I know that only a dedication of right-of-way is required and there will be no requirement to improve the road within the onsite riparian/riverine and CDFW jurisdictional area. However, when RCA reviews your report and sees the site plan, they will not know this. They will reach the conclusion that this area is impacted by the project. Therefore, your report still needs to be revised to be clear that although the proposed Victorian Lane right of way dedication alignment is located within the onsite riparian/riverine and CDFW jurisdictional areas and shown on the site plan, no impacts to these areas are proposed by the project (i.e., construction of street improvements or grading) and will not be required by the City. Thank you for your prompt review. However, there seems to be a misunderstanding regarding the proposed project. Although the proposed Victorian Lane right of way dedication alignment is located within the onsite riparian/riverine and CDFW jurisdictional areas, no impacts to these areas are proposed by the project (i.e., construction of street improvements or grading). Further, no improvements are required to these areas as conditions of approval by the City. Therefore, the biological assessment does not require a discussion of impacts to these areas. Most of the changes relate to the fact that the current site plan no longer shows that the 0.15 acre CDFW jurisdictional area is being avoided. (It’s now part of required right-of-way dedications.) The update of the biological assessment did not include the necessary revisions to reflect this change in the site plan. I tried to catch all the places that need to be revised, but you should us the below revisions as a starting point, and double-check your report to catch any other places that need to be revised, that I may have missed. Page 3 – Section 1.2 Project Description, last sentence, “The proposed development will impact approximately 17.52 acres of the project site” is incorrect. The revised site plan impacts the entire project site. (i.e., 17.67-acre project site.) Page 15 – Section 5.1 (Impacts to Existing Habitats) – This section needs to be amended to show entire site being impacted. Page 15 - Section 5.5 (State and Federal Drainages) - This discussion needs to be revised since the current site plan does not avoid the 0.15-acre CDFW jurisdictional area. Page 17 – Section 6.1.2 discussion, 2nd sentence. Delete the sentence that “The project has been designed to avoid this area of the project site.” Page 17 – Section 6.1.4 Urban/Wildlands Interface Guidelines also needs to discuss the following topics: Lighting, Noise, Barriers and Grading/Land Development. Page 18 – Drainage discussion – Revise references to onsite riparian/riverine areas to reflect that the onsite riparian/riverine areas will be impacted by the project. Figure 5 – Habitat Impacts Map – Needs to be revised to show that the 0.15 Acre CDFW Jurisdictional Area will be impacted. (Correct the label for this area too.) Prior to scheduling a hearing, both the LEAP/JPR process and CEQA review will need to be completed prior to setting a hearing date for your application. It’s also my understanding that engineering reports (preliminary hydro, geo, and WQMP as well as traffic/VMT) are in review; these will all need to be accepted/approved by Engineering Division before CEQA is finalized.
