HomeMy WebLinkAboutCC Reso No 2006-146RESOLUTION NO. 2006-146 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING RESIDENTIAL DESIGN REVIEW NO. 2005-25 FOR THE DESIGN, CONSTRUCTION AND ESTABLISHMENT OF A RESIDENTIAL CONDOMINIUM COMMiJNITY, TO BE LOCATED AT THE SOUTH SIDE OF WOODCREST DRIVE (APNS 379-341-015 AND 379-341-016). WHEREAS, Mr. Kevin Tran has initiated proceedings to approve Residential Design Review No. 2005-25 for the establishment of a residential condominium community; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on April 4, 2006 made its report upon the desirability of the proposed project and made its recommendations in favor of the project by adopting Planning Commission Resolution No. 2006-40 recommending to the City Council approval of Residential Design Review No. 2005-11; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Deparhnent and other interested parties at a public hearing held with respect to this item on September 12, 2006. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION l. The City Council has considered the proposed project priar to making a decision to approve Tentative Condominium Map No. 34309. The City Council finds and determines that this project is consistent with Section 16 "Subdivisions" of the Lake Elsinare Municipal Code (LEMC) and Section(s) 66424 and 66427 of the California Subdivision Map Act (CSMA) Government Code. The City Council finds and determines that the project is exempt from further environmental clearance under Class 3(b) exemption for New Construction or Conversion of Small Structures (14 Cal. Code of Regs ~ 15303) and a Class 16 exemption for Minor Land Divisions (14 Cal. Code of Regs. ~ 15315), as set farth in the California Environmental Quality Act (CEQA), which analyzes environmental effects of the Tentative Condominium Map and Residential Design Review. That in accordance with State Planning and Zoning law and the City of Lake Elsinore, the following findings far the approval of Residential Design Review No. 2005-25 have been made: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Residential Design Review located within Assessor Parcel Number(s) 379-341-015 AND 379-341-016, complies with the goals and objectives of the General Plan, in that the approval of this Condominium Community will assist in achieving the development of a well-balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses as well as encouraging industrial land uses to diversify Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Residential Design Review located at Assessor Parcel Number(s) 379-341-015 AND 379-341-016, is appropriate to the site and surrounding developments in that the Condominium project has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further the project as proposed will complement the qualiry of existing development and will create a visually pleasing, non-detractive relationship between the proposed and existing projects in that the architectural design, color and materials and site design proposed evidence a concern for quality and originality. 3. Subject to the attached Condirions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Pursuant to the California Environmental Qualiry Act (CEQA), the proposed Residentaal Design Review located at Assessor Parcel Number(s) 379-341-01 S AND 379-341-016, as reviewed and conditioned by all applicable City Divisions and Departments and Agencies is exempt from further environmental clearance under a Class 3(b) exemption for New Construction or Conversion of Small Structures (14 Cal. Code of Regs ~ 15303) and a Class 16 exemption for Minor Land Divisions (14 Cal. Code of Regs. ~ 15315) as set forth in the California Environmental Quality Act Guidelines. Conditions and safeguards pursuant to Chapter 17.82.060 of the Zoning Code, including guarantees and evidence of compliance with conditions, ha~e been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake Elsinore Municipal Code (LEMC), the proposed Residential Design Review for the Marina Village Condominiums was scheduled and considered for approval by the City Council. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
