Once a week, the Contractor shall gather current progress information as of a given date (Data Date) and submit this data to the Wal -Mart Construction Manager for processing. The Wal -Mart Construction Manager will process the update data and produce a Progress Schedule, in a format similar to the Final Construction Schedule, which displays a "window" of the schedule encompassing, at a minimum, two weeks prior to the update's data date and ending four (4) weeks subsequent tothecurrentdatadate (6 -Week Window). C. If the updated schedule reveals that the current critical path(s) are in jeopardy, the Owner may direct the Contractor to take such corrective action as may be necessary to recover from the delay(s). 1.06 SCHEDULE REVISIONS A. It the Contractor wishes to make changes in its method of operating and /or sequencing of the Work, he shall notify the Owner in writing stating the rea.;ons for the changes, and provide a written description of the proposed schedule revisions. Upon review and approval of the changes, the Owner will direct its Schedule and provide a reproducible copy of the revised schedule, which will be jointly signed by the Owner and the Contractor, signifying acceptance by both parties. At a minimum proposed schedule, revisions may riot delay contractual milestone dates, after interface with other contractors, modify the overall flow of the Work, or result in an increase in the Contract Sum. B FrnT, time- to -t:me, the Owner or the Contractor may Identify minor revisions to the approved struction Schedule which better represent the Intent of the construction plan. Such minor revisions will be incorporated into the approved Construction Schedule upon agreement by theOwnerandtheContractorandwillbedocumentedinwritingbytheContractor. 1.07 RECOVERY PLAN A. Should the updated Construction Schedule show the Contractor path activities, the Contractor shall Immediately devise a plan for recovery of the lost time within the subsequent reporting period. The Contractors recovery plan will be reviewed at the jobsite Progress Meeting, or as soon as possible thereafter. Once approved by the Owner, the Contractor shall immediately put the recovery planIntoaction. B. During the period covered by the recovery plan, the Contractors progress will continue to be monitored against the approved Construction Schedule. If, by the next Progress Meeting, theContractorhasnotrecoveredfromthedelay, ft shall immedlately prepare a revised recovery plan for approval by the Owner. Persistent failure on the part of the Contractor to recover from its delays will constitute grounds for the Owner to take corrective action, as provided in the Contract, to ensure satisfactory completion of the Project. C. The Contractor shall bear all costs related to recovery from its delays, including costs incurred by theOwner. 1.08 DEFINITIONS A. Beneficial occupancy, or possession of the Project, or a portion thereof, shall be the point at which the Owner may saf occupy the related Work for the purpose In which it was Intended. Possession by the Owner of Incomplete Work does not constitute Substantial Completion. B. Final completion of the Project Is the point at which the Contractor has completed all requirements of the Contract, Including punch lists, cleanup, maintenance manuals and project Closeout activities. C. Float related to an activity, or path of activities, Is the number of wotdng- days' - difference betweentheEarlyFinishdateandtheLateFinishdate. Activities with float values greater than zero (0) may bedelayed, without affecting tt!e associated Contractual Milestone, to the extent of the float beingreducedtozero. Activities wilh float values of zero or less are critical to the timely occurrence of the associated Contractual Milestone. Float is rat for the exclusive use of either party to the Contract.
