ARCO Gas Station by constructing a new 237 sq. ft. walk-in cooler addition, and a new 217 sq. ft. storage addition, and converting an existing storage to new walk in freezer on a 0.76 acre lot APN: 377-040-052 . Environmental Staff has reviewed the proposed project and has determined that the Determination: project is Categorically Exempt from environmental review under Section 15301 Existin Facilities) of the CEQA Guidelines. ADMINISTRATIVE DETERMINATION: Section 17.410.070 of the Lake Elsinore Municipal Code grants the Community Development Director express authority to administratively approve and condition certain types of development projects including: Additions to commercial and industrial structures or the construction of accessory structures, and alterations to existing structures which do substantially change the appearance of the structure even though the floor area may not be affected (i.e., changes in the shape or exterior materials). Staff has determined that the proposed project qualifies for administrative approval under Section 17.410.070 of the Lake Elsinore Municipal Code, and hereby makes the following findings: The project, as approved and conditioned, complies with the goals and objectives of the General Plan and the zoning district in which the project is located. The project complies with the design directives contained in Lake Elsinore Municipal Code Section 17.112 and all other applicable provisions of the Municipal Code. Conditions and safeguards pursuant to Lake Elsinore Municipal Code Section 17.415.060 (E), including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the proposed project to ensure development of the property in accordance with the objectives of this chapter and the planning district in which the site is located. Furthermore, staff has reviewed the project for consistency with applicable provisions of the General Plan, Municipal Code, and the California Environmental Quality Act(CEQA). Based upon that review the Community Development Director finds and determines that the proposed project is Categorically Exempt from environmental review under Section 15301 (existing facilities) of the CEQA Guidelines and is found to be consistent with the General Plan and Municipal Code, subject to the attached Conditions of Approval. Lapse of design review approval and time extensions: The design review approval shall lapse and become void two years following the date on which the design review became effective, unless one of the following: (1) prior to the expiration of two years, a building permit related to the design review is issued and construction commenced and diligently pursued toward completion; or (2) prior to the expiration of two years, the applicant has applied for and has been granted an extension of the design review approval. The expiration date of an approved design review may be extended for no more than two years. The first extension may be granted for one-year subject to the approval of the Community Development Director after consultation with other City departments if such design review complies with current laws, standards and policies. The second one-year extension may be granted by the approving body (i.e., City Council, Planning Commission) that approved the underlying design review so long as the design review complies with current laws, standards and policies. Application for extensions of time shall be filed prior to the expiration of the initial design review approval and accompanied by a fee in an amount as established by resolution of the City Council. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the proposed project projects attached hereto or any of the proceedings, acts or determinations made in connection therewith. 2. Within 30 days of project approval, the applicant shall sign and complete an "Acknowledgement of Conditions," and shall return the executed original to the Community Development Department for inclusion in the case records. Any violation or non-compliance with the Commercial Design Review Conditions of Approval shall be cause for the revocation of this Commercial Design Review in accordance with the provisions set forth in Chapter 17.410 of the Lake Elsinore Municipal Code (LEMC). 5. All Conditions of Approval shall be reproduced on page one of building plans prior to their acceptance by the Building and Safety Division, Community Development Department. All future development proposals shall be reviewed by the City on a project-by-project basis. If determined necessary by the Community Development Director or designee, additional environmental analysis will be required. 7. Any proposed minor revisions to approved plans shall be reviewed and approved by the Community Development Director or designee. Any proposed substantial revisions to the approved plans shall be reviewed according to the provisions of the Municipal Code in a similar manner as a new application. Grading plan revisions shall be reviewed by the City Engineer. 8. The applicant shall provide all project-related on-site and off-site improvements as required by these Conditions of Approval. 9. The applicant shall at all times comply with Section 17.176 (Noise Ordinance) of the LEMC. Site preparation activity and construction shall not commence before 7:00 AM and shall cease no later than 5:00 PM, Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 AM and shall cease no later than 4:00 PM. Construction activity shall not take place on Sunday, or any Legal Holidays. 10. Graffiti shall be removed within 24 hours. 11.All site improvements shall be constructed as indicated on the submitted plans. The applicant shall meet all required development standards as indicated by the Residential Design Guidelines and the LEMC. Any other revisions to the approved site plan or building elevations shall be subject to the review of the Community Development Director or his designee. All plans submitted for Building Division Plan Check shall conform to the submitted plans. 12.All materials and colors depicted on the plans shall be used. If the applicant wishes to modify any of the approved materials or colors depicted on the plans, the applicant shall submit a proposal setting forth the modifications for review by the Community Development Director or his designee. 13. The Applicant shall comply with all applicable City codes and ordinances. 14.The entire site shall be kept free from trash and debris at all times, and in no event shall trash and debris remain for more than 24 hours.
