Should any damage or injury to City of Lake'Elsinore works occur during initial use and/or as a result of this permitted use, either through the acts of agents, servants or employees of Permittee or by any independent contractor of Permittee in the exercise of the rights herein granted. Permittee shall immediately, upon the written demand of City of Lake Elsinore, restore such works to the condition of same on the date of the occurrence of said damage or injury has been caused to the works shall e determined by the City Engineer's Office and City of Lake Elsinore and determination shall be final in the event repair by City of Lake Elsinore is necessary, Permittee shall pay City of Lake Elsinore the cost of such repairs. 5. City of Lake Elsinore reserves the right unto itself to perform any work,upon any portionorallof the area covered bythispermit, or to do any other work necessary at any time. Such work may be performed without incurring any liability of any nature whatsoever to the Permittee. It is further understood and agreed that City of Lake Elsinore reserves unto itself the rights of r ingress over all or any portion of the subject area. r 6. Neither this permit nor any of the rights herein granted shall be assigned without the prior written approval of the City of Lake Elsinore. Permit Is Void upon expiration date. A new fee will be assessed thereafter. ' 7. By acceptance of this permit, Permittee acknowledges and assumes all responsibility for compliance with requirements'of other regulatory governing agencies including but not limited to zoning regulations,applicable ordinances and laws,etc.,of the County of Riverside,the State of California,City of Lake Elsinore,or others having regulatory control overthe use granted herein. All underground work requires 'Inquiry identification Number from Underground Service Alert Regional Notification Center, (Ref: Government Code, Section 4216 and 4217) 8. A copy of this permit and approved plans, if applicable, shall be maintained at the site of work and be shown to any authorized representative of the City of Lake Elsinore, or other regulatory governing agency upon request. 9. No access or work shall be performed within City of Lake Elsinore rights of way without the full knowledge of City of Lake Elsinore°s inspector,who shall be given not less than two work days advance notice of the initiation of permitted use. Failure of Permittee to obtain inspection shall void this permit and necessitate reapplication by Permittee. Permittee further agrees that all operations within City of Lake Elsinore rights of way shall be subject to the operations of City of Lake Elsinore and other authorized persons and under the control and to the satisfaction of City of Lake Elsinore. 10. This permit may be immediately revoked for reasons in the best interest of the City of Lake Elsinore including violation of permit provisions or other applicable rules and regulations or for the creation of a nuisance upon notice given by the City of Lake Elsinore'authorized representative. In the event of such revocation, Permittee shall immediately cease all operations and restore City of Lake Elsinore,right of way as directed by the City of Lake Elsinore°s inspector. All Public Works requirements shall be complied with as a condition of development as specified in the Lake Elsinore Municipal Code (LEMC)prior to building permit. 2. Provide in-lieu payment for future off-site public improvements prior to building permit(Res. 86-35), with Stevens Avenue being $4,850 and Baily Avenue being $9,050. 3. Dedicate a ten-foot slope easement along the northerly property line on Stevens Avenue and the southerly property line on Baily Avenue for future street alignment,prior to issuance of building permit(Res. 87-64). 4. Public right-of-way dedications shall be prepared by the applicant or his agent. Deeds shall be submitted to the Engineering Division for review and approval prior to issuance of building permit. 5. Pay all Capital Improvement and Plan Check fees (LEMC 16.34, Res. 85-26). The traffic mitigation fee is$1,197 and the drainage fee is$2,530(West Elsinore Drainage District)and the TUMF amount is $6,650. 6. Submit a"Will Serve" letter to the City Engineering Division from the applicable water agency stating that water and sewer arrangements have been made for this project. Submit this letter prior to applying for a building permit. 7. Apply and obtain a grading permit with appropriate security prior to building permit issuance.A grading plan signed and stamped by a Calif. Registered Civil Engineer shall be required if the grading exceeds 50 cubic yards or the existing flow pattern is substantially modified as determined by the City Engineer.If the grading is less than 50 cubic yards and a grading plan is not required,a grading permit shall still be obtained so that a cursory drainage and flow pattern inspection can be conducted before grading begins. 8. Applicant to provide erosion control measures as part of their grading plan. The applicant shall contribute to protection of stormwater quality and met the goals of the BP in Supplement"A" in the Riverside County NPDES Drainage Area Management Plan. 9. Arrangements for relocation of utility company facilities (power poles,vaults,etc.) out of the roadway or alley shall be the responsibility of the property owner or his agent. 10. The onsite shall drain to Baily Avenue and to Stevens Avenue and the drainage shall not be concentrated or redirected causing erosion. 11 All natural drainage traversing the site shall be conveyed through the site by a method approved by the City Engineer. 12. Roof and yard drains will not be allowed to outlet through cuts in the street curb and should drain to a landscaped area whenever feasible. 13.
