HomeMy WebLinkAboutPC Reso No 2014-12RESOLUTION NO. 2014 -12 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF COMMERCIAL DESIGN REVIEW NO. 2014 -08, A REQUEST FOR THE INSTALLATION OF A 4,018 SQUARE -FOOT TENT AT THE CLUB HOUSE GREEN OF THE LINKS AT SUMMERLY GOLF COURSE LOCATED AT 29381 VILLAGE PARKWAY. (APN: 371 - 030 -038) WHEREAS, Brad Stormon (the "Applicant "), filed an application with the City of Lake Elsinore requesting approval of Commercial Design Review No. 2014 -08 ( "the Project "), and WHEREAS, the Applicant proposes a 4,018 square -foot tent on a portion of the property located on a 3.4 acre site at 29381 Village Parkway, also known as Assessor's Parcel No.'s 371 - 030 -038 (the "Site "); and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council pertaining to the Design Review of commercial projects; and WHEREAS, on April 15, 2014, at a duly noticed public hearing, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has considered the Commercial Design Review prior to making a decision to recommend approval of the proposed application. The Planning Commission finds that the Commercial Design Review satisfies all requirements set forth in Chapter 17.184 of the Lake Elsinore Municipal Code. SECTION 2. The Planning Commission hereby finds and determines that the Project is categorically exempt from the California Environmental Quality Act (Public Resources Code §§ 21000 et seq.: "CEQA ") and the Guidelines for Implementation of CEQA (14 California Code of Regulations §§ 15000 et seq.: "CEQA Guidelines ") pursuant to Section 15303 (Class 3) (e) (New Constructions) categorical exemption. SECTION 3. That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for the approval of Commercial Design Review 2014 -08: 1. The Project, as approved, will comply with the goals and objectives of the General Plan, and the Zoning District in which the Project is located. The Project complies with the goals and objectives of the General Plan because it will assist in achieving the development of a well balanced and functional mix of PLANNING COMMISSION RESOLUTION NO. 2014 -12 PAGE 2OF4 residential, commercial, industrial, open space, recreational, and institutional land uses. 2. The Project complies with the design directives contained in the General Plan and all other applicable provisions of the Lake Elsinore Municipal Code. The Project is appropriate to the site and surrounding developments in that the tent has been designed in consideration of the size and shape of the property. Sufficient setbacks and enhanced onsite landscaping have been provided thereby creating interest and varying vistas as a person moves along abutting streets and within the center. In addition, safe and efficient circulation has been achieved onsite. 3. Subject to the attached conditions of approval, the Project is not anticipated to result in any significant adverse environmental impacts. Notwithstanding the fact that the Project is exempt from CEQA provisions pursuant to a 15303 (Class 3)(e) (New Constructions) categorical exemption, the Project was reviewed and conditioned by all applicable City departments to ensure that the project blends into existing development, creates the least amount of disturbance, and does not negatively impact the residents or businesses of Lake Elsinore. The Project will not have a significant effect on the environment. 4. Conditions and safeguards pursuant to Chapter 17.184.070 of the Municipal Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Chapter 17.184. Pursuant to Section 17.184.070 of the Lake Elsinore Municipal Code, the Project was considered by the Planning Commission at a duly noticed public hearing on April 15, 2014. SECTION 4. Based upon the evidence presented, the above findings, and the attached Conditions of Approval, the Planning Commission hereby recommends that the City Council approve Commercial Design Review No 2014 -08. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED AND ADOPTED this 15th day of April 2014. MacHott, LEED Green Associate Planning Manager CONDITIONS OF APPROVAL COMMERCIAL DESIGN REVIEW NO. 2014-02 FOR A TENT AT THE GREEN OF THE LINKS AT SUMMERLY CLUB HOUSE GENERAL CONDITIONS The proposed project (Commercial Design Review No. 2014 -02) consists of the installation of a 4,018 square foot tent at The Club House green of The Links at Summerly golf course located at 29381 Village Parkway. 2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the Conditional Use Permit project attached hereto.. PLANNING DIVISION 3. Design Review approval for the Commercial Design Review will lapse and be void unless a building permit is issued within one (1) year of the approval date. 4. Within 30 days of project approval, the applicant shall sign and complete an Acknowledgement of Conditions," and shall return the executed original to the Community Development Department for inclusion in the case records. 5. The applicant shall submit a check in the amount of $50.00 made payable to the County of Riverside for filing of a Notice of Exemption. The check shall be submitted to the Planning Division for processing within 48 hours of the project's approval 6. All conditions of approval shall be reproduced upon page one of building plans submitted to the Building and Safety Division for Plan Check. All conditions of approval shall be met prior to the issuance of a Certificate of Occupancy and release of utilities. 7. All site improvements shall be constructed as indicated on the submitted plans. The applicant shall meet all required development standards as indicated by the Commercial Design Guidelines and the Lake Elsinore Municipal Code (LEMC). Any other revisions to the approved site plan or building elevations shall be subject to the review of the Community Development Director or his designee. All plans submitted for Building Division Plan Check shall conform to the submitted plans as modified by the conditions of approval. 8. All materials and colors depicted on the plans shall be used. If the applicant wishes to modify any of the approved materials or colors depicted on the plans, the applicant shall submit a proposal setting forth the modifications for review by the Community Development Director or his designee. The Applicant shall comply with all applicable City codes and ordinances. 10. Any exterior air conditioning or other mechanical equipment shall be ground mounted and screened so as to be invisible from neighboring property or public streets. Air conditioning units and related equipment may not encroach more than two -feet (2) into the required minimum side yard setback. 11. The Applicant shall satisfy all conditions of approval prior to the issuance of a Certificate of Occupancy and use of the tent for any activities. 11a Two -Year Review - The applicant acknowledges that the proposed tent is temporary in nature and has a limited life expectancy shorter than a traditional permanent structure. On that basis the Community Development Director or designee shall periodically review the condition of the tent and compliance with the conditions of approval. If the applicant has not submitted a complete application fora permanent structure to replace the tent within two years of the issuance date of the Certificate of Occupancy, the Planning-Commission shall review the design and condition of the tent and shall make one of the following findings: (i) the tent must be removed within a specific time period; ii) the tent must be modified and the tent can be maintained for a specified period of time in its existing location; or NO the tent can be maintained in its existing condition for a specified period of time in its existing location. (Added by Planning Commission at its hearing on April 15, 2014.) BUILDING DEPARTMENT PRIOR TO BUILDING PERMITS 12. All construction plans must be in accordance with the 2013 building codes and ADA requirements. 13. Prior to issuance of building permits, the applicant shall provide assurance that all requirements of the City of Lake Elsinore Fire Marshal have been met. 14. Prior to issuance of building permits, the applicant shall pay all appropriate fees. CITY OF LAKE ELSINORE FIRE MARSHAL GENERAL CONDITIONS Planning Commission Page 2 of 6 April 15, 2014 CONDITIONS OF APPROVAL FOR COMMERCIAL DESIGN REVIEW NO. 2014-01 FOR A TENT AT THE GREEN OF THE LINKS AT SUMMERLY CLUB HOUSE 15. Lake Elsinore Fire Protection Planning Office Responsibility- It is the responsibility of the recipient of these Fire Department conditions to forward them to all interested parties. The permit number (as it is noted above) is required on all correspondence. Questions should be directed to the Riverside County Fire Department, Lake Elsinore Fire Protection Planning Division at 130 S. Main St., Lake Elsinore, CA 92530. Phone: 951) 671 -3124 Ext. 225. The following fire department conditions shall be implemented in accordance with the Lake Elsinore Municipal Code and the adopted codes at the time of project building plan submittal, these conditions are in addition to the adopted code requirements. 16. Electrical Wiring- Electrical wiring shall be in accordance with the National Electrical Code. 17. Decorative Materials- All decorative materials (decorations, drapes, backdrops, and props) shall be either inherently flame retardant or labeled as such or shall be treated with a flame retardant that is registered with the California State Fire Marshal. 2404.7 PRIOR TO BUILDING PERMIT ISSUANCE 18. Plan Check Fee- Building plan check fee made payable to The City Lake Elsinore, and shall be submitted to the Fire Department at time plans are submitted to our office(s). Any inspections to be performed shall include the appropriate fees based on the inspection type. PRIOR TO BUILDING FINAL INSPECTION 19. Designated Fire Lanes- The applicant shall prepare and submit to the Fire Department for approval, a site plan designating required fire lanes with appropriate lane painting and/ or signs. 20. Tents- Tents in excess of 400 square feet shall obtain approval from the fire department. a. Detailed Site Plan- Detailed interior site plans shall be provided where a tent has a potential occupant load of over 50 persons on ever tent within this criteria. The floor plan shall include a detailed means of egress plan, seating capacity, arrangement of the seating and location and type of heating and electrical equipment. FLOOR PLAN DOES NOT DETAIL THE WIDTH OF THE REQUIRED EXITS AS REQUIRED BY THE 2013 CALIFORNIA FIRE CODE. Exits- Exits shall be provided to where all points are 100 feet or less from an exit. Exit signs shall be provided at all exits where the occupant load exceeds 50. C. Exit sign Illumination- Exit signs shall be either listed and labeled in accordance with UL 924 as the internally illuminated type and used in accordance with the listing or shall be externally illuminated by luminaires supplied in accordance with section 2403.12.6.1. d. Means of Egress Illumination- Means of egress shall be illuminated with light having an intensity of not less than 1 foot - candle (11 lux) at floor level while the structure is occupied. Fixtures required for means of egress illumination shall be supplied from a separate circuit or source of power. e. No Smoking signs- No Smoking shall be allowed inside of tents and the tents shall be posted with "No Smoking" signs. f. Maintenance of means of egress- The required width of exits, aisles and passageways shall be maintained at all times to a public way. Guy wires, guy ropes and other support members shall not cross a means of egress at a height of less than 8 feet (2438 mm). The surface of means of egress shall be maintained in an approved manner. 21. Fire Break- An unobstructed fire break passageway or fire road not less than 12' wide and free from guy ropes or other obstruction shall be maintained on all sides of all tents and membrane structures. 22. [California Code of Regulations, Title 19, Division 1, §315.(a)] Flame Resistance Standards. a) All tent fabrics and all interior decorative fabrics or materials shall be flame resistant in accordance with appropriate standards set forth in California Code of Regulations, Title 19, Division 1, Chapter 8. Tent tops and sidewalls shall be made either from fabric which has been flame resistant treated with an approved exterior chemical process by an approved application concern, or from inherently flame resistant fabric approved and listed by the State Fire Marshal. 23. Label- Membrane structures or tents shall have a permanently affixed label bearing the identification of size and fabric or material type. Certification. An affidavit or affirmation shall be submitted to the fire code official and a copy retained on the premises on which the tent or Planning Commission Page 4 of 6 April 15, 2014 CONDITIONS OF APPROVAL FOR COMMERCIAL DESIGN REVIEW NO. 2014 -01 FOR A TENT AT THE GREEN OF THE LINKS AT SUMMERLY CLUB HOUSE air - supported structure is located. The affidavit shall attest to the following information relative to the flame propagation performance criteria of the fabric: 1. Names and address of the owners of the tent or air - supported structure. 2. Date the fabric was last treated with flame- retardant solution. 3. Trade name or kind of chemical used in treatment. 4. Name of person or firm treating the material. 5. Name of testing agency and test standard by which the fabric was tested. Planning Commission Page 5 of 6 April 15, 2014 CONDITIONS OF APPROVAL FOR COMMERCIAL DESIGN REVIEW NO. 2014 -01 FOR A TENT AT THE GREEN OF THE LINKS AT SUMMERLY CLUB HOUSE California Code of Regulations, Title 19, Division 1, §315.(d)] Flame Resistance Standards. d) Certificates of flame resistance or other documentation affirming the requirements of California Code of Regulations, Title 19, Division 1, Section 315, Subsection (a) shall be made available upon request of the enforcement authority. 24. Knox Rapid Entry Box- A rapid entry Knox Box shall be installed on the outside of the building. If a Knox box has already been installed provide keys to the tenant space for inclusion in the main building Knox Box. Key(s) shall have durable and legible tags affixed for identification of the correlating tenant space. Special forms are available from this office for ordering the Knox Box. If the building /facility is protected with a fire alarm or burglar alarm system, it is recommended that the lock box be "tamper" monitoring. 25. Fire Extinguishers — Minimum Install portable fire extinguishers complying with Section 906 of the 2010 California Fire Code with a minimum rating of 2A -1013C and signage. Fire Extinguishers located in public areas shall be in recessed cabinets mounted 48" inches) to center above floor level with maximum 4" projection from the wall.
