HomeMy WebLinkAboutCC Reso No 2006-049RESOLUTION NO. 2006-49 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING RESIDENTIAL DESIGN REVIEW NO. 2005-11 FOR THE MARINA VILLAGE RESIDENTIAL CONDOMINIUMS WHEREAS, D.R. Horton Inc., has initiated proceedings to approve Residential Design Review No. 2005-11 for the project lrnown as the Marina Village Condominiums; and WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on April 4, 2006 made its report upon the desirability of the proposed project and made its recommendations in favor of the project by adopting Planning Commission Resolution No. 2006-35 recommending to the City Council approval of Residential Design Review No. 2005-11; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on April 11, 2006. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed project prior to making a decision to approve Residential Design Review No. 2005-11. The City Council finds and determines that this project is consistent with the Design and Development Standards of the Lake Elsinore Municipal Code (LEMC) and that any potentially significant environmental effects of the project have been adequately mitigated in accordance with the Mitigated Negative Declaration No. 2005-1 L SECTION 2. That in accordance with Chapter 17.82 (Design Review) of the LEMC, the City Council makes the following findings: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Residential Design Review located within Assessor Parcel Number(s) 374-271-003, 004, 007, 013, 015, 016, complies with the goals and objectives of the General Plan in that the approval of this condominium community will assist in achieving the development of a well-balanced and CITY COUNCIL RESOLUTION NO. 2006-49 PAGE 2 OF 3 functional mix of residential, commercial, industrial, open space, recreational and institutional land uses to divers~ Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the LEMC. The proposed Residential Design Review located at Assessor Parcel Number(s) 374-271-003, 004, 007, 013, 015, 016, is appropriate to the site and surrounding developments in that the condominium project has been designed in consideration of the size and shape of the property, thereby creating inteYest and varying vistas as a person moves along the street. Further the project as proposed will compliment the quality of existing development and will create a visually pleasing, non-detractive relationship between the proposed and existing pYOjects. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Pursuant to the California Environmental Quality Act (CEQA), the proposed Residential Design Review located at Assessor Parcel Number(s) 374-271-003, 004, 007, 013, 015, 016, as reviewed and conditioned by all applicable City divisions, departments and agencies, will not have a significant effect on the environment pursuant to attached Mitigation Measures and Conditions of Approval. 4. Conditions and safeguards pursuant to Chapter 17.82.060 of the LEMC, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Section 17.82.070 (Action of the Planning Commission) of the LEMC, the proposed Residential Design Review for the Marina Village Condominiums was scheduled and considered for approval by the Planning Commission. SECTION 3. Based upon the above findings, the City of Lake Elsinore hereby approves Design Review No. 2005-O1. SECTION 4. This Resolution shall take effect from and after the date of its passage and adoption.
