AN ORDINANCE PRESCRIBING REGULATIONS GOVERNING THE
SUSDIVISION OF LAN~ AND THE FLLING AND APPRQVAL OF
SUBDIVISON piAPS PR04IDING PENALTIES FOR THE VIOLATION
THFREOF, AND DESIGNATINff AND'ADOISORY AGFNCY SAID
ORDINANCE BEITtG ADOFTFD PTJRSUANT TO THE PROVISIONS
OF THE SUBDIL~ISION ~fAP. ACT OF THE STASE OF CALIFORNIA
I1S AMEAIDED, AND TO THE CENERAZ POLICE POWERS OF THE CITY
' OF ELSINORE~
The City Council of the City of Elsi'~ore does ordair~ as follows:'
SECTION 1, DEFINITIONS •
1. For the purpose of this ordinance the following terms are de£ined
as £ollows (a} «City}" shall be de~med to mean the ~ity of Elsinore~ State
of 8alifornia.
(b) City E~gineer shall be deemed to mean the Engineer or his
representative designated by the City Cou~cil to discharge
Sor the C,ity of E1Ginore those duties p~escribed hereinafter
to be perfozaied b~. the City En~ineer.
{c) "Gocunission"~~ha~]: Be.deemed to mea~ the City Planning
Commission of the City o~ Elsii~ore.
(d) ~FCity Council° shall be deemed to mean the City Council of
the City of Elsino.re,
(e) "Tentative Map" shall mea~ a map prepared in accordance with
° the provisions of the "Subdivisioxi Map Act'~ of the State of
California ar.d w ith provisions of `this ordinanc~ For the purpose
of showing the desig~i of a proposed subdivi.soxi and the existing
conditions in and ~round it and need not be based upom a detail
final survey of the proper.ty. '
` (f) "Final Map° `shall meas~ a~5it~p prepared in accordance with
the'provisions of the "Subdivisiott Map Act" of the State of
California and with the provisioxi~ af tho- ordinance~ which
map is designed to be placed on record in the office of tte
County Recorder.''
(g) The d~finitior~s and meaninga of alI other terms as contaimed
: in the said`"Subdivision Map Act" 'are hereby adopted as the
meanings of su,ch terms whenever they appear ia this ordinance
unless otherwise specifically defined or described.
SECTION 2. ADViSORY !~GENCY
2. The City Plannin~ Commission of the Cit~r oY Elsinore is he.reby
' designated as the "Advisory Agency" for the City and is charged with the Duties
and powers of making 3nvee,tigations'and reparts.on the dasign amd impeovement
of proposed subdivisions~ and of reportimg on the approval~ desapproval mr'
conditio~al approvxl theroY ~J3:rect t o the subidi4ider, as provided in the said
Subdivisiom Map Act". ~
SECTION 3. GENERAL REf~UIRk~NTS '
? 3. The following°regulatioas shall anoly to all subdivisions l~i.ag
wholly or in part within the incorporated limits o£ the City of Elsinore.
(a) Master Plan

(b) Streets
1.' Streets shall not be less thar_ 50 feet in width betweert

3. Private streets~ alleys or ways shall not be permitted

~ !t. Where a subdivisior~ adjoins acreage, streets which may
be extended in the evexit of the subdivision of the acreage
; shall be required to be provided thr~ugh to the boundary
i lines of the tract. ,

~ 5. Whenever a dead end street is permitted~ it shall not
exceed six hundred (600) feet in length and shall hane
a circular end with a minimum radius ~f forty (Lt0) ~
feet.. v.
~c) Alleys
1. Alleys-tweatq (20) feet wide may be required in the rear
of all prospective business property. ' "

(d) Lots
1. The size and shape of lots shall be such as is proper
forthe locality in which the subdivisio~ is situated
! and in conformance with the requirements of the 2oniag
ordinances, but itt no imstance shall the width be less
' than fiftp (50) feet and 6000 square feet of lot area~.

' storm drainage purposes conforming substantially with
the lines of such w ater eourses~ channelsf streams;;er
creeks~ or shall provide by dedication further a~d;suf-
' ficient rights of wag ~r easementa as shall be requind
forstrnctures or ch~nnel changes or both~ to dispa~a of
such surface and storm waters.

1. Street trees of an approved bype shall be located wherevers
' required by the commissi~n.
(~;) Deed Restrictic+ns. ~
1. All deed restrictioms shall rua wiLh the iand and be
enforcable by the owner of any oP the nropertr lyiag
withi~ the subdivision.
~ SECTION ~y. IMPROVEMENTS REQUIRED
4. The follov.*ing improveme~ts shall be considered a minimum in each
case. (a) Stroets ~
1. Streets shall be graded and improved iA accordance with ~~
standarda and specifications as est~blished and adopted ~
by the Citq Couneil and to Grades approved by the Citr -"'
Engin~er. .
(b) Sanitary Sewers

and adopted by the Citq Gouncil.
2. Thes location of sewer lines, pipe sizes~ grades~ manholes

practicable and s~ designated by the Citr Engineer.
(c) Drainage Fzr,ilities
1. Drainage facilities shall be suffieient te prevent inu~datioxi

SECTION 5. INSPECTION
, 5. The .City Enginner or his representative shall check~ inspect and
approve all required impronements and the subdieider sh~ll reimburse the City
for the actual cost of 'such.
~ 5-2 No improvement shall be ar,cepted by the City or eonsic~ered as
having met the requirements of this ordinance until final approval by the City
Engiaeer has been granted,
SECTION 6. IMPROVEMENT BOND
6. In lieu of completing all improvements as required by this ardimance
befare the filing of the finaZ map the subdivider shall e~iter'into an agreement
with the City Coencil agreeing to complete theimprovements withi~ a time as a
~ I apecifie3 in th6 agreement. A Corporzte suretq bond payable,to the City or the.
~ ~ depositq of mone3* with the, City'in sin amount snfficient to cover the costs oP
all improvements and i.nspectionc shall secure agreembnt.
SGCTION 7. TENTATIYE MAP
. 7. All tentative maps shall be drawn on a~e or more sheets eighteet~'
by twenty six inches and to a scale of one inch equals oxie hundre3 feet. Im
' the case of a large tract the Commission may require ox~e map showing the entire
~ract ~ii addition.
7-2 Tentative maps shall~contain the following data:
(a) The tract.name~ north poirt~'~cale~ date and a vicinity map
to show the location and boundary pf the proposed trnet,
', ;(bt~ Names and"addresses of`rocord owner and subdivider: n~me~ addrese
and registration or license number of engineer or survey~r.
(c) Location~ names and pre'sent width of adjacent roads, streets~
_ ` highirays or ways.
' (d) LocaEion~ of official plan lines or nrojected streets or highwayr~
as shown on'the Maste'r Plan o£ the City.
(e) The location~ names and width of all ro~ds~ streets, highways, .
' and ways in the proposed new subdivisiori.
(f) Contocx l~nes having interv~.ls"of not'ever two feet for gro unds
sl~pes`under five percent and not ocer five feet £or gxround
slope°s over five nercent.

(g) Statement of the improvements proposed to be made or installed
ar.d of the time at whibh such improvements are proposed to be
made or completed. Preliminary plafis afld specifications showimg
in general the foregoing proposed iriprovements.
' 7-1~ The subdivider shall Pile with the Planning Comrn~asioa at least
seven (7) days prior to the meeting at which consideration o£ the map is desired
four (1~) dopies of the tentAtive map~,`with accompanying data and statemexits~
The subdivider shall~ at the'time of filing the tentative map, pzy a Siling
fee of ten dollars,

that basis~ shall~ with~nthirty (30) da~eys after the £iling of the tentative
map, unless snch time shall have been extended by mutual agroemtn~ by rr.solutio~

direet to the subdividcr arid shall also transmit to the City Engineer and City
Cc,uncik a copy of the tentatiye map., with accompanying data and statements~
uid a memorandum setting forth the action of the Planhing Commission thereo~.
SECTION 8. COD?STRIICTION OF 3MPROVEMENTS.
8. Beforo beginning com~truction a complete set of p3:ans~ profiles ~
cross sections and other drawings for all improvements shall be submitted to t he
City Engineer £or ~pproval and if approved, the City Engineer shall be furr3i~ad~
without cost~ one or more complete sets'as required. `No work sh~ll commence
unless anthorized by the City Engineer. '
SECTION 9. FINAL MAPS .
9. General Requirements: '

SECTION I0. RE~JERSION TO ACRE=1GE MAPS,
10. Mans filed for the purpose of showing as acreage land previouslq
subdivided into niupbered or lettered parcels shall be c~nspieuou~ly designated
with the title F'THE PURPOSE OF THF MAP IS A REOERSION TO ACREAGE~~ No tentative
man need be filed prior to the filing of such reversion to the'Acreage maps~
and i£ sufficient recorded date exesta from which an accurate map csu3 be comolied~
no survey nor certificate o£ any surveyor or engineer shall be required except
the certifieate of the City Engineer Certifqing to the Correctnesa of the map.
SECTIOid ll. SURVEY AND-MONUf3ENT5.
11. An accurate and.complete surney sgal3 be made of the land to
be subdivided with:all monumemts~ property lines~ center lines of streets~ alley~s
and easements~. ad3oining or:within the trnct tied into the survey.
11-2 Monuraenta shall consist of either new galvanized ir0~ pipe
not less than one (~~T) inch in diaineter znd thir6y-six (36~F) inches long
rei~aforc~d concrete posts six (6) inches by six (6) inches incross section ~r
six (6) inches in diamcter and thirty {30) inches long ~d all monuments shal
have a copper plate'or disk~ securely attached.to the top~ of the monument bg
a copner dowel or nail not less than two and oae-half (2A) inches lomg firml,
embedded in concrete and marking the`exzct-center. The registered license n
number of the engineer or surveyor shall be stamp,~d upoa the copper plate or

SECTION 12. THE SUBDIVISION MAP ACT. ~
12, The provisions of this ordinance sha.ll be in additiott to and
~hall be considered as supplomenting the provi_si.ox~s of ~~the Subd3vison Mag Act«
of the State of California.
SECTION 13. TJALIDITY
' 13. If any sectior~~ subseetiom~ sentence~ clause~ phrase or word
of this ordinance is for any reason held ~o be invalid by a court of cpmpetent
jurisdictior~ such d~cision s hall mot zffect the validity of the remaining
portions of this ordinance. The City Council hereby declares that it would have
passed this ordinance and caeh section subsection, sentence~ clause~ phrase,
or word thereof~ irrespective of the £act that ang one or more section~ subsections~
sentences~ clauses~ phrases or worda should be declared invalid.
SECTION 1lt. PENALITIFS FOR VIOLATION.
1lt. Any offer to sell, contraet to sell-or sale contrarq to the
' provisi.ons of this ordinance shall be a misdemeanor~ and any person~ firm
corporation~ partnership or co-partnership~ upon censictioaa thereof~ shall. be
punishable by a fine of not less than twenty-five dollars and aot raore than three
`'hundred dollars or by imprisonment in the county 3zil for a period.of not
mor6 than three months~ or b~ both such £ine and imprisonment~ except that
notix~g herein contained shall be deemed to bar any legal~ equitable, or summaxy
remedy to which the City or other political subdivieion~ or any pe~som~ Pirm,
coaporatioa, partnership~ orco-partnership may-otherwise be entitled~ ~nd the
City or,zny other political subdivision~ superior co<xrt of the County to restraia
or en3oin any attempted or proposed subdi~i.sion or sale ix~ violation of this
ordinance. :
SECTION 15. .ENACTMENT

place where pool, billiards, snooker~ or si.,,ul~r ffames axr play@d upon'tables
or other apparatus rented for such puroose and/or frem which'the operator of
such place derives revenue, "•

SECTION 2.- _
No such place shall be permitte~ to have any portion t hertof partitioned
for the purpose of provid3ng seperate game rooms apart from the bal¢nce of '
the place~ exeept wach such place sha,ll provide a wash room~ not exceed eithty
(80) square feet of floor ~pace ~nd e~ch such place operat.ing a lunc~hroom'in
connection there~+*ith may be permitted the use of e. partial sr,reen as may meet
with the approval of the health and police deoartments o~' the City~.

It shall be unlwaful for the licensee~ his employee, agent or r
representative to allow any person under the age of eighteen ~1L) years to
frequent~ loaf~ loiter or play any game in such place.

It shall be unlawful to keen any such place open bwtween the hours
of 1:00 arn and 7:00 am of any day, or to play or allow to be played,any game
in such place between these hours.'
SECTION 3.
Any person desiring to open~ opPrate or conduct any such n,lace as
--- described herein shall apply in iM1*riting to the City Council for a Iicense~ which
application shall specify the proposed location~ name and address of the aApli.c;nt
the owner or owners snd manager and if a club or organization the name and addre;,s
of it.s principal officer~ also the number of pool and~or,card tables to be used.

it is presented said anplication shall be held over.until the next regular meeting
of said council and again read to the council~ at Vrhich time the council may
determine whsther or not the pnblic interest~ convenience and necessity require
the issuance ofthe requested license.

SECTIOP~ 5.
Any l~cense issued pursuant to the provisions o£ this ordinanc~ may
be revoked by the Council~ aiter.ten (10) days written notice to the holder t
thereo£ rec,uiring him or them to appear be1'ore the council at a specified time
and olace to show cause why such license should rwt be revoked for any of the
following reasons. , ,.

SFCTICN 6.
Ugon coniriction of the l;cansee or any of his employees b,y a court of
