TREASURER
Background
On November 3, 2020, the City of Lake Elsinore held a General Election for three of its City
Council Districts and for City Treasurer, which was consolidated with the statewide General
Election. Following the election, the County Registrar of Voters canvased the election returns and
certified the results to the City Council on December 3, 2020. A total of 19,602 votes were cast
for the City Treasurer.
On January 18, 2024, City Treasurer Allen Baldwin passed away, thereby leaving the City
Treasurer seat vacant. The City Council may consider several options for filling the vacancy.
Discussion
Vacancy
Once the City Council has determined that a vacancy for the City Treasurer seat exists,
Government Code Section 36512 and Lake Elsinore Municipal Code (“LEMC”) Section 2.42.060
govern the process for filling the vacancy. Government Code section 1770 specifies when a public
office, such as a City Treasurer elective office, is deemed vacant and includes, under Section
1770(a), “the death of the incumbent.” Therefore, the City Treasurer seat became vacant on
January 18, 2024.

LEMC Section 2.42.060 provides that the City Council shall fill the vacancy by appointment.
Additionally, LEMC Section 2.42.070 states that if the City Council fails to fill the vacancy within
30 days from the commencement of the vacancy, the City Council shall call a special election to
fill the vacancy. The LEMC’s 30-day appointment period conflicts with state law. Government
Code section 36512(b) requires the City Council to act within 60 days from the commencement
of the vacancy to either fill the vacancy by appointment or call a special election to fill the vacancy.
Consequently, the City Attorney is recommending revision to the LEMC to conform to Government
Code 36512(b) which will allow the City Council until March 17, 2024 to make an appointment or
call a special election to fill the vacancy.
Appointment
The City Council may choose to fill the vacancy by appointment. If the City Council chooses to
appoint a person to the seat, the process for determining an appointment is up to the City Council.
As an example of option 3A, the City Council could nominate a qualified candidate without
engaging in an application process and appoint that person immediately.
If the City Council selects option 3B, the City Council may consider establishing a process for
taking applications and considering qualified candidates. To do so, the City Council would need
to adopt the proposed Urgency Ordinance so that the City Council would have 60 days to fill the
vacancy (instead of the current 30 days), thereby allowing the City Clerk time to solicit and accept
applications through March 1, 2024, the public to submit applications during that period, and the
City Council to consider submitted applications and make an appointment at its meeting on March
12, 2024.
Lake Elsinore Municipal Code Section 2.42.050 and Government Code Section 34882 establish
the eligibility requirements for appointment. The candidate must reside in the City of Lake Elsinore
and be a qualified elector (registered voter).
Special Election
If the City Council selects option 3C, a special election must be called and held on the next
regularly established election date not less than 114 days from the call of the election (on or after
June 6, 2024). Elections Code section 1000 establishes the following as election dates:
(a) The first Tuesday after the first Monday in March of each even-numbered year that is
evenly divisible by four.
(b) The first Tuesday after the first Monday in March of each odd-numbered year.
(c) The second Tuesday of April in each even-numbered year.
(d) The first Tuesday after the first Monday in June in each even-numbered year that is not
evenly divisible by four.
(e) The first Tuesday after the first Monday in November of each year.
Since none of the established election dates fall between June 6, 2024 and August 9, 2024, an
all-mail ballot election would have to be conducted (Elections Code Section 1003(f)). The all-mail

ballot election would need to be conducted on Tuesday, August 6, 2024, to allow the public time
to submit a petition-in-lieu of filing fees. The estimated cost for a City-wide all-mail ballot election
would be $130,500.
Recommendation
Staff recommends option 3B to accept applications from the public and appoint a qualified
candidate to serve as City Treasurer until a new City Treasurer is elected in the next election for
City Treasurer to be held on November 5, 2024.
Fiscal Impact
There is no fiscal impact if the City Council selects option 3A or 3B. However, if the City Council
selects option 3C, the estimated cost for a City-wide all-mail ballot election would be $130,500.

WHEREAS, on July 10, 1984, the Lake Elsinore City Council adopted Ordinance No. 699
establishing Lake Elsinore Municipal Code (“LEMC”) Section 2.42.070 “Failure to fill vacancy”
which states, “In the event that the City Council shall fail to fill a vacancy by appointment within
30 days after such office has become vacant, the City Council shall forthwith call a special election
to fill such vacancy”; and
WHEREAS, California Government Code Section 36512(b) states, “If a vacancy occurs
in an elective office provided for in this chapter, the council shall, within 60 days from the
commencement of the vacancy, either fill the vacancy by appointment or call a special election to
fill the vacancy”; and
WHEREAS, Government Code Section 36937 expressly authorizes the City Council to
adopt an urgency ordinance for the immediate preservation of the public peace, health or safety;
and
WHEREAS, in order to be consistent with state law governing general law cities and to
allow the City Council time to decide whether to fill a vacancy by appointment or call a special
election to fill a vacancy, give the City Clerk time to solicit applications if the City Council decides
to do so, and give the public time to complete and submit an application if requested by the City
Council, the City Council desires to amend LEMC Section 2.42.070 to allow the City Council to fill
the vacancy or call a special election within 60 days rather than 30 days.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, DOES ORDAIN
AS FOLLOWS:
Section 1: LEMC Section 2.42.070 “Failure to fill vacancy”, is hereby amended as follows:
“2.42.070 Failure to fill vacancy:
In the event that the City Council shall fail to fill a vacancy by appointment pursuant to
Section 2.42.060, the City Council shall, not later than 60 days after such office has become
vacant, call a special election to fill such vacancy. Notwithstanding the foregoing, if such vacancy
occurs within 120 days prior to a general municipal election, such vacancy shall be filled at the
general municipal election.”
Section 2: CEQA. This Ordinance is exempt from the California Environmental Quality
Act in accordance with Section 15061(b) (3) there is no possibility that the activity in question may
have a significant effect on the environment.
Section 3: Severability. If any provision of this Ordinance or its application is held
invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions,
sections, or applications of the Ordinance which can be given effect without the invalid provision
or application, and to this end each phrase, section, sentence, or word is declared to be severable.
Section 4: Effective Date. This Urgency Ordinance is enacted pursuant to the authority
conferred upon the City by Government Code Sections 36937 and shall be in full force and effect

immediately upon its adoption by a four-fifths (4/5) vote of the City Council. This Urgency
Ordinance shall take effect immediately upon adoption and shall become operative on February
13, 2024.
Section 5: Urgency. The adoption of this Urgency Ordinance is necessary for the
immediate preservation of the public peace, health, or safety, as those terms are defined in
Government Code Section 36937(b), in at least the following respects: The office of the elected
City Treasurer became vacant on January 18, 2024 and the City Council requires sufficient time
to evaluate the options to fill the vacancy consistent with the timeline provided by state law, the
Lake Elsinore Municipal fails to provide sufficient time to evaluate those options, and, hence, the
need to amend the City’s Municipal Code to comply with state law is immediate such that it is
essential that the City adopt the above stated Urgency Ordinance.
Section 6: Certification. The City Clerk shall certify to the passage of this Ordinance and
shall cause a synopsis of the same to be published according to law.

Whereas, a vacancy in the office of City Treasurer of the City of Lake Elsinore was created

Whereas, under Government Code 36512, the City Council must fill a vacancy of an
elected official within 60 days from the commencement of the vacancy;
Whereas, Government Code Section 36512(b)(1) states that if the council calls a special
election, the special election shall be held on the next regularly established election date
(established by Elections Code Section 1000) not less than 114 days from the call of the special
election;
Whereas, since none of the established election dates fall between June 6, 2024 and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That pursuant to the laws of the State of California relating to general law
cities, there is called and ordered to be held in the City of Lake Elsinore, California, on Tuesday,
August 6, 2024, a Special Municipal Election conducted by all-mail ballot for the purpose of
electing one (1) City Treasurer for the term of office in which the vacancy was created which ends
December 2024.
Section 2.That in all particulars not recited in this Resolution, the election shall be
conducted as provided by law for the holding of municipal elections.
Section 3.That the City Clerk is authorized, instructed, and directed to coordinate with
the Yolo County Clerk/Recorder/Assessor to procure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment, and paraphernalia that may be necessary in
order to properly and lawfully conduct the election.
Section 4. That notice of the time and place of holding the election is given, and the City
Clerk is authorized, instructed, and directed to give further or additional notice of the election in
time, form, and manner as required by law.
Section 5. This Resolution shall take effect immediately upon its adoption.
Section 6. The City Clerk shall certify to the adoption of this Resolution and enter it into
the book of original Resolutions.

Whereas, §13307 of the Elections Code of the State of California provides that the
governing body of any local agency adopt regulations pertaining to materials prepared by any
candidate for a municipal election, including costs of the candidate statement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. GENERAL PROVISIONS. That pursuant to §13307 of the Elections Code of
the State of California, each candidate for elective office to be voted for at an Election to be held
in the City of Lake Elsinore on Tuesday, August 6, 2024 may prepare a candidates statement on
an appropriate form provided by the City Clerk. The statement may include the name, age, and
occupation of the candidate and a brief description of no more than 200 words of the candidate's
education and qualifications expressed by the candidate himself or herself. The statement shall
not include party affiliation of the candidate, nor membership or activity in partisan political
organizations. The statement shall be filed in typewritten form in the office of the City Clerk at the
time the candidate's nomination papers are filed. The statement may be withdrawn, but not
changed, during the period for filing nomination papers and until 5:00 p.m. of the next working
day after the close of the nomination period.
Section 2. FOREIGN LANGUAGE POLICY.
A. Pursuant to the Federal Voting Rights Act, candidate statements will be translated into
all languages required by the County of Riverside. The County is required to translate
candidate statements into the following languages: Spanish, Mandarin, Cantonese,
Tagalog, Korean, and Vietnamese.
B. The County will mail separate voter information guides and candidate statements in
Spanish, Mandarin, Cantonese, Tagalog, Korean, or Vietnamese to only those voters
who are on the county voter file as having requested a voter information guide in a
particular language. The County will make the voter information guides and candidate
statements in the required languages available at all polling places/vote centers, on
the County's website, and in the Elections Official's office.
Section 3. PAYMENT.
A. Translations:
1. The candidate shall be required to pay for the cost of translating the candidate
statement into any required foreign language as specified in (A) or (B) of
Section 2 above pursuant to Federal or State law.
2. The candidate shall be required to pay for the cost of translating the candidate
statement into any foreign language that is not required as specified in (A) or
(B) of Section 2 above, pursuant to Federal or State law, but is requested as
an option by the candidate.
B. Printing (choose one or more as appropriate):

1. The candidate shall be required to pay for the cost of printing the candidates
statement in English in the main voter pamphlet.
2. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language required in (A) of Section 2 above, in the main
voter pamphlet.
3. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language requested by the candidate per (B) of Section
2 above, in the main voter pamphlet.
4. The candidate shall be required to pay for the cost of printing the candidates
statement in a foreign language required by (A) of Section 2 above, in the
facsimile voter pamphlet.
The City Clerk shall estimate the total cost of printing, handling, translating, and mailing
the candidate's statements filed pursuant to this section, including costs incurred as a
result of complying with the Voting Rights Act of 1965 (as amended), and require each
candidate filing a statement to pay in advance to the local agency his or her estimated pro
rata share as a condition of having his or her statement included in the voter's pamphlet.
In the event the estimated payment is required, the estimate is just an approximation of
the actual cost that varies from one election to another election and may be significantly
more or less than the estimate, depending on the actual number of candidates filing
statements. Accordingly, the clerk is not bound by the estimate and may, on a pro rata
basis, bill the candidate for additional actual expense or refund any excess paid depending
on the final actual cost. In the event of underpayment, the clerk may require the candidate
to pay the balance of the cost incurred. In the event of overpayment, the clerk shall prorate
the excess amount among the candidates and refund the excess amount paid within 30
days of the election. *Addendum can include request of time for county invoices, etc.
Section 4. MISCELLANEOUS.
A. All translations shall be provided by professionally-certified translators.
B. The City Clerk shall allow underlining, capitalization, and bullets to the same extent
and manner as allowed in previous City elections.
C. The City Clerk shall comply with all recommendations and standards set forth by the
California Secretary of State regarding occupational designations and other matters
relating to elections.
Section 5. ADDITIONAL MATERIALS. No candidate will be permitted to include additional
materials in the voter information guide.
Section 6. That the City Clerk shall provide each candidate or the candidate's
representative a copy of this Resolution at the time nominating petitions are issued.
Section 7. That all previous resolutions establishing council policy on payment for
candidates statements are repealed.
Section 8. That this resolution shall apply only to the election to be held on August 6, 2024
and shall then be repealed.
Section 9. This Resolution shall take effect immediately upon its adoption.

Section 10. The City Clerk shall certify to the adoption of this Resolution and enter it into
the book of original Resolutions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF RIVERSIDE TO RENDER SPECIFIED SERVICES TO THE CITY
RELATING TO THE CONDUCT OF AN ALL-MAIL BALLOT SPECIAL
MUNICIPAL ELECTION TO BE HELD ON TUESDAY, AUGUST 6, 2024 TO FILL
A VACANCY OF THE CITY TREASURER
Whereas, the City Council of the City of Lake Elsinore called an All-Mail Ballot Special
Municipal Election to be held on Tuesday, August 6, 2024, for the purpose of the election of one
City Treasurer to fill a vacancy;
Whereas, in the course of conduct of the election, it is necessary for the City to request
services of the County of Riverside Registrar of Voters;
Whereas, all necessary expenses in performing these services shall be paid by the City
of Lake Elsinore.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That pursuant to the requirements of the California Elections Code, the Board
of Supervisors of the County of Riverside is hereby requested to consent and agree to the
provision of election services for the holding of an All-Mail Ballot Special Municipal Election on
Tuesday, August 6, 2023, for the purpose of the election of one City Treasurer.
Section 2.That the election shall be conducted by all-mail ballot pursuant to Elections
Code Section 1003(f) as required by law, and that in all other particulars not recited in this
resolution, the election shall be held and conducted as provided by law for the holding of municipal
elections.
Section 3.That the Riverside County Registrar of Voters is authorized to canvass the
returns of the All-Mail Ballot Special Municipal Election.
Section 4. That the Board of Supervisors is requested to issue instructions to the Registrar
of Voters to take any and all steps necessary for the holding of the election.
Section 5. That the City of Lake Elsinore shall reimburse the County of Riverside for all
costs and expenses incurred by the County in conducting said election upon presentation of a bill
to the City.
Section 6. The City Clerk shall certify to the adoption of this Resolution and enter it into
the book of original Resolutions.
