HomeMy WebLinkAboutTuscany Hills Mello-Roos tax (CDF 90-2)From:Timothy J. Sheridan To:Joe Nelson Cc:Jason Simpson; Jovanny Huerta Subject:Re: [External]Tuscany Hills Mello-Roos tax (CDF 90-2) Date:Thursday, November 21, 2024 2:55:20 PM Hello sir - Here are the answers to your questions: Can you please let me know how the city is addressing Mr. Kilroy's inquiry? As I noted yesterday, Mr. Kilroy reached out about CDF issue on Friday, November 8, 2024. I responded to him that very day. I told him that I would look into the matter and respond back. On Thursday, November 14, 2024, I independently reached out to him again and said that I was still awaiting information on the issue. Yesterday morning, Wednesday, November 20, he emailed me again. I responded and indicated that we were still working on it. Late yesterday afternoon, Wednesday, November 20, I received information that he was correct. I sent him an email informing him. Afterward, I told you as well. All told, from the time that the issue was brought to our attention, until yesterday when we completed our review of the inquiry and responded back to Mr. Kilroy, it took just 8 business days. While we never want to see issues like this arise, we worked diligently and quickly to address the issue. Please keep in mind that our inquiry included working with the City’s Tax Administrator, which is a separate company, and the County as well. Was a mistake by the city and its staff made? There was a mistake made somewhere along the way. However, as soon as learned about it, we began the process of addressing it. As noted above, we got to the correct resolution within 8 business days. If so, will the City Council need to rescind this action taken on June 25? If so, when? No, the City Council, as the Successor Agency to the Redevelopment Agency, is required by the county of Riverside to provide a certified Resolution to the County each year to confirm special taxes for the property tax roll for CFD No. 90-2. We did this year on June 25, 2024. Since it is the original Ordinance adopted on December 11, 1990 that provides for the authorization of the levy and adjustments, we do not need to take any further action on the Resolution. Equally importantly, it is important to recognize that the Resolution did not create a new tax. It was considered and passed to meet County requirements only. Ordinance No. RDA 1 entitled "An Ordinance of the Governing Board of the Redevelopment Agency of the City of Lake Elsinore Levying Special Taxes Within the Redevelopment Agency of the City of Lake Elsinore Community Facilities District No. 90-2 Tuscany Hills Public Improvements)", was adopted on December 11, 1990. How much of this tax has the city already collected from these affected residents? I am told that four homeowners have already paid the tax. All told, 424 homeowners received incorrect tax bills. They will all receive new tax bills in the very near future. I am also told that the updated tax bills for the homeowners in question are already online. Will they be refunded whatever they may have paid? The four homeowners that have already paid the tax will receive a refund. I do not know the timeline for the refunds as I write this. However, I am awaiting additional information so that I can fully understand what happened before I do so. With that said, and because I have now informed Mr. Kilroy, I can also say that he was correct. There are a number of homeowners who will be receiving revised tax bills and refunds if the homeowners in question have already paid the tax bill. As noted above, as soon as I receive a briefing on the matter, I will respond back. Good afternoon! I am a reporter for the Southern California News Group. I write mainly for The Press Enterprise, San Bernardino Sun and Inland Valley Daily Bulletin. I spoke to Mr. Pat Kilroy, a Tuscany Hills resident, today. He said his latest property tax bill included a fee of $2,163.38 for the CFD 90-2 Mello- Roos tax levied by the city in 2007 for infrastructure improvements in the Tuscany Hills housing tract. According to the city's annual report, this tax matured on Oct. 1, 2024. But on June 25, 2024, the City Council approved a tax levy of $885,115.10 on 424 Tuscany Hills' residents. However, according to the city annual report's debt service schedule, it shows no payments were due on this tax after Oct. 1, 2024, as it came to maturity. Mr. Kilroy said he reached out and spoke to Councilmember Timothy Sheridan and the City Clerk about two weeks ago on this issue, but hasn't been provided any update on what the city is doing or plans to do in following up on his inquiry. He said he plans to attend Tuesday's City Council meeting to address this, and is circulating a letter to neighborhood residents informing them of the issue and Tuesday's Council meeting. Questions: Can you please let me know how the city is addressing Mr. Kilroy's inquiry? Was a mistake by the city and its staff made?
