TRANS~ORTElTION, AND RELATING TO INTERSTATE HIGHWAY ROUTE :15.
BE IT HEREBY RESOLVED that the City Council of the City of ."
Lake Elsinore, California, in adjourned regular session assembled
l0th day of January, 197'7, hereby approves the proposed Agreement
between the City of Lake Elsinore and the State of California,
acting by and through its Business and Transportation Agency,
Department of Transportation, and relating Co construction o£
Interstate Aighway Route 15 between the southeasterly city limit
at Malaga Road and the north city limit near Terra Cotta Road; and
BE IT FURTHER RESOLVED that the Mayor of the City of Lake
Elsinore, California, is hereby authorized to execute said Agree-
ment in behalf of the City.

WHEREAS, a vacancy in tne office of inember of the City Council was created
by the resignation of Norman L. Chaf~in on January l, 1977, and;
WHEREAS, the term of office in which the vacancy was created by said
resignation of Norman L. Chaffin ends in March, 1980;
~ NOW, THEREFORE, THE CITY~COUNCSL OF~THE CITY OF~LAKE ELSINORE, CALIFORNIA,
DOES AEREBY RESOLVE,-DECLAFtE, DETER.~ISNE AND ORDER AS FOLLOWS:~ ~ ~
SECTION 1. That pursuant to the requirements of the laws of the State
of California relating to General Law Cities within said State of California,
there shall be and there is hereby called and ordered, held in the City of Lake
Blsinore, County of Riverside, State of California, on Tuesday. the 31st day of May,
1977, a special municipal eleccion of the qualified electors of said City for the
purpose of the election of a member of the City Council of said City for the term
of office in which the vacancy was created by the resignation of Norman L. Chaffin
which ends in March, 1980.
SECTION 2. That the ballots to be used at said election shall be, both as
to form and matter contained therein, such as may be required by law to be used
thereat.
SECTION 3. That the City Clerk of said City is hereby authorized, instructed
and directed to procure and £urnisn any and all official ballots, notices, printed
matter and all supplies, equip~ent and paraphernalia that may be necessary in order
to properly and lawfully conduct said election.
SECTION 4. That for the gurpose of holding said special municipal election,
there shall be and are hereby established four (4) voting precincts oonsisting
of consolidations of the regular election precincts in the City of Lake Elsinore
established for the holding of state and county elections, as said regular election
precincts exist on the date of adontion of this resolution. That the polling places
for the respective precincts snall be the places hereinafter designated; and that
the persons hereinafter named, being competent and qualified electors and residents
of said City and of their respective voting precincts, are hereby appointed
officers of election for their respective voting precincts and they sha11 hold said
election and make return thereof in the manner provided by law.

SECTION 5. That the compensation of the persons hereinbefore named as election
officers is hereby fixed at the sum of thirty dollars for each Inspector and twenty-
five dollars for each Judge and Clerk for said election. The rental for each of
such polling places shall be the sum of ten dollars for said election.

WHEREAS, a Special Municipal Election is to be held in the of Lake
Elsinore on May 31, 1977, and
6dEiEREAS, in the course of conduct of said election and in relation thereto
it will be necessary to mail sample ballots and polling place inserts to the
registered voters of said City, and it will facilitate such mailing if the
County Clerk of the County of Riverside will prepare and furnish the City the
imprinting of the names and addresses of the registered voters of said City on
I.B.M. polling place inserts furnished by the County, and aftex bursting the
forms will insert the polling place insert and sample ballot into envelopes, all
to be furnished by the City; will place all envelopes in zip-coded mail baqs, -
advise City Clerk of the number of pieces to be mailed, prepare POD Form 3602,
"Statement of Mailing Matter With Permit Imprints", and advise the City Clerk
when work is complete so delivery can be arranged; and
WHEREAS, all necessary expense in performing this service shall be paid by

NOW, THEREFORE, the City Council of the City of Lake Elsinore does hereby
~ ~~ RESOLVE, DETERMINE AND ORDER as follows: ~
SECTION 1. That pursuant to the provisions of Section 22003 of the Elections
Code of the State of California, this City Council hereby requests the Board of
Supervisors of siad County to permit the County Clerk to prepare and furnish to
said City, for use in conductinq said election to be held on May 31, 1977, the
imprinting of the names and addresses of the registered voters of said City on
I.B.M. polling place inserts furnished by the County, and after bursting the forms
to insert the polling place inserts and sample:baTlots into envelopes, all to be

WHEREAS a Special Municipal Eleotion is to be held in the City of Lake
Elsinore, California, on Tuesday, the 31st day of May, 1977, and
WHEREAS it is the desire of the City Council of the City of Lake Elsinore
to utilize the services of the Riverside County Election Department with the
services of their vote counting machines,
~ NOW, THEREFORE BE IT RESOLVED, that.the City Council Chambers, 130 South
Main Street, Lake Elsinore, California,. are hereby designated as the Central
Counting Center for the Special Municipal Election to be held May 31, 1977.
BE IT EURTHER RESOLVED that the Ri.verside County Election Department is
hereby requested to furnish the necessary vote counting machines and personnel
for said counting, which expense will be paid by the City of Lake Elsinore.

SELECT SYSTEM MODIFICATION
WHEREAS, a select system of streets for this City has been established with
: Sections 186.3 and 186.4 of the Streets and Highways Code; and
WHEREAS, the City Manager has submitted to this Council a report and map in
which are recommended certain additions and/or deletions to the minor Streets
shown on the select system which are warranted by subdivisions and terrain, other
causes of equal'necessity which have become evident since the system was ammended
on December 10, 1969.
NO!d, THEREFORE, BE IT RESOLVED that this Council does adopt said report and map
in accordance with the provisions of Section 186.3 of the Streets and Highways Code,

WHEREAS, the City of Lake Elsinore, hereinafter referred to as Agency,

for purposes of the Public Employees' Retirement Law and whether such
disability is "industrial" within the meaning of such Law;
WHEREAS, the City Council of the City of Lake Elsinore has determined
upon legal advice that it may delegate authority to make such determinations
to the incumbent of the position of City Manager;
NOW, THEREFORE, BE IT RESOLVED that the City~Council of the City of
Lake Elsinore delegate and it does hereby delegate to the incumbent of the
position of City Manager authority to make determinations under Section
21023.6, Government Code, on behalf~of the Agency, of disability and
whether such disability is industrial and to certify such determinations
and all other necessary information to the Public Employees' Retirement

BE IT FURTHER RESOLVED that such incumbent be and he is authorized
to make applications on behalf of the Agency for disability retirement of

A RESOLUTION OF THE CITY OF LAKE ELSINORE, CALIFORNIA
EXPRESSING ITS SUPPORT BEFORE THE CALIFORNIA PUBLIC
UTILITIES COMMISSION, CONCERNING ELIMINATION OF CERTAIN
TELEPHONE TOLL CHARGES.
WHEREAS, a member of the City Council of Lake Elsinore, California has
testified before the California Public Utilities Commission on February 24, 1977
in support of elimination of telephone toll charge calls within a radius of
thirty miles from the City of Lake Elsinore, California; and
WHEREAS, the testimony offered at the Murrietta hearings from Lake .
Elsinore, together with other localities, appears to indicate that elimination
of such toll charges is necessary and justifiable; and
WHEREAS, the communities of Sun City, Perris, Murrietta and Temecula have
already installed local call exchange services between them; and
WHEREAS, such action is deemed by the Mayor and City Council of Lake
Elsinore to be in the public interest and not harmful to the telephone company.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council~of Lake
Elsinore wholeheartedly support the proposals for elimination of telephone toll
charges within a radius of thirty miles from the City of Lake Elsinore,
California; and ~
BE IT FURTHER RESOLVED that the~:City Clerk is directed to send a copy of
~ this Resolution to the California Public Utilities Commission so that it may be
considered in the matter concerning the appeal currently pending before it.

OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA
AND ORDINANCE N0. 532, AND PROVIDIPJG FOR POSTING
OF NOTICE TO PROPERTY OWNERS AND PROVIDING FOR
A HEARING ON OBJECTIONS, TOGETHER WITN THE FILING
OF COST REPORTS AND ASSESSMENTS AGAINST ABUTTING

WHEREAS, there exists in the City of Lake Elsinore, California,
on certain streets, sidewalks and on private property weeds and other materiais
as defined in Ordinance No. 532 and Section 39561.5 of the Government Code;
WHEREAS, said weeds as defined constitute a nuisance in that
said weeds are a fire hazard;
WHEREAS, the City does designate the City Manager to enforce
the provisions of Ordinance'No. 532 and the provisions of the Government '
Code of the State of California as hereinabove set forth;
WNEREAS, the City Manager has submitted a list of properties
upon which there is growning upon the streets, sidewalks, and private
property weeds which in his opinion constitute a nuisance by virtue of
being a fire hazard;
WHEREAS, there is affixed hereto and made a part hereof by
reference and marked Exhibit A a list of all properties within the City upon
which said weeds exist and which are referred to by commonly known street
names and which further describe the property upon which or in front of which
~ the nuisance exists by giving its lot and block number according to the official
~

; assessment map of the County of Riverside which is the public body which does
ttie assessment for the City of Lake Elsinore. ,
NOW, THEREFORE, be it resolved:
l. That pursuant to the authority granted to the City by
virtue of Sections 89560 to 39588 of the Government Code of the State of Calif-
ornis and Ordinance No. 532 of the City of Lake Elsinore, the City Council does

hereby declare that the weeds growing upon or in front of the properties
within the City as described in Exhibit A are hereby declared to be a nuis-
ance and shall be abated.
2. 7hat notices be sent out to the property owners as last
shown upon the assessment ro ll s in accordance with the said Government Code,
State of California, and of said Ordinance, City of Lake Elsinore, California.
3. That the said Notices shall be in the form set forth in
said Government Code and said City Ordinance and that said notices shall be
- sent at least five (5) days prior to the time of the hearing of objections.
4. That the list of all property owners to whom notices are
to be sent, as well as the location of the property to be posted, are set
forth in Exhi6it A which is attached hereto and made a part hereof by reference.
5. That the City Council does hereby find and declare that
the weeds on the specified parcels of prooerty are seasonal and recurrent
and shall be abated in the manner provided for in Section 39561.5 of the Govern-
ment Code of the State of California and in accordance with Ordinance 532 of
the City of Lake Elsinore, California.
6. That the City Council of the City of Lake Elsinore does
hereby set the date of ~pr;~ ~K 1999 , at the hour of 7:30 p.m.
in the Council Chambers located in the City Hall of the City of Lake Elsinore,
California, to herein consider all objections to the proposed removal of weeds,
rubbage, refuse and dirt.
7. That thereafter if objections have not been made or the
City Council has disposed of those made, the City Manager is ordered to abate
the nuisance in accordance with said Government Code Section and said Ordinance
of the City of Lake Elsinore, California.
8. The City Manager shall keep an account of the cost of the
abatement in front of or on each separate parcel of Land and shall render a
written report showing such costs and shall cause said notice to be posted
in accordance with law.
9. That the contractor that has been employed by the Gity
Council in accordance with Section 39576.5 of the Government Code and Ord-
inance No. 532 of the City of Lake Elsinore shall.keep the said account, and
shall keep an itemized report for each parcel of land as required by law.

10, That the cost of abatement in front of or on each parcel
of land shall constitute an operational assessment against that parcel.
After the assessment has been made and confirmed there shall be made a lien
upon said parcel of property in accordance with said Government Code and the
Ordinance of the City.

APPROVING THE RIVERSIDE COUNTY SOLID WASTE
MANAGEMENT ENFORCEMENT AGENCY.
WHEREAS the County of Riverside and its incorporated cities are
required by Section 66796 of the Government Code to designate an enforcement
agency to carry out the provisions of the Z'Berg-Kapiloff Solid Waste
Control Act of 1976; and ~
WHEREAS the Riverside County Solid Waste Management Enforcement Agency
possesses the required capabilities in environmental health and solid waste
management to implement the Z'Berg-Kapiloff Solid Waste Control Act of 1976
and the regulations and ordinances that have been and will be adopted
pursuant thereto; and .
WHEREAS the Riverside County Solid Waste Management Enforcement Agency
will have sufficient personnel and an adequate budget to carry out the
enforcement program specified by law; fee schedules may be required in
accordance with the provisions of Section 66796 of the Government Code.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Lake Elsinore approves the Riverside County Solid [Qaste Management
Enforcement Agency as established by the Board of Supervisors on May 3, 1977.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE REQUESTING THE RENAMING OF CERTAIN
STREETS CONNECTING WITH LAKESHORE DRIVE IN THE
CITY OF LAKE ELSINORE.
WHEREAS, that portion of the public way known as Lakeshore Drive in the
City of Lake Elsinore, beginning generally at the eastern end at the intersection
<.of Mission Trail and Railroad Canyon Road and proceeding along the lake, to the
City limits at the west, at Machado Street, is a major traffic artery in the
valley, used by private citizens, goyernment and commercial interests, and
WHEREAS, at the intersection of Lakeshore Drive and the City limits at
Machado Street in the west, that road enters the county jurisdiction and proceeds
northwesterly until it intersects with California Highway 71, and is known for
part of that distance as Rice Road and part of that distance as Robb Road, but
is, in fact, Lakeshore Drive, extended, and
WHEREAS, this important artery, having different names in three separate
places, is confusin9 to newcomers, visitors, tourists and incoming commercial
interests, and generally serves to cause confusion and delay, and
WHEREAS, this condition is deemed to be disadvantageous and deleterious to
the general public good by the Mayor and Council of Lake Elsinore;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City
of Lake Elsinore respectfully request that through the good offices of County
Supervisor Walter Abraham, the Board of County Supervisors authorize the changing
of the name of that portion of this important artery betvaeen the City and Highway 71,
from the current designations of Rice Road and Robb Road to Lakeshore Drive, and
that they further authorize this cfiange be shown on all pfficial Riverside County
signs, maps, documents, etc.

FOR TNE 1977-1978 FISCAL YEAR AND APPROPRIATING

WHEREAS, pursuant to the provisions of Section 37208 of the Government Code
that certain document entitled "Budget Fiscal Year 1977-1978 City of Lake Elsinore"
on file in the office of the City Clerk, is hereby approved as the budget for the
City of Lake Elsinore for the fiscal year 1977-1978 to the extent of the totals
set forth for bond redemption and interest requirements, the totals set forth for
each capital improvement project and the totals set forth for each of the various
other funds; and

and authorize the payment of non-budgeted demands from appropriated funds; and
may appropriate funds for budgeted or non-bud9eted items, and any such appropriation
for a non-budgeted item shall constitute an approval to issue a warrant in payment
of a proper demand or demands therefore,
WHEREAS, Section 51508 of the Government Code requires the Council to fix
the amount of revenue from property taxes necessary to support the City's departments
for the current year,

resolution to be published once within fifteen days after its passage, in;the
Valley Tribune as required by Section 36933 of the Government Code; shall certify

and her certification, together with proof of publication, to be entered in the
Book of Resolutions of this City.
NOW, THEREFORE, BE IT FURTHER RESOLVED THAT this resolution, being a resolution
appropriating funds needed for the usual and current expenses of the City, shall
become effective and in full force immediately upon its passage.

WHEREAS, the City of Lake Elsinore was incorporated April 23, 1888, and
WHEREAS, the City provides municipal services to its property owners
and constituents, and
WHEREAS, these services incur an expense to the end that the appropriation
of such money to cover these expenses is derived from the taxing of properties,
and
WHEREAS, the City desires to continue to improve upon these various municipal
services, and
WHEREAS, grants, subventions and other monies, together with the ad valorem
tax rate provide for the payment of these services,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lake
Elsinore does hereby establish the following tax rate to appropriate sufficient
monies to wit:

WHEREAS, Section 37206 of the Government Code of the State of California
requires the City Council to prescribe the time and method of paying salaries
and wages of officers and employees of the City; and
WHEREAS, the City Council authorized and directed under the provisions
of the Personnel System Rules and Regulations, the preparation of a compensation
olan covering all classes of positions in the competetive service.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CIT.Y OF LAKE ELSINORE EXPP.ESSING 5UPPORT FOR CERTAIN
PROPOSED AMENDMENTS TO AB 4327 OEFERED BY ASSEMBLYMAN
TOM SUITT.
WHEREAS, the Mayor and Council of the City of Lake Elsinore are vitally
concerned with the qeneral condition and continued existance of Lake Elsinore,
and,
WHEREAS, there is in existance a plan to redevelop the lake and provide a
rmore permanent source of water, known by some as "Plan C" and
WHEREAS, Assemblyman Tom Suitt shares our concern that the lake
take place as was generally intended in "Plan C" in a proper and effective
manner, and
WHEREAS, Assemblyman Tom Suitt has proposed certain amendments to AB 4327 no~
being considered by the State Legislature; to wit, $300,000 dollars be taken
from the States Park and Recreation Revolving Account, under Sections 2 and 3
~,of the Bill for purchase of water, and be used instead for purposes set forth in
Section 2 of the Bill, which provides for additional monitoring equipment and
istaff costs to determine the f.easibility of drilling a fourth well, and to use
all of this water purchase money for fourth well purposes.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City
of Lake Elsinore hereby place themselves on record as being in wholehearted and
firm support of these amendment to AB 4327 as proposed by Assemblyman Suitt.

WAY, OTHER THAN SUBUIVISIONS.
Be it resolved by the City Council of the City of Lake Elsinore as
follows:
SECTION 1. Pursuant to the provisions of Ordinance No. of the
City of Lake Elsinore, each application shall be accompanied by a fee of
~7.00, except that no fees shall be required on applications from departments
of the City or CounYy of Riverside or the State of California.
For construction, repair or alteration of sidewalks, curbs, gutters,

HIGHWAY 15.
WHEREAS, the City Council of the City of Lake Elsinore, California,
has repeatedly gone on record during recent years, in support of Interstate
15 through the City of Lake Elsinore, as adopted by the State Highway
Commission; and
WHEREAS, if said Interstate 15 is not constructed and usable along
its adopted route, the City of Lake Elsinore will be subject to an intolerable
traffic burden as a direct result of the incompleted sections; and
WHEREAS, plans for a major international exposition at the Ontario
Raceway have increased the need for a fully constructed Interstate 15; and
WHEREAS, the City of Lake Elsinore supported legislation to increase
revenues (SB 100) to fund today's construction costs on a realistic basis;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake
Elsinore that:
1. The City earnestly reaffirms its repeated support of the route of
Interstate 15 through the City Lake Elsinore as adopted by the State
Highway Commission.
2. As much of the originally planned Interstate 15 as possible be
constructed forthwith, and that the California Highway Commission is
earnestly requested to authorize such immediate construction and, at the
same time to reaffirm the need for the full Interstate 15 as planned.
3. The City Council of the City of Lake Elsinore also wishes to commend
the California Highway Commission and CALTRANS on the thorough and excellent
manner in which they performed their duties in adoption of the present route
for Interstate 15 and progress made in construction of the very much needed
portions already completed.

CALIFORNIA, ESTABLISHING FEES FOR REGULATING AND CONSTRUCTION OF CERTAIN
PUBLIC UTILITIES IN AND UNDER PUBLIC RIGHT OF WAY.
Be is resolved by the City Council of the City of Lake Elsinore
as follows:
SECTION 1. The permit and inspection fees required by this
resolution shall be paid within 30 days after the City has billed the
utility company for the completed work. Billing shall be done on the
monthly basis at the following rates:
(a) For an excavation in a city street or right of way,
with or without an installation of an encroachment,
a permit fee of $5.00 and an inspection fee at the
following rates:
For i to 100 lineal feet of excavation, $20.00;
For 101 to 1000 lineal feet of excavation, $30.00;
For 1001 to 4000 lineal feet of excavation, $50.00;
For 4001 to 7000 lineal feet of excavation, $60.00;
For 7001 to 10,000 lineal feet of excavation, $70.00;
For each additional 10,000 lineal feet, $70.00.
(b) For blanket permits for utility service connections
involving excavations within earth portions of the
right of way, 3' x 4' bellholes within the paved
section, and boring, an annual inspection fee of
$50.00.
Be it further resolved that the City Clerk shall certify to
this passage and adoption thereof.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA DESIGNATING THE CITY MANAGER AS
THE AUTHORIZED REPRESENTATIVE TO EXECUTE CERTAIN
DOCUMENTS IN CONNECTION WITH FARMERS HOME ADMINISTRATION
FOR LOAN AND GRANTS FOR WATER SYSSEM IMPROVEMENTS IN THE
CITY OF LAKE ELSINORE.
WHEREAS, the City of Lake Elsinore intends to submit an application
for a loan and a grant to be used for water system improvements in the
City of Lake Elsinore, and "
WfiEREAS, due to certain deadlines imposed upon the applicants by the
Federal Agency administering this program, and
WHEREAS, time is crucial to the success on the part of the City in
making the application for the loan and the grant,
NOW, THEREFORE, BE IS RESOLVED that the City Council does hereby
designate the City Manager as their authorized representative to sign all
documents connected therewith.

and Coastal Park Bond Acb of 1976, which provides funds to the State of California

public recreation and historical purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility for the administration of the program within the state, setting up
necessary procedures governing application by local agencies under the program; and
WHEREAS,.said proGedures established by the State'Department of Parks and'Rec-
reation require the.applicant to certify by resolution the approval of applications
prior to submission of said applications to the state; and
WHEREAS, said applications contain assurances that•the applicant must comply
with: and
WHEREAS, the applicant agency will enter into an agreement with the State of
California for the acquisition and/or development of the project;

1. Approves the filing of an application for 1976 state grant assistance;

visions contained in the sample state/local agreement; and

WHEREAS, there exists in the City of Lake Elsinore, California,
'on certain streets, sidewalks and on private property weeds and other materials
as defined in Ordinance No. 532 and Section 39561.5 of the Government Code;
WHEREAS, said weeds as defined constitute a nuisance in that
said weeds are a fire hazard;
WHEREAS, the City does designate the City Manager to enforce ;
the provisions of Ordinance No. 532 and the provisions of the Government -
Code of the State of California as hereinabove set:forth;
WHEREAS, the City Manager has submitted a list of properties

~ property weeds which in his opinion constitute a nuisance by virtue of

WHEREAS, there is affixed hereto and made a part hereof by
I reference and marked Exhibit A a list of all properties within the City upon
which said weeds exist and which are referred to by commonly known street
names and which further describe the property upon which or in front of which
~~ tBe nuisance exists by giving its lot and block number according .o the official
li, assessment map of the County of Riverside which'is the public body which does

' the assessment for the City of Lake Elsinore.

' NOW, THEREFORE, be it resolved:
1. That pursuant to the authority granted to the City by
virtue of Sections 39560 to 39588 of the Government Code of the State of Calif-
or•i~is and Ordinance No. 532 of the City of Lake Elsinore, the City Council does

hereby declare that the weeds growing upon or in front of the properties
within the City as described in Exhibit A are hereby declared to be a nuis-
ance and shall be abated.
2. That notices be sent out to the property owners as last
shown upon the assessment rolls in accordance with the said Government Code,
State of California, and of said Ordinance, City of Lake Elsinore, California.
3. That the said Notices shall be in the form set forth in
said Government Code and said Gi-ty Ordinance and that said notices sha11 be, -
sent at least five (5) days prior to the time of the hearing of objections.
4. That the list of all property owners to whom notices are
to be sent, as well as the location of the property to be posted, are set
forth in Exhibit A which is attached hereto and made a part hereof by reference.
5. That the City Council does hereby find and declare that
the weeds on the specified parcels of property are seasonal and~recurrent
and shall:be abated in the manner provided for in Section 39561.,5 of the Govern-
ment Code of the State of California and in accordance with Ord~inance 532 of
the City of Lake Elsinore, California.
6. That the City Council of the City of Lake Elsinore does
hereby set the date of octobPr i,,~ 19 ~~, at the hour ;of 7:30 p.m.
in the Council Chambers located in the City Hall of the City of Lake Elsinore,
California, to herein consider all objections to the proposed removal of weeds,
rubbage, refuse and dirt.
7. That thereafter if objections have not been made or the
City Council has disposed of those made, the City Manager is ordered to abate
the nuisance in accordance with said Government Code Section and said Ordinance
of the City of Lake Elsinore, California.
8. The City Manager shall keep an account of the cost of the
abatement in front of or on each separate parcel of Land and shall render a
written report showing such costs and shall cause said notice to be posted
in accordance with law,
9. That the contractor that has been employed by the City
Council in accordance with Section 39576.5 of the Government Code and Ord--
inance No. 532 of the City of Lake Elsinore shall keep the said' account, and
shall keep an itemized report for each parcel of land as required by law.

10. That the cost of abatement in front of or on each parcel
of land shall constitute an operational assessment against that parcel.
After the assessment has been made and confirmed there shall be made a lien
upon said parcel of property in accordance with said Government Code and the
Ordinance of the City.

4lHEREAS, the City Council of City of Lake Elsinore has passed Ordinance
572, providing for,collection of fees for new construction; and
WHEREAS, this Ordinance does provide for these fees to be established
by resolution as the City Council deems necessary;
THEREFORE, be it resolved that every person, firm or corporation
constructing any new commercial-industrial buitding, dwelling unit or
trailer space in the City of Lake Elsinore shall pay to the City the sums
specified herein:
1. SEWER CAPITAL IMPROVEMENT FUND:
All the properties within the City Limits of the City of Lake
Elsinore and those properties outside the City Limits of the City of Lake
Elsinore which were included in the Sewer Assessment District No. 1 of
the City of Lake Elsinore shall pay into the Sewer Capital Improuement Fund:
(a) $420.00 for each residential unit.
(b) $420.00 for the first twenty plumbing fixture units or a
fraction thereof in an industrial-commercial unit and
proportional to the number of units above 20 fixture units.
Z WATER CAPITAL IMPROVEMENT FUND:
All the properties within the service area of the water system
owned and operated by the City of Lake Elsinore shali pay into the t+later
Capital Improvement Fund:

~b) $500.00 for first twenty plumbing fixture units or fraction
thereof in an industrial-commercial unit and proportional
to the number of units above 20 fixture units.
3. STREET CAPITAL IMPROVEMENT FUND AND MAINTENANCE FUND:
All the properties within the City Limits of the City af Lake Elsinore
shall pay into the Street Capital Improvement and Maintenance Fund:
(a) $0.02 per square foot of lot area for capital improvements
for residential and commercial-industrial.
(b) $0.01 per square foot of lot area for maintenance for
residential and commercial-industrial.
4. PARK CAPITAL ID1PROVEMENT FUND:
All properties within the City Limits of the City of Lake Elsinore
shall pay into the Park Capital Improvement Fund:
(a) $0.10 per square foot of building for standard residential.
(b) $0.01 per square foot of lot for mobile home sites and
industrial-commercial.
5. STORM DRAIN CAPITAL IMPROVEMENT FUND:
AT1 the properties within the City Limits of the City of Lake Elsinare
shall pay into the Storm Drain Capital Improvement Fund:
(a) $0.02 per square foot of lot area for both residential and
industrial-commercial.
6. Plan checking fee shall be 3% of the estimated cost of improvements
with a minimum of $50.00 for residential and industriai-commercial.

leadership in staging these frequent horse shows and riding events for the

OF A CERTAIN ALLEY ARE UN~dECESSARY FOR PRESENT OR PROSPECTIVE
ALLEY PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE hereby ordains and resolves
as follows: .
SECTION ONE: The City Council of the City of Lake Elsinore having elected
to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets
- and Highways Code of the State of California, ahd having held a public hearing
as provided therein, hereby finds from all evidence submitted that portions of a
certain a11ey described in this resolution are unnecessary for present or pros-
pective alley purposes and that the public interest and conveniense require the
closing of said portions of a certain alley.
SECTION TWO: The City Council hereby orders the vacation of portions of
certain alley in Mountain View Subdivision as follows:
All of Lot D and that portion of Lot C lying easterly of the southerly
prolongation of the westerly line of Lot 10 in Mountain View Subdivision,
as shown on map recorded in Book 34 of Maps, Pages 15 and 16 thereof,
records of Riverside County, California.
SECTION THREE: In the proceeding herein adopted by this City Council for
~. the vacation of portions of a certain alley described in Section Two, the City
of Lake Elsinore reserves and excepts from the vacation the permanent easement.
and right at any time, or from time to time, to construct, maintain, operate,
replace, remove and revew in, upon, over and across any alley or part thereof
proposed to be vacated, pursuant to any existing franchises or renewals thereof,
or otherwise, to maintain, operate, replace, remove, renew and enlarge lines of
pipe, conduits, cables, wires, poles and other convenient structures, equipment
and fixtures for the operation of telegraphic and telephone lines, and for the
distribution or transportation of electric energy, including access and right
to keep property free from inflammable materials and wood growth, and to other-
wise prctect the same from all hazards in, upon, and over the portion of the
alley proposed to be vacated.
SECTION FOUR: The City Council hereby determines that the vacation of
portions of the alley described herein is required by public interest, con-
venience, safety and welfare.

WHEREAS, the City of Lake Elsinore employs the Riverside County
Sheriff's Department as it's duly authorized Law Enforcement Agency, and
WFIEREAS, in the routine performance of its law enforcement activities
for the City, the Sheriff's Department is called upon to enforce all the
provisions of Title S, Chapter 5.28, Section 5.28.180 of the Lake
Elsinore.Municipal Code, which pertains to the regulations of cardrooms/
registration of empl.oyees, and
WHEREAS, said section requires routine fingerprinting of certain
employees of cardrooms operating in the City of Lake Elsinore,

BE IT FURTHER RESOLVED, that this resolution shall become effective

` The City Council of Lake Elsinore hereby ordains and resolves
as follows:
WHEREAS, there is in existance a Freeway Agreement between the
City of Lake Elsinore and State of California, and
WHEREAS, said Agreement provides for grade separation between
INTERSTATE Route 15 and Franklin Street, and
WHEREAS, a plan has been presented to the City Council indicating
that said separation wi17 be accomplished by Franklin Street crossing
above the grade of the proposed I-15, and
WHEREAS, said proposal is considered superior to any other
possible solution to the problem;
NOW THEREFORE DE TT RESOLVED by the CiCy Council of Lake Elsinore
to accept and support the development of separation in accordance with
said plan,
BE IT FURTHER RESOLVED THAT the existing Agreement be amended to
incorporate the changes necessary to accomplish the construci;ion
associ,ated with I-15 in accordance with this plan.

LOAN RESOLUTION NO. 77-51
A RESOLUTION DF THE CITY COUNCIL OF TAE CITY OF
LAKE ELSINORE AUTHORIZING AND PROVIDING FOR THE
INCURRENCE OF INDEBTEDNESS FOR THE PURPOSE OF
PROVIDING A PQRTION OF THE COST OF ACQUIRINC,,
CONSTRUCTING, ENLARGING, IL4PROVING, AND/OR
EXTENDINGS ITS WATER FACILITY TO SERVE AN AREA
LAWFULLY WITHIN ITS JURISDICTION TO SERVE.
WAEREAS, it is necessary for the City of. Lake Elsinore
(hereinafter called "association") to raise a portion of the
cost of such undertaking by entering into a loan contract in
the princiAal amount not to exceed $356,800 pursuant to the
provisions o£ the Emergency Drouqht Relief Program; and
[4HERFAS, the association intends to obtain assistance from
the Farmers Home Administration, United States Department of
~ Agriculture (herein called the "Government") acting under the
provi.sions of the Consolidated Farm and Rural Development Act
(7 U.S.C. 1921 et seq.) in the planning, financing, and super-
vision o£ such undertaking to to enter into a loan contract with
the Government;
NOW, THEREFORE, in consideration of the premises the
association hereby resolves:
SECTION l. To have prepared on its behalf and to adopt
a resolution for approving a loan contract (herein called the
"Resolution") and containing such items and in such forms as are
required by State statutes and as are agreeable and acceptable
to the Government.
SECTION 2. To refinance the unpaid balance, in whole or
in part of the loan contract upon the request of the Government
if at any time it shall appear to the Government that the

association is able to refinance the loan contract by obtain-
ing a loan for such purposes from responsible cooperative or
private sources at reasonable rates and terms for loans for simi-
lar purposes and periods of time as required by Section 333(c)
of said Consolidated Farm and Rural Development Act (7 U.S.C.
1983(c)).
SECTION 3. To provide for, execute, and comply with Form
FmHA 400-4, "Nondiscrimination Agreement"; and Form FmHA 400-1,
"Equal Opportunity Agreement", including an "Equal Opportunity
Clause", which clause is to be incorporated in, or attached as
a rider to, each construction contract and subcontract involv-
ing in excess of $10,000.
SECTION 4. To indemnify the Government for any payments
made or losses suffered by the Government on behal£ of the associa-
tion. Such indemnification shall be payable from the same source
of funds pledged to pay the loan contract or any other legally
permissable source.
SECTION 5. That upon default in the payments o£ any prin-
cipal and accrued interest on the loan contract or in the
performance of any covenant or agreement contained herein or in
the instruments incident to making or insuring the loan, the
Government, at its option may (a) declare the entire principal
amount then outstanding and accrued interest immediately due and
payable, (b) for the account of the association (payable from
the source of funds pledged to pay the loan contract or any other
legally permissable source) incur and pay reasonable expenses
for repair, maintenance, and operation of the facility and such
other reasonable expenses as may be necessary to cure the cause
of default, and/or (c) take possession ofthe facility, repair,

maintain, and operate or rent it. Default under the provisions
of this Resolution or any instrument incident to the making or
insuring of the loan may be construed by the Government to
constitute default under any other instrument held by the Govern-
ment and executed or assumed by the association, and de£auTt
under any such instrument may be construed by the Government to
constitute default hereunder.
SECTION 6. Not to sell, transfer, lease, or otherwise
encumber the facility or any portion thereof, or interest therein,
not permit others to do so, without the prior written consent of
the Government.
: SFCTION 7. Not to borrow any money from any source, enter
into any contract or aqreement, or incur any other liabilities
in connection with making enlargements, improvements or extensions
to, or for any other purpose in connection with the facility
(exclusive of normal maintenance) without the prior written consent
of the Government if such undertaking would involve the source
of £unds pledged to pay the loan contract.
SECTION 8. To place the proceeds of the loan contract
on deposit in an account, in a bank, and in a manner approved
by the Government.
SECTION 9. To comply with all applicable State and.
Federal laws and regulations and to continually operate and
maintain the facility in good condition.
SECTION 10. To provide for the receipt of adequate revenues
to meet the requirements of debt service, operation and mainten-
ance, and the establishment of. adequate reserves
or use of the facility will be permitted.

SECTION 11. To acquire and maintain such insurance coverage
including fidelity bonds as may be required by the Government.
SECTION 12. To establish and maintain such books and records
relating to the operation of the facility and its financial
affairs and to provide for required audit thereof in such a manner
as may be required by the Government, to provide the Government
without its request, a copy of each such audit, and to make and
forward to the Government such additional information and reports
as it may from time to time require.
S~CTION 13. To provide the Government at all reasonable
times access to all books and records relating to the facility
and access to the property of the system so that the Government
may ascertain that the association is complying with the provisions
hereof and of the instruments incident to the making or insuring
of the loan.
SECTION 14. To serve any applicant with the service area
who desires service and can be feasibly and legally served, and
to obtain the concurrence of the Farmers Home Administration
prior to re£using service to such applicant. Upon the failure
to provide such service which is feasible and legal such appli-
cant shall have a.direct right of action against the association
under this agreement.
The provisions hereof and the provisions of all instruments
incident to the making or the insuring of the loan, unless other-
wise specifically provided by the terms o£ such instruments, shall
be binding upon the association as long as the bonds are held or
insured by the Government. The provisions of Sections 6 throuqh
13 hereof may be provided for in more speci£ic detail in the
Resolution; to the extent that the provisions contained in such

Resolution should be found to be inconsistent with the provisions i
hereof, these provisions shall be construed as controlling as I
between the association and the Government.

SETTING FORTH THE TERMS AND CONDITIONS
OF THE LOAN.
WHEREAS, the United States Department of Agriculture,
Farmers Home Administration (herein "Government") has sub-
mitted to the City Council of the City of Elsinore (herein
the "City") an offer to make a loan of up to $356,800 in
order to aid in financing the acquisition, construction and
completion of water system improvements for the City; and
WHEREAS, the City Council of the City desires to accept
said Offer and to enter into a loan pursuant to the terms
and conditions set forth in the Loan Agreement; and
WHEREAS, the District is authorized pursuant to Section
359 of the Water Code of the State of California to enter
into such a loan upon an affirmative vote of four fifths (4/Sths)
of the City Council of the City;
NOW, THEREFORE, City Council of the City of Lake Elsinore
does hereby determine, order and resolve as follows:
SECTION 1. The Offer of the United States Department of
Agriculture, Farmers Home Administration, Community Facilities
Loan Program, Emergency Drought Relief Program dated
1977, offerinq to loan the City of Elsinore up to $356,800 pur-
suant to the terms and conditions set forth in the Loan Agree-
ment of which the Offer is a part is hereby accepted.

SECTION 2. The Offer attached hereto together with the
General Conditions, being Exhibit "A" thereof, the Special
Conditions, being Exhibit "B" thereof, the Contract Specifica-
tions attached thereto as Exhibit "C" and the Loan Resolution,
Resolution No. ~~_5~ of the City Council of the City
adopted on November 28, 1977, shall constitute the Loan Agree-
ment. The City hereby approves the Loan Agreement and adopts
all terms and conditions set forth in the Loan Agreement as the
terms and conditions for the issuance of the Emergency Drought
Relief Repayment Contract set forth in Exhibit "C" of the
Offer.

THE CITY OF LARE ELSINORE RELATING TO THE CONDUCT OF
A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY
ON MARCH 7, 1978.
, . WHEREAS, a General Municipal Election is to be held in the City of
Lake Elsinore on March 7, 1978; and
WHEREAS, in the course of conduct of said election and in relation
thereto it will be necessary to mail sample ballots and polling place inserts
to the registered voters of the City, and it will facilitate such mailing if
the County Clerk of the County of Riverside will prepare and furnish the City
the imprinting of the names and addresses of the registered voters of said
City on I.B.M. polling place inserts furnished by the County, and after
bursting the forms will insert the polling place insert and samply ballot
into envelopes, all to be furnished by the City; will place all envelopes in
zip-coded mail bags, advise City Clerk of the number of pieces to be mailed,
prepare POD Form 3602, "Statement of Mailing Matter With Permit Imprints",
and advise the City Clerk when work is complete so delivery can be arranged;
and
WHEREAS, all necessary expense in performing this service shall be paid
by the City of Lake Elsinore;
NOW, THEREFORE, the City Council of the City of Lake Elsinore does hereby
RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1_ That pursuant to the provisions of Section 22003 of the Elections
Code of the State of California, this City Council hereby requests the Board
of Supervisors of said County to permit the County Clerk to prepare and furnish
to said City, for use in conducting said election to be held on March 7, 1978,
the imprinting of the names and addresses of the registered voters of said
City on I.B,M. polling place inserts furnished by the County, and after bursting
the forms to insert the polling place insert and sample ballots into envelopes,
all to be furnished by the City, will place all envelopes in zip-coded mail
bags, advise City Clerk of the number of pieces to be mailed, prepare POD Eorm

SECTION 2. That said City shall reimburse said County for services~

to said Board of Supervisors and to said County Clerk, each a certified copy
of this resolution.

RESOLUTION NO. 77-56
WHEREAS, a General Municipal Election is to be held in the City of Lake
Elsinore, California, on Tuesday, the 7th day of March, 1978, and
WHEREAS, it is the desire of the City Council of the City of Lake Elsinore
to utilize the services of the Riverside.County Election Department with the
services of their vote counting machines,
NOW, THEREFORE BE IT RESOLVED, that the City Council Chambers, 130 South
Main Street, Lake Elsinore, California, are hereby designated as the Central
Counting Center for the General Municipal Election to be held March 7, 1978.
BE IT FURTHER RESOLVED that the Riverside County Election Department is
hereby requested to furnish the necessary vote counting machines and personnel
for said counting, which expense will be paid by the City of Lake Elsinore.

the proceedings of the City Council of said City, in the minutes of the meeting at
which the same is passed and adopted.
