(PA 2023-24, TPM No. 38825) Page 2 of 4 1 3 6 3 Planning Commission Action On July 16, 2024, the Planning Commission conducted a duly noticed Public Hearing and recommended approval of the project to the City Council with a 4-0 vote including exempting the project from the Drainage District Fee and 2015-2 Community Facilities District (CFD) fees. No members of the public spoke on record at the meeting. Project Location and Description The project includes an existing 74.72-acre vacant, undeveloped area that consists of 24 parcels and is located within Planning Area 8 (Action Sports, Tourism, Commercial, and Recreation; Mixed Use Overlay) of the East Lake Specific Plan (ELSP). The subject parcels are generally located on the southern side of Lakeshore Drive, west of Lucerne Street, and southeasterly of the intersection of South Main Street and Lakeshore Drive and consists of Assessor Parcel Numbers (APNs) 373-330-001 through 022 and 373-300-038 through 041. Tentative Parcel Map (TPM) No. 38825 is a proposed subdivision of an existing 74.72-acre property to create three (3) new parcels that are 4.74 acres, 19.99 acres, and 49.99 acres, respectively, for conservation purposes. The property will undergo a rehabilitation process to create a restored natural, protected habitat native to the Lake Elsinore area, which will allow for the creation of a mitigation bank. A mitigation bank is a privately or publicly owned land managed for its natural resource value. Once established, the mitigation bank can be used by developers to purchase “credits” in order to satisfy regulatory agencies’ (such as California Department of Fish and Wildlife) legal requirements for mitigating a development project’s environmental impacts on sensitive habitats and resources. By doing so, it allows for more potential development projects to occur in the future in the City especially since currently there are limited mitigation banks available within the Riverside County region. Discussion General Plan and Municipal Code Consistency The project site is located within Planning Area 8 of the East Lake Specific Plan (ELSP) and has Action Sports, Tourism, Commercial, and Recreation with a Mixed Use Overlay. The land use regulations, including development standards for Planning Area 8 are derived from Chapter 2.5 of the ELSP. Allowable uses in Planning Area 8 include bars or cocktail lounges, hotels, passive open spaces, and natural areas or preserves. Planning Area 8 does not have minimum lot size requirements for a newly created parcel. However, it does require newly created parcels to have a minimum width of 100 feet. The three proposed parcels would establish natural areas and preserves for conservation easement purposes and have lot widths that exceed the minimum requirement. Therefore, the proposed project complies with the ELSP development standards for Planning Area 8. The project is also consistent with the General Plan because the ELSP was found to be consistent with the General Plan at adoption. (PA 2023-24, TPM No. 38825) Page 3 of 4 1 3 6 3 The proposed subdivision also complies with Chapter 16.24 (Tentative Map) of the Lake Elsinore Municipal Code and the Subdivision Map Act. Furthermore, the Design Review Committee, which includes staff from Planning, Building and safety, Fire Prevention, and Engineering, has reviewed the proposed project and added recommended conditions of approval to ensure compliance with adopted plans, policies, and regulations. Drainage District and Community Facilities Fees The project is located within the Lake Zone of the Master Drainage Plan (MDP) and is subject to the Drainage District Fee, as established by Chapter 16.72 of the Lake Elsinore Municipal Code (LEMC). Prior to the approval of any final subdivision map or parcel map within any drainage district designated in the master plan of drainage, the applicant is required to pay the drainage fee. In addition to the drainage fee, the project is also subject to the Traffic Infrastructure Fee pursuant to LEMC Section 16.74.040. However, the proposed project does not involve any new structures or land uses that will have an impact on drainage facilities or generate additional new traffic. Therefore, the applicant requests to be exempt from the Drainage District and Traffic Infrastructure Fees. Further, Engineering Department and Planning Division staff contend that the intended end use of the site may not apply to either fee and the project should be exempted from the requirement. The project is also located within the 2015-2 Community Facilities District (CFD) – Maintenance Services, as designated by Ordinance No. 1359. The City requires project applicants to initiate annexation into the CFD and make a non-refundable deposit of $15,000 or at the current rate in place at the time of annexation prior to issuance of a grading permit. However, the project does not propose any new public facilities or right-of-way improvements that the City must maintain. As such, the applicant also requests to be exempt from the 2015-2 CFD non-refundable deposit which staff also concurs with. Since these fees were adopted and established by the City Council, only the City Council has the authority to consider the requested fee exemptions. As part of their recommendation to the City Council, the Planning Commission approved staff’s recommendations to exempt these specific fee requirements. Further, the project will not be required to pay a Transportation Uniform Mitigation Fee (TUMF) since the project will not create new vehicular trips and proposes no new development. Environmental Determination Staff recommends that the City Council find the project exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15315 (Minor Land Divisions) and Section 15304 (Minor Alterations to Land). Class 15 consists of the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous 2 years, and the parcel does not have an average slope greater than 20 percent. TPM No. 38825 is a subdivision of an (PA 2023-24, TPM No. 38825) Page 4 of 4 1 3 6 3 existing property into three (3) new parcels for conservation easements. The subject site is zoned Specific Plan (SP) and is located in a location that meets the definition of an urbanized area as set forth in Section 21071(a)(2) of the Public Resources Code. The project is consistent with the General Plan and zoning and does not require a variance or an exception. All necessary services and access to the property are available. The parcels were not involved in a division of a larger parcel within the previous 2 years. The parcels were created in 2008 (TR 31839). The parcels are relatively flat and have no average slope of over 20 percent. Class 4 consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes. The project does not include the removal of healthy, mature, or scenic trees and proposed improvements are limited to micro grading to restore natural habitats. MSHCP Consistency The project has been reviewed for consistency with the Western Riverside County Multiple Species Habitat Conservation Plan (MSHCP). The project site is within the MSHCP Elsinore Area Plan – Criteria Cells #4740 and #4742. On May 14, 2008, the Western Riverside County Regional Conservation Authority (RCA) completed the Joint Project Review (JPR #06-03-08-01) process and concluded that the project was consistent with the Criteria and other plan requirements of the MSHCP. On August 3, 2023, the RCA authorized an amendment to JPR #06-03-08-01 to amend the original JPR Proposed Project Boundary to omit parcels acquired by a separate entity for a new JPR process. After the amendment, the project remained consistent with the Criteria and other plan requirements of the MSHCP. Public Notice Notice of the hearing for this application has been published in the Press-Enterprise newspaper and mailed to property owners within a 300-foot radius of the subject property. As of the writing of this report, no written comments concerning this application have been received by staff. Fiscal Impact The time and costs related to processing this application have been covered by application fees paid for by the applicant. No General Fund budgets have been allocated or used in the processing of this application. Attachments Attachment 1 – MSHCP Resolution Attachment 2 – TPM Resolution Attachment 3 – Conditions of Approval Attachment 4 – GIS Exhibits Attachment 5 – TPM No. 38825 Attachment 6 – Public Notice Materials RESOLUTION NO. 2024-__ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING FINDINGS THAT PLANNING APPLICATION NO. 2023- 24 (TENTATIVE PARCEL MAP NO. 38825) IS CONSISTENT WITH THE WESTERN RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP) Whereas, Patrick Brown, WatersEdge Elsinore, has filed an application with the City of Lake Elsinore (City) requesting approval of Tentative Parcel Map No. 38825 to subdivide an existing 74.72-acre property into three (3) new parcels that are 4.74 acres, 19.99 acres, and 49.99 acres, respectively, for conservation purposes. The project is located on the southern side of Lakeshore Drive, west of Lucerne Street, and southeasterly of the intersection of South Main Street and Lakeshore Drive (APNs: 373-330-001 through 022 and 373-300-038 through 041); Whereas, Section 6.0 of the Multiple Species Habitat Conservation Plan (MSHCP) requires that all discretionary projects within a MSHCP Criteria Cell undergo the Lake Elsinore Acquisition Process (LEAP) and the Joint Project Review (JPR) to analyze the scope of the proposed development and establish a building envelope that is consistent with the MSHCP criteria; Whereas, Section 6.0 of the MSHCP further requires that the City adopt consistency findings demonstrating that the proposed discretionary entitlement complies with the MSHCP Criteria Cell, and the MSHCP goals and objectives; Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to tentative maps; Whereas, on July 16, 2024, at a duly noticed Public Hearing the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item, and by a resolution recommended that the Council adopt Findings of Consistency with the MSHCP; and Whereas, on August 27, 2024, at a duly noticed Public Hearing the Council has considered the recommendation of the Commission as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: The forgoing recitals are true and correct and are hereby incorporated into these findings by this reference. Section 2: The Council has considered the project and its consistency with the MSHCP and the recommendation of the Commission as well as evidence presented by the Community Development Department prior to adopting Findings of Consistency with the MSHCP. Section 3: That in accordance with the MSHCP, the Council makes the following findings for MSHCP consistency: CC Reso. No. 2024-____ Page 2 of 6 3 7 6 5 4 1. The Project is a project under the City’s MSHCP Resolution, and the City must make an MSHCP Consistency finding before approval. The project site is within the MSHCP Elsinore Area Plan – Criteria Cells #4740 and #4742. Pursuant to the City’s MSHCP Resolution, the project has been reviewed for MSHCP consistency, including consistency with “Other Plan Requirements.” These include the Protection of Species Associated with Riparian/Riverine Areas and Vernal Pool Guidelines (MSHCP, § 6.1.2), Protection of Narrow Endemic Plant Species Guidelines (MSHCP, § 6.1.3), Additional Survey Needs and Procedures (MSHCP, § 6.3.2), Urban/Wildlands Interface Guidelines (MSHCP, § 6.1.4), Vegetation Mapping (MSHCP, § 6.3.1) requirements, Fuels Management Guidelines (MSHCP, § 6.4), and payment of the MSHCP Local Development Mitigation Fee (MSHCP Ordinance, § 4). 2. The Project is subject to the City’s LEAP and the Western Riverside County Regional Conservation Authority’s (RCA) Joint Project Review (JPR) processes. The entire project site is located within Criteria Cells #4740 and #4742, which are in MSHCP Elsinore Area Plan, Subunit 3 (Elsinore). Therefore, a formal and complete LEAP application, LEAP 2005-14 was submitted to the City in 2005. The JPR (JPR-06-03-08-01) process with RCA was completed on May 14, 2008. On August 3, 2023, the RCA amended JPR-06-03-08- 01 to delete three parcels totaling 9.86 acres and reducing the total acreage covered by this JPR to 168.13 acres. 3. The Project is consistent with the Riparian/Riverine Areas and Vernal Pools Guidelines. In March 2008, Harmsworth Associates conducted field surveys of the site to determine whether the project site includes riparian/riverine area or vernal pools. The site includes approximately 123 acres of MSHCP riparian/riverine areas: 57.96 acres are associated with the proposed development sites and 65.69 acres with riparian/riverine resources on the Enhancement Site. The project area reportedly does not include vernal pools or fairy shrimp habitat, nor will the project reportedly impact any watershed for nearby vernal pools. Marginal quality foraging habitat exists on the site for Least Bell’s vireo and willow flycatcher. However, these species were not found on the site during focused surveys. The project would result in the permanent loss of all 57.96 acres of riparian/riverine areas associated with the development sites and 51.4 acres of temporary impacts to riparian/riverine areas associated with the Enhancement Site. The majority of this riparian/riverine habitat is low quality tamarisk scrub, with 0.18 acre being low quality willow riparian scrub. Under the Functional Assessment prepared by Harmsworth, these 57.96 acres of low-quality riparian habitat are equivalent to 9.1 acres of high-quality riparian habitat. The applicant is proposing to mitigate these impacts using the functional equivalent acres at a ratio of 2:1, thus a minimum of 18.2 acres of mitigation on the Enhancement Site. However, the proposed mitigation site, the Enhancement Site, also currently supports low quality riparian/riverine habitat that would be impacted by the mitigation. Specifically, 51.4 of 65.69 acres of low quality riparian/riverine habitat on the Enhancement Site would be temporarily impacted by the proposed mitigation. Under the Functional Assessment, every acre to be mitigated for on the Enhancement Site shall be multiplied by 1.27 acres. Therefore, with a 2:1 mitigation ratio, as well as the 1.27 multiplier to account for existing low-quality riparian/riverine habitat at the mitigation site, the CC Reso. No. 2024-____ Page 3 of 6 3 7 6 5 4 applicant is proposing a minimum of 23.2 acres of high quality riparian habitat as mitigation on the Enhancement Site under the MSHCP. The proposed 23.2 acres would ultimately, with mitigation and monitoring, provide higher functions and values for target MSHCP species than what exists currently. The applicant is also proposing to enhance 14.5 acres of poor-quality riparian vegetation with tamarisk removal and habitat enhancement as mitigation for temporary impacts to the Enhancement Site. The applicant is planning to remove and control tamarisk scrub on an additional 27.2 acres of the Enhancement Site. The current project applicant would be responsible for implementation of the mitigation plan for the Enhancement Site. The mitigation plan would provide for the establishment of high-quality riparian vegetation communities, such as willow-cottonwood woodland, willow riparian scrub, wetland ponds, and emergent marsh vegetation communities. Implementation of the mitigation plan would be subject to wetlands regulatory agencies’ review and approval. Any revisions or changes to the Functional Assessment and mitigation plan for this project as a result of the wetlands agencies approvals will supersede the wetlands Functional Assessment and mitigation reviewed and documented herein. Therefore, the project with the proposed wetlands mitigation and monitoring would be biologically superior to the no project alternative. The project is therefore compliant with the Riparian/Riverine Areas and Vernal Pool Guidelines set forth in Section 6.1.2 of the MSHCP. 4. The Project is consistent with the Protection of Narrow Endemic Plant Species Guidelines. The property is located within Narrow Endemic Plant Species Survey Area 2 (NEPSSA), which includes Munz’s onion, San Diego ambrosia, Many-stemmed dudleya, Spreading navarretia, California Orcutt grass, Hammitt’s clay-cress, and Wright’s trichocoronis. Habitat assessment and focused surveys were conducted on the site for plant species by Harmsworth Associates (March 2008) in spring and summer in 2003-2007. Though the project site includes potential habitat for some of the Narrow Endemic Plant Species in Species Survey Area 2, none of the Narrow Endemic Plant Species for Survey Area 2 were detected on site during the focused survey efforts, the project demonstrates compliance with Section 6.1.3 of the MSHCP. 5. The Project is consistent with the Additional Survey Needs and Procedures. The MSHCP requires additional surveys for certain species if the project is located in certain locations. Pursuant to MSHCP Figure 6-2 (Criteria Area Species Survey Area), Figure 6-3 (Amphibian Species Survey Areas with Criteria Area), Figure 6-4 (Burrowing Owl Survey Areas with Criteria Area), and Figure 6-5 (Mammal Species Survey Areas With Criteria Area), burrowing owl surveys are required for the subject property prior to approval of a development proposal. The project site is located within the Burrowing Owl Survey Area and within the Criteria Area Species Survey Area 2, which includes San Jacinto Valley Crownscale, Parish's brittlescale, Davidson's saltscale, Thread-leaved brodiaea, Round-leaved filaree, Smooth Tarplant, Coulter's goldfields, and Little Mousetail. Burrowing owl surveys were conducted on the site and revealed no evidence that the owls exist or that any suitable burrows exist on the project site. CC Reso. No. 2024-____ Page 4 of 6 3 7 6 5 4 Though the project site includes potential habitat for some of the Criteria Area Species Survey Area 2 species (specifically San Jacinto Valley Crownscale, Parish's brittlescale, Davidson's saltscale, Smooth Tarplant, Coulter's goldfields, and Little Mousetail), none of the Criteria Area Plant Species for Survey Area 2 were detected on site during the focused surveys. The project complies with the Additional Survey Needs and Procedures set forth in Section 6.3.2 of the MSHCP. 6. The Project is consistent with the Urban/Wildlands Interface Guidelines. Section 6.1.4 of the MSHCP sets forth guidelines that are intended to address indirect effects associated with locating development in proximity to the MSHCP Conservation Area, where applicable. The guidelines in Section 6.1.4 of the MSHCP are intended to address indirect effects associated with development near MSHCP Conserved Areas. Developments in proximity to MSHCP Conserved Areas may result in “edge effects” that might adversely affect biological resources within MSHCP Conserved Areas. The subject project involves the subdivision of the 74.72-acre property into three (3) parcels for conservation purposes. The property will undergo a rehabilitation process to create a restored natural, protected habitat native to the Lake Elsinore area, which will allow for the creation of a mitigation bank. Therefore, the project will not adversely impact on MSHCP conserved areas. The subject project is consistent with the Urban/Wildlife Interface Guidelines. 7. The Project is consistent with the Vegetation Mapping requirements. The entire 74.72-acre project site consists of disturbed, ruderal habitat. This habitat is characterized by brome grass and non-native vegetation that grows in previously disturbed areas, including common barley (hordeum vulgare), cheatgrass (bromus tectorum), cheeseweed (malva parviflora), shortpod mustard (Hirschfeldia incana) and tall tumblemustard (Sisymbrium altissimum). Other species in this habitat include stinknet (Oncosiphon piluliferum), common sunflower (Helianthus annuus), and Western ragweed (Ambrosia psilostachya). This mapping is sufficient under the MSHCP and is consistent with the MSHCP vegetation mapping requirements. 8. The Project is consistent with the Fuels Management Guidelines. Section 6.4 of the MSHCP requires that new developments adjacent to the MSHCP Conservation Area or other undeveloped lands incorporate any fuel/brush management zones and Best Management Practices (BMPs). The Project will incorporate the BMPs outlined in Volume I, Appendix C of the MSHCP pursuant to regulatory and/or County requirements. Therefore, the Project is consistent with the Fuels Management Guidelines as set forth in Section 6.4 of the MSHCP. 9. The Project will be conditioned to pay the City’s MSHCP Local Development Mitigation Fee. As a condition of approval, the Project will be required to pay the City’s MSHCP Local CC Reso. No. 2024-____ Page 5 of 6 3 7 6 5 4 Development Mitigation Fee at the time of issuance of building permits. 10. The Project is consistent with the MSHCP. The project site is located in Criteria Cells #4740 and #4742, which are in MSHCP Elsinore Area Plan, Subunit 3 (Elsinore). The properties that will be developed by the Proposed Project include that area. Conservation within Cell #4740 will range from 70% to 80% of the Cell focusing on the southeastern portion of the Cell. Conservation within Cell #4742 will range from 30% to 40% of the Cell focusing on the southern portion of the Cell. The conservation requirements set forth for these Criteria Cells have been replaced with the preservation of habitat in the Back Basin of Lake Elsinore through the 770-acre Agreement. Therefore, conservation of the project site, or any portion thereof, is not required. The proposed project is consistent with the MSHCP. Section 4: Based upon the evidence presented, both written and testimonial, and the above findings, the Council hereby finds that the Project is consistent with the MSHCP. Section 5: This Resolution shall take effect immediately upon its adoption. Section 6: The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions. Passed and Adopted on this 27th day of August 2024. The project is located on the southern side of Lakeshore Drive, west of Lucerne Street, and southeasterly of the intersection of South Main Street and Lakeshore Drive (APNs: 373-330-001 through 022 and 373-300-038 through 041); Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to tentative maps; Whereas, on July 16, 2024, at a duly noticed Public Hearing, the Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item and adopted a resolution recommending that the Council Approve Tentative Parcel Map No. 38825; Whereas, pursuant to Section 16.24.120 of the LEMC, the Council has the responsibility of making decisions to approve, conditionally approve, or disapprove recommendations of the Commission for tentative maps; and Whereas, on August 27, 2024, at a duly noticed Public Hearing, the Council has considered the recommendation of the Commission as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: The forgoing recitals are true and correct and are hereby incorporated into these findings by this reference. Section 2: The Council has reviewed and analyzed Tentative Parcel Map No. 38825 pursuant to the appropriate Planning and Zoning Laws and Chapter 16 (Subdivisions) of the LEMC and the Subdivision Map Act. Section 3: In accordance with the California Environmental Quality Act (CEQA) Guidelines Sections 15304 (Minor Alterations to Land) and 15315 (Minor Land Divisions), the Council makes the following findings and recommendations regarding the approval of Tentative Parcel Map No. 38825: 1. The Project is exempt from CEQA pursuant to pursuant to CEQA Guidelines Section 15304 (Minor Alterations to Land). Class 4 consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, CC Reso. No. 2024-____ Page 2 of 4 3 7 7 3 2 mature, scenic trees except for forestry or agricultural purposes. The project does not include the removal of healthy, mature, or scenic trees and proposed improvements are limited to micro grading to restore natural habitats. 2. The Project is exempt from CEQA pursuant to Section 15315 (Minor Land Divisions). Class 15 consists of the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous 2 years, and the parcel does not have an average slope greater than 20 percent. Tentative Parcel Map No. 38825 is a subdivision of an existing 74.72-acre property into three (3) new parcels that are 4.74 acres, 19.99 acres, and 49.99 acres, respectively, for conservation purposes. The proposed subdivision is compliant with the General Plan and Zoning Classification as adopted by the East Lake Specific Plan’s standards, no variances or exceptions are required, access is available, and the parcel was not involved in a division of a larger parcel within the previous two (2) years, and the proposed parcels do not have an average slope greater than 20 percent. Section 4: That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Council makes the following findings for approval of Tentative Parcel Map No. 38825: 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses, and programs specified in the General Plan (Government Code Section 66473.5). The project site is located within Planning Area 8 of the East Lake Specific Plan (ELSP) and has Action Sports, Tourism, Commercial, and Recreation with a Mixed Use Overlay. The land use regulation including development standards for Planning Area 8, where the project site is located, are derived from Chapter 2.5 of the ELSP. Allowable uses in Planning Area 8 include bars or cocktail lounges, hotels, passive open space, and natural areas or preserves. For a newly created parcel, Planning Area 8 does not have minimum lot size requirements. However, it does require newly created parcels to have a minimum width of 100 feet. The three proposed parcels would establish natural areas and preserves for conservation easement purposes and have lot widths that exceed the minimum requirement. Therefore, the proposed project complies with the ELSP development standards for Planning Area 8. The Tentative Parcel Map is consistent with the designated land use, development, design standards, and all other appropriate requirements in the General Plan and the Subdivision Map Act. The project is also consistent with the General Plan because the ELSP was found to be consistent with the General Plan at adoption. 2. The site of the proposed subdivision of land is physically suitable for the proposed density of development in accordance with the General Plan. The proposed subdivision is to establish conservation easements and involves no development including new structures or dwelling units. This finding does not apply to the project. CC Reso. The effects that this project is likely to have upon the housing needs of the region, the public service requirements of its residents, and the available fiscal and environmental resources have been considered and balanced. The proposed parcels will undergo a habitat rehabilitation process that aims to restore native riparian and riverine habitats, restore and expand vernal pool habitats, remove invasive non- native plants, and plant native flora. Once restored, the parcels are proposed to be used as a mitigation bank to be owned and managed by the applicant. The project as proposed will not have a direct impact on housing needs, public services, or fiscal resources. It will create a positive impact on environmental resources by protecting the subject parcels in perpetuity as conservation. 4. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. The proposed subdivision will create a mitigation bank and remain as open space for conservation purposes. The project involves no development activity and will not be accessible to the public. The Tentative Parcel Map has been adequately conditioned by all applicable departments and agencies and will not result in any significant environmental impacts. The proposed subdivision, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. Section 5: Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Tentative Map, the Council hereby approves Tentative Parcel Map No. 38825. Section 6: This Resolution shall take effect immediately upon its adoption. PLANNING DIVISION 4. Tentative Parcel Map No. 38825 will expire two years from the date of approval unless within that period of time a Final Map has been filed with the County Recorder, or an extension of time is granted by the City of Lake Elsinore City Council in accordance with the State of California Subdivision Map Act and applicable requirements of the Lake Elsinore Municipal Code (LEMC). 5. Tentative Parcel Map No. 38825 shall comply with the State of California Subdivision Map Act and applicable requirements contained in the LEMC, unless modified by approved Conditions of Approval. All Conditions of Approval shall be reproduced on page one of building plans prior to their acceptance by the Building and Safety Division, Community Development Department. All Conditions of Approval shall be met prior to the issuance of a Certificate of Occupancy. 8. All future development proposals shall be reviewed by the City on a project by project basis. If determined necessary by the Community Development Director or designee, additional environmental analysis will be required. 9. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted, deny or further condition issuance of all future building permits, deny revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. 10. Provisions of the City's Noise Ordinance (LEMC Chapter 17.176) shall be satisfied during all site preparation and construction activity. The applicant shall place a weatherproof 3’ X 3’ sign at the entrance to the project site identifying the approved days and hours of construction activity. Site preparation activity and construction shall not commence before 7:00 AM and shall cease no later than 5:00 PM, Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 am and shall cease no later than 4:00 p.m. Construction activity shall not take place on Sunday, or any Legal Holidays. The sign shall identify the name and phone number of the development manager to address any complaints. 11. Landscaping installed for the project shall be continuously maintained to the reasonable satisfaction of the Community Development Director. If it is determined that the landscaping is not being maintained, the Director of Community Development shall have the authority to require the property owner to bring the landscaping into conformance with the approved landscape plan. The continued maintenance of all landscaped areas shall be the responsibility of the developer or any successors in interest. 12. The developer/permit holder or any successor in interest shall comply with the following for the life of this permit. If during ground disturbance activities, unanticipated cultural resources are discovered, the following procedures shall be followed: a. All ground disturbance activities within 100 feet of the discovered cultural resource shall be halted until a meeting is convened between the developer, the Project Archaeologist, representatives from the Pechanga Band of Indians (or other appropriate ethnic/cultural group representative), and the Community Development Director or their designee to discuss the significance of the find. b. The developer shall call the Community Development Director or their designee immediately upon discovery of the cultural resource to convene the meeting. At the meeting with the aforementioned parties, the significance of the discoveries shall be discussed and a decision is to be made, with the concurrence of the Community Development Director or their designee, as to the appropriate mitigation (documentation, recovery, avoidance, etc.) for the cultural resource. d. Further ground disturbance shall not resume within the area of the discovery until a meeting has been convened with the aforementioned parties and a decision is made, with the concurrence of the Community Development Director or their designee, as to the appropriate mitigation measures. e. Treatment and avoidance of the newly discovered resources shall be consistent with the Cultural Resources Treatment and Monitoring Agreements entered into with the appropriate tribes. This may include avoidance of cultural resources through project design, in-place preservation of cultural resources located in native soils, and/or re-burial on the Project property so they are not subject to further disturbance in perpetuity as identified in Non-Disclosure of Reburial Location measure. f. If the find is determined to be significant and avoidance of the site has not been achieved, a Phase III data recovery plan shall be prepared by the Project Archeologist, in consultation with the Tribe(s), and shall be submitted to the City for their review and approval prior to implementation of the said plan. g. Pursuant to Calif. Pub. Res. Code § 21083.2(b) avoidance is the preferred method of preservation for archaeological resources and cultural resources. If the Project Applicant and the Tribe(s) cannot agree on the significance or the mitigation for the archaeological or cultural resources, these issues will be presented to the Community Development Director for decision. The Community Development Director shall make the determination based on the provisions of the California Environmental Quality Act with respect to archaeological resources, recommendations of the project archeologist and shall take into account the cultural and religious principles and practices of the Tribe(s). Notwithstanding any other rights available under the law, the decision of the City Community Development Director shall be appealable to the City Planning Commission and/or City Council.” Evidence of compliance with this mitigation measure, if a significant archaeological resource is found, shall be provided to City of Lake Elsinore upon the completion of a treatment plan and final report detailing the significance and treatment finding. 13. In the event that Native American cultural resources are discovered during the course of grading (inadvertent discoveries), the following procedures shall be carried out for final disposition of the discoveries. One or more of the following treatments, in order of preference, shall be employed with the tribes. Evidence of such shall be provided to the Community Development Department: a. Preservation-In-Place of the cultural resources, if feasible. Preservation in place means avoiding the resources, leaving them in the place where they were found with no development affecting the integrity of the resources. b. Relocation of the resources on the Project property. The measures for relocation shall include, at least, the following: Measures and provisions to protect the future reburial area from any future impacts by means of a deed restriction or other form of protection (e.g., conservation easement) in order to demonstrate avoidance in perpetuity. PA 2023-24/TPM No. 38825 PC: July 16, 2024 Conditions of Approval CC: August 27, 2024 Applicant’s Initials: _____ Page 4 of 11 3 7 7 3 3 Relocation shall not occur until all legally required cataloging and basic recordation have been completed, with an exception that sacred items, burial goods and Native American human remains are excluded. Any reburial process shall be culturally appropriate. Listing of contents and location of the reburial shall be included in the confidential Phase IV report. The Phase IV Report shall be filed with the City under a confidential cover and not subject to Public Records Request. c. If preservation in place or reburial is not feasible then the resources shall be curated in the culturally sensitive matter at a Riverside County curation facility that meets State Resources Department of Office of Historic Preservation Guidelines for the Curation of Archaeological Resources ensuring access and use pursuant to the Guidelines. The collection and associated records shall be transferred, including title, and are to be accompanied by payment of the fees necessary for permanent curation. Evidence of curation in the form of a letter from the curation facility stating that subject archaeological materials have been received and that all fees have been paid, shall be provided by the landowner to the City. There shall be no destructive or invasive testing on sacred items, burial goods and Native American human remains. Results concerning finds of any inadvertent discoveries shall be included in the Phase IV monitoring report. Evidence of compliance with this mitigation measure, if a significant archaeological resource is found, shall be provided to the City of Lake Elsinore upon completion of a treatment plan and final report detailing the significance and treatment of finding. 14. Upon completion of the implementation phase, a Phase IV Cultural Resources Monitoring Report shall be submitted that complies with the Riverside County Planning Department's requirements for such reports for all ground disturbing activities associated with this grading permit. The report shall follow the County of Riverside Planning Department Cultural Resources (Archaeological) Investigations Standard Scopes of Work posted on the County website. The report shall include results of any feature relocation as well as evidence of the required cultural sensitivity training for the construction staff held during the required pre- grade meeting. Once the report is determined to be adequate, two (2) copies shall be submitted to Eastern Information Center (EIC) at the University of California Riverside (UCR) and one (1) copy shall be submitted to the Monitoring Tribes. 15. In the event that human remains (or remains that may be human) are discovered at the project site during grading or earthmoving, the construction contractors, project archaeologist and/or designated Native American Monitor shall immediately stop all activities within 100 feet of the find. The project applicant shall then inform the Riverside County Coroner and the City of Lake Elsinore Community Development Department immediately, and the coroner shall be permitted to examine the remains as required by California Health and Safety Code Section 7050.5(b). Section 7050.5 requires that excavation be stopped in the vicinity of discovered human remains and that no further disturbance shall occur until the Riverside County Coroner has made the necessary findings as to origin. If human remains are determined to be Native American, the applicant shall comply with the state law relating to the disposition of Native American burials that fall within the jurisdiction of the NAHC (PRC Section 5097). The coroner shall contact the NAHC within 24 hours and the NAHC will make the determination of most likely descendant. The most likely descendant shall then make recommendations and engage in consultation concerning the treatment of the remains as provided in Public Resource Code Section 5097.98. In the event that the applicant and the MLD are in disagreement regarding the disposition of the remains. State law will apply and the mediation process will occur with the NAHC, if requested (see PRC Section 5097.98(e) and 5097.94(k)). According to the California Health PA 2023-24/TPM No. 38825 PC: July 16, 2024 Conditions of Approval CC: August 27, 2024 Applicant’s Initials: _____ Page 5 of 11 3 7 7 3 3 and Safety Code, six or more human burial at one location constitutes a cemetery (Section 81 00), and disturbance of Native American cemeteries is a felony (Section 7052). 16. It is understood by all parties that unless otherwise required by law, the site of any reburial of Native American human remains or associated grave goods shall not be disclosed and shall not be governed by public disclosure requirements of the California Public Records Act. The Coroner, pursuant to the specific exemption set forth in California Government Code 6254 (r), parties, and Lead Agencies, will be asked to withhold public disclosure information related to such reburial, pursuant to the specific exemption set forth in California Government Code 6254 (r). Prior to Recordation of Final Parcel Map 17. All lots shall comply with minimum standards contained in Chapter 3.9 (Planning Area 8: Action Sports, Tourism, Commercial and Recreation; Mixed Use Overlay). All new submittals for plan check or permit shall be made using the City’s online Citizen Self-Service Portal (mill.lake- elsinore.org/EnerGov_Prod/SelfService#/home ). Prior to Issuance of Grading Permits and Building Permits 18. All of the project improvements shall be designed by the applicant's Civil Engineer to the specifications of the City of Lake Elsinore. 19. Prior to the issuance of a grading permit, at least 30 days prior to the issuance, the applicant shall contact Pechanga Band of Indians. The applicant shall coordinate with the Pechanga Band of Indians to develop an individual Tribal Monitoring Agreement. A copy of the signed agreement shall be provided to the City of Lake Elsinore Community Development Department, Planning Division prior to the issuance of a grading permit. The Agreement shall address the treatment of any known tribal cultural resources (TCRs) including the project’s approved conditions of approval; the designation, responsibilities, and participation of professional Tribal Monitors during grading, excavation and ground disturbing activities; project grading and development scheduling; terms of compensation for the monitors; and treatment and final disposition of any cultural resources, sacred sites, and human remains/burial goods discovered on the site per the Tribe’s customs and traditions and the City’s conditions of approval. The Tribal Monitor will have the authority to stop and redirect grading in the immediate area of a find in order to evaluate the find and determine the appropriate next steps, in consultation with the Project archaeologist. 20. Prior to the issuance of a grading permit, the project applicant shall obtain all necessary State and Federal permits, approvals, or other entitlements, including obtaining the necessary authorizations from the regulatory agencies for proposed impacts to jurisdictional waters. Authorizations may include a Section 404 Permit from the U.S. Army Corps of Engineers, a Section 1602 Streambed Alteration Agreement from the California Department of Fish and Wildlife, and a Section 401 Water Quality Certification/Waste Discharge Requirement from the Regional Water Quality Control Board. 21. Prior to the issuance of a building permit, the applicant shall pay the City’s Multiple Species Habitat Conservation Plan (MSHCP) Local Development Mitigation Fee, at the rate in effect at the time of payment. Prior to the issuance of a building permit, the applicant shall pay Development Impact Fees (DIF), at the rate in effect at the time of payment. 23. Prior to issuance of each building permit, a receipt or clearance letter from the Lake Elsinore School District shall be submitted to the Building and Safety Department evidencing the payment or exemption from School Mitigation Fees. 24. The project shall connect to water and sewer and meet all requirements of the Elsinore Valley Municipal Water District (EVMWD). The applicant shall submit water and sewer plans to the EVMWD and shall incorporate all district conditions and standards. 25. The property address (in numerals at least six inches high) shall be displayed near the entrance and be easily visible from the front of the subject property and public right-of-way. 26. The proposed location of on-site construction trailers shall be approved by the Community Development Director or designee. A cash bond of $1,000 shall be required for any construction trailers placed on the site and used during construction. Bonds will be released after removal of trailers and restoration of the site to an acceptable state, subject to approval of the Community Development Director or designee. Such trailer(s) shall be fully on private property and outside the public right of way. ENGINEERING DEPARTMENT GENERAL 27. All new submittals for plan check or permit shall be made using the City’s online Citizen Self-Service Portal (mill.lake-elsinore.org/EnerGov_Prod/SelfService#/home). 28. All engineering plans shall be prepared by a registered Civil Engineer using the City’s standard title block. 29. All required soils, geology, hydrology and hydraulic reports shall be prepared by a registered Civil Engineer or Soils Engineer as applicable. 30. All slopes and landscaping within the public right-of-way shall be maintained by the property owner, owner’s association, firms contracted by the property owner’s association, or another maintenance entity approved by the City Council. 31. All open space and slopes except for public parks and schools and flood control district facilities, outside the public right-of-way shall be owned and maintained by the property owner or property owner’s association. 32. In accordance with the City’s Franchise Agreement for waste disposal and recycling, the applicant shall be required to contract with CR&R, Inc. for removal and disposal of all waste material, debris, vegetation and other rubbish generated both during cleaning, demolition, clear and grubbing or all other phases of construction and during occupancy. 33. The site will accommodate all construction activity, building activity, vehicles, etc. No staging on public streets, or private property belonging to others shall be conducted without the written permission of the property owner. Minimum good housekeeping and erosion and sediment control Best Management Practices (BMPs) as identified by the City shall be implemented. FEES 35. Applicant shall pay all applicable permit application and Engineering assessed fees, including without limitation plan check and inspection fees, at the prevalent rate at time of payment in full. 36. Project is required to provide cash-in-lieu for the following improvements prior to grading permit issuance: a. Ultimate half-width improvements along Lucerne Street, from existing pavement terminus through the unpaved portion along the property frontages of Parcel 2 and a portion of Parcel 3 of the Tentative Parcel Map No. 38825. Permitting/Construction 56. Prior to grading permit issuance, project is required to provide cash-in-lieu for Lucerne Street improvements. 57.
