CONFERENCE WITH LEGAL COUNSEL--ANTICIPATED LITIGATION Initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: 4 potential cases Mayor Pro Tem Manos arrived at 5:33 p.m. RECONVENE/CALL TO ORDER The Regular Meeting of the City Council reconvened and the Regular Meeting of the Successor Agency was called to order at 7:00 p.m. PLEDGE OF ALLEGIANCE Mayor Pro Tem Manos led the Pledge of Allegiance. City Council Minutes - Final October 10, 2023 City of Lake Elsinore Page 2 MOMENT OF SILENCE ROLL CALL Present: 4 - Council/Agency Members Sheridan and Magee; Mayor Pro Tem/Vice Chair Manos; and Mayor/Chair Johnson Absent: 1 - Council/Agency Member Tisdale CLOSED SESSION REPORT City Attorney Leibold reported that the City Council discussed one item and unanimously directed the City's prosecutor to initiate abatement and related legal action against four properties regarding illegal camping and related Lake Elsinore Municipal Code violations. PRESENTATIONS/CEREMONIALS 1) Domestic Violence Awareness Month Present a Proclamation declaring the Month of October 2023 as "Domestic Violence Awareness Month" in the City of Lake Elsinore. Mayor Johnson presented the Proclamation to Adriana Moreno, CEO of the Safe Family Justice Center, and Dianne Johnson, Patricia Miller, Jynna Chung, Judy Guglielmana, Linda Compos, Sylvia Gallegos, Heidi Dodd, Lynda Krisko, Nancy Hunzeker, Sonya Matthies, Cassie Garofalo, Claudia La Greca, Deborah Bondar, Elizabeth McNeel, and Darlene Wharton from the Elsinore Woman's Club. 2) Riverside County Sheriff's Office 2023 Third Quarter Statistical Update Lieutenant Clark presented the update. PUBLIC COMMENTS - NON-AGENDIZED ITEMS - 1 MINUTE Douglas Norfolk was called to speak. Kimberly Ryan was called to speak. CITY COUNCIL CONSENT CALENDAR A motion was made by Mayor Johnson, seconded by Mayor Pro Tem Manos to approve the City Council Consent Calendar with Item No. 8 being pulled for discussion. This item was approved on the City Council Consent Calendar. 7) Second Reading and Adoption of an Ordinance Approving Zone Change No. 2023-02 to Change the Zoning Designation from Single-family Residential (R-1) to Medium Density Residential (R-2) for an Approximately 33.23-acre Site Located in the Lake Elsinore Hills District Adopt by title only and waive further reading of AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING ZONE CHANGE NO. 2023-02 CHANGING THE ZONING DESIGNATION FROM SINGLE- FAMILY RESIDENTIAL (R-1) TO MEDIUM DENSITY RESIDENTIAL (R-2) FOR APNS 363-240-006, 010, 012, 014, 015, 022, 024, 025, 029, 031, 033, 039, 363-241- 025, 050, 057, 064, 363-250-001 THROUGH 012. This item was approved on the City Council Consent Calendar. 8) Appointment to the Planning Commission Appoint Anthony Williams to serve on the Lake Elsinore Planning Commission for a partial term expiring December 31, 2024. This item was removed from the City Council Consent Calendar for discussion. 9) Notice of Decision - Planning Commission Approval of Planning Application No. 2022-15 (Lake Pointe Apartments) Approving a Residential Design Review to Develop a 152-unit Multi-family Residential Apartment Complex with 336 Parking Spaces and Related Improvements on an 8.27-acre Site Receive and file the Notice of Decision for Planning Application No. 2022-15 approved by the Planning Commission on September 19, 2023. This item was approved on the City Council Consent Calendar. City Council Minutes - Final October 10, 2023 City of Lake Elsinore Page 4 10) Dia De Los Muertos - Street Closures Approve Temporary Street Closures for the Dia De Los Muertos event on October 28, 2023. This item was approved on the City Council Consent Calendar. 11) Purchase of (1) 2023 Dodge Ram 5500 4x4 Chassis and Cab Authorize the City Manager to purchase one (1) 2023 Dodge Ram 5500 4x4 Chassis and Cab for Squad #97 per the attached specifications in the total amount of $167,614.41 from the County of Riverside and waive the formal bidding process under LEMC Section 3.08.070 in place of the County's bidding procedure. This item was approved on the City Council Consent Calendar. 12) Award a Public Works Agreement to Edmonson Construction Co. for the Demolition of the Buildings Located at 102, 106, 108, 110, and 114 South Main Street, Demolition Project (CIP Project #Z20006) 1. Award a public works agreement to Edmonson Construction Co. for the City- owned buildings next to City Hall, Building Demolition Project (CIP Project #Z20006); and, 2. Approve and authorize the City Manager to execute the agreement for a not-to- exceed amount of $149,950.00 with Edmonson Construction Co. in the form attached and in such final form as approved by the City Attorney; and, 3. Authorize the City Manager to execute change orders not to exceed a 10% contingency amount of $14,995.00 for construction uncertainties and adjustments. This item was approved on the City Council Consent Calendar. 13) Purchase of Citywide Park Amenities for Citywide Park Improvements with Quick Crete Products Approve and authorize the City Manager to execute a Purchase Order with Quick Crete Products for Citywide Park Amenities in an amount not to exceed $232,608.57 in such final form as approved by the City Attorney and authorize the City Manager to execute change orders not to exceed a 10% contingency of $23,260.00 for unanticipated costs. This item was approved on the City Council Consent Calendar. 14) Agreement for Contractor Services with Hi-Way Safety, Inc. for Guardrail Installation, Repair and Maintenance Citywide Approve and Authorize the City Manager to execute Agreement for Contractor Services with Hi-Way Safety Inc. for Guardrail Installation, Repair, and Maintenance Citywide in an amount not to exceed $86,154.57 per Fiscal Year for a term of three (3) years in such final form approved by the City Attorney and authorize the City Manager to execute change orders not to exceed a 10% contingency of $8,615.00 for unanticipated costs. City Council Minutes - Final October 10, 2023 City of Lake Elsinore Page 5 15) Change Order No. 1 to the Public Works Construction Agreement with NPG, Inc. for the Asphalt Repairs, Slurry Seal, and Striping for Park Parking Lots Approve and authorize the City Manager to execute Change Order No. 1 to the Public Works Construction Agreement with NPG, Inc. in an amount not exceeding $60,990.00 for the Asphalt Repairs, Slurry Seal, and Striping of Park Parking Lots, Project No. Z40023 in such final form approved by the City Attorney. This item was approved on the City Council Consent Calendar. 16) Purchase of Trash Cans and Recycle Bins for Citywide Parks with BearSaver Approve and authorize the City Manager to execute a Purchase Order with BearSaver for the purchase of trash cans and recycle bins for Citywide Parks in an amount not to exceed $114,145.37 in such final form as approved by the City Attorney and authorize the City Manager to execute change orders not to exceed a 10% contingency of $11,414.00 for unanticipated costs. ITEM REMOVED FROM THE CITY COUNCIL CONSENT CALENDAR FOR DISCUSSION 8) Appointment to the Planning Commission Appoint Anthony Williams to serve on the Lake Elsinore Planning Commission for a partial term expiring December 31, 2024. A motion was made by Mayor Pro Tem Manos, seconded by Council Member Magee to approve the appointment. The motion carried by the following vote: Aye: 4 Council Members Sheridan and Magee; Mayor Pro Tem Manos; and Mayor Johnson Nay: 0 None Absent: 1 Council Member Tisdale SUCCESSOR AGENCY CONSENT CALENDAR A motion was made by Vice Chair Manos, seconded by Agency Member Magee to approve the Successor Agency Consent Calendar. PUBLIC HEARING 21) Planning Application No. 2023-28 (Zone Change No. 2023-03) – Amendment to the Lake Elsinore Municipal Code, Title 17 (Zoning) Updating Chapter 17.58 Density Bonuses and Adding Chapter 17.78 No Net Loss Program Introduce by title only and waive further reading of AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING AMENDMENTS TO TITLE 17 OF THE LAKE ELSINORE MUNICIPAL CODE RELATED TO DENSITY BONUSES AND ADDING A NO NET LOSS PROGRAM. The Public Hearing was opened at 7:28 p.m. Assistant Community Development Director Abraham presented the staff report. Kim Cousins was called to speak. Guy Selleck was called to speak. The Public Hearing was closed at 7:34 p.m. A motion was made by Mayor Pro Tem Manos, seconded by Council Member Magee to introduce by title only and waive further reading of the Ordinance. CITY COUNCIL COMMENTS/REPORTS ON MEETINGS ATTENDED Mayor Pro Tem Manos invited the community to the Dia De Los Muertos event on October 28, 2023 from 5:00 p.m. to 9:00 p.m. on Downtown Main Street. Mayor Pro Tem Manos left at 7:36 p.m. Council Member Sheridan reported on his attendance at the Riverside Transit Agency Transportation Now meeting on September 27, 2023; announced Opheliatrics at the Music Hall which will be held on October 21 and 22 at 7:30 p.m. at the Dream Extreme Neighborhood Center; announced the Halloween Festival & Marketplace October 27-29, 2023 at Diamond Stadium; invited the community to attend the Veterans Day Observance Ceremony on Saturday, November 11, 2023 at 9:00 a.m. at Diamond Stadium; and announced the Winterfest Parade on December 2, 2023 at 5:30 p.m. on Downtown Main Street. Council Member Magee provided updates on the Lake; and announced the Animal Friends of the Valleys Spooktacular Paws on the Promenade event on October 28, 2023 from 10:00 a.m. – 1:00 p.m. at the Temecula Promenade. Mayor Johnson reported on her attendance at the Western Riverside County Regional Conservation Authority meeting on October 2, 2023; announced October is Breast Cancer Awareness Month; provided an update on the Lake Management Plan; invited the community to attend the Trunk or Treat event on October 14, 2023 from 5:00 p.m. to 8:00 p.m. on Downtown Main Street; shared her involvement in Project Connect at Elsinore Middle School; congratulated October's Students of the Month; shared information on a meeting with Assemblymember Bill Essayli and City staff; reported on the State of the City which was held on Thursday, October 5, 2023; and shared that a memorial has been dedicated honoring first responders. ADJOURNMENT The Lake Elsinore City Council adjourned at 7:54 p.m. to the next Regular meeting of Tuesday, October 24, 2023 in the Cultural Center located at 183 N. Main Street.
