Background
The City of Lake Elsinore was incorporated in 1888 as a General Law city and, therefore, must
adhere to all laws pertaining to the conduct and holding of elections as can be found in the
California Elections Code. The laws allow for cities to set regulations pertaining to candidate and
election materials either by Resolution or through their Municipal Code.
On February 1, 2018, the City adopted the By-District election process, subdividing the City into
five districts. Each district is represented by one seat on the City Council. City Council Members
for Districts two, four, and five and the City Treasurer will be on the ballot.
The question of whether the position of City Treasurer should continue to be elected or should be
an appointed position was presented by the City Council in 2004 to the Mayor’s Electoral Reform
Ad Hoc Committee. On this issue, the Committee made nine findings, including “[D]ue to the
complexity of government finance, the role defined by the laws of the State of California for a City
Treasurer can best be satisfactorily performed by a full time, qualified financial professional” and
“[T]he position of Director of Administrative Services of the City of Lake Elsinore requires a
credentialed finance professional with commensurate education and experience. Any candidate
qualified to be the Director of Administrative Services would be qualified to perform the duties of
City Treasurer.” Based on its Findings, the Committee recommended that a measure be placed
on the ballot to eliminate the position of elected City Treasurer.
Moreover, former Elected City Treasurer Baldwin strongly advocated changing the position from
elective to appointive to ensure that a qualified and experienced municipal finance and municipal
accounting professional fills the position. Following Treasurer Baldwin’s passing, the City Council,
at its meeting on March 12, 2024, appointed Edwin Castro to serve an incomplete term as City
Treasurer through December 2024 and directed staff to prepare a Resolution with proposed ballot
measure wording to change the City Treasurer position from elective to appointive to be submitted
to the Riverside County Registrar of Voters for inclusion on the November 5, 2024 General
Municipal Election ballot.
Discussion
The election will be conducted on Tuesday, November 5, 2024 for the purpose of electing a City
Treasurer and three members of the City Council (District 2, District 4, and District 5) to four-year
terms. The City Council must adopt Resolutions calling the election, setting candidate statement
regulations, and requesting the County of Riverside to consolidate the election with the Statewide
General Election and render services required to conduct the election.
There are several significant dates associated with the election which are listed in Attachment
4. The significant dates pertaining to qualifying as a candidate are as follows:
Nomination Period – July 15 through August 9, 2024
The period where those interested in running for election to one of the available seats must pull
and submit nomination papers in order to qualify having their name on the ballot.

Nomination Period Extended – through August 14, 2024
The nomination period is extended for a period of five days if an incumbent does not file to run in
the election
Write-In Candidacy Nomination Period – September 9 through October 22, 2024
The nomination period where persons not on the ballot, wishing to submit their name as a write-
in candidate must submit their nomination forms.
County Voter Information Guide Mailed – September 26 through October 15, 2024
Vote-By-Mail Ballots Mailed Beginning October 7, 2024
City Treasurer
The California Government Code addresses the election process for this ballot question for a
General Law city.
Section 36508. “At any municipal election, or a special election held for that purpose, the
city council may submit to the electors the question whether the elective officers, or any
of them except council members, shall be appointed by the city council; provided,
however, that the city council shall not submit such question to the electors more often
than once in an 11-month period.”
Section 36509. “The question shall be printed on the ballots used at the election
substantially in one of the following forms:
(c) “Shall the office of City Treasurer be appointive?”
The words “yes” and “no” shall be so printed on the ballots that the voters may express
their choice.”
Section 36510. “If a majority of the votes cast on the proposition is for it, the city council
shall appoint such officers at the expiration of the terms of the officers then in office and
on a vacancy in any such office. Such officers shall hold office during the pleasure of the
city council and, notwithstanding Section 36502 to the contrary, are not required to be
residents or electors in the city. The City Council may, by ordinance, vest in the City
Manager its authority to appoint such officers.”
To place a ballot measure before the electorate, the City Council must adopt a resolution that:
• Submits proposed ballot measure wording (including whether the full text will be printed)
to the Riverside County Registrar of Voters;
• Authorizes City Council Members and other individuals (up to five) to file a written
argument regarding the measure, including providing for the filing of rebuttal arguments
to the measure in accordance with filing deadlines; and
• Directs the City Attorney to prepare an impartial analysis of the measure.

Elective Versus Appointive City Treasurer
A survey of nine surrounding Cities resulted in seven having an appointed City Treasurer and the
remaining two having an elected position. The Cities with the appointed City Treasurer are also
their Finance or Administrative Services Directors who fulfill the treasurer duties within their
director classification based on their relevant experience in government finance and professional
financial background.
If the position of City Treasurer becomes appointive in Lake Elsinore, the duties will likely be
fulfilled by the Assistant City Manager or Finance Director/Director of Administrative Services as
appointed by and working under the direction of the City Manager. Having the City Treasurer
function performed by qualified in-house professional staff would be more efficient. Under the
current arrangement the elected Treasurer performs a largely ceremonial role.
Ballot Measure Timing
The Resolution calling for the Municipal Election must be adopted at least 88 days before the
election, which for the November 5, 2024 election would be by August 9, 2024. The last regular
City Council meeting before the 88-day deadline is July 23, 2024.
Mr. Castro will fulfill the position’s duties until the November 5, 2024 Municipal Election. Should
the measure pass, the position will become appointive as of December 2024.
Fiscal Impact
The elected City Treasurer receives $150 per month. Instead, a full-time hourly employee would
perform the duties currently performed by the elected City Treasurer, so there would be a salary
savings of $1,800 per year. Additionally, if the position is appointed instead of elected, the City
would only pay for the election for the three Districts’ Council Members that are currently on the
ballot at the same time, since the position would no longer be on the ballot. So, the City would
only pay for an election in three Districts rather than Citywide, unless another measure is on the
ballot.
The County has estimated that the base cost for this Election will be approximately $130,500.
Adding the measure onto the ballot would be an additional roughly $38,0000. Funding will be
included in the Fiscal Year 2024-25 Budget.

THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW
CITIES AND FOR THE SUBMISSION TO THE VOTERS A QUESTION

Whereas, under the provisions of the laws relating to general law cities in the State of
California, a General Municipal Election shall be held on November 5, 2024, for the election of
Municipal Officers, and
Whereas, the City Council also desires to submit to the voters at the election a question
relating to whether the City Treasurer position should be changed from elective to appointive.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1.That pursuant to the requirements of the laws of the State of California
relating to General Law Cities, there is called and ordered to be held in the City of Lake Elsinore,
California, on Tuesday, November 5, 2024, a General Municipal Election for the purpose of
electing three Members of the City Council for the full term of four years and a City Treasurer for
the full term of four years.
Section 2.That the City Council, pursuant to its right and authority, does order subitted
to the voters at the General Municipal Election the following question:

Section 3.That the proposed complete text of the measure submitted to the voters is
attached as Exhibit A.
Section 4.That the vote requirement for the measure to pass is a majority (50%+1) of
the votes cast.
Section 5.That the ballots to be used at the election shall be in form and content as
required by law.
Section 6.That the City Clerk is authorized, instructed, and directed to coordinate with
the County of Riverside Registrar of Voters to procure and furnish any and all official ballots,
notices, printed matter, and all supplies, equipment, and paraphernalia that may be necessary in
order to properly and lawfully conduct the election.

Section 7.That the vote centers for the election shall be open at seven o’clock a.m.
of the day of the election and shall remain open continuously from that time until eight o’clock
p.m. of the same day when the polls (vote centers) shall be closed, pursuant to Election Code
§10242, except as provided in §§14212, 14401 of the Elections Code of the State of California.
Section 8.That in all particulars not recited in this Resolution, the election shall be
held and conducted as provided by law for holding municipal elections.
Section 9.That notice of the time and place of holding the election is given, and the
City Clerk is authorized, instructed, and directed to give further or additional notice of the election
in time, form, and manner as required by law.
Section 10.That in the event of a tie vote (if any two or more persons receive an equal
and the highest number of votes for an office) as certified by the County of Riverside Registrar of
Voters, the City Council, in accordance with Election Code § 15651 (a), shall set a date and time
and place and summon the candidates who have received the tie votes to appear and will
determine the tie by lot.
Section 11.The City Council authorizes the City Clerk to administer said election, and
all reasonable and actual election expenses shall be paid by the City upon presentation of a
properly submitted bill.
Section 12.This Resolution shall take effect immediately upon its adoption.
Section 13.The City Clerk shall certify to the adoption of this Resolution and enter it
into the book of original Resolutions.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING LAKE ELSINORE MUNICIPAL CODE CHAPTER
2.42 (CITY TREASURER) OF TITLE 2 (ADMINISTRATION AND PERSONNEL)
TO MAKE THE OFFICE OF CITY TREASURER AN APPOINTIVE OFFICE
Whereas, Government Code Section 36508 and Elections Code Section 9222 authorize
the City Council to submit to the electors the question of whether the elective City Treasurer shall
be an appointive office and, if a majority of voters voting on the measure approve it, the office
shall become appointive; and
Whereas, an appointive City Treasurer will be required to possess relevant experience in
government finance and a professional financial background, training, skills and experience
necessary to fulfill the important responsibilities of the office of City Treasurer; and
Whereas, on April 23, 2024, pursuant to State law, the City Council adopted Resolution
No. 24-__, submitting this ordinance to the voters at the General Municipal Election on Tuesday,
November 5, 2024; and
Whereas, all other legal prerequisites to the adoption of this ordinance have occurred.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
ORDAIN AS FOLLOWS:
Section 1.Subject to the approval of a majority of the voters of the City of Lake Elsinore
at the scheduled election so designated by the City Council in a separate resolution placing this
proposal on the ballot for such election, Chapter 2.42 of Title 2 of the Lake Elsinore Municipal Code
is hereby amended to read as follows:
2.42.010 Office established.
As of the November 5, 2028 Municipal Election, the office of the City Treasurer shall cease
to be elected as provided by law and shall become an appointive office. Pursuant to
California Government Code section 36510, such appointive officer shall be appointed by
the City Manager. The City Manager may appoint himself, the Director of Finance, or other
professional with relevant experience in government finance and a professional financial
background, training, skills and experience necessary to fulfill the powers and duties of
City Treasurer.
2.42.020 Elective office.
The City Treasurer shall be elected from the City at large at a general municipal election.
2.42.030 Term of office.
The City Treasurer shall serve for a term of four years and until his successor is elected
and qualified.

2.42.050 Eligibility.
No person shall be eligible to hold the office of City Treasurer unless such person, at the
time of assuming office, shall be a qualified elector of the City and shall have been a
resident of the City for at least the minimum period provided by law next preceding the
date of such person’s election or appointment.
2.42.060 Vacancies.
A vacancy in the office of City Treasurer shall be filled by appointment by the City Council.
Such appointee shall hold office until the next succeeding general municipal election and
until his successor is elected and qualified.
2.42.070 Failure to fill vacancy.
In the event that the City Council shall fail to fill a vacancy by appointment within 30 days
after such office has become vacant, the City Council shall forthwith call a special election
to fill such vacancy; provided, that if such vacancy occurs within 120 days prior to a general
municipal election, such vacancy shall be filled at the general municipal election.
2.42.080 Powers and duties.
The City Treasurer shall be the custodian of all public funds belonging to or under the
control of the City or of any office, department or agency of the City and shall perform such
duties as may be prescribed from time to time by the City Council consistent with this
chapter and applicable law.
2.42.020 Bond Requirements
Pursuant to California Government Code Section 36518, the City Treasurer shall furnish
a corporate surety bond to be approved by the City Council in the same amount as that
required of the Director of Finance and City Clerk, and it shall be conditioned upon the
satisfactory performance of the duties imposed upon the City Treasurer by statute,
ordinance, or resolution. Any premium for such bond shall be a proper charge against the
City of Lake Elsinore.
2.42.030 Powers and duties.
The City Treasurer shall perform the duties as are prescribed by Cal. Gov’t Code Sections
41001 through 41007 and by any other provisions of law applicable to deposit, investment
and safekeeping of public funds of the city.
Section 2. Validity. If any portion of this Ordinance is declared invalid by a court of
law or other legal body with applicable authority, the invalidity shall not affect or prohibit the force
and effect of any other provision or application of the Ordinance that is not deemed invalid. The
voters of the City hereby declare that they would have circulated for qualification and/or voted for
the adoption of this section, and each portion thereof, regardless of the fact that any portion of
the initiative may be subsequently deemed invalid.

Section 3. Supersedence. To the fullest extent allowed by law, the provisions of this
Ordinance shall prevail over, and supersede, all other provisions of the Municipal Code and any
ordinances, resolutions or administrative policies of the City of Lake Elsinore which are in conflict
with any provision of this Ordinance.
Section 4. Amendments. This section shall not be repealed or amended except by a
measure approved by a majority of the electors voting on the issue at a General Municipal
Election, or at a special election called for that purpose.
Section 5. CEQA. This Ordinance is exempt from the California Environmental Quality
Act in accordance with Section 15061(b) (3) there is no possibility that the activity in question may
have a significant effect on the environment.
Section 6. Severability. If any provision of this Ordinance or its application is held
invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions,
sections, or applications of the Ordinance which can be given effect without the invalid provision
or application, and to this end each phrase, section, sentence, or word is declared to be severable.
Section 7. Effective Date. This Ordinance shall take effect only if approved by a
majority of the eligible voters of the City of Lake Elsinore voting at a General Municipal election
to be held on November 5, 2024, and shall take effect ten (10) days after the City Council has
certified the results of the General Municipal election by resolution.
Section 8. Attestation. The Mayor is hereby authorized to attest to the adoption of
this Ordinance by the People voting thereon on November 5, 2024, by signing where indicated
below.
Section 9. Certification. The City Clerk shall certify to the passage of this Ordinance
and shall cause a synopsis of the same to be published according to law.

Whereas, the City Council of the City of Lake Elsinore, California, called a General
Municipal Election to be held on November 5, 2024 for the purpose of the election of a City
Treasurer and three Members of the City Council (District 2, District 4, and District 5) for full four-
year terms;
Whereas, the City Council is submitting to the voters the question relating to whether the
City Treasurer position should be changed from elective to appointive, and
Whereas, it is desirable that the General Municipal Election be consolidated with the
Statewide General election to be held on the same date and that within the city, the precincts,
vote centers, and election officers of the two elections be the same, and that the Riverside County
Registrar of Voters canvass the returns of the General Municipal Election and that the election be
held in all respects as if there were only one election.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1.That pursuant to the requirements of §10403 of the Elections Code, the
Board of Supervisors of the County of Riverside is hereby requested to consent and agree to the
consolidation of a General Municipal Election with the Statewide General election on Tuesday,
November 5, 2024 for the purpose of the election of a City Treasurer and three Members of the
City Council (District 2, District 4, and District 5) for full four-year terms.
Section 2.That a measure is to appear on the ballot as follows:

Section 5.That the county election department is authorized to canvass the returns
of the General Municipal Election. The election shall be held in all respects as if there were only
one election, and only one form of ballot shall be used. The election will be held and conducted
in accordance with the provisions of law regulating the statewide or special election.
Section 6.That the Board of Supervisors is requested to issue instructions to the
Registrar of Voters to take any and all steps necessary for the holding of the consolidated election.

Section 7.That the City of Lake Elsinore recognizes that additional costs will be
incurred by the County by reason of this consolidation and agrees to reimburse the County for
any costs.
Section 8.That the City Clerk is hereby directed to file a certified copy of this
Resolution with the Riverside County Board of Supervisors and the Registrar of Voters.
Section 9.This Resolution shall take effect immediately upon its adoption.
Section 10.The City Clerk shall certify to the adoption of this Resolution and enter it
into the book of original Resolutions.

CALIFORNIA, AMENDING LAKE ELSINORE MUNICIPAL CODE CHAPTER
2.42 (CITY TREASURER) OF TITLE 2 (ADMINISTRATION AND PERSONNEL)
TO MAKE THE OFFICE OF CITY TREASURER AN APPOINTIVE OFFICE
Whereas, Government Code Section 36508 and Elections Code Section 9222 authorize
the City Council to submit to the electors the question of whether the elective City Treasurer shall
be an appointive office and, if a majority of voters voting on the measure approve it, the office
shall become appointive; and
Whereas, an appointive City Treasurer will be required to possess relevant experience in
government finance and a professional financial background, training, skills and experience
necessary to fulfill the important responsibilities of the office of City Treasurer; and
Whereas, on April 23, 2024, pursuant to State law, the City Council adopted Resolution
No. 24-__, submitting this ordinance to the voters at the General Municipal Election on Tuesday,
November 5, 2024; and
Whereas, all other legal prerequisites to the adoption of this ordinance have occurred.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
ORDAIN AS FOLLOWS:
Section 1.Subject to the approval of a majority of the voters of the City of Lake Elsinore
at the scheduled election so designated by the City Council in a separate resolution placing this
proposal on the ballot for such election, Chapter 2.42 of Title 2 of the Lake Elsinore Municipal Code
is hereby amended to read as follows:
2.42.010 Office established.
As of the November 5, 2028 Municipal Election, the office of the City Treasurer shall cease
to be elected as provided by law and shall become an appointive office. Pursuant to
California Government Code section 36510, such appointive officer shall be appointed by
the City Manager. The City Manager may appoint himself, the Director of Finance, or other
professional with relevant experience in government finance and a professional financial
background, training, skills and experience necessary to fulfill the powers and duties of
City Treasurer.
2.42.020 Elective office.
The City Treasurer shall be elected from the City at large at a general municipal election.
2.42.030 Term of office.
The City Treasurer shall serve for a term of four years and until his successor is elected
and qualified.

2.42.050 Eligibility.
No person shall be eligible to hold the office of City Treasurer unless such person, at the
time of assuming office, shall be a qualified elector of the City and shall have been a
resident of the City for at least the minimum period provided by law next preceding the
date of such person’s election or appointment.
2.42.060 Vacancies.
A vacancy in the office of City Treasurer shall be filled by appointment by the City Council.
Such appointee shall hold office until the next succeeding general municipal election and
until his successor is elected and qualified.
2.42.070 Failure to fill vacancy.
In the event that the City Council shall fail to fill a vacancy by appointment within 30 days
after such office has become vacant, the City Council shall forthwith call a special election
to fill such vacancy; provided, that if such vacancy occurs within 120 days prior to a general
municipal election, such vacancy shall be filled at the general municipal election.
2.42.080 Powers and duties.
The City Treasurer shall be the custodian of all public funds belonging to or under the
control of the City or of any office, department or agency of the City and shall perform such
duties as may be prescribed from time to time by the City Council consistent with this
chapter and applicable law.
2.42.020 Bond Requirements
Pursuant to California Government Code Section 36518, the City Treasurer shall furnish
a corporate surety bond to be approved by the City Council in the same amount as that
required of the Director of Finance and City Clerk, and it shall be conditioned upon the
satisfactory performance of the duties imposed upon the City Treasurer by statute,
ordinance, or resolution. Any premium for such bond shall be a proper charge against the
City of Lake Elsinore.
2.42.030 Powers and duties.
The City Treasurer shall perform the duties as are prescribed by Cal. Gov’t Code Sections
41001 through 41007 and by any other provisions of law applicable to deposit, investment
and safekeeping of public funds of the city.
Section 2. Validity. If any portion of this Ordinance is declared invalid by a court of
law or other legal body with applicable authority, the invalidity shall not affect or prohibit the force
and effect of any other provision or application of the Ordinance that is not deemed invalid. The
voters of the City hereby declare that they would have circulated for qualification and/or voted for
the adoption of this section, and each portion thereof, regardless of the fact that any portion of
the initiative may be subsequently deemed invalid.

Section 3. Supersedence. To the fullest extent allowed by law, the provisions of this
Ordinance shall prevail over, and supersede, all other provisions of the Municipal Code and any
ordinances, resolutions or administrative policies of the City of Lake Elsinore which are in conflict
with any provision of this Ordinance.
Section 4. Amendments. This section shall not be repealed or amended except by a
measure approved by a majority of the electors voting on the issue at a General Municipal
Election, or at a special election called for that purpose.
Section 5. CEQA. This Ordinance is exempt from the California Environmental Quality
Act in accordance with Section 15061(b) (3) there is no possibility that the activity in question may
have a significant effect on the environment.
Section 6. Severability. If any provision of this Ordinance or its application is held
invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions,
sections, or applications of the Ordinance which can be given effect without the invalid provision
or application, and to this end each phrase, section, sentence, or word is declared to be severable.
Section 7. Effective Date. This Ordinance shall take effect only if approved by a
majority of the eligible voters of the City of Lake Elsinore voting at a General Municipal election
to be held on November 5, 2024, and shall take effect ten (10) days after the City Council has
certified the results of the General Municipal election by resolution.
Section 8. Attestation. The Mayor is hereby authorized to attest to the adoption of
this Ordinance by the People voting thereon on November 5, 2024, by signing where indicated
below.
Section 9. Certification. The City Clerk shall certify to the passage of this Ordinance
and shall cause a synopsis of the same to be published according to law.

OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE
VOTERS AT AN ELECTION (TO BE HELD ON TUESDAY NOVEMBER 5, 2024
Whereas, §13307 of the Elections Code of the State of California provides that the
governing body of any local agency adopt regulations pertaining to materials prepared by any
candidate for a municipal election, including costs of the candidate statement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. GENERAL PROVISIONS. That pursuant to §13307 of the Elections Code of
the State of California, each candidate for elective office to be voted for at an Election to be held
in the City of Lake Elsinore on Tuesday, November 5, 2024 may prepare a candidate's statement
on an appropriate form provided by the City Clerk. The statement may include the name, age,
and occupation of the candidate and a brief description of no more than 200 words of the
candidate's education and qualifications expressed by the candidate himself or herself. The
statement shall not include party affiliation of the candidate, nor membership or activity in partisan
political organizations. The statement shall be filed in typewritten form in the office of the City
Clerk at the time the candidate's nomination papers are filed. The statement may be withdrawn,
but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next
working day after the close of the nomination period.
Section 2. FOREIGN LANGUAGE POLICY.
A. Pursuant to the Federal Voting Rights Act, candidate statements will be translated into
all languages required by the County of Riverside. The County is required to translate
candidate statements into the following languages: Spanish, Mandarin, Cantonese,
Tagalog, Korean, and Vietnamese.
B. The County will mail separate voter information guides and candidate statements in
Spanish, Mandarin, Cantonese, Tagalog, Korean, or Vietnamese to only those voters
who are on the county voter file as having requested a voter information guide in a
particular language. The County will make the voter information guides and candidate
statements in the required languages available at all polling places/vote centers, on
the County's website, and in the Elections Official's office.
Section 3. PAYMENT.
A. Translations:
1. The candidate shall be required to pay for the cost of translating the candidate
statement into any required foreign language as specified in (A) or (B) of
Section 2 above pursuant to Federal or State law.
2. The candidate shall be required to pay for the cost of translating the candidate
statement into any foreign language that is not required as specified in (A) or
(B) of Section 2 above, pursuant to Federal or State law, but is requested as
an option by the candidate.
B. Printing (choose one or more as appropriate):

1. The candidate shall be required to pay for the cost of printing the candidates
statement in English in the main voter pamphlet.
2. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language required in (A) of Section 2 above, in the main
voter pamphlet.
3. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language requested by the candidate per (B) of Section
2 above, in the main voter pamphlet.
4. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language required by (A) of Section 2 above, in the
facsimile voter pamphlet.
The City Clerk shall estimate the total cost of printing, handling, translating, and mailing
the candidate's statements filed pursuant to this section, including costs incurred as a
result of complying with the Voting Rights Act of 1965 (as amended), and require each
candidate filing a statement to pay in advance to the local agency his or her estimated pro
rata share as a condition of having his or her statement included in the voter's pamphlet.
In the event the estimated payment is required, the estimate is just an approximation of
the actual cost that varies from one election to another election and may be significantly
more or less than the estimate, depending on the actual number of candidates filing
statements. Accordingly, the clerk is not bound by the estimate and may, on a pro rata
basis, bill the candidate for additional actual expense or refund any excess paid depending
on the final actual cost. In the event of underpayment, the clerk may require the candidate
to pay the balance of the cost incurred. In the event of overpayment, the clerk shall prorate
the excess amount among the candidates and refund the excess amount paid within 30
days of the election. *Addendum can include request of time for county invoices, etc.
Section 4. MISCELLANEOUS.
A. All translations shall be provided by professionally-certified translators.
B. The City Clerk shall allow underlining, capitalization, and bullets to the same extent
and manner as allowed in previous City elections.
C. The City Clerk shall comply with all recommendations and standards set forth by the
California Secretary of State regarding occupational designations and other matters
relating to elections.
Section 5. ADDITIONAL MATERIALS. No candidate will be permitted to include additional
materials in the voter information guide.
Section 6. That the City Clerk shall provide each candidate or the candidate's
representative a copy of this Resolution at the time nominating petitions are issued.
Section 7. That all previous resolutions establishing council policy on payment for
candidates statements are repealed.
Section 8. That this resolution shall apply only to the election to be held on November 5,
2024 and shall then be repealed.
Section 9. This Resolution shall take effect immediately upon its adoption.

ELECTION RESULTS
The city elections official,upon receipt of the
results of the election from the Registrar of Voters,
shall certify the results to the City Council which
shall,no later than the next regularly scheduled
City Council meeting following presentation of the
28-day canvass of the returns,or at a special
meeting called for this purpose,comply with the
applicable provisions of California Elections Code
Section 10263.
