California Environmental Quality Act and the City's CEQA
requirements, and are complete and adequate in their evaluation of all environmental effects
of the Tentative Tract Map No. 29637. Approval of Tentative Tract Map No. 29637 will not
result in any significant and unavoidable impacts.
2. The proposed applications will not have impacts that are individually limited but
cumulatively considerable. Given that project impacts are insignificant, cumulative impacts
are not foreseen.
3. The proposed applications do not have the potential to adversely affect humans, either
directly or indirectly.
4. The Planning Commission recommends to the City Council that it finds that Negative
Declaration No. 2001-01 is complete and adequate and provides appropriate environmental
documentation for the project and fully complies with the requirements of CEQA, the State
CEQA Guidelines, and the City's environmental clearance procedures.
NOW, THEREFORE, based on the above findings, the Planning Commission of the City
of Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake
Elsinore certify Negative Declaration No. 2001-01.

WHEREAS, an application has been filed with the City of Lake Elsinore by Tozai, Inc. to

SECTION 1. The Planning Commission has considered the proposed subdivision,
Tentative Tract Map No. 29637, prior to making a decision to recommend that the City Council
approve the proposed 10.5 acre subdivision into 44 single family residential lots. The Planning
Commission finds and determines that Mitigated Negative Declaration No. 2001-01 is adequate
and prepared in accordance with the requirements of the California Environmental Quality Act
(CEQA) which analyzes environmental effects of Tentative Tract Map No. 29637 and has
recommended City Council certification.
SECTION 2. That in accordance with State of California Subdivision Map Act, and the
City of Lake Elsinore the following findings for the approval of Tentative Tract Map No. 29637
have been made as follows:
1. The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the
objectives, policies, general land uses and programs specified in the General Plan
(Government Code Section 66473.5).
2. The effects this project is likely to have upon the housing needs of the region, the public
service requirements of its residents and the available fiscal and environmental resources
have been considered and balanced.
3. The design of the subdivision provides to the greatest extent possible, for future passive or
natural heating or cooling opportunities in the subdivision. (Governmental Code Section
66412.3)
NOW, THEREFORE, based on the above findings, the Planning Commission of the City
of Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake
Elsinore approve Tentative Tract Map No. 29637.

APPROVING CONDITIONAL USE PERMIT, CUP NO.
2001-02 FOR OUTDOOR STORAGE FOR TWO LOTS,
WITHIN BUSINESS PARK- APN 377-140-017 and -019.
WHEREAS, an application has been filed with the City of Lake Elsinore by FCI
Constructors to request a Conditional Use Permit, CUP No. 2001-02, for a storage yard for two
industrial lots to be located on a 11.40 acre site within the Business Park District;
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of approving Conditional Use Permit requests for outdoor storage; and
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed request for the
outdoor storage for the two (2) lots, within the Business Park and has found it acceptable. The
Planning Commission finds and determines this project is consistent with the Lake Elsinore
Municipal Code and that this action is exempt from the requirements of the California
Environmental Quality Act (CEQA).
SECTION 2. That in accordance with Chapter 17.74 (Conditional Use Permit) of the
Lake Elsinore Municipal Code the following findings for the approval of the outdoor storage
have been made as follows:
1. That this proposed use, on its own merits and within the context of its setting, IS III
accordance with the Goals, Objectives, and Policies ofthe Lake Elsinore General Plan.
2. That this proposed use, as proposed will not be detrimental to the general health, safety,
morals, and welfare ofthe persons residing in the neighboring area or the City.
3. That the site is adequate in size and shape to accommodate the use, and for all the yards,
setbacks, walls or fences, landscaping, buffers and other features required by the Zoning
Ordinance.
4. That in approving this use as requested and amended, there will not be an adverse effect on
abutting property or church participants.
5. Conditions and safeguards pursuant to Chapter 17.82.070 ofthe Zoning Code, including
guarantees and evidence of compliance with conditions, have been incorporated into the
approval ofthe subject project to ensure development ofthe property in accordance with the
Objectives of Chapter 17.82.

SECTION 1. The Planning Commission has considered the proposed design for the two

WHEREAS, an application has been filed with the City of Lake Elsinore by Woodside
Homes to request Minor Design Review approval of a four-unit Model Home Complex and
ultimate development of production units throughout 130 lots within Vesting Tract Map No.
23848; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of approving Design Review requests for Residential Projects; and
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed design for the
four-unit Model Home Complex and has found them acceptable. The Planning Commission
finds and determines this project is consistent with the Cottonwood Hills Specific Plan and the
Environmental Impact Report (EIR 88-01) that was certified by the City in 1988 for this area.
Under Section 15182 of the California Environmental Quality Act (CEQA) Guidelines, this
proj ect has been declared exempt from further environmental clearance.
SECTION 2. That in accordance with Section 17.82 (Design Review) of the Lake
Elsinore Municipal Code the following findings for the approval of Residential Project No.
2001-02 have been made as follows:
1. Subject to the attached conditions the proposed project is not anticipated to result in any
significant adverse environmental impacts.
2. The project complies with the Goals, Objectives and Policies of the General Plan and the
Cottonwood Hills Specific Plan, as approved.
3. This project complies with the design directives contained in Chapter 17.82.060 and all other
applicable provisions of the Lake Elsinore Municipal Code.
4. Conditions and safeguards pursuant to Chapter 17.82.070, including guarantees and evidence
of compliance with conditions, have been incorporated into the approval of the project to
ensure development of the property in accordance with the General Plan, Muncipal Code,
and Cottonwood Hills Specific Plan, as approved.
NOW, THEREFORE, based on the above Findings, the Planning Commission of the City

WHEREAS, an application has been filed with the City of Lake Elsinore by Verizon
Wireless to request approval of Variance No. 2001-01 for the construction of a 55 foot monopole
"monopine" at B Hampton Circle.
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of approving Variances for the requirements of the Zoning Code; and
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed 55 foot monopole
"monopine" and has found that topographical contstraits exits to warrant approval of the project.
The Planning Commission finds and determines this project is consistent with the Lake Elsinore
Municipal Code and that this action is exempt from the requirements of the California

SECTION 2. In accordance with State Planning and Zoning law and the City of Lake
Elsinore, the following findings for the approval of SPA No. 1 have been made:
1. Specific Plan Amendment No. 1 meets the City's Specific Plan criteria for content and
required implementation of the General Plan established by Section 65450 et seq. of the
California Government Code and Section 17.99 of the City of Lake Elsinore Municipal
Code.
2. Specific Plan Amendment No. 1 shall be implemented consistently with the Goals, Policies
and Objectives of the General Plan; and with any other applicable plans or policies adopted
by the City.

supersede applicable City ordinances and codes, unless specifically stated to the contrary.
Approval of Specific Plan Amendment No. 1 shall not be interpreted as waiving compliance
with other Federal or State laws or City Codes.
5. Specific Plan Amendment No. 1 allows future development to be well-integrated with its
surroundings.
6. Specific Plan Amendment No. 1 will be adequately serviced by existing and/or future public
facilities and services.
7. Overall design of Specific Plan Amendment No. 1 will produce attractive, efficient and
stable development.
8. Specific Plan Amendment No. 1 will not be detrimental to the health, safety, comfort or
general welfare of the persons residing or working near the project area or within the City,
nor will it be injurious to property or improvements in the project area or within the City.

Variance from the strict interpretation of the Municipal Code, allowing a twelve foot (12') rear

WHEREAS, an application has been filed with the City of Lake Elsinore by Richmond
American Homes requesting Minor Design Review approval of a three-unit Model Home Complex
and ultimate development of production units throughout 81 lots within Tract Map Nos. 29568 and
23848-5; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with
the responsibility of approving Minor Design Review requests for residential projects; and
NOW THEREFORE, the Planning Conmussion of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed design for the three-
unit Model Home Complex and production units and has found them acceptable. The Planning
Commission finds and determines this project is consistent with the Cottonwood Hills (commonly
known as Canyon Hills) Specific Plan and the Environmental Impact Report (EIR 88-01) that was
certified by the City in 1988 for this area. Under Section 15182 of the California Environmental
Quality Act (CEQA) Guidelines, this project has been declared exempt from further environmental
clearance.
SECTION 2. That in accordance with Section 17.82 (Design Review) of the Lake Elsinore
Municipal Code the following findings for the approval of Residential Project No. 2001-09 have
been made as follows:
1. Subject to the attached conditions the proposed project is not anticipated to result in any
significant adverse environmental impacts.
2. The project complies with the Goals, Objectives and Policies of the General Plan and the
Canyon Hills Specific Plan, as approved.
3. This project complies with the design directives contained in Chapter 17.82.060 and all other
applicable provisions of the Lake Elsinore Municipal Code.
4. Conditions and safeguards pursuant to Chapter 17.82.070, including guarantees and evidence of
