HomeMy WebLinkAboutPA 2022-24, CDR 2022-13 Admin Approval CITY OF LADE LSII`IOF�E OR JE RECORD OF ADMINISTRATIVE APPROVAL Applicant: Elston Jones w/TEP on behalf of Crown Castle for Dish Wireless Applicant Address: 4710 Elwood St. Suite 9, Phoenix, AZ 85040 Project Manager: Carlos Serna, MPP, Assistant Planner Log No. & Name: PA 2022-24/CDR 2022-13 Minor Design Review Location/Address: 61000 Lake Street (APN: 390-120-011) Dish Wireless Site ID: LSSNA02133A Project Description: The project is a proposal by Dish Wireless to install two (2) panel antennas, one (1) antenna T-arm mount assembly, four (4) RRUs, one (1) over voltage protection device, and one (1) hybrid cable at 53'-0" high centerline on an existing 75'-8" high monopole. Additionally, the proposal includes the installation of one (1) concrete pad, one (1) ICE bridge, one (1) PPC cabinet, one (1) equipment cabinet, one (1) power conduit, one (1) Telco conduit, one (1) Telco-Fiber box, one (1) GPS unit, one (1) Fiber Nid, one (1) Meter with disconnect mounted on the existing CMU wall, and one (1) fiber handhole that would be enclosed by 8'-8" by 7'-4" CMU wall expansion with an access gate with a 35 sq. ft. lease area expansion at the existing wireless communications facility. The Project is located at 61000 Lake Street APN: 390-120-011 Environmental The project is Categorically Exempt from environmental review under Determination: Section 15301 (Class 1: Existing Facilities) of the CEQA Guidelines. ADMINISTRATIVE DETERMINATION: Per Section 17.415.140.E of the Lake Elsinore Municipal Code (LEMC), minor design review applications for eligible facilities request shall be reviewed by the Community Development Director or his designee. The Community Development Director shall approve the minor design review application, provided the following findings can be made: 1. The applicant proposes an eligible facilities request; and, 2. The proposed collocation or modification does not defeat any existing concealment elements of the support structure. Staff has determined that the proposed project qualifies as an eligible facilities request in accordance with Section 17.415.140.B.4 of the LEMC. Eligible facilities request means any request for modification of an existing tower or base station that, within the meaning of the Spectrum Act, does not substantially change the physical dimensions of that tower or base station, and involves the collocation of new transmission equipment, the removal of transmission equipment, or the replacement of transmission equipment. The Project is proposing to modify an existing wireless communications facility and qualifies as an eligible facilities request. The Project also complies with the design directives contained in LEMC Section 17.415.140.E and all other applicable provisions of the Municipal Code. PA 2022-24/CDR 2022-13 Dish Wireless Site ID: LSSNA02133A Administrative Approval: 12/05/2022 Conditions and safeguards pursuant to LEMC Sections 17.415.060 and 17.415.140.E including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the proposed project to ensure development of the property in accordance with the objectives of these chapters and the planning district in which the site is located. Furthermore, staff has reviewed the project for consistency with applicable provisions of the California Environmental Quality Act (CEQA). Based upon that review the Community Development Director finds and determines that the proposed project is Categorically Exempt from environmental review under Section 15301 (Class 1: Existing Facilities). Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The Project involves modifying an existing wireless communications facility by adding additional antennas, ancillary equipment and ground equipment. The Project only involves a minor alteration to the existing facility. APPROVED AND ADOPTED this 51" day of December, 2022: Damaris Abraham, Interim Asst. Community Development Director Appeals: In accordance with Section 17.415.140.F.1 of the LEMC, the Community Development Director's decision on minor design review applications for Eligible Facilities is final and shall not be appealable. Lapse of design review approval and time extensions: The design review approval shall lapse and become void two years following the date on which the design review became effective, unless one of the following: (1) prior to the expiration of two years, a building permit related to the design review is issued and construction commenced and diligently pursued toward completion; or (2) prior to the expiration of two years, the applicant has applied for and has been granted an extension of the design review approval. The expiration date of an approved design review may be extended for no more than two years. The first extension may be granted for one-year subject to the approval of the Community Development Director after consultation with other City departments if such design review complies with current laws, standards and policies. The second one-year extension may be granted by the approving body (i.e., City Council, Planning Commission) that approved the underlying design review so long as the design review complies with current laws, standards and policies. Application for extensions of time shall be filed prior to the expiration of the initial design review approval and accompanied by a fee in an amount as established by resolution of the City Council.
