3 BE IT RESOLVED that the Mayor and City Clerk of the
4 City of Elsinore be and they are hereby authol'ized to execute
5 for and on behalf of the City of Elsinore, a lease covering
6 Lots 1 and 2 in Block 15 of the Town of Elsinore, to G. R. Gough,
7 M. H. Wesner and Arthur Bodj.ne as joint tenants and as trustees
8 fOI' Lynn Mort Post No. 200 of the A...'11erican Legion for a period
10 the conditions and terms set out in the attached copy of a
9 of twenty-five years at an annual rental of One Dollar and on
11 proposed lease.
12 BE IT FURTHER RESOLVED that the said property is not now
13 necessary for the use of the City of Elsinore for park or other

purposes, and that it will be to the advantage of the City of
Elsinore and the residents thereof that the said property be
used as a clubhouse for American Legion purposes and for a
swimming pool.
BE IT FURTHER RESOLVED that that certain lease dated
19 February 9th, 1942, between the City of Elsinore, a Municipal
20 Corporation, and G. R. Gough, M. H. Wesner and Arthur Bodine
21 as joint tenants and as trustees for Lynn Mort Post No. 200 of
22 the American Legion, be and the same is hereby cancelled by
23 agreement with the sa id lessees named in said lease.

LEASE
THIS LEASE made this /.J:zl day of May, 1946, between
CITY OF' ELSINORE, a municipal corporation, hereinafter referred
to as the Lessor, and G. R. GOUGH, M. H. WESNER and ARTHUR BODINE,
as jojnt tenants and as trustees for LYNN MORT POST NO. 200 of
the American Legion, hereinafter referred to as the Tenant;
WITNESSEI'H:
That the Lessor hereby lets and rents unto the Tenant,
and the Tenant hereby hires and takes from the Lessor the
premises situated in theCity of Elsi.nore, County of Riverside,
State of California, known and described as follows:
Lots 1 and 2: in Block 15 of the TOVlIN OF' ELSINORE,
as shown by map thereof on file in the office of
the County Recorder of the County of San Diego,
state of California, in Book 6 of Maps, at page
302 thereof.
TO HAVE AND TO HOLD the same for the term of twenty-five
years from the 1st day of June, 1946.
This lease is made and accepted upon the following terms
and conditions, which the parties hereto consent and agree to
keep and perform.
RENTAL: The Tenant agrees to pay as rent the sum of
One Dollar ($1.00) per year in advance on the 1st day of February
of each year of the term hereof.
The Tenant shall not use the said property for any unlaw-
ful purpose or in violation of any law or ordinance, and it is
contemplated that the Tenant will erect on the Westerly 150 feet
of said property a clubhouse for the use of the American Legion;
and in the event that the said Tenant should fail to erect said
clubhouse within two years from the date hereof, this lease may,

ing to plans which must be first approved by the City Council,
and which must in every particular conform to the State Law on
the subject, and it is agreed that said swilnming pool when
constructed shall be open to the use of the public at reasonable
rates during the swimming season, and shall be operated in all
particulars according to State and Municipal laws.
In the event that said Tenant should fail to construct
said swimming pool within two years from date hereof, that
portion of this lease, covering the Easterly 150 feet of the
property described herein, shall be cancelled and of no further
force and effect.
The Tenant agrees to pay all bills for labor or materials
used in the construction of any improvements or clubhouse on
said property, and to keep the said property free of lien, and
to pay when due any assessments or taxes which may become a
lien against the said property.
This lease shall not be assigned, nor shall the said
property be sublet, except that the same may be assigned to
other trustees for the Amerjcan Legion.
In the event tha t the Tenant shall, for' a per iod of six
months, cease to US& the property for clubhouse purposes for
the said Ame!'ican Legion, this lease may at the opt ion of the
Lessor be cancelled.
The Tenant may at any time during the term of this lease,
and if it Is not in default in the payment of rent, remove any
buildings or improvements placed on said property by the Tenant,
providing that the ground is restored to its original condition.
The Lessor covenants with the Tenant, that the Tenant on
paying the said rent and performing the said COvenants on their

1 At the termlna tion of this lease by lapse of time or
2 otherwise, the Tenant agrees to yield up the premises to the
3 Lessor.
4 IN WITNESS WHEREOF, the parties hereto have set their
5 hands; the Mayor and City Clerk of the City of Elsinore having
6 been duly au thorized to execute the same for and on behalf of
7 said City by resolution of the City Council.
