CONSENT CALENDAR ITEMS All matters on the Consent Calendar are approved in one motion, unless a Commissioner or any members of the public requests separate action on a specific action. 1. Minutes a. Regular Planning Commission Minutes of November 16, 2004 PAGE 2 – PLANNING COMMISSION AGENDA – December 7, 2004 PUBLIC HEARINGS 2. Merritt/Luster Annexation • Annexation 71. The applicant is proposing an annexation of 15.75 net acres into the City of Lake Elsinore. The annexation, which has been initiated by the current property owners, will consist of the removal of the site from the County of Riverside jurisdiction to the city limits of Lake Elsinore. The Annexation is pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (Government Code Section 56000-56001) and the standards and policies established by the Riverside Local Agency Formation Commission (LAFCO). • General Plan Amendment No. 2004-09. The General Plan Amendment will remove the subject property, subject to the completion of Annexation 71, from the City of Lake Elsinore’s Sphere of Influence and into the city limits of Lake Elsinore. Further, the General Plan Amendment will change the current County Land Use category from “Future Specific Plan” (FSP) and Low Density to the City of Lake Elsinore’s General Plan Designation of Low-Medium Density, allowing a maximum of six (6) dwelling units per acre. The General Plan Amendment is pursuant Section I.D.3. (General Plan Amendment Procedure) of the City of Lake Elsinore General Plan. • Zone Change No. 2004-04. The applicant is requesting a Zone Change, subject to the completion of Annexation 71 to designate the property proposed for annexation as R-1 (Single Family Residential). The Zone Change is pursuant to Chapter 17.84 (Amendments) and Chapter 17.92 (Hearings) of the Lake Elsinore Municipal Code (LEMC). • Vesting Tentative Tract Map No. 32503. The applicant is requesting approval for a Vesting Tentative Tract Map, subject to the completion of Annexation 71, creating sixty (60) single-family lots, three (3) open space lots and a remainder lot consistent with the R-1 Zoning District. Review is pursuant to Chapter 17.23 (R-1 Single-Family Residential District) and Chapter 16.25 (Vesting Tentative Maps) of the Lake Elsinore Municipal Code (LEMC) and Section(s) 66452, 66454, 66474.2 and 66498 of the California Subdivision Map Act (CSMA). • Mitigated Negative Declaration No. 2004-09. The City of Lake Elsinore intends to adopt a Mitigated Negative Declaration (MND) pursuant to the Guidelines established by the California Environmental Quality Act (CEQA). Conditional Use Permit No. 2004-37 – A request to operate a tattoo studio at 31089 Riverside Drive. (APN 379-224-015). • The applicant is requesting approval of a Conditional Use Permit for the operation of a tattoo studio pursuant to Chapter 17.74 (Conditional Use Permits) and Chapter 17.52 (C- P, Commercial Park District) of the Lake Elsinore Municipal Code (LEMC). Commercial Design Review No. 2004-07 for the Mission Trail Medical Plaza. • Commercial Design Review No. 2004-07. The applicant is requesting Design Review consideration for the design and construction of a medical office complex and associated improvements located @ 31182 Mission Trail. Review is pursuant to Chapter 17.38 (Non- Residential Development Standards), Chapter 17.44 (C-1/Neighborhood Commercial District), Chapter 17.66 (Parking Requirements) and Chapter 17.82 (Design Review) of the Lake Elsinore Municipal Code (LEMC). Residential Project No. 2004-13, Minor Design Review of Model Homes and Production Units For Vesting Tract Map No. 28214-1 (Alberhill Ranch) • Request approval of building designs for 52 single-family detached residential units, including a four-plan model home complex. The proposed residences will be constructed within the Alberhill Ranch Specific Plan area, which was previously subdivided by Vesting Tract Map No. 28214-1.
