HomeMy WebLinkAboutCC Reso No 2006-150RESOLUTION NO. 2006-150 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING RESIDENTIAL DESIGN REVIEW NO. 2005-09 FOR THE VILLAGE AT LAKSHORE RESIDENTIAL CONDOMINIUMS. WHEREAS, Classic Pacific C/O Albert A. Webb has initiated proceedings to approve Residential Design Review No. 2005-09 for the project know as The Village at Lakeshore Residential Condominiums; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on August 15, 2006, made its report upon the desirability of the proposed project and made its recommendations in faeor of the project by adopting Planning Commission Resolution No. 2006-77 recommending to the City Council approval of Residential Design Review No. 2005-09; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Deparhnent and other interested parties at a public hearing held with respect to this item on September 12, 2006. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed project prior to making a decision to approve Residential Design Review No. 2005-09. The City Council finds and determines that Mitigated Negarive Declaration No. 2006-OS is adequate and prepared in accordance with the requirements of the California Environmental Quality Act (CEQA) which analyzes environmental effects of the Specific Plan and Residenrial Design Review. SECTION 2. That in accordance with State Planning and Zoning Law and the City of Lake Elsinore Municipal Code, the City Council makes the following findings for the approval of Residential Design Review No. 2005-09: 1. The project, as approved, will comply with the goals and objectives of the General Plan, and the Zoning District in which the project is located. The proposed Residential Design Review for a proposed attached single- family condominium comrnunity complies with the goals and objectives of CITY COUNCIL RESOLUTION NO. 2006 -150 PAGE 2 OF 4 the General Plan designation for this area, which is Village at Lakeshore Specific Plan. The Village at Lakeshore Specifzc Plan is intended for a wide range of residential development types including attached single family units. In addition, the designation permits a macimum density of twelve (12) dwelling units per acre. The project proposes 7.4 dwelling units per acre overall. The approval of this attached single family condomanium communaty wdll assist in achieving the development of a well balanced and functional mix of residential, limited commercial, limited industrial, open space, recreational and institutional land uses by providing additional housing within the City of Lake Elsinore, as well as encouraging the development and maintenance of a broad range of housing rypes for all income groups and age categories. It should be noted that the proposed dwelling units will incorporate "Spanish Colonial, Craftsman and Tuscan " style architecture that will provide a well rounded design while maintaining the desirable rural characteristics and base framework to achieve quality and compatibility in the physical design of the developing portions of the City. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Residential Design Review is appropriate to the site and surrounding developments in that the pYOject has provided a variety of setback, open space and landscape standards along with safe and efficient onsite vehicular circulation. Further, the project as proposed will complement the quality of existing development and will create a visually pleasing, non-detractive relationship between the proposed and existing projects in that the applicant is providing three different architectural styles which include: 360-degree architectural articulation pursuant to the "Village at Lakeshore Specific Plan ", arched elements, decorative ornamental features per the specific architectural style, and concrete tile roofs. In addition, the applicant is providing a variety of colors and materials. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Pursuant to Title 14 of the California Code of Regulations Section 15070, a mitigated negative declaration was prepared for this project. The mitigation CITY COLTNCIL RESOLUTION NO. 2006 -150 PAGE 3 OF 4 contained in the mitigated negative declaration, mitigation monitoring plan, and the conditions of approval for the project adequately mitigate all of the potentially significant environmental impacts identified in the initial study to a level of insignificance. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to LEMC Section 17.82.070 (Action of the Planning Commission), the proposed Residential Design Review has been considered and approved by the Planning Commission. The pYOposed project has also been conditioned to comply with the LEMC. For example, Condition of Approval Number Twenty-Five (#25) has been included which states that all site improvements shall be constructed as indicated on the approved site plan and elevations, with revision noted herein. The Applicant shall meet all required setbacks and development standards pursuant to the Medium Density development standards as mandated in the Village at Lakeshore Specific Plan. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
