Labonhot-2 polarized light microscope and a Swift ster(•rj
microscope to estimate the percentage of asbestos by :(alum(
and determine the type present.
Scott Morrison & Associates determines percentages and t_ pe of
asbestos by using NIOSH approved method 7403 , the principles
of polarized light microscopy and dispersion staining.
Asbostos is quantified by using thy visual arena (estimation
technique and can only determine the approximate percentage of
asbestos present.
After a thorough search is conducted and no asbestos is
detected none detected will be noted in the report . '!'hr•
essence of polarized light microscopy is not to emphatically
dct(,rtnine that no asbestos is preserlt, merely that nc)n� was
detected or , i.f it was, it was likely to be l(•ss than l + of
the sample.
When findings reveal less than 1? present contained , further
analysis may be called for on additional. samples to (-Onfi.rm or
denounce the initial findings. The South Coast Air Q1u;lity
Management District ( SCAQMD) recommends three or mor(• samples
from a homogeneous area be analyzed before any bui.ldinq
material is determined to be non-hazardous.

ACREENIUIT FOR -,4RVICEB
THIS AGREEMENT is made and entered into this 28th day of August
1992, by and between the CITY OF LAKE ELSINORE, a Municipal
Corporation, hereinafter referred to as "CITY", and
Environmental Control Systems,, Inc. , hereinafter referred to as
"CONTRACTOR", in order to secure the services of CONTRACTOR as an
independent contractor to abate a hazardous structure(s)
within the City.
RECITALS
1. CITY desires to contract with a person to render special
services to abate a hazardous scructure(s) within the
City.
2. CONTRACTOR is specially skilled in the area of structure
abatement and has a thorough knowledge of the structure abatement
codes adopted by the City.
3. CONTRACTOR is an independent contractor who, in rendering
services, is to exercise independent judgment and represents the
CITY only as to the results of his work, and not as a means whereby
the work is to be accomplished.
WI�NES5ETH
In consideration of the foregoing and the mutual agreements herein
contained, it is hereby agreed by the parties as follows:
1. SCOPE: CITY agrees to retain CONTRACTOR to render services
pertaining to the abatement of a hazardous structure(s) located at
15900 Grand Avenue (Assessor's Parce.1 Numbers 381-050-002
The abatement involves complete removal of all asbestos material,
structures, foundations, and walkways, and the filling in or
removal of any
septic system. CONTRACTOR does hereby accept said agreement.
2. DUTIES: CONTRACTOR agrees to render services pertaining to
the abatement of Hazardous structures, including obtaining
necessary permits and/or making timely notifications to Air Quality
Management District.
3. RELATIONSHIP: CITY and CONTRACTOR intend, by this Agreement,
to establish an independent contractor relationship and not an
employer-employee relationship. This is due to the distinct skills
and experience possessed by CONTRACTOR and the projected length of
time the CITY will need such services.
4. COMPENSATIONS:_ CONTRACTOR shall render services to CITY on
a non-exclusive basis, but agrees to provide up to forty (40) hours
of service per week to CITY, and in excess of forty (40) hours per
week if needed.
CITY and CONTRACTOR agree that CONTRACTOR shall. be compensated
in the amount of $9,500.00. Any adjustment to this rate shall be
made by written "addendum to this Agreement, executed by both
parties hereto. CITY shall pay CONTRACTOR for CONTRA,u'TOR's services
within thirty (30) days of receiving an invoice therefor.
As an independent contractor, CONTRACTOR shall not be entitled
to, nor shall he receive, any other aompensati.on except as
expressly provided herein. Specifically, CONTRACTOR -hall not
receive any of the employee benefits provided by ' CITY to its
employees, such as, but not limited to, paid vacations and holidays
health insurance and uniform allowances.
5. TAXES, UNEMPLOYMENT.INSURANCE: No taxes shall be withheld or
unemployment insurance paid. by CITY on CONTRACTOR'S behalf or for
CONTRACTOR'S benefit. If CONTRACTOR desires any insurance
protection, CONTRACTOR shall acquire on CONTRACTOR'S own behalf.
6. INSTRUMENTALITIES OF OCCUPATION: As CONTRACTOR is ar,
independent contractor, it is understood and agreed by the parties
that CONTRACTOR shall provide all of the instrumentalities and
tools required in the performance of the terms of this Agreement.
7. TERMINATION: It is mutually understood and agreed that each
party reserves the right to terminate this Agreement upon fifteen
(15) days written notice to the other party. In the event of the
termination of this Agreement by either party, CONTRACTOR will
cooperate with the CITY in transferring CONTRACTOR'S files and
records to the CITY.
8. INTEGRATION: This Agreement supersedes any and all other
agreements either oral or in writing between the parties hereto
with respect to the subject matter hereof, and no other agreement,
statement, or promise relating to the subject matter of this
Agreement which is not contained herein shall be valid and binding.
9. ASSIGNABILITY: Neither this Agreement nor any duties or
obligations hereunto shall be assignable by CONTRACTOR without the
prior written consent of the CITY.
10. LFF CT V AT • This contract shall commence on August 28,
1992.

executed by their officers or agents thereunto duly authorized, the
day and year above written.
