Prior to installation, placement of markers must be approved by the Riverside County Fire Department . 10 . FIRE. 4 SMP*-#23-MIN REQ FIRE FLOW DRAFT Minimum required fire flow shall be 0 GPM for a hour duration at 20 PSI residual operating pressure, which must be available before any combustible material is placed on the job site . Fire flow is based on type construction per the 1997 UBC and Building (s) having a fire sprinkler system. 10 .FIRE . 5 SMP-#20-SUPER FIRE HYDRANT DRAFT Super fire hydrants (s) (6"x4"x2 1/211x2 1/2 " ) shall be located not less than 25 feet or more than 165 feet from any portion of the building as measured along approved vehicular travel ways . 80 . The waiting room , I am going to install hanging blinds from the ceiling, the same kind they have at hospitals. since there isnt a whole lot of room, I wont be adding any walls to change the structure of the room.Just privacy blinds and / or cubicle style walls that can be moved to accomidate any situation. The back door is going to be posted "Private" and will not be an entrance or exit for public use. (APN 363-172-018). PROJECT DESCRIPTION The applicant is requesting a Conditional Use Permit for the operation of a full-service tattoo and piercing salon. The applicant is proposing to lease an approximately 400 square foot area of the adjacent Attitudes Salon. The tattoo salon will have a separate entrance,waiting area, and work area. The proposed hours of operation are Tuesday to Saturday from 11:00 am to 10:00 pm. The business will have 1-2 full-time employees. The applicant anticipates 1-5 clients per artist per day. DISCUSSION This project is located within a C-2 (General Commercial) Zoning district. The Lake Elsinore Municipal Code (LEMC) does not list "tattoo parlor" as a permitted use. However, Section 17.48.030 (I) of the LEMC provides for mechanisms by which an applicant of a use that is not listed as permitted can be provided with the opportunity to apply for a permit via a conditional use permit provided certain findings can be made. Because the California Penal Code Section 653 states that it is unlawful to tattoo anyone under the age of eighteen, it was determined that the operational characteristics of tattoo studios are similar to those uses that are only allowed by conditional use permit such as bars, cocktail lounges, and adult entertainment businesses which have similar prohibitions regarding serving the underage. Therefore, a CUP would provide the appropriate process to analyze what impacts a tattoo parlor may have on a certain area. As stated above, California Penal Code states that it is unlawful to perform tattooing services to anyone under the age of eighteen. It is therefore important to discourage the establishment of tattoo studios in areas frequented by minors. Staff has surveyed the businesses in the same shopping center and did not find any sensitive receptors. As a precautionary measure, staff has recommended that the windows of the work area be tinted and blinds be installed so that pedestrians will not be able to look into the tattoo and piercing work area. In addition, the applicant will be installing privacy curtains around the individual work areas. The applicant will also be posting a sign of sufficient size at the window and inside the studio alerting potential customers that California Penal Code Section 653 states that it is unlawful to tattoo anyone under the age of eighteen; therefore, minors are not allowed within the premises. The applicant will also be encouraged to discourage loitering outside the premises at all times. Tattoo salons are required to be registered with the County Department of Environmental Health. Staff has included a condition that would require the applicant register with the County. Staff contacted the Police Department and has not received any comments. Below and attached are a detailed description of our proposed business practices. We operate 5 days a week. 11 am to 10 pm Tuesday to Saturday. Initially we plan to have one employee full time and eventually 2 full time employees. During the normal course of a business day, we anticipate to have from 1- 5 clients Per artist, per day. The average time per client would be 2 hours. We have a large parking lot with 62 spaces that we share with various other businesses in the surrounding area. A personal survey of the parking lot shows that an average of 32 spaces are used during normal business hours. We are applying to be a full service tattoo and piercing salon. Tattoo services would be available to adults 18 years of age and older with Proper Legal Identification.
