RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING
RESIDENTIAL DESIGN REVIEW NO. 2004-24, FOR THE
DEVELOPMENT OF FOUR RESIDENTIAL DUPLEX UNTTS
LOCATED ON THE EAST SIDE OF GRAHAM AVENUE
ASSESSOR PARCEL NUMBER(S) 373-046-006 THRU 373-046-
009.
WHEREAS, Philip McElhinney, has initiated proceedings to obtain
approval of Residential Design Review No. 2004-24 for the approval of four (4)
residenrial tri-level duplexes located on separate lots; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a
regular meeting held on May 16, 2006; made its report upon the desirability of the
proposed project and made its recommendations in favor of the project by adopting
Planning Commission Resolution No. 2006-52 recommending to the City Council
approval of Residential Design Review No. 2004-24; and
WHEREAS, Philip McElhinney submitted a request for reconsideration
pursuant to City Council Policy No. 100-SA following the City Council's denial of
Residential Design Review No. 2004-24 on June 13, 2006 which request was
granted by the City Council on July 25, 2006; and
WHEREAS, public notice of City Council reconsideration of Residential
Design Review No. 2004-24 has been given, and the City Council has considered
evidence presented by the Community Development Department and other
interested parties at a public meeting held on August 8, 2006.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. The City Council has reconsidered the proposed project prior
to making a decision to approve Residential Design Review No. 2004-24. The
City Council finds and determines that the proposed project is categorically exempt
from California Environmental Quality Act (CEQA) pursuant to Section I5303(b);
(New Construction of Small Structures). Therefore, no additional environmental
clearance is necessary.

SECTION 2. That in accordance with State Planning and Zoning law and
the City of Lake Elsinore Municipal Code ("LEMC), the following findings for the
approval of Residential Design Review No. 2004-24 have been made:
1. The project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the project is located.
The proposed Residential Design Review located within Assessor Parcel
Number(s) 373-046-006 through 373-046-009, complies with the goals and
objectives of the General Plan, in that the approval of this Residential Design
Review will assist in achieving the development of a well-balanced and
functional mix of residential, commercial, industrial, open space, recreational
and institutional land uses as well as encouraging industrial land uses to
diversify Lake Elsinore's economic base.
2. The project complies with the design directives contained in LEMC Section
17.82.060 and all other applicable provisions of the LEMC.
The proposed Residential Design Review located at Assessor Parcel Number(s)
373-046-006 through 373-046-009, is appropriate to the site and surrounding
developments in that the Residential Design Review project has been designed
in consideration of the size and shape of the property, thereby creating interest
and varying vistas as a person moves along the street. Further the project as
proposed will cornplement the quality of existing development and will create a
visually pleasing, non-detractive relationship between the proposed and
existing projects in that the architectural design, color and materials and site
design proposed evidence a concern for quality and originality.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Pursuant to the California Environmental Quality Act (CEQA), Section
I5303(b); (New Construction of Small Structures), the proposed Residential
Design Review located at Assessor Parcel Number(s) 373-046-006 through
373-046-009, as reviewed and conditioned by all applicable City Divisions and
Departments and Agencies, will not have a significant effect on the
environment.
4. Conditions and safeguards pursuant to LEMC Chapter 17.82.060, including
guarantees and evidence of compliance with conditions, have been incorporated
into the approval of the subject project to ensure development of the property in
accordance with the objectives of LEMC Chapter 17.82.

Pursuant to Section 17.82.070 (Action of the Planning Commission) of the Lake
Elsinore Municipal Code (LEMC), the proposed Residential Design Review for
the four (4), tri-level Duplex Development was considered by the Planning
Commission and recommended for City Council approval.
SECTION 3. Based on the recommendation of the Planning Commission,
the written and verbal staff reports and testimony presented, the City Council of
the City of Lake Elsinore, California, hereby approves Residential Design Review
No. 2004-24 subject to the conditions set forth in the staff report.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.
PASSED, APPROVED AND ADOPTED this 8t" day of August 2006, by
the following vote:
