Recommendation
1. Find that the proposed project is exempt from the California Environmental Quality Act
(CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) (“Common Sense Exemption”);
and
2. Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. 39310, TO SUBDIVIDE 81.38
ACRES INTO TWO PARCELS THAT ARE 35.64 ACRES AND 45.74 ACRES IN SIZE FOR
FINANCING PURPOSES WITHIN THE CANYON HILLS ESTATES SPECIFIC PLAN
LOCATED AT APN 365-230-001.
Planning Commission Action
On December 2, 2025, the Planning Commission (Commission) held a duly noticed public hearing
and recommended approval of Tentative Parcel Map (TPM) No. 39310 which included
modifications to Condition of Approval Nos. 22 and 23.
In attendance at the meeting were the applicants who addressed the Commission and two
residents from the City of Wildomar who provided oral testimony raising concerns with the
environmental impact of the parcel map.

The Commission recommended approval of the project with a 3-0 vote (Commissioner Devor
absent).
Project Location
The proposed project is located on an approximately 81-acre parcel within Canyon Hills Estates
Specific Plan (CHESP). More specifically, the parcel is south of Sugarbush Lane and east of
Cottonwood Canyon Road and includes Assessor Parcel Number (APN) 365-230-001. The
project area is currently vacant and undisturbed open space with brush and trees across the
landscape.
Background
On January 23, 2007, the City Council approved the CHESP which included Final Environmental
Impact Report (FEIR) No. 2006-04 (SCH No. 2006051073), General Plan Amendment (GPA) No.
2006-04, Specific Plan (SP) No. 2006-01, and Tentative Tract Map (TTM) No. 34249 for the
subdivision of approximately 246.41 acres into 302 single-family residential lots, 12 open space
lots, one public park, and two tank sites.
More recently, on February 20, 2024, Revision No. 1 to TTM No. 34249 was approved to
subdivide the 81.32-acre portion of the 246.41-acres into 133 single-family residential lots, three
open space lots, two water quality/detention basins, and one 5.82-acre park.
The subject parcel is located west of the recently approved map revision for TTM No. 34249 within
the CHESP (refer to the CHESP Land Use Plan in Attachment 5).
Project Description
Tentative Parcel Map No. 39310 consists of an existing 81.38-acre parcel located within the
CHESP. Tri Pointe proposes to subdivide the parcel into two parcels with Parcel 1 proposed to
be 35.64-acres and Parcel 2 proposed to be 45.74-acres.
The subdivision would create an additional parcel without altering existing entitlements, land use
designations, or environmental conclusions previously adopted under FEIR No. 2006‑04 (SCH
No. 2006051073). The subdivision does not introduce new residential components nor modify the
topography, hydrology, or access conditions of the property. TPM No. 39310 is intended to reduce
annexation costs into the Elsinore Valley Municipal Water District (EVMWD) and streamline
processing through the Riverside Local Agency Formation Commission (LAFCO), while
preserving long‑term planning objectives of the Specific Plan.
No construction or physical improvements are proposed with the request as the subdivision is
strictly for financing purposes. Any future development would require a separate application and
review process and would be subject to its own public hearing(s) at Planning Commission and/or
City Council.

Discussion
The analysis below provides a discussion of the proposed project’s consistency with the CHESP
and General Plan. In addition, the Design Review Committee, including staff from Planning,
Building and Safety, Fire, and Engineering Departments and the Elsinore Valley Municipal Water
District, has reviewed the project and have included recommended conditions of approval to
ensure compliance with adopted plans, policies, and regulations.
Specific Plan and General Plan Consistency
The project is located within the CHESP’s Single Family-1 (SF-1) and Open Space (OS) land use
designations. The SF-1 designation is intended for single family detached residential development
at a density between two and four dwelling units per acre. However, as previously mentioned in
the above section of this staff report, TPM No. 39310 is for financing purposes only and no
development of any type is being proposed with it.
The proposed subdivision complies with the minimum lot area and street frontage requirements
outlined in the CHESP. Legal access to both parcels is provided via public improvements currently
under construction through the previously approved Tract No. 34249, satisfying the access
standards set forth in Lake Elsinore Municipal Code Sections 16.12.030 and 16.12.040. These
provisions require vehicular access to all lots and connection to a publicly maintained road.
Although no residential development is proposed currently, the parcel configuration ensures
adequate frontage and access. Additionally, the proposed TPM No. 39310 conforms to the
requirements of LEMC Chapter 16.24 and the Subdivision Map Act. As such, the proposed
subdivision is consistent with the CHESP, which was found to align with the General Plan at the
time of its adoption. Accordingly, the project is also consistent with the General Plan.
Environmental Determination
Pursuant to CEQA Guidelines Section 15061(b)(3), the project is exempt under the “Common
Sense Exemption.” The land division is for financing purposes only and does not propose any
development or construction. Therefore, it can be seen with certainty that there is no possibility
that the land division may have a significant effect on the environment and is not subject to CEQA.
MSHCP Consistency
The Project is consistent with the Western Riverside County Multiple Species Habitat
Conservation Plan (MSHCP). The proposed project site is not located in a Criteria Cell and was
not required to be processed through the Lake Elsinore Acquisition Process (LEAP) and Joint
Project Review (JPR) processes. The project complies with all other applicable requirements of
the MSHCP.
Public Notice
Notice of the public hearing for this application has been published in the Press-Enterprise
newspaper and mailed to property owners within a 600-foot radius of the subject property. As of

the writing of this report, no written comments concerning these applications have been received
by staff.
Fiscal Impact
The time and cost related to processing this application have been covered by fees paid for by
the applicant. No General Fund budgets have been allocated or used in the processing of this
application.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. 39310, FOR THE
SUBDIVISION OF 81.38 ACRES INTO TWO PARCELS THAT ARE 35.64 ACRES
AND 45.74 ACRES IN SIZE FOR FINANCING PURPOSES WITHIN THE CANYON
HILLS ESTATES SPECIFIC PLAN LOCATED AT APN 365-230-001
Whereas, Tri Pointe Homes has filed an application with the City of Lake Elsinore (City)
requesting approval of Planning Application No. 2025-11 (Tentative Parcel Map No. 39310) to
subdivide an existing 81.38-acre parcel into two parcels (35.64 acres and 45.74 acres) for
financing purposes. The site is located south of Sugarbush Lane and east of Cottonwood Canyon
Road within the Canyon Hills Estates Specific Plan (APN: 365-230-001);
Whereas, Section 6.0 of the Multiple Species Habitat Conservation Plan (MSHCP)
requires that all discretionary projects within a MSHCP Criteria Cell undergo the Lake Elsinore
Acquisition Process (LEAP) and the Joint Project Review (JPR) to analyze the scope of the
proposed development and establish a building envelope that is consistent with the MSHCP
criteria;
Whereas, Section 6.0 of the MSHCP further requires that the City adopt consistency
findings demonstrating that the proposed discretionary entitlement complies with the MSHCP
Criteria Cell, and the MSHCP goals and objectives;
Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative
Map) the Planning Commission (Commission) has been delegated with the responsibility of
making recommendations to the City Council (Council) pertaining to the tentative map review;
Whereas, on December 2, 2025, at a duly noticed Public Hearing, the Commission has
considered evidence presented by the Community Development Department and other interested
parties with respect to this item, and adopted a resolution recommending that the Council Approve
TPM No. 39310; and
Whereas, on January 27, 2026, at a duly noticed Public Hearing, the City Council
(Council) has cons considered evidence presented by the Community Development Department
and other interested parties with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1: The Council has considered the project and has found it acceptable.
Section 2: That in accordance with the MSHCP, the Council makes the following findings
for MSHCP consistency:
1. The project is not subject to the City’s LEAP and the Western Riverside County Regional
Conservation Authority’s (RCA) JPR processes as it is not located within a Criteria Cell.
2. The project site is vacant and undeveloped. The project is proposing a subdivision for
financing purposes only and no development or construction is involved. As such, the

Riparian/Riverine Areas and Vernal Pool Guidelines as set forth in Section 6.1.2 of the
MSHCP are not applicable.
3. The project is consistent with the Protection of Narrow Endemic Plant Species Guidelines as
set forth in MSHCP Section 6.1.3 and the Additional Survey Needs and Procedures as set
forth in MSHCP Section 6.3.2 because the project is not located within any Narrow Endemic
Plant Species Survey Areas or Critical Species Survey Areas.
4. The project is consistent with the Fuels Management Guidelines because the project site is
not within or adjacent to any MSHCP Criteria Cell or conservation areas.
5. The project is exempt from MSHCP local development mitigation fees pursuant to LEMC
Section 16.85.090.B because the project does involve any development or construction as
the project is strictly a subdivision for financing purposes.
Section 3: The Council finds and determines that the project is exempt from the California
Environmental Quality Act (Cal. Pub. Res. Code §§21000 et seq.: “CEQA”) and the CEQA
Guidelines (14 C.C.R. §§ 15000 et seq.) pursuant to CEQA Guidelines Section 15061(b)(3)
(“Common Sense Exemption”). The land division is for financing purposes only and does not
propose any development or construction. Therefore, it can be seen with certainty that there is no
possibility that the land division may have a significant effect on the environment and is not subject
to CEQA.
Section 4: That in accordance with State Planning and Zoning Law and the LEMC, the
Council makes the following findings to approve TPM No. 39310:
1. The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the
objectives, policies, general land uses and programs specified in the General Plan
(Government Code Section 66473.5).
The project is located within the Canyon Hills Estates Specific Plan (CHESP). The proposed
project is compatible with the objectives, policies, general land uses and programs as
identified in the CHESP. The CHESP was subject to a consistency finding with the General
Plan prior to adoption. The proposed project complies with the minimum standards of the
Single Family-1 (SF-1) and Open Space (OS) land use designations for minimum lot size
and street frontage requirements. The proposed project is consistent with the provisions of
the CHESP and is therefore found to be consistent with the General Plan.
2. The site of the proposed subdivision of land is physically suitable for the proposed density
of development in accordance with the General Plan.
The project is strictly a subdivision for financing purposes and does not involve any
development or construction. Any future development would require a separate application
and review process and would be subject to its own public hearing(s) at Planning
Commission and/or City Council.
3. The effects that this project are likely to have upon the housing needs of the region, the
public service requirements of its residents and the available fiscal and environmental
resources have been considered and balanced.

subdivision does not introduce new residential components nor modify the topography,
hydrology, or access conditions of the property. Furthermore, the project does not involve
any development or new construction.
4. The proposed division of land or type of improvements is not likely to result in any significant
environmental impacts.
The project is exempt from the California Environmental Quality Act (Cal. Pub. Res. Code
§§21000 et seq.: “CEQA”) and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.) pursuant

5. The design of the proposed division of land or type of improvements is not likely to cause
serious public health problems.
TPM No. 39310 has been designed in a manner consistent with the General Plan and the
CHESP and does not divide previously established communities. In addition, the project
does not involve any type of improvement(s) since it is strictly a TPM for financing purposes.
6. The design of the proposed division of land or type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of property within the
proposed division of land.
The project has been reviewed by all applicable City departments, including the Engineering
Department and outside agencies, and it has been determined that TPM No. 39310 will not
conflict with easements for access or use of the property. Legal access to both parcels will
be provided via public improvements currently under construction through the previously
approved Tract No. 34249, satisfying the access standards set forth in Lake Elsinore
Municipal Code Sections 16.12.030 and 16.12.040.
Section 5: Based upon the evidence presented, both written and testimonial, and the above
findings, and the conditions of approval imposed upon the project, the Council hereby finds the
project is consistent with the MSHCP and approves TPM No. 39310.
Section 6: This Resolution shall take effect immediately upon its adoption.

GENERAL CONDITIONS
1. Planning Application No. 2025-11 (Tentative Parcel Map No. 39310) proposes to subdivide

purposes. The site is located south of Sugarbush Lane and east of Cottonwood Canyon

2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, Agents, and its Consultants
(Indemnitees) from any claim, action, or proceeding against the Indemnitees to attack, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning approval, implementation and construction of TPM 39310, which
action is bought within the time period provided for in California Government Code Sections
65009 and/or 66499.37, and Public Resources Code Section 21167, including the approval,
extension or modification of TPM 39310 or any of the proceedings, acts or determinations
taken, done, or made prior to the decision, or to determine the reasonableness, legality or
validity of any condition attached thereto. The Applicant's indemnification is intended to
include, but not be limited to, damages, fees and/or costs awarded against or incurred by
Indemnitees and costs of suit, claim or litigation, including without limitation attorneys' fees,
penalties and other costs, liabilities and expenses incurred by Indemnitees in connection
with such proceeding. The City will promptly notify the applicant of any such claim, action,
or proceeding against the City. If the project is challenged in court, the City and the applicant
shall enter into formal defense and indemnity agreement, consistent with this condition

"Acknowledgment of Conditions" and shall return the executed original to the Community

PLANNING DIVISION
4. Tentative Parcel Map No. 39310 shall comply with the State of California Subdivision Map
Act, the Canyon Hills Estates Specific Plan, and applicable requirements set forth in the
Lake Elsinore Municipal Code (LEMC), unless modified by approved Conditions of Approval.
5. Each sheet of the subdivision map shall clearly provide the following: “For Finance and
Conveyance Purposes Only. A Future Subdivision Map or Land Use Entitlement or Permit
is Necessary to Develop this Property. This Map Does Not Remove any Conditions of
Approval For Separate Land Use Entitlements or Tentative Maps or Use Permits Approved
for this Land.”
6. Future development shall comply with the provisions and requirements contained in the
Canyon Hills Estates Specific Plan.

7. All future development proposals shall be reviewed by the City on a project-by-project basis.
If determined necessary by the Community Development Director or designee, additional
environmental analysis may be required.
8. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms,
to be implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to revoke
or modify all approvals herein granted, deny or further condition issuance of all future
building permits, deny revoke, or further condition all certificates of occupancy issued under
the authority of approvals herein granted; record a notice of violation on the property title;
institute and prosecute litigation to compel their compliance with said conditions or seek
damages for their violation.
Prior to Recordation of Final Parcel Map
9. A precise survey with closures for boundaries and all lots shall be provided per the LEMC.
10. Street names within the subdivision shall be approved by the Community Development
Director or Designee.
11. The applicant shall meet all requirements of Elsinore Valley Municipal Water District
(EVMWD).
BUILDING DIVISION
General Conditions
12. Compliance with Code. All design components shall comply with applicable provisions of
the 2022 edition of the California Building, Plumbing and Mechanical Codes: 2022 California
Electrical Code; California Administrative Code, 2022 California Energy Codes, 2022
California Green Building Standards, California Title 24 Disabled Access Regulations, and
Lake Elsinore Municipal Code.
ENGINEERING DEPARTMENT
General
13. This two (2) parcel tentative map is for financing and conveyance purposes only. A
subsequent tract map or parcel map shall be required to further subdivide these properties.
Specific conditions of approval related to traffic circulation, grading, drainage, right-of-way
dedications, mitigation fees, conservation easements and other related engineering
requirements and/or mitigations shall be required when the property is subdivided or at time
of development.
14. Each parcel shall have legal access to public right-of-way.
15. The processing of this map shall conform to the requirements of the Subdivision Map Act.
16. Monumentation shall be in accordance with Lake Elsinore Municipal Code Section 16.32
and Subdivision Map Act.

17. The developer shall be responsible for acquiring any necessary rights-of-way in which the
developer or the City has no legal title or interest.
18. Applicant shall submit for plan check review and approval for the Final Map for financing
and conveyance purposes. All new submittals for plan check shall be made using the City’s
online Citizen Service Portal (CSSP).
19. Applicant shall pay all applicable application and Engineering assessed fees, including
without limitation plan check and monumentation inspection fees, at the prevalent rate at
time of payment in full.
20. Security and inspection fee for monumentation shall be paid and two contiguous monuments
shall be inspected prior to scheduling City Council approval of final map.
CITY OF LAKE ELSINORE FIRE MARSHAL
21. The applicant/operator shall comply with all requirements of the Riverside County Fire
Department Lake Elsinore Office of the Fire Marshal. Questions should be directed to the

DEPARTMENT OF ADMINISTRATIVE SERVICES
Annex into CFD 2015-1 (Safety) Law Enforcement, Fire and Paramedic Services CFD
22.For any future implementing project such as but not limited to, tentative tract maps and
design reviews, the applicant shall submit an application to the Department of Administrative
Services to initiate the annexation process into Community Facilities District No. 2015-1
(Safety) the Law Enforcement, Fire and Paramedic Services Mello-Roos Community
Facilities District to offset the annual negative fiscal impacts of the project on public safety
operations and maintenance issues in the City. Alternatively, the applicant may propose
alternative financing mechanisms to fund the annual negative fiscal impacts of the project
with respect to Public Safety services. Applicant shall make a non-refundable deposit of
$15,000, or at the current rate in place at the time of annexation toward the cost of
annexation, formation or other mitigation process, as applicable. (Revised per 12/2/2025

Annex into the City of Lake Elsinore Community Facilities District No. 2015-2 (Maintenance
Services)
23.For any future implementing project such as but not limited to, tentative tract maps and
design reviews, the applicant shall submit an application to the Department of Administrative
Services to initiate the annexation process into the Community Facilities District No. 2015-
2 (Maintenance Services) or current Community Facilities District in place at the time of
annexation to fund the on-going operation and maintenance of the public right-of-way
landscaped areas and neighborhood parks to be maintained by the City and for street lights
in the public right-of-way for which the City will pay for electricity and a maintenance fee to
Southern California Edison, including parkways, street maintenance, open space and public
storm drains constructed within the development and federal NPDES requirements to offset
the annual negative fiscal impacts of the project. Alternatively, the applicant may propose

NOTICE IS HEREBY GIVEN that the City Council of the City of Lake Elsinore, California, will hold
a Public Hearing on January 27, 2026, at the Lake Elsinore Cultural Center, 183 North Main

NOTICE IS HEREBY GIVEN that the City Council of the City of Lake Elsinore,
California, will hold a Public Hearing on January 27, 2026, at the Lake Elsinore
Cultural Center, 183 North Main Street, Lake Elsinore, California, 92530, at 7:00 p.m.,
or as soon thereafter as the matter may be heard, to consider the following: Planning
Application No. 2025-11 (TPM No. 39310): The proposed project is a request
submitted by Brian Ortwein of Tri-Pointe Homes for approval of a Tentative Parcel
Map (TPM No. 39310) to subdivide an existing 81.38-acre parcel into two parcels,
creating one 35.64-acre lot and one 45.74-acre lot for finance purposes only . TPM
No. 39310 does not involve any development or new construction. The project site is
within the Canyon Hills Estate Specific Plan and is generally located south of
Sugarbush Lane and east of Cottonwood Canyon Road and more specifically
identified by Assessor’s Parcel Number 365-230-001. Pursuant to the California
