RESOLUTION OF THE
CITY COUNCIL OF THE
CITY OF LAKE ELSINORE
Approving the Application Por Grant Funds Under
the State liitter Control, Recycling and Resource
Recovery Fund.
WHEREAS, the Leyislature of the State of California has
enacted the State Litter Control, Recycling and Resource
Recovery Act which provides funds to certain entities Por
Litter cleanup, litter 1aw en£orcement, litter education,
and purckiase of litter receptacles; and,
WHEREAS, the State So1id Waste Management Board has
been delegated tkie responsibility for the administration o£
the program, setting up necessary procedures governing
application by local agencies under the program; and,
WHEREAS, said procedures established by the StaL-~ So1id
Waste Management Board require the applicant to certi£y the
approval of applications prior to submission of said
applications to the State; and,

NOW, THEREFORE ~E IT RESOLVED that the City Caxncil
o£ the City of Lake Elsinore:
1. Approves the filing of an application for funding
under the Litter Control, Recycling and Resource Recovery
Fund; and,
2. Certifies that said agency understands the general
provisions of the grant agreement; and,
3. Authorizes the County of Riverside as agent of the
City of Lake Elsinore to conduct a11 negotiations; execute
and submit all documents including but not limited to
applications, grant agreements, amendments and payment requests,
which may be necessary for the completion of the aforementioned
program.

IN SUPPORT OF THE CONTINUAPdCE OF THE WF.ST

WHEREAS, for many years the best interest of the citizens of Riverside
County, the Real Estate Community and the Building and Development Industry
have benefited because of the operations of the West Area Planning Council
(W.A.P.C.), and
WHEREAS, because of the work done by the W.A.P.C., it is felt that the
work load of the Riverside County Planning Commission is greatly reduced
thus freeing the Planning Commissi~n to devote their resources to other
priorty matters, and
WHEREAS, the City of La'_c~=_ Elsinore is awar.e of the existance of pending
Ordinance No. 460/348, which would abolish the West Area Planning Council
if adopted by the County Board of Supervisors, and
WHEREAS, in our opinion, we believe that elimination of the Td.A.P.C.
would not result in any ultimate reduction of cost or shortening of process
time for P.U. and C.O. permits nor would it serve any other useful purpose,
and
WHEREAS, we are reasonably certain that the case load of the W.A.P.C.
could not effectively be taken over by the Planning Commission, in light of
their existing ~aork load particularly when you consider the recent news
statement by Planning Commission members regarding their large work load and
the strains already upon their proper consideration of land division
applications.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the
City of Lake Elsinore hereby wishes to be on record in clear and firm support
of the continuance of the West Area Planning Council.
BE IT FURTHER RESOLVED that we respectfully request the Riverside County
Board of Supervisors take no action to adopt pending Ordinance No. 460/348 or
any similar Ordinance amendment in the future which would cause the termin-
ation of the Sdest Area Planning Council.

RESOLUTION NO 79-4
A Resolution of the City Council of the City of Lake Elsinore
requesting congressional Hearings prior to instituting any changes as
proposed by FAA Notice of Proposed Rule Makirig 78-19 (NPRM 78-19).
WHERFAS the FAA has issued NPRM 78-19 which will lower the
positive control airspace to 10,000 ft ASL;
j~REAS NPRM 78-19 would create the basis for expending and
increasing terminal control areas (TCA) and Terminal Raclas Service
Areas (TRSA);
WIIEREAS NPRM 78-19 would require transponders and 360 channel
raflios on all aircraft within a TCA or TRSA;
Wf~REAS these requirements would not have prevented the
recent mid air collission at San Diego; the unitentional ditching
of National 193 in Escambia Bay, Florida; nor the fuel exhaustion
of United Flight 173 in Portland, Oregon;
WI-IEREAS the above mentioned accidents all occured in
controlled airspace;
Wf-IEREAS the proposal would set aside 75% of all useable
air space for 1.3% of civilian air craft and 25% for the remaining
airspace for 98.7% of the civilian aircraft;
WfIEREAS the proposal would severly decrease general aviation
safety by congesting the air traffic in the 8500 and 9500 A4SL elevations;
N~EIEREAS tfiere is Imown increase in mid air collissions
between general auiation aircraft in the vicinity sourounding TRSA
and TCA'S.
WHEREAS NPRM 78=19 will have a drastic negative effect on
general aviation without having a significant positive effect on
cormnercial aircraft safety. '
NOW THEREFOR BE IT RESOLVED that the City Council of the
City of Lake Elsinore requests the FAA to stop all procedures toward
implementing NPRM 78-191
AND BE IT FURTHER RESOLVED that the City Council of the City
of Lake Elsinore requests the President of the United States, the United
States Congress, the Senate Aviation Sub-committee, the House Aviation
Sub-committee, the FAA and NTSB to institute proceedings for full

Congressional Hearings to determine proper methods of seperating
commercial air traffic and general aviation without adversly affecting
general aviation airspace and safety.
This Resolution passed and adopted this 26th day of
February , 19 79 .

A RESOLUTION OG THE CITY COUNCIL
-0F THE CITY OF LAKE ELSINORE
COMMITTING TO THE IMPLEMENTATION AND ENFORCEMENT
OF THOSE ELEMENTS OE TNE SOUTH COAST AREAWIDE WASTE
TREATMENT MANAGEMENT PLAN APPROPRIATE TO ITS JURISDICTION
WHERE/1S the Federal Water Pollution Control Act (33 U.S.C.
1251, et. seq., as amended) seeks to develop a cooperative Federal,
State, r~egional and loca.l government program to prevent and control
sources of pollution to ground and surface waters in order to restore
and maintain the chemical, physical and biological integrity of the
Nation's waters; and
WNEREAS pursuant to Section 208 of the Federal Water
Pollution Control Act of 1972, as amended, the Southern California
Association of 6overnments (herein referred to as SCAG) has prepared
an Areawide Waste Treatment Management Plan for the South Coast area
with the assistance of the Counties of Los Angeles, Orange, Riverside
and San Bernardino, the City of Los Angeles, the Newport-Irvine
Waste-Management Planning Agency, the Santa Ana tdatershed Project
Authority and the Ventura Regional County Sanitation District; and
WHEREAS the Areawide Waste Treatment Management Plan for the
South Coast area will be adopted by SCAG on April 5, 1979, and forwar-
ded to the State 4Jater Resources Control Board for certification and
thereafter will be forwarded to the Federal Environmental Protection
Agency in compliance with Section 208 (b) (3) of the Federal Water
Pollution Control Act of 1972, as amended; and
WHEREAS the Areawide Waste Treatment Management Plan for the
Sovth Coast Area proposes management agencies to be responsible for
plan implementation and pursuant to published United States Environ-
mental Protection Agency guidelines (42 Fed.Reg. 44777 (1977),) must
indicate each management agency's willingness to proceed to carry out
its responsibilities as identified in the Plan; and
4FHEREAS the City of Lake Elsinore is assigned certain
responsibilities in the Areawide Waste Treatment Mana9ement Plan fior
the South Coast Area, approved by the SCA6 Executive Committee on
February 1', 1979;

' N041 THEREFORE BE IT PE~OLVED THAT it is the intent o` the
City Council o` the City of Lake Elsinore:
Section 1:
( To proceed with implementation of its responsibilities
as set forth in the 208 Areawide ldaste Treatment
Management Plan as approved by SCAG, said responsibil-
ities specifically described as follows:
a. Maintain existing street sweeping programs (prior
to Proposition 13} with consideration given to
increasing their effectiveness in reducing
wasteloads to receiving waters, to the extent
financially feasible.
b. Maintain current litter control programs, to the
extent financially feasible.
c. Maintain current catchbasin and storm drain
cleaning programs with consideration given to
increasing ,program effectiveness, to the extent
financially feasible.
' d. Emphasize reduction of runoff volume and peak
fiow rates as mitigation measures in environ-
mental impact reports (EIRs) and in conditions
for approval for new developments.

OF NOTICE TO PRORERTY OWNERS AND PROVIDING FOR
' A HEARING ON OBJECTIONS, TOGETNER WITH THE FILING
OF COST REPORTS AND ASSESSMENTS AGAINST ABUTTING

WNEREAS, there exists in the City of Lake Elsinore, California,
on certain'streets,~ sidewalks and on private property ~veeds and other materials
as defined in Ordinance No. 532 and Section 39561.5 of the Government Code;
_ WHEREAS, said weeds as~defined constitute a nuisance in that
- said weeds are a fire hazard;
WHEREAS, the City does designate the City Manager to enforce
the provisions'of Ordinance No. 532 and the provisions of the Government
Code of the State of California as hereinabove set`forth;
~ : WNEREAS, the City Manager has submitted a list of properties

upon which there is growning upon the Streets,`sidewalks,.and private _
property weeds which in.his opinion constitute a nuisance by yirtue of
being a fire hazard;
WHEREAS, there is affixed hereto and made a part hereof by
reference and marked Exhibit A a list of all properties within the City upon
which said weeds exist and which are referred to by commonly known street
names and which further describe the property upon which or in front of which
the>nu-isance exists by giving its lot and 61ock number according to the official :
assessment map of the County of Riverside which is the public body ~ahich does
the assessment for the City of Lake Elsinore.
NOW, THEREFORE, be it resolved_
i 1. That pursuant to the authority granted to the City by
virtue of Sections 39560 to 39588 of the Government Code of the State of Calif-
ornis and Ordiriance No. 532 of the City of Lake Elsinore, the City Council does

hereby declare that the weeds growing upon or in front of the properties
within the City as described in Exhibit A are hereby declared to be a nuis-
ance and shall be abated. `
' Z That notices be sent out to the property owners as last
shown upon the assessment rolls in accordance with the said Government Code,
State of California, and of said Ordinance, City of Lake Elsinore, California.
3.' That the said Notices.shall be in the form set forth in '
said Government Code and said.City Ordinan'ce and that said notices shall be
sent at least five (5) days prior to the time of the_hearing of objections.

4. That tfie list of all property owners to whom notices are
to be sent, as well as the location of the property to be posted, are set
forth in Exhihit A which is attached hereto and made a part hereof by reference.
5. That the City Council does hereby find and declare that
the weeds on the specified parcels of property are seasonal and recurrent
and shall.be abated in the manner provided for in Section 39561.5 of the Govern-
ment Code of the State ofi California and in accordance a~ith Ordinance 532 of
the City of Lakz Elsinore, California.
6. That the City Council of the City of Lake Elsinore does
hereby set the date of February 26. 197g , at the hour of 7:30 p.m.
in the Counc~l Chambers located in the City Hall of the City of Lake Elsinore,
California, to herein consider all objections to the proposed removal of weeds,
rubbage, refuse and dirt.
7. That thereafter if objections have not been made or the
City Council has disposed of those made, the City Manager is ordered to'abate
the nuisance in accordance with said Government Code Section and said Ordinance
of the City of Lake Elsinore, California.
8. The City Manager sha1T keep an account of the cost of the
abatement in front of or on each separate parcel of Land and shall render a
written report showing such costs and shall cause said notice to be posted
in accordance with law.
9. That the contractor that has been employed by the City
Council in accordance with Section 39576.5 of the Government Code and Ord-
inance No. 532 of the City of Lake Elsinore shall keep the said account, and
shall keep an itemized report for each parcel of land as required by law.

( ON CRIMINAL JUSTICE - REGION S AS THE REGIONAL CRIMINAL JUSTICE AND
~ DELINQUENCY PREV~NTION PLANNING AND C~ORDINATING BODY IN THE COUNTIES
OF IMPERIAL AND RIVERSIDE, CALIFORNIA
WHEREAS, the Omnibus Crime Control and Safe Streets Act of 1968
(Public Law 90-351), as amended, and the Deukmejian-Morietti Act of i973,
as amended, recognize the problems of crime, delinquency and recidivism
as primarily a problem of local government; and,
WHEREAS, the cxTY oF ~ EissNO~ recognizes that
effective planning and coordination for the reduction of crime,
delinquency and recidivism can 6est be accomplished through direct,
immediate and continuing cooperation of local officials charged with
general governmental and justice system responsibilities, and members of
( the community; and,
f WHEREAS. pursuant to Section 13900, et seq, of the California
Penal Code, counties and their member cities may establish a criminal
juatice and delinquency prevention planning district; and,
WHEREAS, the counties of and the cities witfiin Imperial and
Riverside, California have participated in a cooperative criminal justice
and delinquency prevention planning and coordinatiny effort since 1969;
NOW THEREFORE BE IT RESOLVED that the ~rmv oF TA F FT,QTNORF
designates the Council on Criminal Justice - Region S as the planning and
coordinating body for criminal justice and delinquency prevention in the

counties of Imperial and Riverside, California.
BE IT FURTHER RESOLVED that the csTY oF ~ ELSZNOxE
recognizes the Council on Criminal Justice - Region S as an unincorporated
association whose functions shall include but not be limited to:
coordinating local criminal justice and delinquency prevention activities;
planning far the use of federal and state funds which may affect the
criminal justice or juvenile justice systems; receive and disburse
federal, state or other funds and serve as a conduit for applications
for such funds; develop comprehensive, unified and orderly procedures
to insure that local criminal juatice and delinquency prevention plans
comply with federal and state guidelines, and that all applications for
grants-in-aid, loans, awards or other forms of funding assistance are
processed efficiently; cooperate with and render technical assistance
to units of local government, combinations of such units, or other public
or private agencies; organizations or institutions within or outside of
the district in matters relating to criminal justice and delinquency
prevention; conduct evaluations of programs and activities of criminaT
justice and jvuenile justice systems; and perform other functions and
duties as may be required by federal or state laws, rules, regulations
or guidelines.
6E IT FURTHER RESOLVED that the cx~r oF L~ EL~u2NORE recognizes
the membership of the Council on Criminal Justice - Region S as
representative of the broad range of community interests and viewpoints
in Imperial and Riverside Counties, and is balanced in terms of those
factors that are essential in.carrying out its duties.
BE IT FURTHER RESOLVED that the cz~r oF x~x~ ELSZNOxE shall
not be obligated to finance the activities of the Council on Criminal
Justice - Region S in the event that federal or state support of such
activities is lacking.

A RESOLUTION OE THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, ADJUSTING THE RATES FOR AMBULANCE SERVICE IN THE
CITY.
BE IT RESOLVED, by the City Council of the City of Lake Elsinore,
State of California, Yur~;uant to Section 5.24.130 of the City of Lake
Elsinore Municipal Code, that, the schedule of maximum rates~~:that may
be charged for ambulance services for one patient shall be as follows:
1. Response tc call $63.00
2. Mileage Rate: Ea.ch mile or fraction thereo.f. 3.00
3. Time Rate: Except. where an ambulance is hired on a stand-by
basis to provide serv~ice in case a person should become ill or injured,
for each 15-minute period or fraction thereof waiting time or stand-by
time at the request of the person hiring the ambulance, 7.50
4. Request for service after 7:00 P.M. and before 7:00 A.M. of next
day will be subject to an additional charge of 11.00
5. Cases requiring oxygen shall be subject to an additional charge
°f 10.00
6. Emergency cases requiring use of red light and siren shall be
subject to an additional charge of 22.00
BE IT FURTHER RESOLVED that the schedule of maximum rates for
ambulance service adopted by this Council by resolution on August 25, 1975,
is hereby revolked.
BE IT FURTHER RESOLVED that the Clerk shall mail a copy of this
resolution to the ambulance service permittee in the City oP Lake Elsinore.

SETTING FEES FOR CERTAIN PETITIONS IN ACCORDANCE WITH SECTION.17.88.020
OF CITY CODE OF 'I'f~ CITY OF I.AI~ ELSINORE.
WHERE.AS the City Council of the City of Lake Elsinore has adopted
Ordinance 586 amending Title 17 of the Municiple Code of the City of
Lake Elsinore. '
- lU1-IERFAS Ordinance 586 will be published and become e£fective as
provided by law.
LVfIEREAS Title 17 of the City Code of the City of Lake Elsinore does
call for certain Public Hearings for Zone Changes, Conditional Exceptions
and General Plan changes. °
A~HEREAS Chapter 17.88.020 of the City Code allows the City Council
to adopt by Resolution certain fees for Petitions for Zone Changes, Conditional
Exceptions, and General P1an changes.
NOW TI~REFORE BE IT RESOLVED THAT:
The City Council does hereby set the follotiaing fees:
A. Zone Changes. The swn of Four Hundred and Fifty Dollars plus
Ten Dollar,~%per acre £or each type of zoning being requested. Plus Two
Hundred and Fifty Dollars for Environmental Assessment. Enviromental Impact
Reports shall be actual costs plus 10o.
B. Conditional Exceptions. The swn of Two Hundred and Fifty
Dollars plus Thirty Dollars per acre for each use. Plus Seventy Five Dollars
and Ten Dollars per acre for Environmental Assessment. Environmental Impact
Report shall be actual costs plus 10%. In the event that a petition is filed
which includes parcells of land not in common ownership, each owner shall
pay the fee as herein provided in the same amount as if seperate petitions
had been filed.
C. General Plan Changes. The swn of Four Hundred and Fifty Dollars
plus Tiventy Dollars per acre for each new General Plan Designation, plus Three
Hundred and Fifty Dollars and Ten Dollars per acre for Environmental Assessment.
Environmental Impact Reports shall be actual costs plus 10a.
D. Fees on Appeals. There shall be a'Itventy Five Dollar fee for
appeals of Zone Change, General Plan Change or Conditional Exception decisions.

SECTION 1: TENI'ATIVE MAP FILING FEE
4.7 Filing Fees - A fee for the examination of the tentative map shall
be paid at the time of its filing to be deposited into a General Fund, as follows:
A. Subdivision Tentative Map -$450.00 plus $7.00 per lot
other than lots to be dedicated or conveyed for streets,
alleys, easements, and other public purposes, except
that when the map is for a condominimtun, the fee shall
be $450.00 plut $42.00 for each gross acre within the
boundary of the map. Plus $250.00 for Environmental
Assessment. Enviromental Impact Reports shall be actual
costs plus 10%.
B. Revision to Acreage - $450.00.
C. B4inor Land Division TenLative Map -$450.00 plus ~125.00
for Environmental Assessment. Environmental Impact Report
shall be actual costs plus 10%.
D. Revised Tentative Map - To confoxm to the conditions of
approval of-the Initial Map - $75.00.
E. Lot Line Adjustment -$ 100.00
SEC;fION 2: FINAL MAP CHECKING FEES
5.11 Final Map Checking Fees - The land divider shall pay a final
map checking fee to the City at the time the final map is first submitted to
the City Engineer for the checking and processing of the final map. The
checking fee shall be for the amount as fol•lows:
A. Subdivisions -$450.00 plus $9.00 for each lot except
for condmniniwn, the fee shall be $450.00 plus $60.00
for each gross acre included within the land division
boundary.

6.14 Improvement Plan Checking Fees - At the time the improvement plans
are submitted to the City for checking and approval, the land divider shall deposit
with the City a Plan Checking Fee in an amount equal to 1°s of the estimated con-
struction cost. The City Engineer shall approve the cost estimates shall be based
on reasonable up-to-date costs for comparable improvements in the City.
6.16 Construction Snspeetion Fees - The land divider shall deposit with
the City a Construction Inspection Fee for the Inspection of the construction of
the improvements in an amount equal to 3Z% of the estimated construction costs.
SECTION 4: The City Council is hereby ordered and directed to certify
to the passage of this Resolution.

INTERPRETATION OF PAYMENT OF CERTAIN PERMIT
FEES MANDATED UNDER CITY ORDINANCE NO. 572
WHEREAS, the Mayor and Council of the City of Lake Elsinore have
adopted Ordinance No. S72 requiring the payment of certain development
fees in order to finance needed improvements in the City~ ~. ~.. .~.
meet development needs, and provi~ie for orderly growth, and
WHEREAS, Ordinance No. 572 speak~ to the application of this fee -
structure for new construction and additions or alterations requiring ~
building permit or permits; but is silent regarding fee requirements ~
for the reconstruction of properties severely damaged by fire or flood
in which reconstruction would also require a building permit or permits,
and
WHEREAS, the Mayor and Council recognize there !nay be certain
advantages to the Community's welfare in encouraging the re-construction
of burned-out and severely flood-damaged properties and,
WHEREAS, since the adoption of Ordinance No. 572, the City has had
requests from property owners regarding forgiveness of development fees
which could have been required for reconstruction of properties damaged
in fire and flood situations, the City Council has determined a policy
regarding such eventualities is necessary..
THEREFORE BE IT RE50LV~D, that it 5ha31 be'.'the po].icy of the'-Mayar
and Council of the City of Lake Elsinore that individuals who feel ~
capital improvement fees mandated under Ordinance No. 572 may be in- ~
appropriate because their properties have been damaged by fire or flood ~ ~~,
have the option of applying to the Mayor and Council for forgiveness of ~
fees and,
BE IT FURTHER RESOLVED that the Council is willing to review each
petition individually in order to determine the appropriateness and .

WHEREAS, on October 18, 1978; Congress passed a series of
admendments to the Older American'Act which were so extensive as .
to almost constitute a new act;~and
WHEREAS, the intent of these new amendments was to mandate
programs to assist our older Ameri~;ans to reiaain in their communities
should they choose to do so; and
WHEREAS, the current funding under a. continuing resolution passed
by Congress does not provide all the necessary monies to carry out these
nev~ Congressional mandates. ~
NOW,.THEREFOf2E, BE IT RESOLVED that the Mayor and Council of the
City of Lake Elsinore goes on record as favoring an adequate federal
appropriation to take the plaae of the continuing resolution for fiscal
year 1979, and
BE IT FURTHER RESOLVED that adequate funding be made available
for the Older Americans Act~in.1980, and
BE IT FINALLY RESOLVED that we ask your support of this action
as a member of the Congress of the United States.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE SETTING
FEES FOR CERTAIN PETITIONS IN ACCORDANCE WITH SECTION 17.88.020 OF CITY CODE OF
THE CITY OF LAKE ELSINORE.
WNEREAS the City Council of the City of Lake Elsinore has adopted
Ordinance S86 amending Title 17 of the Miniciple Code of the City of Lake Elsinore.
WHEREAS Title 17 of the City Code of the City of lake Elsinore does call
for certain Public Hearings for Zone Changes, Conditional Exceptions and General
Plan Changes.
WHEREAS Chapter 17.88.020 of the City Code atlows the City Council
to adopt by Resolution certain fees for Petitions for Zone Changes, Conditional
Exceptions, and General Plan Changes.
NOW THEREFORE BE IT RESOLVED THAT:
The City Council does hereby set the followi~g fees:
A. Zone Changes. The sum of Four Hundred and Fifty Dollars plus Three
Dollars per acre for each type of zoning being requested. Plus Two Hundred and
Fifty Dollars for Environmental Assessment. Environmental Impact Reports shall
be actual costs plus 10$.
B. Conditional Exceptions. The sum of Two Hundred and fifty Dollars
plus One Dollar per acre for each use, plus Seventy Five Dollars and Two Dollars
per acre for Environmental Assessment.~~,Envfronmental Impact Reports shall be
acutal costs plus 10$. In the event that a petition is filed which includes
parcells of land not in common ownership, each owner shall pay the fee as
herein proveded in the same amount as if seperate petitions had been filed.
C. General Plan Changes. The sum of Four Hundred and Fifty Dollars
plus Three Dollars per acre for each new General Plan Desi9nation, plus Three
Hundred and Fifty Dollars and Two Dollars per acre for Environmental Assessment.

WHEREAS, EDWARD L. JACKSON, SR. has heretofore filed
a Petition with the City of Lake Elsinore, California thrbuqh
the Planninq Commission of said City requesting a conditional
use permit in connection with certain real property located in
the City of Lake Elsinore, County of Riverside, State of
California and more particularly described as Exhibit "A", which

WHEREAS, said matter was duly heard at the Planning

WHEREAS the City Council of the City of Lake Blsinore has received Zone
Change Application 79-8 requesting the change from R-2 to R-l.
WHEREAS the local residents have initiated Zone Chanqe Application 79-8.
WHEREAS the applicants have requested denial of two family and multi
family residential permits.
WHEREAS Government Code Section 65850 notes of decisions "C" regulatory
Amendments, Repeals, and Exceptions; Administrative relief and permits (56-85);
states "An Administrative bureau charged with the administration of a zoning
ordinance has the discretion to deny a permit application on the ground that
the structure described therein would soon be rendered illegal by a pending
ordinance not yet enacted". West Coast Advertising Co. v San Francisco (1967)
256 Ca 2d 357, 64 Cal Rptr 94.
WHEREAS a greater hardship will be realized by construction of residences
not conforming to R-1 development standards should the application be approved
than will be realized by the delay of construction of R-2 uses should the
application be denied.
NOW THEREFORE BE IT RESOLVED that~the City Council of the City of Lake ~
Elsinore directs the Planning Department not to approve two family and multi-
family residential structures within the R-2 zone covered by Zone Change 79-8
qenerally described as that area bounded by Smith Avenue, Lash Street, Shrier
Drive, McBride Avenue, Pinnell Street and Gunnerson Street. '
BE IT FURTHER RESOLVED that this Resolution shall be effective until

WHEREAS, She City of Lake Elsinore has received a request from the
City of Norco for support of the construction of the "NOrco Reach" of
Interstate 15, and
~WHEREAS, The City of Norco has further requested support of the
construction of that link of I-15, also known as the "adopted route" which
the City of Norco has indicated is the most direct link in completing the
existing qap in I-15, and
WHEREAS, the completion of the construction of that particular segment
of the freeway system will have an impact on the City of Lake Elsinore by
providing a more direct and expeditious route of travel to and from the
general area of the City of Lake Elsinore.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
endorse the completion of.the completion of Interstate 15 on as rapid a
schedule as is possible by the Department of Transportation, and
BE IT FURTHER RESOLVED that the City of Lake Elsinore supports the
City of Norco's position in connection with the construction of I-15 along
the "adopted route" as the most direct routing for the completion of that
seqment of the Interstate 15 Highway.

the Government Code of the State of California.

required by section 39574 of the Government Code of the State of
California.
2. That the cost of abatement of said nuisance in front of or
upon each parcel of land shall constitute a special assessment
against that parcel and shall be a lien on said parcel of land in
accordance with the provisions of the Government Code of the State
of California and Ordinance No. 532 of the City of Lake Elsinore,
California.
3. That an itemized written report and bill for each separate
parcel of land is affixed to this Resolution and made a part thereof
by reference as though more fully set forth herein. That certified
copies of this Resolution together with the exhibit attached hereto
shall be delivered to the Riverside County Auditor-Controller and
shall be made a part of the tax assessment unless paid prior to
filing, and be made a part of the tax rolls including a recording
fee of $15 per parcel, all in accordance with Sections 39578, 39579,
39580 and 29583 of the Government Code of the State of California
and other provisions of law applicable thereto. Said report is being
filed with the County Auditor for the reason that the County Assessor
and Tax Collector of said Riverside County perform the function of

OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, DESIGNATED
CERTAIN EDIPLOYEES AND OFFICERS AUTHOR-
IZED TO ISSUE ARREST CITATIOPdS FOR
SPECIFIED MISDEMEANOR VIOLATIONS
WHEREAS Section 1.06.050 of the Lake Elsinore Municipal
Code provides that certain officer,s and employees may be
designated by resolution of the City Council to exercise
the arrest and citation authority therein conferred; and
WHEREAS Section 1.06.050 further provides that such arrest
and citation authority shall be for specified misdemeanor
violations;
NOW THEREFORE be it resolved by the City Council of the City
of Lake Elsinore that the following officers and employees
of the City o£ Lake Elsinore are hereby designated to exercise
the arrest and citation aizthority conferred by Section 1.06.050
for the misdemeanor violations which are set forth below, next

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, REGARDING THE CITY'S ELIGIBILITY TO BE-
COME A MORTGAGE ASSISTANCE AREA, UNDER THE CRITERIA
OF THE CALIFORNIA HOUSING FINANCE AGENCY.
WHEREAS, the City of Lake Elsinore wishes to participate in the
- California Housing Finance Agency Program of providing State Funded Mortgage
Assistance for owner-occupied housing purchase and/or rehabilitation of single-
family dwelling units and;
WHEREAS, this program will be concentrated primarily in our
Neighborhood Strategy Areas, but will be available on a priority basis every-
where inside the City Limits, arid;
WHEREAS, it is the goal of the locality to assist persons and
families of low and moderate income to achieve access to housing financing,
and;
~dHEREAS, the Gdli.forni'a Houslnq Fin~nce Anencv has such.programs,
we hereby designate the City of Lake Elsinore to receive financing assistance
from the California Housing Finance Agency,
NOW, THEREFORE, BE IT RESOLVED, that the City of Lake Elsinore
declares the entire incorporated limits of the City of Lake Elsinore to be a
California Housing Finance Agency Mortgage eligible area.
AND BE IT FURTHER RESOLVED, that the City of Lake Elsinore asks
the California Housing Finance Agency to designate the entire Gity of Lake
Elsinore including the proposed Neighborhood Strategy Areas to be a Mortgage
Assistance Area.

A RESOLUTION OF THE CITY OF LARE EL5INORE, CALIFORNIA,
REGARDING THE ESTABLISHMENT OF CITY REFUSE COLLECTION
ACTIVITY AS AN ENTERPRISE FUND
WHEREAS, The City of Lake Elsinore, in accordance with Chapter 8.16
of the Municipal Code operates a regular Garbage and Waste Matter Collection
Service within the City of Lake Elsinore, and
WHEREAS, in connection with this se.rvice, a fee is collected on a
I monthly basis at a rate which is established by Resolution of the City Council,
I such Resolution currently in effect is #78-46, and
I WHEREA5, it is appropriate under such a set of~circumstances that this
type of activity be idehtified as a Municipal "Enterprise" Activity, and
WHEREAS, in the past, the Garbag~e and Waste Matter Collection Program
has been included as part of the General Fund for budgetary and accounting
purposes.
NOW, THEREEORE, BE IT RESOLVED that beginning with ~'iscal Year
1979-80 the City Manager, Finance Director and Treasurer are herebp autherized
and instructed to separately d2pict all revenue and expenditure items
resulting from the Garbage and Waste Matter Collection Enterprise in the
same fashion as is generally followed with the other City Enterprise fund
activities within the City's~annual operating budget and all other financial
records.

WHEREAS, this resolution adopts the budget for the Fiscal Year
1979-1980; and
WHEREAS, the City Manager, upon recommendation of the Finance
Director, may transfer funds within, but not between, each of the
functional appropriations of the General Fund as required to achieve
the purpose of the function; and
WHEREAS, The Council, from time to time, by motion or resolution,
may approve and authorize the payment of non-budqeted demands from
appropriated funds; and may appropriate funds for budgeted or nona
budgeted items, and any such appropriation for a non-budget item
shall constitute an approval to issue a warrant in payment of a proper
demand or demands theref.ore;
WHEREAS, Section 51508 of the Government Code requires the Council
to fix the amount of revenue from property taxes necessary to support the
City's Departments for the current year;
NOW, THEREFORE, BE IT RESOLVED that the following are fixed as the
amounts of revenue to be derived from property taxes:

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Clerk shall cause
this resolution to be published once within fifteen days after its passage,
in the Lake Elsinore Sun as required by Section 36933 of the Government
Code; shall certify to the adoption and publication of this resolution, and
shall cause this resolution and her certification, together with proof of
publication, to be entered in the Book of Resolutions of this City.
NOW, THEREFORE, BE IT FURTHER RESOLVED that this resolution, being
a resolution appropriating funds needed for the usual and current expenses
of the City, shall become effective and in full force immediately upon
its passage.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE ESTABLISHING THE AD VALOREM TAX RATE FOR
FISCAL YEAR }979-1980.
WHEREAS, the City of Lake Elsinore was incorporated April 23,
1888, and;
WHEREAS, the City provides municipal services to its property
owners and constituents, and;
WHEREAS, these services incur an expense to the end that the
appropriation of such money to cover these expenses is derived from the
taxing of properties, and;
WHEREAS, the City desires to continue to improve upon these
various municipal services, and;
WHEREAS, grants, subventions,and other monies, together with the
ad valorem tax rate provide for the payment of these services;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Lake Elsinore does hereby estabTish the following tax rate to appropriate
sufficient monies to wit:
TOTAL TAX RATE $1.40 Per $100.00 Assessed Value

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING SECTIONS ll and 12 (a) OF RESOLUTION N0.
1376, REGARDING THE COMPENSATION SCHEDULES FOR'ALL CLASSES OF
OF EMPLOYMENT IN THE CITY SERVICE: PROVIDING FOR CERTAIN OTHER
COMPENSATION BENEFITS AND REPEALING ALL OTHER RESOLUTIONS IN
CONFLICT THEREWITH.
WHEREAS, Section 37206 of the Government Code of the State of
California requires the City Council to prescribe the time and method of paying
salaries and wages of officers and employees of the City; and
WHEREAS, the City Council authorized and directed under the pro-
visions of the Personnel System Rules and Regulations, the preparation of a
compensation plan covering all classes of positions in the competetive service.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lake Elsinore that Section 1T of Resolution No. 1376 is hereby amended to a
five step Basic Salary Schedule as shown in Exhibit "A" attached hereto.
BE IT FURTHER RESOLVED that Section 12 (a) of Resolution No. 1376
(Allocation of Classes of Employment to Salary and Waqe Schedule) is hereby
amended to read as follows:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE PERTAINING TO THE RENAMING
OF MACHADO PARK.
WfIEREAS, The Lake Elsinore Va11ey was saddened by the recent unexpected
and premature passing of one of its native born sons, Mr. Steve Torn; and
WHEREAS, Steve was for most of his twenty-nine years much interested
and active in the promotion and imporvement of public park and recreation
facilities; and
WHEREAS, at the time of his passing Steve Torn was actively engaged in
park and recreation activities as an elected member of the Lake Elsinore
Valley Recreation and Park Board.
NOW, THEREEORE, BE IT RESOLVED that the public park facility located at
the intersection of Machado and Joy Streets, located immediately next to the
Machado Elementary School, hereinafter be officially named and be known as
"Steve's Park"; and
BE IT FURTHER RESOLVED that upon adoption of this resolution and concurrent
resolutions by the other two members of the, joint powers authority responsable
for this public facility, a suitable commerative marker be erected at an ~
appropriate location within the park grounds.

WHEREAS it has come to the attention of the City Coancil of the City of
Lake~Elsinore that the California Energy Commission StafE is forecasting an
annual growth of peak electric power demand of 1.4o for Southern California
for the years 1978 through 1990 and,
WHEREAS the City of Lake Elsinore believes this forecasted rate of growth to
be inconsistent with, and considerably less than, the City's recent qrowth
trends and,
: WHEREAS the City of Lake Elsinore is also concerned that restricting the growth
of electrical power can adversely affect present and future economic conditions
and could have a severe impact of the general health and safety of the City
citizenry,
. ~ NOW THEREFORE, BE IT RESOLVED that the City of Lake.Elsinore hereby requests:.~ ~~.
the California Energy Commission to (1) carefully analyze the basis and
reasonableness of the Commission Staff's preliminary forecast for electrical
power growth within our area and (2) assure the citizenry of the City of Lake
Elsinore that sufficient energy resources will continue to be available for
the balance of this century to promote commerce and a better standard of living
for a11 concerned.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA OF CONCURRENCE WITH THE &CAG-78
GROWTH FORECAST POLICY.
WHEREAS, the SCAG-78 Growth Forecast Policy was developed with the
participation of local governments;
WHEREAS, the SCAG-78 G.F.P. has been incorporated in the Regional Air
~~ Quality Management, Waste Water Treatment, Housing, and Trans-
portation plans;
WHEREAS, as a requirement for using SCAG-78 G.F.P. instead of the State
Forecast for the funding of waste water facilities, the State
Water Resources Control Board has called for resolutions from
local governments for concurrence with SCAG-78 G.F.P.;
WHEREAS, if SCAG-78 G.F.P. is not approved, the State may use its "F75"
Forecast, a forecast which is approximately one million persons
lower than that of SCAG-78 G.F.P. and shows 300 less growth; and,
WHEREAS, the SCAG-78 Forecast is revised approximately every two (2) years~,
and amendments can occur at any time;
NOW, THEREEORE, BE IT RESOLVED, that the City Council of the City of Lake
. Elsinore, concurs with the use of the SCAG-78 Growth Forecast Policy
and its use in regional plans.

LAKE ELSINORE, CALIOFRNIA, REQUESTING THE BOARD OF
SUPERVISORS OF THE COUNTY OE RIVERSIDE, TO RENDER
5PECIFIED SERVICES TO SAID CITY RELATING TO THE
CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD
IN SAID CITY ON TUESDAY~ APRIL 8, 1980.
WHEREAS, a General Municinal Election is to be held in the City of
Lake Elsinore, California, on April 8, 1980; and
WHEREAS, in the course of conduct of said election and in relation there-
to it will be necessary to mail sample ballots and polling place information
to the registered voters of the City, and it will facilitate such mailing if
the Registrar of Voters of the County of Riverside will make available to said
City the comp~..uter record of the names and addresses of all eligible registered
voters in order that labels may be printed for attaching to self-mailer sample
ballot pamphlets; and ~
WHEREAS, all necessary expense in performing this service shall be paid
by the City of Lake Elsinore;
NOW, THEREFORE, THE CITY COUNCIL OE THE CITY OF LAKE ELSINORE, CALIFORNIA,
DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the provisions of Section 22003 of the
Elections Code of the State of California, this City~Council hereby requests
the Board of Supervisors of said County to permit the Registrar of Voters to
prepare and furnish to said City for use in conducting said election the
computer record of the names and address of all eligible registered voters in
said City in order that the City may print labels to be attached to self-mailer
sample ballot pamphlets; and will also furnish to the City printed indexes of
the voters to be used by the precinct board at the polling place; and will make
to the City additional election equipment and assistance according to

SECTION 2. That said City shall reimburse said County for services

NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION
TO BE HELD IN SAID CITY ON TUESDAY, APRIL 8, 1980,
FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS
REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF
CALIFORNIA RELATING TO GENERAL LAW CITIES.
WHEREAS, under the provisions of the laws relating to General Law Cities
in the State of California, a regular general municipal election shall be held

SECTION 2. That the ballots to be used at said election shall be, both
as to form and matter contained threin, such as may be required by law to be
used thereat.
SECTION 3. That the City Clerk of said City is hereby authorized,..
instructed and directed to procure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment and paraphernalia that may
be necessary in order to properly and lawfully conduct said election.
SECTION 4. That the polls for said election shall be open at seven o'cl~
a.m. of the day of said election and shall remain open continuously from said
time until 7 o'clock p.m. of the same day when said polls shall be closed,
except as provided in Section 14301 of the Elections Code of the State of
California.
SECTION 5. That in all particulars not recited in this Resolution, said
election shall be held and conducted as provided by law for holding municipal
elections in said City.
SECTION 6. 'That notice of the time and place of holding said election
is hereby given and the City Clerk is hereby authorized, instructed and directed
to give such further or additional notice of said election, in time, form and
manner as required by law.

MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS
THEREOF FOR THE GENERAL MUNICIPAL ELECTION TO BE
HELD IN SAID CITY ON TUESDAY, APRIL 8, 1980.
WHEREAS, Section 10012 of the Elections Code of the State of California
provides that the governing body of any local agency adopt regulations
pertaining to materials prepared by any candidate for a municipal election, ,
including costs thereof;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OE LAKE ELSINORE, CALIFORNIA,
DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION l. GENERAL PROVISIONS. That pursuant to Section 10012 of the
Elections Code of the State of~California, each candidate for elective office
to be voted for at the General Municipal Election to be held in the City of
Lake Elsinore on April 8, 1980, may prepare a candidate's statement on an
appropriate form provided by the City Clerk. Such statement may include the
name, age and occupation of the candidate and a brief description of no more
than 200 words of the candidate's education and qualifications expressed by
the candidate himself. 5uch statement shall not include party affiliation of
~Ithe candidate, nor membership or activity in partisan political organizations.
ISuch statement shall~be~.filed in the office of the City Clerk at the time the
Icandidate's nomination papers are filed. 5uch statement may be withdrawn, but
not changed, during the period for filing nomination papers and until 5:00 P.M.
of the next working day after the close of the nomination period.
SECTION 2. SPANISH LANGUAGE. The City Clerk shall publish the
~candidate's statment bilingually.
SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to
linclude additional materials in the sample ballot package.
SECTION 4. PAYMENT. The City Clerk shall estimate the total cost of
printing, handling, translating, and mailing the candidate's statements filed
pursuant to the Elections Code, and require each candidate filing a statement
Ito pay in advance his or her pro rata. share as a condition of having his or her
statement included in the voter's pamphlet. The City Clerk shall bill each
candidate £or any cost in excess of the deposit and shall refund any unused
portion of any deposit.

WHEREAS, a regular general municipal election will be held and conducted
in the City of Lake Elsinore, CaliFornia, on Tuesday, April 8, 1980, as
required by law; and
WHEREAS, the City Council of said City desires the canvass of said
election to be made by the City Clerk of said City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA,
