Home My WebLink AboutCC Reso No 2006-070RESOLUTION NO. 2006-70 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFO1tNIA, REPEALING RESOLUTION NOS. 99-7, 2001-41, 2002-09, 2002-50 AND 2003- 54, AND APPROVING THE DESIGNATION OF THE PRIMA FACIE SPEED LIMIT FOR CERTAIN STREETS WHEREAS, Prima Facie Speed Limits have been established on certain designated portions of City streets by Resolution Nos. 99-7, 2001-41, 2002-09, 2002-50 and 2003-54; and WHEREAS, portions of certain City streets do not have established prima facie speed limits; and WHEREAS, most established prima facie speed limits will no longer be valid for the enforcement of speed limits by radar and other electronic measuring device when seven years old; and WHEREAS, a Engineering and Traffic Survey, as required by the California Vehicle Code, has recently been completed, a copy of which is on files for public inspection in the office of the City Clerk; and WHEREAS, Section 10.20.010 of Title 10 of the Municipal Code provides for the designation of prima facie speed limits by resolution of the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CTTY OF LAI~ ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council hereby repeals the prima facie speed limits set forth in City of Lake Elsinore Resolution Nos. 99-7, 2001-41, 2002-09, 2002- 50 and 2003-54. SECTION 2. That in accordance with the City of Lake Elsinore Municipal Code, the City Council determines as follows 1. That the Prima Facie Speed Limits are set farth in E~iibit "A" attached hereto and such designated speeds are the most appropriate to facilitate the orderly movement of traffic and to be reasonably safe. 2. That the Engineering and Traffic Surveys in the City of Lake Elsinare dated April 11, 2006, followed the procedures prescribed by the CITY COUNCIL RESOLUTION NO. 2006-70 PAGE 2 OF 4 California Vehicle Code and the MUTCD 2003 California Supplement and describes the speed limits to be established by this Resolution. 4. The prima facie speed limits established by this Resolution shall become effective when appropriate signs giving notice thereof are erected upon the streets specified. 5. The City Engineer shall place and maintain signs and markings sufficient to notice such prima facie speed limits. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
