CITY COUNCIL RESOLUTION NO. 2006-33 PAGE 2 OF 3 SECTION 2. That in accordance with Title 14 of the California Code of Regulations Section 15070, the Mitigated Negative Declaration/Mitigation Monitoring Program No. 2005-OS is complete and adequate and constitutes sufficient environmental documentation based upon the following findings made by the City Council: FINDINGS - MITIGATED NEGATIVE DECLARATION NO. 2005-OS 1. The initial study identified potentially significant effects, but revision of the project plans or proposal made by or agreed to by the applicant before a proposed mitigated negative declaration and initial study are released for public review would avoid the effects or mitigated the effects to a point where clearly no significant effects would occur. The applicant has agreed to the attached conditions of approval which mitigate the potentially significant environmental effects identified by the initial study to a level of insignificance. Moreover, after consultation with all city departments, divisions and interested agencies, the applicant has made revisions to the project which reduces potentially significant environmental effects to a level of insignificance. 2. There is no substantial evidence in light of the whole record before the agency that the project as revised may have a significant effect on the environment. Based upon the whole record before the Ciry Council, the project will not have a significant effect on the environment. The attached conditions of approval and the Mitigation Monitoring Program adequately mitigate any potential effects that were identified in the Initial Study. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
