RIGHT OF WAY / PERMISSION TO GRADE - RIGHT OF ENTRY Project: Nichols / El Toro Road Improvements County of Riverside, City of Lake Elsinore Assessor Parcel Nurn ers:(347-420-020, old) 347-420-025, 026, 028 New I , Eric P. Reynolds, the undersigned, hereby state that I am the legal owner of the above referenced vacant property located on EI Toro Road, in Lake Elsinore, CA. I also state that I have seen and received a copy of the construction drawings for Nichols EI Toro Rd. Improvements, which propose construction of said property consisting of: I. Roadway grading, cut and fill slopes and graded /concrete swales; and 2. Drainage improvements including culverts, rip rap and related grading. The proposed construction has been shown on the construction drawings -Dated 7/13/04 and was explained to me. I hereby give my consent and permission for the Right of Entry onto the above -identified property to perforin the above stated construction. This permission shall continue in force only until the above -identified work has been completed and a Notice of Completion is issued on this project. It is expressly understood that upon completion of the work, this Right of Entry is terminated and said property will be left in a neat and orderly condition. I hereby give my consent also that I will not at any time block or divert any drainage into or out of the proposed drainage facility as shown on the Plans. North Peak Partners, L.P., A California Limited Partnership or assigns (hereinafter called "NPP") and its designees, agents, employees, contractors and authorized representatives agrees to defend and hold harmless the property and the undersigned owner thereof from any liability or responsibility to any third party for any accident, loss or damage to persons or property, happening or occurring as the proximate result of any of the entry, inspection or any operation performed as a result of such entry and inspections. Notwithstanding the foregoing, the right of entry shall expire and NPP's duty to defend and hold harmless the property and the owner shall terminate upon completion of proposed work indicated above.
