A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LAKE ELSINORE, CALIFORNIA,
ADOPTING FINDINGS OF CONSISTENCY WITH
SECTION 6.0 OF THE MULTIPLE SPECIES HABITAT
CONSERVATION PLAN (MSHCP) FOR THE
PROJECT KNOWN AS INDUSTRIAL DESIGN
REVIEW NO. 2005-O1 TO BE LOCATED ON
PASADENASTREET
WHEREAS, a site specific focused survey (General Biological Resources
Assessment) for the Burrowing Owl, Criteria Area Species, and Nanow Endemic Plan
Species was required by the Multiple Species Habitat Conservation Plan (MSHCP) for
the purpose of allowing development of an industrial building and associated
improvements; and
WHEREAS, the City of Lake Elsinore evaluated the consistency of the project
with the MSHCP; and
WHEREAS, public notice of said application has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this item
on December 20, 2005; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of making recommendation to the City Council adopting
the Findings of Consistency with the MSHCP.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The General Biological Resources Assessment prepared by Natural
Resources Assessment, Inc, has been submitted and reviewed in accordance with
requirements of the Multiple Species Habitat Conservation Plan (MSHCP). The report
is complete and adequate in its evaluation of all environmental effects of the project
known as Industrial Design Review No. 2005-01 and will not preclude the
implementation of the MSHCP goals, based on the following finding:

The proposed project is consistent with the Multiple Species Habitat Conservation
Plan
According to the Multiple Species Habitat Conservation Plan (MSHCP), "Within
identified Narrow Endemic Plant Species survey areas (NEPSSA), site-specific
focused surveys for Narrow Endemic Plant Species shall be required for all public
and private projects when appropriate habitat is present. " Since the General
Biological Resources Assessment dated September 21, 2005 found no appropriate
habitat for Narrow Endemic Plant Species future focus studies are not required.
SECTION 2. This Resolution shall take effect from and after the date of its passage
and adoption.
