A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, ADOPTING MITIGATED
NEGATIVE DECLARATION/MITIGATION MONITORING
PLAN NO. 2005-OS FOR THE PROJECT KNOWN AS ZONE
CHANGE NO. 2005-02 AND TENTATIVE TRACT MAP NO.
33486
WHEREAS, an application has been filed by Corman Leigh Commuriities
requesting approval of Mitigated Negative Declaration and Mitigation Monitoring
Plan No. 2005-OS for Zone Change No. 2005-02 and Tentative Tract Map No.
33486; and
WHEREAS, Mitigated Negative Declaration and Mirigation Monitoring
Program No. 2005-OS has been prepared, submitted to all responsible agencies, and
has been reviewed in accordance with the requirements of the California
Environmental Quality Act (CEQA) and the City's CEQA policy; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at a
regular meeting held on January 17, 2006, found the Mitigated Negative
Declaration and Mitigation Monitoring Plan to be acceptable and adopted Planning
Commission Resolution No. 2006-07 recommending that the City Council approve
Mitigated Negative Declaration/Mitigation Monitoring Plan No. 2005-06; and
WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on February 28, 2006.
NOW, THEREFORE, THE CITY COUNCIL OF THE CTTY OF
LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed Mitigated
Negative Declaration/Mitigation Monitoring Program No. 2005-07. The City
Council finds and determines that the project is consistent with CEQA and all of
the required procedures, policies, guidelines and provisions of the Lake Elsinore
Municipal Code (LEMC).

SECTION 2. That in accordance with Title 14 of the California Code of
Regulations Section 15070, the Mitigated Negative Declaration/Mitigation
Monitoring Program No. 2005-OS is complete and adequate and constitutes
sufficient environmental documentation based upon the following findings made
by the City Council:
FINDINGS - MITIGATED NEGATIVE DECLARATION NO. 2005-OS
1. The initial study identified potentially significant effects, but revision of the
project plans or proposal made by or agreed to by the applicant before a
proposed mitigated negative declaration and initial study are released for
public review would avoid the effects or mitigated the effects to a point
where clearly no significant effects would occur.
The applicant has agreed to the attached conditions of approval which
mitigate the potentially significant environmental effects identified by the
initial study to a level of insignificance. Moreover, after consultation with
all city departments, divisions and interested agencies, the applicant has
made revisions to the project which reduces potentially significant
environmental effects to a level of insignificance.
2. There is no substantial evidence in light of the whole record before the
agency that the project as revised may have a significant effect on the
environment.
Based upon the whole record before the Ciry Council, the project will not
have a significant effect on the environment. The attached conditions of
approval and the Mitigation Monitoring Program adequately mitigate any
potential effects that were identified in the Initial Study.
SECTION 3. This Resolution shall take effect from and after the date of its
passage and adoption.
