The area was first known as Canyon Lake Hills. In 1978 several private consultants and developer joined forces to begin the process to annex the area into the City of Lake Elsinore's City Boundary. The City Council adopted a resolution giving consent to annex 1,002 acres on August 28, 1978. On May 29, 1980 the City of Lake Elsinore signed a Development Agreement that established the conditions, terms, standards, restrictions, and requirements for the development, construction and operation of the proposed development of Canyon Lake Hills. In December of 1982 the Development Agreement was amended but these were not formally adopted. This Development .Agreement was completely amended and superceded by a second Development Agreement that was recorded on February 8, 1990. ADMINISTRATIVE REVIEW DUNE 19, 2001 PAGE 2 OF 5 SUBJECT: MINOR DESIGN REVIEW OF A MODEL HOME COMPLEX AND PLOTTING PLAN FOR PHASE ONE FOR RESIDENTIAL PROJECT NO. 2001-01, A PORTION OF TRACT 24383, US HOME, "VELLAGIO" LOCATED AT TUSCANY HILLS The first tentative tract for the Canyon Lake Hills area was Tentative Tract Map No. 17413. This map was originally approved by the City of Lake Elsinore May 12, 1981 (an Environmental Impact Statement and appendices was completed in October 1982). This original map, TTM 17413, was owned and processed by a firm known as ABC Heritage, Inc. of Irvine. This map proposed to subdivide the southern portion of the Canyon Lake Hills Plan into 614 lots. Davidson Communities acquired the southern portions of the Canyon Lake Hills area in the late 1980s, and the area was renamed Tuscany Hills at that time. The Tuscany Hills Specific Plan and Development Agreement (mentioned above) were approved by the City on January 23, 1990 (Ordinance No. 880), and recorded on February 8, 1990 (the Development Agreement expired on February 8, 2000). After approval the Redevelopment Agency of the City of Lake Elsinore "established a Community Facilities District No. 90-2 (Tuscany Hills Public Improvements) for the purpose of constructing and acquiring certain public improvements needed to meet increased demand upon the Agency ..." (Redevelopment Agency of the City of Lake Elsinore, September 1998). This District is currently levying taxes on existing property owners, and also on undeveloped land. On January 9, 1990 City Council approved Tentative Tract Map No. 24383 along with seven other tentative maps located in the northerly half of the Tuscany Hills Specific Plan. City Council approved Final Tract Map No. 24383 September 22, 1992. This map was purchased by U. S. Home, the applicant. US Home requested approval for Minor Design Review for Residential Project No. 98-6 which consisted of a Model Home Complex and Phase One development of forty-two (42) lots (164 were proposed to be developed in 5 phases). The Community Development Director approved this request on January 11, 1999 as permitted per Section VIII, Development Standards (page 44), of the Tuscany Hills Specific Plan . PROJECT DESCRIPTION The application is requesting to divide the original tract of 164 lots into two different developments that will include two model home complexes. The original model home complex that was approved on January 11, 1999 will operate as Volterra at Tuscany Hills. One hundred twenty-four (124) lots will be developed as Volterra. The applicant intends to develop the remaining forty (40) lots using the three plans reviewed by this Minor Design Review. These two developments will be constructed simultaneously. A "Mediterranean" type architecture is proposed for the entire project which complies with the direction given by the Design Guidelines of the Tuscany Hills Specific Plan. Front balconies are shown on several plans giving dimension to the plan. A separate "casita" is included with Plan One. The casitas and the separated garages create entry piazzas adding depth to the street view. Other architectural features include castle type turret entries, low entrance wall enclosures with gates, arched windows, various types of shutters, and optional decorative masonry trim. Materials and Colors The applicant has provided a detailed materials board (see Exhibit `H') illustrating the color combinations proposed for all nine elevations. It was determined that the project met the directives of all of these documents. The documents used, and the details and results of this research is as follows: Documents: Conditions of Approvalfor Tract Map No. 24383; Tuscany Hills Specific Plan; Redevelopment Agency's Community Facilities District No. 90-2 (Tuscany Hills Public Improvements); Lake Elsinore Municipal Code. 1. Conditions of Approval for Tract Map No. 24383 The project is subject to the Conditions of Approval for Tract Map No. 24383 (attached). 2. Tuscany Hills Specific Plan The architectural styles recommended by the Tuscany Hills Specific Plan include California Ranch, Monterey Style, Mediterranean Contemporary and Mediterranean Country. The Plans proposed reflect both the Mediterranean Contemporary and Country styles. Garages are setback in varied degrees creating a diverse street scene. Therefore, the project meets the requirements of the Tuscany Hills Specific Plan. 3. Redevelopment Agency's Community Facilities District No. 90-2 As previously mentioned the Redevelopment Agency of the City of Lake Elsinore established this district for the purpose of constructing and acquiring certain public improvements needed to meet increased demand upon the Agency and the City of Lake Elsinore as a result of development. There are five (5) categories of Special Taxes: Category I: Taxable Property in the District not subject to a special tax under Category III or Category V (this project is subject to Category III and V, therefore it is exempt from Category I) Category II: One-time tax payable at the time of approval of final map with respect to a parcel. Tract 24383, 164 lots, Special Tax for each developable parcel by which final map is less that the projected developable parcels - $20,261. Category III: Any Parcel for which a final map has been recorded and for which Category II special taxes have been paid, if applicable, will be classified in Category III, until such time as a building permit has been issued (Tract No. 24383 $2,745.20 maximum special tax). Category IV: Special tax is a one-time tax payable at the time of issuance of building permit (based on average square feet per parcel; if below average (2,325 sq. ft.) a"downsizing" fee is charged). Tract No. 24383 minimum unit size is 2,357 square feet, therefore,no fee is required. Category V: All Parcels for which a building permit has been issued and for which a Category II and IV special tax has been paid. The estimated fee for Tract No. 24383 is $732.40 per Parcel plus $0.57 per square foot. Lake Elsinore Municipal Code The proposed project meets the requirements of the Lake Elsinore Municipal Code (LEMC) including design and development standards and guidelines listed. ENVIRONMENTAL An Environmental Impact Report was prepared for the Tuscany Hills Specific Plan. This document was found to be in compliance with the California Environmental Quality Act (CEQA) and certified in December of 1989. The division of Tract 24383 into two developments known as US Home- Vellagio, and US Home Volterra at Tuscany Hills is in compliance with the Tuscany Hills Specific Plan and therefore, adequate environmental clearance has been provided with the approval of the previously approved environmental documents. RECOMMENDATION It is recommended that the Community Development Director approve Minor Design Review Residential Project No. 2001-01 for the Model Home Complex, Phase One consisting of sixteen (16) lots, for single family residential development to be known as US Home Vellagio, based the following Findings, Exhibits 'A' thru 'H', and subj ect to the attached Conditions of Approval. This includes the area outside your eastern boundary. What is the status of this requirement? Since this may take some time to finalize, and your projects are approaching completion, I recommend that you resolve this as soon as possible. I have also contacted the Homeowner's Association to ask if they have received any dedications from you. While checking Volterra, Lots 124 through 128 today I found that the added architectural features that are required along the rear elevations of Pointe Loren where not included. Therefore, I have requested that all homes on Point Loren have architectural features added to the rear elevations per Condition No. 9. I have finaled Lots 125, 126, & 127, but I can not final any other houses until this requirement has been completed. A third issue is the existing side yard block wall along Lot 124. It is approximately 3.5 feet from the residence. The minimum distance allowed is 5 feet. Your Construction Supervisor said that you had received approval for this block wall location. I have looked through my file, and could not find an interior fencing plan that showed this condition. Please submit a copy of an interior fencing plan for Lots 124 through 141, and the approval for this wall. Lastly, our accounting division has notified me that both projects are overdrawn. The questions were how does the timing of the construction of the Monument Walls effect the timing of the final approvals for your residential units, and how many walls are required and at what locations. Per the Specific Plan, your projects are required to build three (3) Tertiary Monument Walls, one (1) at the corner of Summerhill Drive and Ponte Russo and two (2) at the entrance of your new Vellagio project, at the comers of La Strada and Bella Vista. Staff decided that the completion of the Summerhill Drive wall could coincide with the approval of the last unit in Phase 3 of the Volterra project. It was also decided that this wall could be reduced in size while meeting the design requirements of the wall. Mr. Hutchins felt that this wall could be constructed within 90 days. One (1) Monument Wall has been constructed at the northwest corner of La Strada and Bella Vista within the Vellagio tract. A second wall is required on the northeast corner. It is also the intention of the parties that U.S. Home grant to White Rock a temporary easement over certain portions of said Tract No. 24383 (described in Exhibit "B" as "B'OA Maintenance Area') as reasonably necessary for the relocation of the brow ditch back unto said Tract No. 24383 at such time, if any, as Grantor, its successors or assigns, determines that such relocation is needed for its proposed development of the Proposed Easement area within the Parcel. E. The areas of the Parcel to be affected by the easements being granted to U_S_ Home, referred to herein as the "Proposed Easement", are shown on said Exhibit "B"and are described as follows: A strip of land being the southerly eight hundred and ninety three feet(893') of the easterly seventy-five feet (75') of the southeast section of section 33, TSS, R4W, shown on Exhibit "A' attached hereto and incorporated herein by this reference, excepting therefrom the westerly forty-five feet (45') of the northerly six hundred and ninety-three feet(693') of said strip, F. Upon completion of such relocation, White Rock, its successors or assigns, shall restore the HOA Maintenance Area to its condition prior to such work being performed and shall repair and/or reestablish, to the pre-construction existing condition, any and all landscaping, irrigation, planting, fencing or grading disrupted and/or damaged by the reconstruction of the said brow ditch onto or within said HOA Maintenance Area. White Rock shall have the right and power to assign and transfer said easement or other entity and/or the owners of the real property benefited by such easements subject to such entity assunung the obligations of White Rock under this Deed. The easement granted in this paragraph shall terminate upon completion of such relocation and re- establishment and reconstruction work. 4_ Termination of Fuel Modification Easement. The temporary easement granted above to U.S. Home for fuel modification zone purposes shall terminate at such time as the Parcel is developed by White Rock or its successors or assigns with regard to permanently eliminating the need for such weed abatement buffer/fuel modification zone, as required and describe by the City of Lake Elsinore, County of Riverside and State of California to protect life and property from possible "wild fires"_ The owner(s) of the Parcel described on Exhibit "A" shall have the power to terminate such temporary easement at such time by recordation of an appropriate document upon written notice from City of Lake]Elsinore that such fuel modification zone is no longer required. S. Termination of Brow Ditch Easement. The temporary easement granted above to U.S. Home for encroachment and maintenance of the brow ditch shall terminate at such time as the brow ditch or appropriate alternate drainage improvements have been relocated. The easement deed for the area to the West (above Vellagio) is with East Bridge Partners , Bill Shopoff for signature and I should have it back by the end of the week for recording. The area to the North and north west are Lettered Lots A-C on the Tract map and were dedicated to the HOA for maintenance on the map. So we would not have to Deed these. With regard to the East area, as I stated I have applied for the access easement and have not yet received the review form the BLM for a meeting. I do still have the Cooperative Agreement that you gave me should I need to go that direction. With regard to these issues I think that you can be comfortable that I will stand behind them to get them resolved in a timely manner as we move forward to complete this community. The city is still in control with the improvement bonds that are in place. We are currently pursuing the completion of the slopes to get them in a condition that we can walk with the HOA. We are just now ending the 90 day weed abatement that we are having the HOA's contractor (Staygreen) perform before we can complete the plantings. I you may know the plantings were postponed due to the water pressure issue that came up on the upper portion of Vellagio. We had to install a booster pump and the lost time gave the weeds a chance to take over. Before we complete the plantings, I would like to get with Rod and yourself and our contractor and Landscape Architect to possibly change out some types of plants. This is due to what we are seeing with those that are planted already. Some species are doing quite well while others are struggling to get going, due to the conditions. This is not something that we have to do, only considering that if we address the matter now we can give the HOA and City a much better landscape without any serious cost issues. Lastly, with this information and my commitment to you to continue pursuing the issues, can you talk with Armondo to see if you can release my last few homes? If you need some other type of assurances let me know and I will oblige with whatever I can.
