HomeMy WebLinkAboutCC Reso No 1970 CC Resos 1304-1351RESOLUTION NO. 1304 WHEREAS, The United States General Services Administration did declare as surplus that Federal property and building known as the San Francisco Mint, located at the corner of Fifth and Mission Streets in San Francisco, California, and: WHEREAS, The United States General Services Administration on June 16, 1969 did transfer and make available to the United States Department of Health, Education and Welfare the aforementioned property and building for the purpose of deeding it to any public and /or nonprofit private agency to be used and utilized for health or education purposes, and: WHEREAS, The only qualifing application on file before the United States Department of Health, Education and Welfare for the use of the property and building is the San Francisco State College, whose announced purposes is to demolish the building and to erect a downtown campus, and: WHEREAS, The Smithsonian Institute qualifies for the use and utilization of the property and building as set forth by The United States Department of Health, Education and Welfare, but cannot under Congressional rules ask for or solicit any property of items, but may accept them as gifts for the people of the United States, and: WHEREAS, Certain Federal, State and Local Departments, as well as national and state private organizations have petitioned and asked that the United States Department of Health, Education and Welfare deed the property and building to the Smithsonian Institute as a Western Division of that Institute, so that as a historical edifice it will be preserved and that the many rooms of the mint building will be used for educational, cultural and display purposes, and now therefore: BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA calls upon Secretary Robert H. Finch of the United States Department of Health, Education and Welfare to consider transfering the San Francisco Mint building and property to the Smithsonian Institute for the purpose of establishing and maintaining it as a Western Division of the Institute so that a greater number of citizens may acquire the knowledge and scientific services offered by the Smithsonian Institute. City Clerk of the City of Elsinore RESOLUTION NO. 1305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF RIVERSIDE TO PERMIT THE COUNTY CLERK OF SAID COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF ELSINORE, RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 14, 1970• WHEREAS, a General Municipal Election is to be held in the City of Elsinore on April 14, 1970; and WHEREAS, in the course of conduct of said election and in relation thereto it will be necessary to mail sample ballots and polling place inserts to the registered voters of the City, and it will facilitate such mailing if the County Clerk of the County of Riverside will prepare and furnish the City the imprinting of the names and addresses of the registered voters of said City on I.B.M. polling place inserts furnished by the County, and after bursting the forms will insert the polling place insert and sample ballot into envelopes, all to be furnished by the City; will place all envelopes in zip -coded mail bags, advise City Clerk of the number of pieces to be mailed, prepare POD Form 3602, "Statement of Mailing Matter With Permit Imprints ", and advise the City Clerk when work is complete so delivery can be arranged; and WHEREAS, all necessary expense in performing this service shall be paid by the City of Elsinore; NOW, THEREFORE, the City Council of the City of Elsinore does hereby RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. That pursuant to the provisions of Section 22003 of the Elections Code of the State of California, this City Council hereby requests the Board of Supervisors of said County to permit the County Clerk to prepare and furnish to said City for use in conducting said election to be held on April 14, 1970, the imprinting of the names and addresses of the registered voters of said City on I.B.M. polling place inserts furnished by the County, and after bursting the forms to insert the polling place insert and sample ballots into envelopes, all to be furnished by the City, will place all envelopes in zip -coded mail bags, advise City Clerk of the number of pieces to be mailed, prepare POD Form 3602, "Statement of Mailing Matter With Permit Imprints ", and advise the City Clerk when work is complete so delivery can be arranged. City Clerk of the City of Elsinore RESOLUTION NO. 1306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 14TH DAY OF APRIL, 1970, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PRO- VISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. WHEREAS, under the provisions of the laws relating to General Law Cities in the State of California, a regular general municipal election ;shall be held on the 14th day of April, 1970, for the election of two (2) members of the City Council of said City for the full term of four years; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Clerk of said City is hereby authorized, instructed and directed to procure and furnish any ailitl all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary to order to properly and lawfully conduct said election. SECTION 4. That for the purpose of holding said regular general municipal election, there shall be and are hereby established three (3) voting precincts consisting of consolidations of the regular election precincts in the City of Elsinore established for the holding of state and county elections, as said regular election precincts exist on the date of adoption of this resolution. That the polling places for the respective precincts shall be the places hereinafter designated; and that the persons hereinafter named, being competent and qualified electors and residents of said City and of their respective voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. That the compensation of the persons hereinbefore named as election officers is hereby fixed at the sum of Twenty Dollars for each Inspector and Eighteen Dollars for each Judge and Clerk for said election. The rental for each of such polling places, where a charge is made, shall be the sum of Ten Dollars for said election. When required, the compensation of the Custodian of a building shall be Ten Dollars for said election. -2- 9 SECTION 6. That the polls for said election shall be open at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. SECTION g. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 8. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time,form and manner as required by law. SECTION 9. PASSED, APPROVED AND ADOPTED this 26th day, of Ja�nuaryyl,f 1970. yor of the City of Eisi e, California %r ATTEST: City Clerk of the City of Elsinore, California -3- RESOLUTION NO. 1307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF RIVERSIDE COUNTY TO ADOPT A REDUCTION FORMULA PHASING THE COUNTY OUT OF SHARING IN THE CITY'S SALES AND USE TAX AND CIGARETTE TAX REVENUES. WHEREAS; the cities in certain counties in the state have agreed pursuant to the Bradley -Burns Uniform Local Sales and Use Tax Law to share a percentage of their local sales and use tax with their respective county, while cities in other counties do not share their local sales and use tax with their respective county; and WHEREAS, the cities that share their local sales and use tax with their county receive a lesser percentage of their sales tax than they would other- wise receive and their county a proportionately greater percentage; and WHEREAS, the State Board of Equalization advises that there is a definite trend for counties in the state to phase out the agreement to share in cities sales and use tax; and WHEREAS, the City of Elsinore believes that conditions have significantly changed since it entered into the sharing agreement with the County on May 27, 1957; and WHEREAS, existing inequities have been recognized by other counties in the state and they have agreed to phase out, over a certain period of time, of sharing in the cities' sales and use tax. NOW, THEREFORE, BE IT RESOLVED by the City of Elsinore that the Board of Supervisors of Riverside County be requested to adopt a policy similar to other I counties in the state to phase out of sharing in the cities' sales and use tax over the next five year period to correct existing inequities by reducing the amount of sales and use tax it receives from the cities in Riverside County by twenty per cent per year beginning with July 1, 1970 and concluding June 30, 1975, when the cities of Riverside County will receive 100 per cent of their share of sales and use taxes. WHEREAS, under the provisions of the laws relating to general law cities in the State of California, Resolution No. 1306 was duly adopted on the 26th day of January, 1970, calling for a regular general municipal election to be held on the 14th day of April, 1970, for the election of two members of the City Council of said City for the full term of four years; WHEREAS, since the adoption of said Resolution No. 1306 the City of Elsinore, California, has received an initiative petition submitting an ordinance to said City whether or not the City Administrator and /or City Manager form of government should be retained or whether certain ordinances establishing said form of government should be repealed; WHEREAS, the City Clerk of the City of Elsinore, California, has certified and determined that the said initiative petition contains a sufficient number of qualified electors and that said proposition should be presented to the electorate of said City, and thereafter on the 9th day of February, 1970, the City Council of said City did order that the initiative measure 1. relating to the City Manager and /or City Administrator form of government be placed upon the ballot at the election to be held on the 14th day of April, 1970; WHEREAS, certain negotiations have taken place in reference to the possibility of the City of Elsinore taking over Lake Elsinore, its property and appurtenances, from the State of California, and the City desires to have an advisory measure placed upon the ballot for the purpose of ascertaining the feeling of the electorate as to the possible acquisition of said Lake Elsinore, its property and appurtenances; WHEREAS, pursuant to Sections 36508 and 36509 of the Government Code of the State of California provides for the sub- mission of a question as to whether or not the City Treasurer may be appointed, and the City Council did on the 9th day of February, 1970, direct that this question be presented to the electorate; WHEREAS, it is the desire and direction of the City Council that the following questions, propositions and measures be consolidated with the election of the two members of the City Council at the general municipal election to be held on the 14th day of April, 1970; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE AND ORDER AS FOLLOWS: Section 1: That said City Council pursuant to the laws of the State of California and in particular the Election Code of said State does hereby order to be submitted to the 2. qualified electors of said City at said general municipal election to be held on the 14th day of April, 1970, the follow- ing questions, propositions and measures, to wit: . Mayor of the City of Elsinore, California Attest: City Clerk of the City of Elsinore, California RESOLUTION NO. 1317 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF ELSINORE ON THE 14th DAY OF APRIL, 1970, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS, a regular general municipal election was held and conducted in the City of Elsinore, County of Riverside, State of California, on Tuesday, the 14th day of April, 1970, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 1316 adopted the 13th day of April, 1970, the City Clerk of the City of Elsinore canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That there were three voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in the City of Elsinore as established for the holding of state and county elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the laws relating to cities in the State of California, to wit: Two (2) Members of the City Council of said City for the full term of four years. SECTION 3. That at said regular general municipal election, the following measure weaesubmitted to the electors of said City, to wit: #1. Shall City Ordinance No. 403, No. 415, No. 449 which enacted an Administrator and /or Manager form of City government be repealed? #2. Should the City of Elsinore enter into negotiations with the State of California for the possible acquisition by said City of Lake Elsinore, its property and other appurtenances? #3. Shall the office of City Treasurer be appointive? a SECTION 4. That the whole number of votes cast in said City (except absent voter ballots) was 1,164. That the whole number of absent voter ballots cast in said City was 67, making a total of 1,231 votes cast in said City. SECTION 5. That the names of persons voted for at said election for Member of the City Council of said City are as follows: WALTER C. BITTLE EUGENE J. CARTER FRANK L. DE PASQUALE JERRY HARMATZ GORDON B. HUNT RUPERT H. LUCAS GEORGE PERRY SANFORD S. REED DAVID SILVER CHARLES WARD JR. That the measures voted upon at said election were as follows: #1 Shall City Ordinance No. 403, 415, No. 449 which enacted an Administrator and /or Manager form of City government be repealed? #2 Should the City of Elsinore enter into negotiations with the State of California for the possible acquisition by said City of Lake Elsinore, its property and other appurtenances? #3 Shall the office of City Treasurer be appointive? That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates and for and against the measureswere as listed in Exhibit "A" attached. SECTION 6. The City Council does declare and determine that: Frank L. DePasquale was elected as Member of the City Council of said City for the full term of four years; Jerry Harmatz was elected as Member of the City Council of said City for the full term of four years; That as a result of said election, a majority of the qualified voters voting on measure #1 relating to repealing City Manager form of government did vote in favor thereof, and that said proposition was carried, and shall be deemed adopted and ratified. That as a result of said election, a majority of the qualified voters voting on measure #2 relating to negotiating for Lake Elsinore did not vote in favor thereof, and that said proposition was not carried, and shall not be deemed adopted and ratified. That as a result of said election, a majority of the qualified voters voting on measure #3 relating to appointment of City Treasurer did not vote in favor thereof, and that said proposition was not carried, and shall not be deemed adopted and ratified. -2- SECTION 7. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election showing: (1) The whole number of votes cast in the city; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6) The numberof votes given in the City to each person, and for and against each measure. SECTION 8. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 11565 and Section 11568 of the Elections Code of the State of California, shall deliver to each of such persons so elected a Certificate of Election :ssigned by her and duly authenticated; that she shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in her office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City;. and shall make a minutes of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. In the event the work is not completed within the time limit specified in the contract or within such further time as may be extended; the City shall charge the contractor liquidated damages in the net amount of One Hundred Dollars ($100.00) for each day or delay until the work is completed. SECTION 8. The legislative body further elects and declares that the redemption provisions of said bonds will pro - vide a premium of five percent (5%) on the unmatured principal. Holiday, Sunday and overtime employment is not usually permitted, but if allowed, wages shall be one and one - half times the above rates. In the event the work is not completed within the time limit specified in the contract or within such further time as may be extended, the City shall charge the contractor liquidated damages in the net amount of One Hundred Dollars ($100.00) for each day or delay until the work is completed. II OBJECTIVE: To establish responsibilities for the creation, computation, control, and affixing of the monetary amounts of weed abate - ment, 1911 act liens, nuisance abatement, and any other special assessments and tax liens to the current tax roll. III SCOPE: The scope of this procedure encompasses: All cities, fire departments, community services districts or other public agencies who qualify under the law to attach special assess- ments or tax liens to the current tax roll. Exception: Water District standby charges, which will be added by Auditor's Standard Procedure #001. IV RESPONSIBILITIES: A. The Agencies 1. The agency will initiate and forward to the Auditor- Controller's Office a list by code and parcel number in ascending numerical sequence, in triplicate, by August 10th each year. This list must show each assessment number with the total amount of the charge. All amounts must be divisable by two. A grand total for balancing must be included. 2. Pursuant to Section 39579 of the Government Code, the agency "attaching the-'liens must check the assessment number of the lien on the County Assessor's map books after the first day of March ". Code and parcel numb- ers as recorded on the Assessor's map books are to be used and they must be certified correct after the first of March (the tax lien date) for the year the liens are to be attached. 3. SPECIAL NOTE a. The Riverside County Data Processing Department will be able to prepare updated listings of the assessment rolls on and after April 15, 1969 for those agencies who require' this service. Requests must be received in triplicate in the Auditor's Office by June 1, 1969, on "Request for Special Data Processing Service" (attached). 3. SPECIAL NOTE (Cont'd.) b. The reverse side of the "Request for Special Data Processing Service" should be utilized to indicate exactly the code areas and parcel numbers for which listings are desired. (Column numbers at the top of the form may be disregarded.) c. The updated Assessor's map books will not be avail- able at the Assessor's branch offices until after July 1, 1969. Therefore, those agencies who pre - pare their own parcel listings prior to July 1, 1969 will have to use the map books in the Assess- or's main office in Riverside for preparation of any certified lists which would be submitted prior to July 1, 1969. d. The certification required should be part of the resolution requesting the County Board of Super- visors to levy the charge and must accompany the assessment number list sent to the Auditor. B. Auditor - Controller's Office 1. Upon receipt of the lists, the Auditor - Controller's Office will assign fund number if necessary, forward one copy of the lists to Data Processing. One copy will be filed in the Tax Collector's Office for the use of title companies and other interested parties. C. Data Processing 1. Data Processing will keypunch from the lists. List- ings of total charges will be processed by code and parcel number, fund number and amount with a grand total. A copy of the Data Processing listing will be returned to the Auditor - Controller's Office for balancing of Data Processing totals with the agency's total. 2. A listing of all erroneous numbers or duplications, etc., will be sent to the Auditor - Controller's Office, upon completion after August 10, 1969. D. Auditor - Controller's Office 1. The Auditor - Controller's Office will contact the agency for the corrections. Corrections must be made by the agency within three working days or the number will be dropped from the list. E.. The Agencies 1. It is the responsibility of the agency to determine the validity of the charge. The taxpayer will be, referred to the agency on all charges he feels are -2- incorrect. The agency will make a petition (Auditor - Controller's petition form) for the correction. Cor- rections cannot be made on any parcel that is paid. The agency must check the current tax roll, for pay- ment, before making a petition for correction. F. Auditor - Controller's Office 1. State Board of Equalization (S.B.E.) parcels must be listed by the S.B.E. parcel description number and code area. The Auditor - Controller's Office will - assign a County S.B.E. roll assessment number to these parcels, otherwise, they will be treated the same as all other parcels. G. The Agencies 1. when resolutions and lists are received after the closing date for additions to the Assessment Roll and before the first of March of the following year, they must be accompanied with a letter requesting the Auditor - Controller to place the lists in a conspicuous place where the title companies and other interested parties can locate the liens. Certified lists must be resubmitted before August 10th as indicated in Section IV above. 2. Payment of all necessary costs for processing their requested jobs is the responsibility of each district. These costs will be determined by the Auditor -Con- troller and Data Processing, and will be submitted to the District via the normal billing procedure. -3- FLORENE: I have prepared the Resolution, but as you will note, somebody must prepare an exhibit known as Exhibit "A ". Exhibit "A" is a list of the assessor's parcel numbers, the amount of the charge, and at the end the total charge for all of the properties. That said bonds shall be issued for all un- paid assessments or portions thereof which amount to Fifty Dollars ($50.00) or over, and shall be in the respective amounts as set forth in the assessment for Assessment District No. 1. Said bonds will be dated the 31st day after the recording of the assessment Said bonds and the coupons thereof shall be issued sub- stantially in the form authorized for the issuance of bonds under Division 7 of the Streets and Highways Code of the State of California. These bonds shall be serial bonds and shall extend over a period ending nine (9) years from the second day of January next succeeding the next September first following their date, and an even annual proportion of the principal sum thereof year after the next September first following their date, until the -2- whole is paid, and the interest shall be payable semi - annually, by coupon, on the second days of January and July, respectively, of each year following the date of the bonds.
