The City Council of the Cay of Elsinore does ordain as follows; `SECTION 1. That the office of City Administrator of the City of Elsinorebe, and the same is hereby creatsd and established, The said administrator shall be appointed by the ,City Council 'and shall hold office for'and during the pleasure of the City Council. SECTION 2. The City Administrator shall receive. such compen- sation and expense ;allowance as .the City Council shall from time to time determine and fix by re"solution.: SECTION 3. The City Administirator shall be "the administrative head of the ,government of the .City of Elsinore under the direction and control of 'the,Q ty"Council... He shall be,.responsible for the efficient'; administration of `all the affairs of !the City which are under his`control. In addition to :his general powers as administrative head, and not as any limitation `thereon, he shall have the following., :powers and duties: (a) To a"ttend meetings of the City Council and to report upon or discuss any 'matter concerning the:: affairs of the departments, services or activities under his supervision,. (b`} To assist `the .City Council in co-ordinating the • admni"strative functions and'operatons of the varous.deparbments, divisions ,'and services of;Lhe City Government, and on its behalf to carry out the:. ~~ ordinances,, resolutions, regulations andpoliei.es adopted bg at, relating to th'e"administration of such departments, divisions or services...: (c;) To analyze the functions, duties and activities of the wari.ous"departments, divisions and services. of the Citq Government, and to make recommendations; thereon t© the Gty Council..' (d) To'aause"to be prepared and submitted to him by "each degartment,,division or ervice of the City.. government; itemized annual estimates of expenditures required for capital outlay,.. salaries,. wages and miscellaneous operating costs;; to tabulate'"them into a preliminary consolidated budget; and to submit the proposed annual budget and salary, plan to the Ci;ty- Council for its .approval. ° (e') To be 'responsible for the administration of the budget after its final adoption, and to keep the City Council at all-times fully advised as to.the- financial conditions and needs of the Gity. (f) To act'"as`purchasing agent for the City"fos the ° purchase of'a11 supplies, goods, wares, merchandise, equpment,and material; which may be..required by anp department or division of the'City. ,No ex- ~-- penditures sha1T be submitted`or recommended to the City Council except upon the report and appprovaI of the`-City Administrator. (g} To„appoint and remove, subject to-;applicable ordinances or resolutions'of the City, any officers and emplogees of the City, except elected "officers and.-their re- spective staffs; subject further to the"'approval of the City Council. - (h) To-compile and'keep up to date a complete inventory. inventory of all property, real and personal, owned by the City and to recommend to the City Council the purchase of new machinery, equipment and supplies whenever in his judgment the same can be obtained to the best advantage of the City. 18$ ':' (3-) Tc supervise the maintenance,-yard and to see that a21 mobile equipment is kept"in 'good condition-and .repair and satisfactory working order. (j) To serve as public relations :.officer of the Gity Government. _,. (k) To co-operate-with all community organizations whose aim and purpose shall be the advancement of the moral and material interests of the `Ci'ty and its ..:people, and to assist them through the Gity Government. ` (T) To enforce or cause to be enforced all laws and ordinances of the City, and o see that .all"franch~aes, contracts, permits and privileges granted by the.., .City Council are faithfully observed. (m) To control, order and give directions tq all heads of departments and to subordinate officers: and employees of the`City under 'his jurisdiction through .their department heads.. (n) To develop .and organise necessary public improvement :projects and programs,.-and to;assi"st the Gity'Comncil in various departments of government in carrying; out 'such .projects. The City Administrator shall act as the agent for the Gity'Council in the discharge of its administrative functions' but ahall,not exercise any policy-making or legislative functions, nor attempt, to commit or bind the City;."council or any member thereoftto any action, plan or program requiring official action of the Gity Council. It is not intended by this Ordinance to grant any.authority to,,'oir"impose;any'duty upon, the City Ad- -ministrator"which i n vested in"or imposed by general law or ' valid, city ordinahces'in any other commission, board, department, officer, employee, or the City Council..:' In the discharge of his duties, the Citg Administrator shall endeavor at all times to exercise the highest degree of,tact,`patience and courtesy, in his contacts with the public and Gity personnel, and he shall nnc.hiahaaP.nffnw•e~.bi.:.-~~.,ti.ts:.ws.._u .:_s_~._.e._. _,'-.-`---'--._ all personnel :employed by the City of'Elsinore, hereof,:and to maintain; the-highest possible ~~9 (Rescinded February 11, 1963) 'ORDTNANCE N0: 404 ~/ AN ORDINANCE OF`THE CITY OF'ELSINORE, GALIFORNIA,_ TEMPORARILY REGULATING THE CONSTRUCTION AND MOVING OF BUILDINGS WITHIN A DEFINED AREA OF THE CITY ` AND DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE . The City Council of the-.city of Elsinore does hereby find, determine :and ordain as,,follows: SECTION 1: The City Planning Commission, in good faith, intends to conduct studies and intends to hold hearings for the purpose of recommending to the legislative body-the adoption of amend- --~ merits or additions o Zoning Ordinance No 349. The legis- lative body; to protect the public safety, health and welfare, as an emergency measure, does .adopt this temporary interim zoning ordinance prohibiting anq uses which may be in conf3iet with this ordinance, all in accordance with the provisions. of Section 65,$06 of the Government Code of the State of California. SECTION 2: It shall be unlawful for any person, firm or corpora- tion to erect, construct. or enlarge any building.. or structure within"the territory described in Section 3 of this ordinance, or to move any building or structure into said territory. SECTION 3; The territory within which this ordinance shall apply is all that certain territory in the City of Elsinore, County'of Riverside,-State of California, and more particularly described as follows: (By map and description on file) (Temescal ditch area) SECTION ty: Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of'mis- demeanor and upon conviction thereof, shall be punished by a fine not exceeding Five Hundred (500.00) Dollars; or by imprisoruaent not exceeding six>(6) months, or by both such fine and imprisonment.- SECTION 5: Any building or structure erected, constructed, enlarged or moved into he territory described in Section 3, in violation of the provision of this ordinance, shall be deemed to be a public nuisance and, in addition to-the limits provided above in this section, the City>Attorney is hereby'authorized'to institute action for. injunction to restrain such violation,•or to institute:: the appropriate action for the removal of said building or: tructure, oT to institute any other appropriate legal proceedings to enforce the provisions of this ordinance. SECTION 6; This ordinance shall remain in effect during the period provided for in Section 65,$06 of the Government Code or if sooner repealed. SECTION<7: :This ordinance is an emergency measure designed for the protection of the public health, peace, safety and general- welfare and shall take effect immediately upon its adoption. The facts giving rise to such emergency are as follows: A zoning plan of the extent eontemplated'by the studies and hearings mentioned in''Section l ofrthis ordinance cannot be properly made unless adequate time is allowed to gather-all data:and information relative to existing conditions in the territory to-which the' .same will apply, 'and: to work out :all details'neeessary to the`' proper-operation of such .plan. It would be: destructive to the proposed plan; if, during the period of such plan and hearings, the erection, construction or enlargement of buildings or the' moving of buildings,; within the-territory subject to such studies and.hearings,;is allowed to progress in an unregulated manner' so faros to defeat n whole or: in part the ultimate execution of the plans_embraeed by :the proposed new .zoning. `°This'ordii= once is, therefore, necessary as a temporary measure to maintain, so far as may reasonably ,be necessary,:exsting conditions. ..within"said erritory and as a precaution, o prevent.neubrali- zation of the effect of the proposed rezoning,. in accordance with the provisions of Section 65,$06 of the Government Code of the State of California. 19 SECTION 8: The City Clerk shall certify to the adoption of this ordinance and cause it to-be .published-once in the Lake Elsinore Valley Sun newspaper.. The facts'giving rise to such an emergency are as follows.: There has been in`exi"stence in the Citp of Elsinore `a water rate schedule which,<by virtue of the<provisions of the Ordinance setting said water rates, said Ordinance shall no longer be effective. That in order to preserve the revenues of the City and"in particular, the revenues of the Water Department of this City, the water rates - heretofore 3n -existence must be maintained at the present level. The part of skid Volume l of such code so adopted by reference is made a past of this Ordinance as though set forth at length in this Section. SECTION 2: All of the "UNIFORM WIRING CODE," 1961 Edition, "published by Building Nevrs, Inc., a copy of which is certified as a true copq and is on file in the office of the City C erk, is hereby adopted by reference. All of said code so adopted by reference is made apart of this Section as though set forth at length in"this Section. ':ARTICLE 'l l' DEFINFTIONS SECTION 2.1. CIVIL DEFENSE. As used in this ordinance, the term "Civil Defense".'shall mean the preparation for & the carrying out , of all emergency functions,-other han functions-for which military forces are primarily responsible, to prevent; minimize & repair injury to persons.& property resulting fram disasters. It shall not incluke, nor does any provision of this ordinance apply to, any condition relating Lo a labor controversy.. SECTION 2.2. DISASTER. As used in this ordinance the term "disaster" shall mean actual or threatened enemy attack, sabotage, extraordinary-fire, `flood, storm, epidemic, riot, .earthquake, or any-similar:public calamity: SECTION'2.3. OTHER DiFINITIONS. .Other terms used herein shall the: meanings as 'used in the CAlifornia Disaster Act. ARTICLE 1.1.1. CIVIL DEFENSE CORPS. SECTION 3.1 CREATION. There is hereby created a "Civil Defense Corps" which shall consist of all officers and employees of the City of Elsinore, and its agencies, together-with all volunteers & persons commandeered under the provisions of the :California . Disaster Act & this ordinance, with all equipment & materiel publicly owned, Jolunteered,'commandeered or in _any way uhder the control of `the aforementioned personhel; for-the support of the aforementioned personnel in the conduct of disaster operations. SECTION 3.2. ACT1VATl0IJ: The~City of Elsinore Civil Defense Corps shall become activated, ~ function as a disaster relief body, only: ` (A) Upon the existence of a "State of Extreme Emergency," (B) Upon the declaration by the Governor of the State of California, or persons authorized to act in his stead, of a "State of Disaster" affectiny Riverside County,
