HomeMy WebLinkAboutCC Reso No 2006-143RESOLUTION NO. 2006-143 A RESOLUTION OF THE CTTY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING TENTATIVE TRACT MAP NO. 34231, A ONE-LOT SUBDIVISION FOR CONDOMI1vIUM PURPOSES, ON APPROXIMATELY 13.81+ ACRES LOCATED AT THE SOUTHWEST CORNER OF ROSETTA CANYON DRIVE AND HIGHWAY 74, WITHIN THE RAMSGATE SPECIFIC PLAN, AND KNOWN AS ASSESSOR'S PARCEL NO. 347-120-047 WHEREAS, an application has been filed with the City of Lake Elsinore by MBK Homes to subdivide approximately 13.81± acres of unimproved property into one lot far condominium purposes; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council pertaining to the subdivision of land; and WHEREAS, the Planning Commission of the City of Lake Elsinore considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on August 1, 2006, and recommend the City Council approve Tentative Tract Map No.34231, subject to the 98 Conditions of Approval as revised by the Planning Commission and in accordance with Exhibit `F'; and WHEREAS, public norice of said application has been given, and the City Council has considered evidence presented by the Community Development Deparhnent and other interested parties at a public hearing held with respect to this item on August 22, 2006. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed Tentative Tract Map No. 34231 prior to making a decision to approve the proposal to subdivide approximately 13.81+ acres into one lot for CITY COiJNCIL RESOLUTION NO. 2006-143 Page 2 of 4 condominium purposes. Pursuant to Section 21080 (c)(2) of the Califomia Environmental Quality Act (CEQA), the City Council finds and deternlines that Addendum No. 3 to the Final Supplemental Environmental Impact Report (SCH No. 88090525) is adequate and prepared in accordance with the requirements of CEQA which analyzes environmental effects of the proposed proj ect. SECTION 2. That in accordance with State of California Subdivision Map Act and the City of Lake Elsinore Municipal Code the following findings for the approval of Tentative Tract Map No. 34231 are made: TENTATIVE TRACT MAP FINDINGS: 1. The proposed subdivision, together with the provisions for its design and improvements, is consistent with the City of Lake Elsinore General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). a. The design of the proposed map is for a one lot subdivision consistent with the Ramsgate Specific Plan Fourth Revision, and therefore with the General Plan. 2. The site of the proposed division of land is physically suitable for the proposed density of development in accordance with the General Plan. a. The General Plan encourages clustered development in order to facilitate the conservation of identified wildlife corridors and habitat. The project density and design is compatible with the apartments and community park under construction adjacent to it. b. The map provides open space areas that protect the natural topography and views. 3. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. CITY COUNCIL RESOLUTION NO. 2006-143 Page 3 of 4 a. The project is consistent with the City's General Plan. During the approval of City's General Plan, housing needs, public services and fiscal resources were scrutinized to achieve a balance within the City. b. The map has been conditioned to anne~ into Community Facilities District 2003-O1 to offset the annual negative fiscal impacts of the project on public safety operations and maintenance issues in the City. c. The map has been conditioned to annex into Lighting and Landscape Maintenance District No. 1 to offset the annual negative fiscal impacts of the project on public right-of-way landscaped areas to be maintained by the City, and for street lights in the public right-of-way for which the City will pay for electriciry and a maintenance fee to Southern California Edison. d. The map has been conditioned to form a Mello-Roos Community Facilities District to fund the on-going operation and maintenance of the new parks, parkways, open space and public storm drains constructed with in the development and federal NPDES requirements to offset the annual negative fiscal impacts of the project. 4. The design of the proposed division of land ar type of improvements is not likely to cause serious public health problems. a. Tentative Tract Map No. 34231 is conditioned to comply with all development standards of the Ramsgate Specific Plan Fourth Revision. These standards have been prepared and reviewed to benefit the public health, safery and welfare. 5. The design of the proposed division of land or the type of improvements will not conflict with easements, acquired by the public at large, for access tlu~ough or use of property within the proposed division of land. a. All known easements or requests for access have been incorporated into Tentative Ti-act Map No. 34231. CITY COUNCIL RESOLUTION NO. 2006-143 Page 4 of 4 b. The map has been circulated to City departments and outside agencies, and appropriate conditions of approval have been applied for their approval during construction. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
