BRADY CITY MANAGER DATE: AUGUST 11, 2009 SUBJECT: PROCLAMATION OF THE CITY COUNCIL SUSPENDING BURNING PERMITS AND OTHER USES OF OPEN FIRE Background Do to critical fire weather and high fire hazard conditions, the Riverside County Fire Chief has issued a proclamation suspending burning permits and other uses of open fire in the County with the exception of incorporated cities. Discussion The same hazardous fire conditions exist in the City as do in the County. It is the recommendation of the County Fire Chief and the Lake Elsinore Fire Chief the issuance of burn permits and other use of open fire in the City should be suspended. Fiscal Impact None. Recommendation The City Council should consider the attached proclamation suspending the issuance of burn permits and other uses of open fire. Brady City Manager CC August 11, 2009 Item No. 5 Page 2 of 7 A PROCLAMATION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, SUSPENDING THE ISSUANCE OF BURN PERMITS AND OTHER USES OF OPEN FIRE Due to extreme menace of destruction by fire to life, improved property or natural resources caused by critical fire weather and acute dryness of vegetation; and / or fire suppression forces being heavily committed to control fire; and, under the authority provided in Section 307 of the 2007 California Fire Code, adopted by reference in Chapter 15.56 of the Lake Elsinore Municipal Code, the City of Lake Elsinore hereby suspends the privileges of burning by Permit and other uses of open fire within the City. In addition to suspension of open burning, the following restrictions also are hereby applied within the City of Lake Elsinore: Use of campfires is restricted to within established campfire facilities located in established campgrounds and beaches open to the public. 2. Cooking fires with a valid permit are permissive when no alternate means of cooking is available and requires an on-site inspection prior to the issuance of a Permit. 3. Warming fires are permissive when weather conditions exist to justify the request and require an on-site inspection prior to the issuance of a Permit. This order shall become effective at 1200 hours on August 12, 2009 and remain in effect until this proclamation is formally terminated. Vegetation clearance requirements in urban-wildland interface areas shall be in accordance with the International Wildland-Urban Interface Code. 304.1.3 Space underneath seats. Spaces underneath grandstand and bleacher seats shall be kept free from com- bustible and flammable materials. Except where enclosed in not less than 1-hour fire-resistance-rated construction in accordance with the California Building Code, spaces underneath grandstand and bleacher seats shall not be occu- pied or utilized for purposes other than means of egress. 304.2 Storage. Storage of combustible rubbish shall not pro- duce conditions that will create a nuisance or a hazard to the public health, safety or welfare. 304.3 Containers. Combustible rubbish, and waste material kept within a structure shall be stored in accordance with Sec- tions 304.3.1 through 304.3.3. 304.3.1 Spontaneous ignition. Materials susceptible to spontaneous ignition, such as oily rags, shall be stored in a listed disposal container. Contents of such containers shall be removed and disposed of daily. 304.3.2 Capacity exceeding 5.33 cubic feet. Containers with a capacity exceeding 5.33 cubic feet(40 gallons) (0.15 m3) shall be provided with lids. Containers and lids shall be constructed of noncombustible materials or approved com- bustible materials. 304.3.3 Capacity exceeding 1.5 cubic yards. Dumpsters and containers with an individual capacity of 1.5 cubic yards [40.5 cubic feet (1.15 m')] or more shall not be stored in buildings or placed within 5 feet (1524 mm) of combusti- ble walls, openings or combustible roof eave lines. Exceptions: 1. Dumpsters or containers in areas protected by an approved automatic sprinkler system installed throughout in accordance with Section 903.3.1.1, 903.3.1.2 or 903.3.1.3. 2. Storage in a structure shall not be prohibited where the structure is of Type I or HA construction, lo- cated not less than 10 feet (3048 mm) from other buildings and used exclusively for dumpster or container storage. SECTION 305 IGNITION SOURCES 305.1 Clearance from ignition sources. Clearance between ignition sources, such as luminaires, heaters, flame-producing devices and combustible materials, shall be maintained in an approved manner. 305.2 Hot ashes and spontaneous ignition sources. Hot ashes, cinders, smoldering coals or greasy or oily materials subject to spontaneous ignition shall not be deposited in a com- bustible receptacle, within 10 feet (3048 mm) of other combus- tible material including combustible walls and partitions or within 2 feet (610 mm) of openings to buildings. Exception: The minimum required separation distance to other combustible materials shall be 2 feet (610 nun) where 34 the material is deposited in a covered, noncombustible receptacle placed on a noncombustible floor, ground sur- face or stand. 305.3 Open-flame warning devices. Open-flame warning devices shall not be used along an excavation, road, or any place where the dislodgment of such device might permit the device to roll, fall or slide on to any area or land containing combustible material. 305.4 Deliberate or negligent burning. It shall be unlawful to deliberately or through negligence set fie to or cause the bum- ing of combustible material in such a manner as to endanger the safety of persons or property. SECTION 306 MOTION PICTURE PROJECTION ROOMS AND FILM 306.1 Motion picture projection rooms. Electric arc, xenon or other light source projection equipment which develops haz- ardous gases, dust or radiation and the projection of rib- bon-type cellulose nitrate film, regardless of the light source used in projection, shall be operated within a motion picture projection room complying with Section 409 of the California Building Code. 306.2 Cellulose nitrate film storage. Storage of cellulose nitrate film shall be in accordance with NFPA 40. SECTION 307 OPEN BURNING AND RECREATIONAL FIRES 307.1 General. A person shall not kindle or maintain or autho- rize to be kindled or maintained any open burning unless con- ducted and approved in accordance with this section. 307.1.1 Prohibited open burning. Open burning that is offensive or objectionable because of smoke or odor emis- sions or when atmospheric conditions or local circum- stances make such fires hazardous shall be prohibited. 307.2 Permit required. A permit shall be obtained from the fire code official in accordance with Appendix Chapter 1, Sec- tion 105.6 prior to kindling a fire for recognized silvicultural or range or wildlife management practices, prevention or control of disease or pests, or a bonfire. Application for such approval shall only be presented by and permits issued to the owner of the land upon which the fire is to be kindled. 307.2.1 Authorization. Where required by state or local law or regulations, open burning shall only be permitted with prior approval from the state or local air and water quality management authority, provided that all conditions specified in the authorization are followed. I 307.3 Extinguishment authority. The fire code official is authorized to order the extinguishment by the permit holder, another person responsible or the fire department of open burn- ing that creates or adds to a hazardous or objectionable situa- tion. 307.4 Location. FIRE CODE ORDINANCE NO. 1237 AN ORDINANCE OF THE CITY COUNCIL FO THE CITY OF LAKE ELSINORE, CALIFORNIA, REPEALING AND REENACTING CHAPTERS 15.02, 15.04, 15.20, 15.24, 15.36, 15.38, 15.56 OF THE MUNICIPAL CODE, ADOPTING BY REFERENCE THE 2007 EDITION OF THE (CCR, T-24), INCORPORATING: THE INTERNATIONAL BUILDING CODE, 2006 EDITION; THE UNIFORM PLUMBING CODE, 2006 EDITION; THE UNIFORM MECHANICAL CODE, 2006 EDITION; THE NATIONAL ELECTRICAL CODE, 2005 EDITION; THE INTERNATIONAL EXISTING BUILDING CODE, 2006 EDITION; THE INTERNATIONAL FIRE CODE, 2006 EDITION; AND AMENDING THOSE CALIFORNIA BUILDING STANDARDS AS IDENTIFIED HEREIN, THROUGH EXPRESS FINDINGS OF LOCAL NECESSITY WHEREAS, The City Council of the City of Lake Elsinore does ordain as follows: Section 1. Ordinance number 1087 is hereby repealed with the exception of chapters 15.08, 15.12, 15.16, which address abatement. of dangerous buildings, relocation of buildings, and housing code provisions respectively, and also with the exception of 15.04.020 B, C. D, and E, 15.20.020 B, 15.24.020 B, and 15.38.020 A; and their respective code sections which establish fees for building, mechanical, plumbing, and electrical fees respectively. These will remain in place un-amended and are not apart of the State Building Standards. Section 2. 15.04.010 Building Code -Adopted Except as provided in this chapter, those certain building codes known and designated as the California Building Code, 2007 Edition, including Appendix 1, Appendix 1, and Appendix J, based on the 2006 International Building Code as published by the International Code Council, with the amendments set forth in Section 15.04.020, shall become the building codes of the City for regulating the erection, construction., enlargement, alteration, repair, moving, removal, demolition, conversion; occupancy, equipment, use, height, area and maintenance of all buildings and/or structures in the City. The California Building Code and its appendix will be on file for public examination in the office of the Building Official and the office of the City. Clerk. All handling and drying of laundry must be inside with mechanical dryers or inside mobilehome trailer park if lines cannot be seen by anyone outside the trailer park. I. All facilities for sanitation, garbage, sewage and trash disposal and water supply shall be subject to such rules and regulations as the Health Officer shall determine. J. Trailer spaces must be at least forty feet wide with depth enough to allow for ten-foot front and rear setback. Trailer length includes length of hitch assembly. All cul-de-sacs are to be of sixty-foot radius, and all mobilehome parks must be served by separate ingress and egress roads of standard width and paving. (Ord. 410 § 7,1963) . 15.44.080 Enforcement. It shall be the duty of the Building Inspector to enforce all of the provisions of this chapter pertaining to construction, alteration and modification of all buildings, plumbing, electrical wiring, sewage _ disposal construction and gas piping, including appurtenances thereto within mobilehome parks. It shall be the duty of the Health Officer to enforce all of the provisions of this chapter pertaining to maintenance, operation, safety, sanitation and occupancy of mobilehome parks. Upon presentation of proper credentials, the Building Inspector, Fire Marshal, Health Officer, or the duly authorized representa- tive of any of them, may at reasonable time enter upon the premises of any mobilehome park to inspect the structures, sites and facilities, including the register of occupants, and to ascertain and require compliance with this chapter. (Ord. 1087 § 2 (part), 2002; Ord. 1051 § 2 (part), 1999) *Editor's Note: Chapter 15.48, Outdoor Commercial Advertising, previously contained herein, has been repealed in entirety by Ordinance No. 803.. *_Editor's Note: Previous ordinance history includes portions of Ordinance Nos. 1007, 944, 882 and 800. 1512 q nn q CC August 11262 Urd 47T 61? f STATE OF CALIFORNIA THE RESOURCES AGENCY DEPARTMENT OF FORESTRY AND FIRE PROTECTION PROCLAMATION SUSPENDING BURNING PERMITS AND OTHER USES OF OPEN FIRE Due to the extreme menace of destruction by fire to life, improved property or natural resources caused by critical fire weather and acute dryness of vegetation; and/or fire suppression forces being heavily committed to control fires; and, under authority vested in me by the Director of the Department of Forestry and Fire Protection as per section 4423.1 of the Public Resources Code, I hereby suspend, except within incorporated cities, the privileges of burning by permit and other uses of open fire in the geographic area described as: ALL STATE AND LOCAL RESPONSIBILITY AREA LANDS WITHIN THE COUNTY OF RIVERSIDE. In addition to suspension of open burning, the following restrictions also are hereby applied in the area cited above: 1. Use of campfires is restricted to within established campfire facilities located in established campgrounds open to the public. 2. Agricultural burning in the Palo Verde Valley and Coachella Valley is authorized as required for agricultural rehabilitation. 3. Cooking fires with a valid permit are permissive when no alternate means of cooking is available and requires an on-site inspection prior to the issuance of a permit. 4. Warming fires are permissive and require an on-site inspection prior to the issuance of a permit when weather conditions exist to justify the request. In accordance with section 4423.2 of the Public Resources Code, state officers having jurisdiction and authorized by the Director of Forestry and Fire Protection may issue restricted temporary burning permits whenever it can be shown that burning or use of open fire is essential for reasons of public health, safety, or welfare. This order shall become effective at 1200 his hours on July 8, 2009 and remain in effect until I formally terminate this proclamation. JOHN R.
