Lake Elsinore, California, in adjourned regular session assembled l0th day of January, 197'7, hereby approves the proposed Agreement between the City of Lake Elsinore and the State of California, acting by and through its Business and Transportation Agency, Department of Transportation, and relating Co construction o£ Interstate Aighway Route 15 between the southeasterly city limit at Malaga Road and the north city limit near Terra Cotta Road; and BE IT FURTHER RESOLVED that the Mayor of the City of Lake Elsinore, California, is hereby authorized to execute said Agree- ment in behalf of the City. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State of California, there shall be and there is hereby called and ordered, held in the City of Lake Blsinore, County of Riverside, State of California, on Tuesday. the 31st day of May, 1977, a special municipal eleccion of the qualified electors of said City for the purpose of the election of a member of the City Council of said City for the term of office in which the vacancy was created by the resignation of Norman L. Chaffin which ends in March, 1980. SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 3. That the City Clerk of said City is hereby authorized, instructed and directed to procure and £urnisn any and all official ballots, notices, printed matter and all supplies, equip~ent and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 4. That for the gurpose of holding said special municipal election, there shall be and are hereby established four (4) voting precincts oonsisting of consolidations of the regular election precincts in the City of Lake Elsinore established for the holding of state and county elections, as said regular election precincts exist on the date of adontion of this resolution. WHEREAS, the City of Lake Elsinore, hereinafter referred to as Agency, is a contracting agency of the Public EYnployees' Retirement System• WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which he is classified as a local safety member is disabled for purposes of the Public Employees' Retirement Law and whether such disability is "industrial" within the meaning of such Law; WHEREAS, the City Council of the City of Lake Elsinore has determined upon legal advice that it may delegate authority to make such determinations to the incumbent of the position of City Manager; NOW, THEREFORE, BE IT RESOLVED that the City~Council of the City of Lake Elsinore delegate and it does hereby delegate to the incumbent of the position of City Manager authority to make determinations under Section 21023.6, Government Code, on behalf~of the Agency, of disability and whether such disability is industrial and to certify such determinations and all other necessary information to the Public Employees' Retirement System; and, ~ BE IT FURTHER RESOLVED that such incumbent be and he is authorized to make applications on behalf of the Agency for disability retirement of employees in employments in which they are local safety members and to initiate requests for reinstatement of such employees who are retired for disability. WHEREAS, a member of the City Council of Lake Elsinore, California has testified before the California Public Utilities Commission on February 24, 1977 in support of elimination of telephone toll charge calls within a radius of thirty miles from the City of Lake Elsinore, California; and WHEREAS, the testimony offered at the Murrietta hearings from Lake . Elsinore, together with other localities, appears to indicate that elimination of such toll charges is necessary and justifiable; and WHEREAS, the communities of Sun City, Perris, Murrietta and Temecula have already installed local call exchange services between them; and WHEREAS, such action is deemed by the Mayor and City Council of Lake Elsinore to be in the public interest and not harmful to the telephone company. That pursuant to the authority granted to the City by virtue of Sections 89560 to 39588 of the Government Code of the State of Calif- ornis and Ordinance No. 532 of the City of Lake Elsinore, the City Council does -1- hereby declare that the weeds growing upon or in front of the properties within the City as described in Exhibit A are hereby declared to be a nuis- ance and shall be abated. 2. 7hat notices be sent out to the property owners as last shown upon the assessment ro ll s in accordance with the said Government Code, State of California, and of said Ordinance, City of Lake Elsinore, California. 3. That thereafter if objections have not been made or the City Council has disposed of those made, the City Manager is ordered to abate the nuisance in accordance with said Government Code Section and said Ordinance of the City of Lake Elsinore, California. 8. The City Manager shall keep an account of the cost of the abatement in front of or on each separate parcel of Land and shall render a written report showing such costs and shall cause said notice to be posted in accordance with law. 9. WHEREAS the County of Riverside and its incorporated cities are required by Section 66796 of the Government Code to designate an enforcement agency to carry out the provisions of the Z'Berg-Kapiloff Solid Waste Control Act of 1976; and ~ WHEREAS the Riverside County Solid Waste Management Enforcement Agency possesses the required capabilities in environmental health and solid waste management to implement the Z'Berg-Kapiloff Solid Waste Control Act of 1976 and the regulations and ordinances that have been and will be adopted pursuant thereto; and . WHEREAS, that portion of the public way known as Lakeshore Drive in the City of Lake Elsinore, beginning generally at the eastern end at the intersection <.of Mission Trail and Railroad Canyon Road and proceeding along the lake, to the City limits at the west, at Machado Street, is a major traffic artery in the valley, used by private citizens, goyernment and commercial interests, and WHEREAS, at the intersection of Lakeshore Drive and the City limits at Machado Street in the west, that road enters the county jurisdiction and proceeds northwesterly until it intersects with California Highway 71, and is known for part of that distance as Rice Road and part of that distance as Robb Road, but is, in fact, Lakeshore Drive, extended, and WHEREAS, this important artery, having different names in three separate places, is confusin9 to newcomers, visitors, tourists and incoming commercial interests, and generally serves to cause confusion and delay, and WHEREAS, this condition is deemed to be disadvantageous and deleterious to the general public good by the Mayor and Council of Lake Elsinore; NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of Lake Elsinore respectfully request that through the good offices of County Supervisor Walter Abraham, the Board of County Supervisors authorize the changing of the name of that portion of this important artery betvaeen the City and Highway 71, from the current designations of Rice Road and Robb Road to Lakeshore Drive, and that they further authorize this cfiange be shown on all pfficial Riverside County signs, maps, documents, etc. Frank L. WHEREAS, the Mayor and Council of the City of Lake Elsinore are vitally concerned with the qeneral condition and continued existance of Lake Elsinore, and, WHEREAS, there is in existance a plan to redevelop the lake and provide a rmore permanent source of water, known by some as "Plan C" and WHEREAS, Assemblyman Tom Suitt shares our concern that the lake take place as was generally intended in "Plan C" in a proper and effective manner, and WHEREAS, Assemblyman Tom Suitt has proposed certain amendments to AB 4327 no~ being considered by the State Legislature; to wit, $300,000 dollars be taken from the States Park and Recreation Revolving Account, under Sections 2 and 3 ~,of the Bill for purchase of water, and be used instead for purposes set forth in Section 2 of the Bill, which provides for additional monitoring equipment and istaff costs to determine the f.easibility of drilling a fourth well, and to use all of this water purchase money for fourth well purposes. NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of Lake Elsinore hereby place themselves on record as being in wholehearted and firm support of these amendment to AB 4327 as proposed by Assemblyman Suitt. WHEREAS, the City Council of the City of Lake Elsinore, California, has repeatedly gone on record during recent years, in support of Interstate 15 through the City of Lake Elsinore, as adopted by the State Highway Commission; and WHEREAS, if said Interstate 15 is not constructed and usable along its adopted route, the City of Lake Elsinore will be subject to an intolerable traffic burden as a direct result of the incompleted sections; and WHEREAS, plans for a major international exposition at the Ontario Raceway have increased the need for a fully constructed Interstate 15; and WHEREAS, the City of Lake Elsinore supported legislation to increase revenues (SB 100) to fund today's construction costs on a realistic basis; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elsinore that: 1. The City earnestly reaffirms its repeated support of the route of Interstate 15 through the City Lake Elsinore as adopted by the State Highway Commission. 2. As much of the originally planned Interstate 15 as possible be constructed forthwith, and that the California Highway Commission is earnestly requested to authorize such immediate construction and, at the same time to reaffirm the need for the full Interstate 15 as planned. 3. The City Council of the City of Lake Elsinore also wishes to commend the California Highway Commission and CALTRANS on the thorough and excellent manner in which they performed their duties in adoption of the present route for Interstate 15 and progress made in construction of the very much needed portions already completed. Be is resolved by the City Council of the City of Lake Elsinore as follows: SECTION 1. The permit and inspection fees required by this resolution shall be paid within 30 days after the City has billed the utility company for the completed work. Billing shall be done on the monthly basis at the following rates: (a) For an excavation in a city street or right of way, with or without an installation of an encroachment, a permit fee of $5.00 and an inspection fee at the following rates: For i to 100 lineal feet of excavation, $20.00; For 101 to 1000 lineal feet of excavation, $30.00; For 1001 to 4000 lineal feet of excavation, $50.00; For 4001 to 7000 lineal feet of excavation, $60.00; For 7001 to 10,000 lineal feet of excavation, $70.00; For each additional 10,000 lineal feet, $70.00. The City Manager shall keep an account of the cost of the abatement in front of or on each separate parcel of Land and shall render a written report showing such costs and shall cause said notice to be posted in accordance with law, 9. That the contractor that has been employed by the City Council in accordance with Section 39576.5 of the Government Code and Ord-- inance No. 532 of the City of Lake Elsinore shall keep the said' account, and shall keep an itemized report for each parcel of land as required by law. -2- 10. PARK CAPITAL ID1PROVEMENT FUND: All properties within the City Limits of the City of Lake Elsinore shall pay into the Park Capital Improvement Fund: (a) $0.10 per square foot of building for standard residential. (b) $0.01 per square foot of lot for mobile home sites and industrial-commercial. 5. WAEREAS, it is necessary for the City of. Lake Elsinore (hereinafter called "association") to raise a portion of the cost of such undertaking by entering into a loan contract in the princiAal amount not to exceed $356,800 pursuant to the provisions o£ the Emergency Drouqht Relief Program; and [4HERFAS, the association intends to obtain assistance from the Farmers Home Administration, United States Department of ~ Agriculture (herein called the "Government") acting under the provi.sions of the Consolidated Farm and Rural Development Act (7 U.S.C. 1921 et seq.) in the planning, financing, and super- vision o£ such undertaking to to enter into a loan contract with the Government; NOW, THEREFORE, in consideration of the premises the association hereby resolves: SECTION l. To have prepared on its behalf and to adopt a resolution for approving a loan contract (herein called the "Resolution") and containing such items and in such forms as are required by State statutes and as are agreeable and acceptable to the Government. SECTION 2. To refinance the unpaid balance, in whole or in part of the loan contract upon the request of the Government if at any time it shall appear to the Government that the -1- association is able to refinance the loan contract by obtain- ing a loan for such purposes from responsible cooperative or private sources at reasonable rates and terms for loans for simi- lar purposes and periods of time as required by Section 333(c) of said Consolidated Farm and Rural Development Act (7 U.S.C. 1983(c)). SECTION 3. To provide for, execute, and comply with Form FmHA 400-4, "Nondiscrimination Agreement"; and Form FmHA 400-1, "Equal Opportunity Agreement", including an "Equal Opportunity Clause", which clause is to be incorporated in, or attached as a rider to, each construction contract and subcontract involv- ing in excess of $10,000. SECTION 4. To indemnify the Government for any payments made or losses suffered by the Government on behal£ of the associa- tion. Such indemnification shall be payable from the same source of funds pledged to pay the loan contract or any other legally permissable source. SECTION 5. That upon default in the payments o£ any prin- cipal and accrued interest on the loan contract or in the performance of any covenant or agreement contained herein or in the instruments incident to making or insuring the loan, the Government, at its option may (a) declare the entire principal amount then outstanding and accrued interest immediately due and payable, (b) for the account of the association (payable from the source of funds pledged to pay the loan contract or any other legally permissable source) incur and pay reasonable expenses for repair, maintenance, and operation of the facility and such other reasonable expenses as may be necessary to cure the cause of default, and/or (c) take possession ofthe facility, repair, -2- maintain, and operate or rent it. Default under the provisions of this Resolution or any instrument incident to the making or insuring of the loan may be construed by the Government to constitute default under any other instrument held by the Govern- ment and executed or assumed by the association, and de£auTt under any such instrument may be construed by the Government to constitute default hereunder. SECTION 6. Not to sell, transfer, lease, or otherwise encumber the facility or any portion thereof, or interest therein, not permit others to do so, without the prior written consent of the Government. : SFCTION 7. Not to borrow any money from any source, enter into any contract or aqreement, or incur any other liabilities in connection with making enlargements, improvements or extensions to, or for any other purpose in connection with the facility (exclusive of normal maintenance) without the prior written consent of the Government if such undertaking would involve the source of £unds pledged to pay the loan contract. SECTION 8. To place the proceeds of the loan contract on deposit in an account, in a bank, and in a manner approved by the Government. SECTION 9. To comply with all applicable State and. Federal laws and regulations and to continually operate and maintain the facility in good condition. SECTION 10. To provide for the receipt of adequate revenues to meet the requirements of debt service, operation and mainten- ance, and the establishment of. adequate reserves or use of the facility will be permitted. No free service -3- SECTION 11. To acquire and maintain such insurance coverage including fidelity bonds as may be required by the Government. SECTION 12. To establish and maintain such books and records relating to the operation of the facility and its financial affairs and to provide for required audit thereof in such a manner as may be required by the Government, to provide the Government without its request, a copy of each such audit, and to make and forward to the Government such additional information and reports as it may from time to time require. S~CTION 13. To provide the Government at all reasonable times access to all books and records relating to the facility and access to the property of the system so that the Government may ascertain that the association is complying with the provisions hereof and of the instruments incident to the making or insuring of the loan. SECTION 14. To serve any applicant with the service area who desires service and can be feasibly and legally served, and to obtain the concurrence of the Farmers Home Administration prior to re£using service to such applicant. Upon the failure to provide such service which is feasible and legal such appli- cant shall have a.direct right of action against the association under this agreement. The provisions hereof and the provisions of all instruments incident to the making or the insuring of the loan, unless other- wise specifically provided by the terms o£ such instruments, shall be binding upon the association as long as the bonds are held or insured by the Government. The provisions of Sections 6 throuqh 13 hereof may be provided for in more speci£ic detail in the Resolution; to the extent that the provisions contained in such _4_ Resolution should be found to be inconsistent with the provisions i hereof, these provisions shall be construed as controlling as I between the association and the Government. WHEREAS, a General Municipal Election is to be held in the City of Lake Elsinore on March 7, 1978; and WHEREAS, in the course of conduct of said election and in relation thereto it will be necessary to mail sample ballots and polling place inserts to the registered voters of the City, and it will facilitate such mailing if the County Clerk of the County of Riverside will prepare and furnish the City the imprinting of the names and addresses of the registered voters of said City on I.B.M. polling place inserts furnished by the County, and after bursting the forms will insert the polling place insert and samply ballot into envelopes, all to be furnished by the City; will place all envelopes in zip-coded mail bags, advise City Clerk of the number of pieces to be mailed, prepare POD Form 3602, "Statement of Mailing Matter With Permit Imprints", and advise the City Clerk when work is complete so delivery can be arranged; and WHEREAS, all necessary expense in performing this service shall be paid by the City of Lake Elsinore; NOW, THEREFORE, the City Council of the City of Lake Elsinore does hereby RESOLVE, DETERMINE AND ORDER as follows: SECTION 1_ That pursuant to the provisions of Section 22003 of the Elections Code of the State of California, this City Council hereby requests the Board of Supervisors of said County to permit the County Clerk to prepare and furnish to said City, for use in conducting said election to be held on March 7, 1978, the imprinting of the names and addresses of the registered voters of said City on I.B,M. polling place inserts furnished by the County, and after bursting the forms to insert the polling place insert and sample ballots into envelopes, all to be furnished by the City, will place all envelopes in zip-coded mail bags, advise City Clerk of the number of pieces to be mailed, prepare POD Eorm 3602, "5tatement of Mailing Matter With Permit Imprints, and advise the City Clerk when work is complete so delivery can be arranged.
