time as he shall deem pro~er; but he must inspect anal grade any restaurant
within five da,ys after written demeni bq the ovmer, operator~'or-person in
charge.of anq restxurant~ which received a grade of lesa than 90~ on the
last inspeetion, the record of each ~.nspection and the computation an~
ietermination of eaeh grading of each restaurant shall'be in triplicate
signed copy deliqered to the owner, operator,:or-persors in charge of the
restaur~.nt,. who shall sign:z receipt therefor. such<reoords shall be kept
and'preserved ia the.of£ice..of the Hezith Officer. '.

restaurznt:which complies ti,,,i.th the mi.nimum requirments of the lawe of
the State:of Californ.ia and:the ordinanees,of the City of Elsinore and
rules and regulations of the HeaTth Department~ regulating the sanitation

of restaurants. The Hea].th Officer may revoke_the;certificate ~ssued to
nny,restaurant upon a continuing:failure,,to comply,with such".miaimum
r~quirements within a reasonable time nftex writ~sn notice.
Such notice shsll specify the particulars oP non-compliance with`su.ch
lzms and reguLations and shall be dalivere~ to the.;owner;<operator or person

` The City Council of the City of Elsinore does hereby ordai~xl as follovrr:
SECTION 1. _

organization to establish, open operate, or maintain eithbr as owaer~ agent~
or,empc~oyqe, any pool.room~ card room, or combined pool & Car~ room as hereinafter '
definei without first obtaining a license.from the City,Council.

apparytus rented for such purpose anel/or from which the operator of such place .

upon a retailer or consumer.

a sales or use tax has become due by reason o£ the same transaction
to any other city a.nd county~ county other than the co nty in which this
city is loc te3~ or city in this state under a sales or usce tax ordinanee
enacted by that City and county~ co mty other than the county in *~~ich
this city is located, or city in this State in accordance vrith Part 1.5
of Division 2 0£ the said Revenue and Taxation Code.
(iii) Receipts from sales to operators of: common carrier and
~ wa.ter borne vessels o£ nroperty to be used or consumed in the operation
o£ such common carriers or water borne vessels principally outside of
this rity. . _ :

retailer on or aFte the operative date of this ordinance, £or ss~orage,

include deli.very charges when such eharges are subject to S~ate sales or
use tax regardless of the place to tlhich delivery is made.
(b) (1) Except as hereinaft?r provi.ded, and except inso£ar as they are
inconsistent with the provisions of Part 1.5 of Division 2 of the said
Revenue and Taxation Code~ all o£the provision5 of Part 1 of Division 2
of said Code~ as amended and in force and effect on the operati.ve date oY

'(2)` Wherever, and to the e~tent that, in Part.l of Divison 2 of the said

to the sales and use tax and which are not inconsistent with Part 1.5 0£

SFCTION 7. ~':vTJ0I1VING "OLI~CTIOn1 FOkSIDDEN, No i_n~uction or writ of

any oificer of the State or this CiLy, to prevent or en~oim the collection

SECTION,8 PENALTIES. ;iny person vi.lating any of the provision oF this
ordinance shall be deemed guil y of a misdemeanor, and upon conviction
thereof shall be punishable by a fine o£ not more than ,~500,00 or by
impri~onment for a period o£ not more than six (6) months in the City Jail,
or by both such fine and imprisonm~nt. ,
SECTION 9. SEVFRABIIlTY. if any section, subsection, sentence clause,
phraGe or portion of this ordinancey including but not limited to any exemption
is £or any reason held to be i~nvalid or unconstitutional by the decis~on
o£ any court o£ competent jurisdiction~ such decision shall not effebt
the validity of t.he remaining portions of this ordi,n<.nce. The Counci2
of the City of Elsinore hereby declares that it wculd have adoated this
ordinance and each section~ subsection~ sentence, clause~ phrase or portion
thereof~ irresnective of he fact~ that any one or more sections~ subsection~

IN SUCH PUBLIC PLACES. - '

Section 1. It shall be unlawfu7l £or any person or persons to
drink or.eonsume or attempt ot drink or consume any alcoholic
beverages while such person or persons are in or upon any public
park, street, alley, highwag~ or other public place, except in or
upor~ those public places where the drinking or consuming of alcoholic
beverages is expressly peimi.tted.,bj~ law. -
Section 2. It:shall be unlawful for any person or persens while
in or upon any.public par~~,~alley~ street „ highwag~ or other public
place~ irithin the coxporate limits of the -City:of Elsinoro, except in ~;s
or upon those publ3c places where the drinking.or consuming o£ alcvholi
beveragea is e~cpressly permitted by law, to offer or furnish or give,

beveragea to any other person or persons with the intention'that such

or over which vehicles may be parked or driven.
