Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2025-08 TO ALLOW THE TEMPORARY INSTALLATION OF FOUR MODULAR CLASSROOM BUILDINGS AND ONE MODULAR OFFICE BUILDING FOR A NEW PUBLIC CHARTER SCHOOL (VISTA LAGO GLOBAL ACADEMY) LOCATED WITHIN THE SOUTHERN PORTION OF THE PARKING LOT AT ALBERHILL RANCH COMMUNITY PARK AT 28200 LAKE STREET (APN 389-020-056). Project Location The proposed project site is within the southern portion of the existing surface parking lot at the City-owned Alberhill Ranch Community Park which is a 22-acre public park located at the northwest corner of Lake Street and Nichols Road. Access to the project site is provided by an existing driveway along Lake Street. The Alberhill Ranch Community Park is zoned Specific Plan (SP) and is located within the Murdock Alberhill Ranch Specific Plan which is part of the Alberhill District. (PA 2025-10 Vista Lago Modulars) Page 2 of 5 2 0 1 6 Background Vista Charter Public Schools (Vista) has been in operation for over 15 years as a small network of charter schools located throughout Southern California that offer free public education for transitional kindergarten through 12th grade. Vista is proposing to establish their seventh location, Vista Lago Global Academy (Vista Lago), in Lake Elsinore. Vista has entered into a license agreement with the City to grant them the temporary right to use a portion of the parking lot at Alberhill Ranch Community Park. The license agreement, which was approved by the City Council at their regular meeting on July 22, 2025, is for a three-year term with a one-year option to extend. Vista will operate at the park temporarily while they apply and secure the necessary entitlement approval(s) and building permit(s) to construct the permanent location for Vista Lago. Vista’s rights under the license are contingent upon obtaining the necessary entitlements and the Planning Commission retains its discretion to review this matter independently of the approval of the license. Their permanent location is proposed to be at Riverside Drive and Joy Street (APN 379-160-004). Project Description The proposed project is a Commercial Design Review (CDR-2025-08) to allow the temporary installation of four (4) modular classroom buildings and one (1) modular administrative office building for the temporary operation of a new public charter school, Vista Lago Global Academy. The project also includes minor site improvements, including temporary hook-ups and infrastructure for utilities, directional wayfinding signage, fencing for safety and security, and an outdoor recreation space for recess. To accommodate the temporary modulars, a total of 41 parking spaces within the southern portion of the Alberhill Ranch Community Park parking lot are proposed to be temporarily removed. Vista Lago intends to offer free public education for kindergarten through 9th grade with up to 170 students and 24 staff members. The proposed school schedule is 7:45 a.m. to 2:45 p.m. for kindergarten through 5th grade and 8:30 a.m. to 3:30 p.m. for 6th through 9th grade. The administrative office hours are proposed from 7:00 a.m. to 4:30 p.m. Vista Lago would also offer an after-school program from 2:45 p.m. to 6:00 p.m. Pursuant to the terms of the license agreement with the City, Vista would be responsible for returning the parking lot (and any other areas allowed to be used under the license) back into its original condition upon vacating the use once their permanent school has been fully constructed. Analysis The following analysis provides a discussion of the proposed project’s consistency with the development standards and requirements pursuant to the Lake Elsinore Municipal Code (LEMC) as well as the General Plan. In addition, the Design Review Committee, including Staff from Planning, Building and Safety, Fire, Engineering, Economic Development, and Community (PA 2025-10 Vista Lago Modulars) Page 3 of 5 2 0 1 6 Services Departments has reviewed the project and has included recommended conditions of approval to ensure compliance with adopted plans, policies, and regulations. General Plan and Municipal Code Consistency The project site is located within the Murdock Alberhill Ranch Specific Plan. This Specific Plan provides for a comprehensive development plan, regulations, and guidelines for a master planned community, which combines residential, commercial, and open space and recreational uses. Pursuant to the Specific Plan’s land use regulations, elementary, junior high, and high schools are permitted uses. As such, the proposed temporary public charter school is consistent with the allowed uses of the Murdock Alberhill Ranch Specific Plan and complies with the applicable development standards. Furthermore, the project is also consistent with the General Plan because the Murdock Alberhill Ranch Specific Plan was found to be consistent with the General Plan at adoption. Architecture and Site Design The project has been reviewed for compliance and consistency with the design guidelines and standards outlined in the Murdock Alberhill Ranch Specific Plan. The overall architectural theme for the Murdock Alberhill Ranch neighborhood is based on styles familiar to rural California with influences of the natural environment that surrounds the Alberhill District. This is reflected in the current design of the community park, which features red clay roof tiles as well as bricks and stucco in natural color tones. The proposed temporary modular buildings are pre-manufactured structures. Each modular classroom building is approximately 1,400 square feet and features two separate classrooms and two restrooms. The modular office is approximately 650 square feet, which includes three separate offices and one restroom. Although the modulars are pre-manufactured, the exterior color is a light sand color that would complement the existing community park building and the natural setting. Therefore, the project would be consistent with the design and architectural theme and development standards of the Murdock Alberhill Ranch community. Parking The community park currently has over 330 parking spaces that are provided in a surface parking lot with existing driveway access along Lake Street and Nichols Road. The school proposes to temporarily remove 41 parking spaces to create their temporary school grounds. The school also proposes using 18 parking spaces for their part-time staff and visitors. When the school is not in operation, these 18 spaces would be available to park visitors. The community park would temporarily have approximately 290 parking spaces remaining to accommodate regular park use as well as planned sports tournaments/games that occur throughout the year. To ensure the parking is managed properly and avoid potential conflicts with the regular park use and sports tournaments/games, Vista Lago has proposed staggering their school schedule hours which include two different start and end times for the two grade groups (kindergarten through 5th (PA 2025-10 Vista Lago Modulars) Page 4 of 5 2 0 1 6 and 6th through 9th). Furthermore, many of the sports tournaments are typically in the evening times and on weekends when the school is not in operation. It is anticipated that regular park use would be more frequented during the evening and weekends when school is not in session. Although the afterschool program would be offered until 6:00 p.m., the anticipated parking demand and impact would be minimal given that not all students would attend the afterschool program and that Vista Lago only needs six (6) parking spaces for it. Vista has indicated that they would continue to coordinate and work with the City to manage the parking especially during their planned school events that would occur during the evening time (e.g. Back to School Night, Open House Night). Should there be a parking impact, a condition of approval has also been included to require Vista address the parking issue and coordinate with the City to resolve it. Drop-off and Pick-up Circulation Plan The proposed school drop-off and pick-up circulation route is provided on the site plan of Attachment 4 (Project Plans). The drop-off/pick-up entrance is proposed to be at the existing driveway along Lake Street. Parents and/or guardians would follow this designated route that loops around the parking spaces to then drop off the students at the designated drop-off/pick-up area which is proposed to be within the existing soccer field area near the school’s main entrance. The drop-off/pick-up exit is proposed to be at the existing driveway along Nichols Road. Thus, the drop-off/pick-up route has been designed for “one way in and one way out” to ensure safe vehicular travel especially with the anticipated typical morning commute. The queueing of cars would occur entirely onsite within the parking lot and have a queueing capacity for approximately 37 cars. Given that as well as the staggered school schedule, it is not anticipated that the drop- off/pick-up would cause traffic impacts to the surrounding neighborhood. Furthermore, Vista Lago would have directional wayfinding signage on Lake Street and cones during the drop-off/pick-up times to mark the path of travel for cars. There would also be signage at the drop-off point as well as signs to direct cars which way to exit. In addition to the signs, there would be staff members assigned at the drop-off entrance driveway, school parking lot, drop-off area, and school entrance to facilitate, monitor, and manage the drop-off/pick-up activity. Vista has also indicated that they would continually monitor the circulation route and make adjustments as needed to minimize any traffic impacts to the community. A condition of approval has been included to require that there be school staff continually present during the drop-off/pick-up times to monitor and manage it, in addition to a condition to require Vista address any future traffic impacts or concerns from the surrounding neighborhood. Environmental Determination The proposed temporary use is exempt from the California Environmental Quality Act (Cal. Publ. Res. Code §§21000 et seq.: “CEQA”) and the State CEQA Guidelines (14. Cal. Code Regs §§15000 et seq.), specifically pursuant to Section 15311 (Class 11 – Accessory Structures) because the use consists of the placement of temporary modular structures appurtenant to a publicly owned park and Vista Charter is a public charter school available for enrollment for children throughout the community. (PA 2025-10 Vista Lago Modulars) Page 5 of 5 2 0 1 6 MSHCP Consistency On February 24, 2004, Castle & Cooke properties throughout Riverside County were removed from coverage under the MSHCP pursuant to a lawsuit settlement agreement with Riverside County. The subject property was part of this settlement agreement and is not subject to the provisions of the MSHCP. Therefore, the project is exempt from the requirements of the MSHCP. Public Notice Notice of the public hearing for this application has been published in the Press-Enterprise newspaper and mailed to the property owners within 300 feet of the subject property. As of the writing of this report, no written comments concerning this application have been received by staff. Attachments Attachment 1 – CDR Resolution Attachment 2 – Conditions of Approval Attachment 3 – GIS Exhibits Attachment 4 – Project Plans Attachment 5 – Public Notice Materials RESOLUTION NO. 2025- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2025-08 TO ALLOW THE TEMPORARY INSTALLATION OF FOUR MODULAR CLASSROOM BUILDINGS AND ONE MODULAR OFFICE BUILDING FOR A NEW PUBLIC CHARTER SCHOOL (VISTA LAGO GLOBAL ACADEMY) LOCATED WITHIN THE SOUTHERN PORTION OF THE PARKING LOT AT ALBERHILL RANCH COMMUNITY PARK AT 28200 LAKE STREET (APN: 389-020-056) Whereas, Alyssa Ross, Vista Charter Public Schools, has filed an application with the City of Lake Elsinore (City) requesting approval of Planning Application No. 2025-10 (Commercial Design Review No. 2025-08) to allow the temporary installation of four (4) modular classroom buildings and one (1) modular administrative office building for the temporary operation of a new public charter school, Vista Lago Global Academy. The public charter school proposes to operate their school temporarily for up to four (4) years within the modular buildings which will serve up to 170 students from kindergarten through 9th grade. The proposed hours for the temporary school operations are Monday through Friday from 7:45 a.m. to 3:30 p.m. and school office hours are proposed from 7:00 a.m. to 4:30 p.m. The project also includes minor site improvements including temporary hook-ups and infrastructure for utilities, directional wayfinding signage, fencing for safety and security, and an outdoor recreation space for recess. The project is located within the southern portion of the existing surface parking lot at the City-owned Alberhill Ranch Community Park at 28200 Lake Street (APN: 389-020-056); Whereas, pursuant to Section 10.1 of the Murdock Alberhill Ranch Specific Plan (MARSP), the Planning Commission (Commission) has been delegated with the responsibility of approving, conditionally approving or denying design review requests for developments in the MARSP area; Whereas, Pacific Clay Products, Inc., Castle & Cooke Lake Elsinore Outlet Centers, Inc., Castle & Cooke Corona, Inc., Gateway Business Park, LLC, and Murdock Alberhill Ranch Limited Partnership, (collectively “Owner”) entered into that certain settlement agreement and memorandum of understanding (the “Settlement Agreement”) with the County of Riverside on February 24, 2004, which exempts and excludes all of the Owner’s properties (including present and future uses and development of Owner’s properties) from the Western Riverside County Multiple Species Habitat Conservation Plan (MSHCP) for all purposes; Whereas, the subject property is in the Murdock Alberhill Ranch Specific Plan area and is covered by the terms of the Settlement Agreement, and is therefore exempt from the requirements of the MSHCP; Whereas, on August 5, 2025, at a duly noticed Public Hearing, the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: The Commission has reviewed and analyzed the proposed project pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §§ 59000 et seq.), the Lake Elsinore PC Reso. No. 2025-____ Page 2 of 3 3 8 6 7 8 General Plan (GP), the MARSP, and the LEMC and finds and determines that the proposed project is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the GP, MARSP, and the LEMC. Section 2: The Commission hereby finds and determines that the project is categorically exempt from California Environmental Quality Act (Cal. Publ. Res. Code §§21000 et seq. “CEQA”) and CEQA Guidelines (14. Cal. Code Regs. §§15000 et seq.), specifically pursuant to Section 15311 (Class 11 – Accessory Structures) because the use consists of the placement of temporary modular structures appurtenant to a publicly owned park and Vista Charter is a public charter school available for enrollment for children throughout the community. Section 3: The Commission acknowledges the Settlement Agreement which exempts and excludes the project from the requirements of the MSHCP. Therefore, the Commission finds that the project is exempt from the MSHCP and that no further MSHCP action is required. Section 4: That in accordance with LEMC Section 17.415.070.C. Findings, the Commission makes the following findings regarding Commercial Design Review No. 2025-08: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the zoning district in which the project is located. The proposed project has a General Plan land use designation of Specific Plan (SP) and is also zoned SP. More specifically, the project site is located in the Murdock Alberhill Ranch Specific Plan (MARSP). The MARSP provides for a comprehensive development plan, regulations, and guidelines for a master planned community which combines residential, commercial, and open space and recreational uses. Pursuant to the Specific Plan’s land use regulations, elementary, junior high, and high schools are permitted uses. As such, the proposed temporary public charter school is consistent with the allowed uses of the Murdock Alberhill Ranch Specific Plan and complies with the applicable development standards. 2. The project complies with the design directives contained in the LEMC and all applicable provisions of the LEMC. The overall architectural theme for the MARSP is based on styles familiar to rural California with influences of the natural environment that surrounds the Alberhill District. Although the proposed modular buildings are pre-manufactured, the exterior color is a light sand color that would complement the existing community park building and the natural setting. Therefore, the project is consistent with the design and architectural theme of the Murdock Alberhill Ranch Specific Plan and applicable development standards contained in the LEMC. 3. Conditions and safeguards pursuant to Section 17.415.050.G.3 of the LEMC, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Section 17.415.050. Pursuant to Section 17.415.050.E of the LEMC, the project was considered by the Planning Commission at a duly noticed Public Hearing held on August 5, 2025. The project has been reviewed and conditioned by all applicable City divisions, departments and agencies to ensure the proposed project would be consistent with the major design review PC Reso. No. 2025-____ Page 3 of 3 3 8 6 7 8 objectives contained in LEMC . Furthermore, the project would be required to demonstrate compliance with the conditions of approval and other applicable requirements prior to the issuance of a building permit and/or City business license. Section 5: Based upon the evidence presented, the above findings, and the Conditions of Approval imposed upon the Project, the Commission hereby approves Commercial Design Review No. 2025-08. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, Agents, and its Consultants (Indemnitees) from any claim, action, or proceeding against the Indemnitees to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the approval, implementation, and construction of CDR-2025-08, which action is bought within the time period provided for in California Government Code Sections 65009 and/or 66499.37, and Public Resources Code Section 21167, including the approval, extension, or modification of CDR-2025-08 or any of the proceedings, acts or determinations taken, done, or made prior to the decision, or to determine the reasonableness, legality or validity of any condition attached thereto. The Applicant's indemnification is intended to include, but not be limited to, damages, fees and/or costs awarded against or incurred by Indemnitees and costs of suit, claim or litigation, including without limitation attorneys' fees, penalties and other costs, liabilities and expenses incurred by Indemnitees in connection with such proceeding. The City will promptly notify the applicant of any such claim, action, or proceeding against the City. If the project is challenged in court, the City and the applicant shall enter into formal defense and indemnity agreement, consistent with this condition. 3. Within 30 days of Project approval and prior to issuance of any building permits, the applicant shall sign and complete an “Acknowledgement of Conditions,” and shall return the executed original to the Community Development Department for inclusion in the case records. PLANNING DIVISION 4. Commercial Design Review No. 2025-08 shall lapse and become void two years following the date on which the design review became effective, unless one of the following: (1) prior to the expiration of two years, a building permit related to the design review is issued and construction commenced and diligently pursued toward completion; or (2) prior to the PA 2025-10/CDR-2025-08 Conditions of Approval PC: August 5, 2025 Applicant’s Initials: _____Page 2 of 8 3 8 6 7 9 expiration of two years, the applicant has applied for and has been granted an extension of the design review approval pursuant to subsections (1) and (2) of Lake Elsinore Municipal Code (LEMC) Section 17.415.050.I.1. Notwithstanding conditions to the contrary, a design review granted pursuant to LEMC Section 17.415.050.I.2 shall run with the land for this two- year period, subject to any approved extensions, and shall continue to be valid upon a change of ownership of the site, which was the subject of the design review application. 5. The applicant shall meet all applicable City Codes and Ordinances. 6. The applicant shall at all times comply with Section 17.176 (Noise Ordinance) of the LEMC. 7. An application for modification, expansion or other substantial change in the approved Commercial Design Review shall be reviewed according to the provisions of the LEMC, Title 17 in a similar manner as a new application. 8. A business license shall be obtained prior to a certificate of occupancy of the proposed establishment. 9. The school shall be allowed to operate Monday through Friday during the following hours: •Kindergarten through 5th Grade: 7:45 a.m. to 2:45 p.m. •6th Grade through 9th Grade: 8:30 a.m. to 3:30 p.m. •Administrative Office: 7:00 a.m. to 4:30 p.m. •After-school Program: 2:45 p.m. to 6:00 p.m. Other planned school-related events occurring in the evening times including but not limited to Back to School Night, Open House, etc. may be allowed with prior notification to the City to ensure no parking conflicts with any scheduled park events including but not limited to sports tournaments. The school shall notify the City in writing no later than 30 days prior to the date of the school-related event. In the event the applicant proposes to modify the hours of operation, the modification shall be subject to review by the Community Development Director. The Community Development Director may approve the modification or refer the matter to the Planning Commission if judged to be substantial. 10. All Conditions of Approval shall be reproduced on page one of building plans prior to their acceptance by the Building and Safety Division, Community Development Department. All Conditions of Approval shall be met prior to the issuance of each individual Certificate of Occupancy and release of utilities. 11. Provisions of the City's Noise Ordinance (LEMC Chapter 17.176) shall be satisfied during all site preparation and construction activity. Site preparation activity and construction shall not commence before 7:00 AM and shall cease no later than 5:00 PM, Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 am and shall cease no later than 4:00 p.m. Construction activity shall not take place on Sunday, or any Legal Holidays. 12. Commercial Design Review No. 2025-08 shall be limited to the site and floor plan prepared by the applicant and included in the staff report. In the event the applicant proposes to modify the site or floor plan, the modification shall be subject to review by the Community PA 2025-10/CDR-2025-08 Conditions of Approval PC: August 5, 2025 Applicant’s Initials: _____Page 3 of 8 3 8 6 7 9 Development Director. The Community Development Director may approve the modification or refer the matter to the Planning Commission if judged to be substantial. 13. Graffiti shall be removed within 24 hours. 14. All materials and colors depicted on the approved plans shall be used. If the applicant wishes to modify any of the approved materials or colors depicted on the plans, the applicant shall submit a proposal setting forth the modifications for review by the Community Development Director or his designee. 15. The entire site shall be kept free from trash and debris at all times and in no event shall trash and debris remain for more than 24 hours. 16. School staff must be present at all times during the drop-off and pick-up times to monitor and manage the traffic flow to ensure safety for parents/guardians, students, staff, and the immediately surrounding neighborhood. 17. Directional wayfinding signage shall be provided at all times during the drop-off and pick-up times. At a minimum, there shall be signs directing parents/guardians to the entrance and exit driveway access. The school shall ensure that directional signage is kept in good condition and well maintained to ensure signs are visible and legible. 18. The temporary school use and its operations shall comply with all applicable terms of the Right of Entry Agreement and License (entered into as of July 22, 2025) between Vista Charter Public School and the City of Lake Elsinore including but not limited to restoring the parking lot into its original condition upon expiration or termination of the agreement. 19. If operation of this use triggers concerns related to parking, noise, traffic, or other impacts, at the discretion of the Community Development Director, the school shall be responsible for addressing these impacts and remedying them with solution(s) approved by the Community Development Director or designee to reduce said impacts which may include but not limited to reducing class sizes, modifying hours of operations, and/or revising the drop-off/pick-up routes. 20. Any proposed exterior signage shall comply with LEMC Section 17.196.180 requirements. BUILDING DIVISION 21. Final Building and Safety Conditions. Final Building and Safety Conditions will be addressed when building construction plans are submitted to Building and Safety for review. These conditions will be based on occupancy, use, the California Building Code (CBC), and related codes which are enforced at the time of building plan submittal. 22. Compliance with Code. All design components shall comply with applicable provisions of the 2022 edition of the California Building, Plumbing and Mechanical Codes: 2022 California Electrical Code; California Administrative Code, 2022 California Energy Codes, 2022 California Green Building Standards, California Title 24 Disabled Access Regulations, and Lake Elsinore Municipal Code. 23. Applicant must obtain street addressing for all proposed buildings by requesting street addressing and submitting a site plan for commercial or multi-family residential projects or a recorded final map for single- family residential projects. A receipt or clearance letter from the Lake Elsinore School District shall be submitted to the Building and Safety Department to ensure the payment or exemption from School Mitigation Fees. 26. Obtain Approvals Prior to Construction. Applicant must obtain all building plans and permit approvals prior to commencement of any construction work. 27. Obtaining Separate Approvals and Permits. Trash enclosures, patio covers, light standards, and any block walls will require separate approvals and permits. 28. Sewer and Water Plan Approvals. On-site sewer and water plans will require separate approvals and permits. Septic systems will need to be approved from Riverside County Environmental Health Department before permit issuance. 29. House Electrical Meter. Applicant shall provide a house electrical meter to provide power for the operation of exterior lighting, irrigation pedestals and fire alarm systems for each building on the site. Developments with single user buildings shall clearly show on the plans how the operation of exterior lighting and fire alarm systems when a house meter is not specifically proposed. At Plan Review Submittal 30. Submitting Plans and Calculations. Applicant must submit to Building and Safety four (4) complete sets of plans and two (2) sets of supporting calculations for review and approval including: a. An electrical plan including load calculations and panel schedule, plumbing schematic, and mechanical plan applicable to scope of work. b. A Sound Transmission Control Study in accordance with the provisions of the Section 5.507, of the 202241 edition of the California Building Code. c. A precise grading plan to verify accessibility for the persons with disabilities. d. Truss calculations that have been stamped by the engineer of record of the building and the truss manufacturer engineer. Prior to Beginning of Construction 34. Pre-Construction Meeting. A pre-construction meeting is required with the building inspector prior to the start of the building construction. ENGINEERING DEPARTMENT GENERAL 35. Project shall provide for review and approval a traffic management plan to the satisfaction of the City Engineering Department for proper mitigation including but not limited to queueing, circulation, and traffic control mitigation measures prior to issuance of occupancy. Initial traffic management plan submittal is required prior to building permit issuance. 36. The site will accommodate all construction activity, building activity, vehicles, etc. No staging on public streets, or private property belonging to others shall be conducted without the written permission of the property owner. 37. Minimum good housekeeping and erosion and sediment control Best Management Practices (BMPs) shall be implemented. 38. Applicant shall pay all applicable permit application and Engineering assessed fees, including without limitation plan check and construction inspection fees, at the prevalent rate at time of payment in full. 39. Applicant shall apply for, obtain and submit to the City Engineering Department a letter from Southern California Edison (SCE) indicating that the construction activity will not interfere with existing SCE facilities. Non-Interference Letter (NIL) shall be provided prior to building permit. 44. Submit a “Will Serve” letter to the City Engineering Department from the applicable water agency stating that water and sewer arrangements have been made for this project and specify the technical data for the water service at the location, such as water pressure, volume, etc. Will Serve letters shall be provided prior to building permit. 45. Roof drains shall not be allowed to outlet directly through coring in the street curb. Roofs should drain to a landscaped area to maximum extent possible. 46. The site shall be planned and developed to keep surface water from entering buildings (California Green Building Standards Code 4.106.3). 47. An Encroachment Permit shall be obtained prior to any work on City right-of-way. The developer shall submit the permit application, required fees, and executed agreements, security and other required documentation prior to issuance. 48. Applicant shall pay all outstanding applicable processing and development fees prior to occupancy and/or final approval. CITY OF LAKE ELSINORE FIRE MARSHAL 49. Submittal of construction plans to the Office of the Fire Marshal for development, construction, installation, and operational use permitting will be required. Final fire and life safety conditions will be addressed when the Office of the Fire Marshal reviews these plans. These conditions will be based on occupancy, use, California Building Code (CBC), California Fire Code, and related codes, which are in effect at the time of building plan submittal. 50.
